Planners and Commissioners, The Conditional Use Permit application before you, is an application for a 'Home Occupation' permit. The location is in Garfield County on a 4.056 acre parcel of land (Re: Attached Mayfly Bend Subdivision Plat, and Architectural Site Plan) shown as Lot 2, in the Mayfly Bend Subdivision. The Mayfly Bend Subdivision is made up of 5 lots, all at approximately 4 acres in size, with approximately 20 acres of shared common space belonging to the Mayfly Bend Homeowners Association. LOCATION AND AREA DESCRIPTION The location of Lisa Speaker's existing house and barn is approximately 1/2 mile north of CR100. The physical address for the location is: 421 Ponderosa Pines Way. The property is a relatively isolated parcel, and is accessed from County Road 100, by turning north on Ponderosa Pines Way, located 1 1/2 miles East of Carbondale. Entry to the site (lot 2) is approximately 400 ft. west of Ponderosa Pines Way, on an access easement that serves lot 2 and lot 4 of the subdivision. See the attached 'vicinity' map. OWNERSHIP AND USE Lisa Speaker and her husband Ron Speaker are the owners of the property. See the Warranty Deed attached title. Lisa would like to teach classes on animal massage using the existing house and barn (primarily the barn) located on their property. See attached letter of explanation from Lisa Speaker. HOME OCCUPATION DESCRIPTION The Home Occupation could be described as instructing 3-10 students in classes on the methods of Animal Massage. These classes would take place a few times each month, and only during the day time. While none of the occupations or activities listed under the Garfield County zoning regulations section 5.03 is an exact match for this activity, we have reviewed the code and feel there would be no conflict with the requirements outlined in section 5.03. • Page 2 September 18, 2007 UTILITIES AND ADJACENT IMPACTS Water is served by a well on the property, and the well is connected to both the house and barn. See attached well permit #65213-F. Both house and barn are served by one ISDS that was designed for the uses proposed. See attached letter from Timberline Engineering The electrical service is also provided at the property by Holy Cross and currently serves both the house and barn. There is adequate electrical service that would be required for the proposed use. The owner's private drive way to the house also extends approximately 155 feet east to the barn area and will provide additional parking for five or more vehicles at barn location, with additional parking at the residence. 1t should be noted here that there will be no vehicles or equipment stored on site for this proposed use. It is assumed that the additional traffic volume generated by this home occupation would be very slight, and have no significant impact on the public roads in the area. This class room environment would add no additional dust or odors. There would be no additional night time lighting as there will be no classes given after dark. The Mayfly Bend's H.O.A. association has also reviewed this use and provided a letter of support, unanimously by all homeowners. Please see attached letter from the Mayfly Bend Subdivision Homeowners Association. Given the amount of property surrounding the proposed location of the home occupation, and additional careful planning and lay- out of the parking to the barn area, it would be highly unlikely that there would be any unwanted visual impact on neighbors. It is Lisa Speaker's intention to screen the barn visually and we will attach the landscape plan that is now in progress for the site. See barn landscaping and planting plan, Sheet L-4.1. Overall it is our belief that there will be no negative impacts on the character of the existing neighborhood. Lisa Speaker has included a $400.00 base fee and has signed the "Agreement for Payment" form. David Pesnichak, Senior Planner Dear Mr. Pesnichak, [ have received your letter, dated October 2, regarding deficiencies in the application submitted for a Home Occupation for Ron and Lisa Speaker. To address and complete our application I am attaching two tetters. A letter from our septic engineer, Timberline Engineering should address your concerns with the septic design and the capacity to handle our proposed use. A lefter from water attorney, Sherry Caloia, should demonstrate the ability to prove a legal water source for our proposed use, once the BWCD contract and new well permit are finalize and issued. Staff !-ia s completed a Technical Compliance review of the application and found it to be incomplete for the following reasons: 1;1 •rhe letter submitted from Timberline Engineering only indicates that the ISDS was installed in accordance with County specifications. However, this letter does not indicate whether the installed ISDS is capable of handling the existing residence, barn and impact from the proposed Home Occupation. Please submit a letter from a Colorado Registered Engineer ,stating that the installed !SOS is capable of handling this capacity. 21 It is unclear as to whether the proposed water source is legal for the Home Occupation. Well permit number 65213 indicates that "the use of ground water from this well is limited to ordinary household purposes inside one single family dwelling and the irrigation of not more I:han 7500 square feet of home gardens and lawns... This well is known as Mayfly Bend Ranch Well no. 2 (aka MBR well no. 2)." Please demonstrate that legal water is available to 'serve the proposed Home Occupation. This office will not schedule the request to be considered before the Board of County Comrni:sioners until the aforementioned deficiencies have been addressed. The BWCD will be meeting this month and T believe that the application will be approved. Once approved we can obtain an additional well permit for the additional uses. The uses that are to be additionally permitted and covered by the BWCD are daily water for 4 horses, horse washing and washing of the stalls, washer/dryer, restroom, and kitchenette. These uses should be consistent with those as have been included in their county application. Once the well permit and the BWCD contract are finalized and issued 1 will provide them to your office. Te Whom It May Concern, I am writing because 1 would like to teach an animal massage class out of our existing barn and home. I will only be using our own animals, so there will be no animals boar ied, kenneled or visiting for these classes. Then.; would be no need for signage, additional lighting or any change in existing environment or landscaping. The barn has already been located and is currently being laad';caped for the best possible screening of any activity from adjacent neighbors. All of the r neighbors are on 3-4 acre lots in a 5 lot subdivision. There will be no additional equi pment or materials required or stored on site. Nothing associated with this 'home oeci:rpation' use will change the current character of our neighborhood. All of the classes will take place primarily at our barn, with some activities possible at our house as well. All the classes being taught will have a maximum of 10 students and a minimum of three. All :lasses are 9am-5pm. There are no evening classes. Classes take place approximately soviet days per month. There are five parties in our HOA (two of the parties/properties/votes are our own) and the other three properties have approved the home based business. That all representations made by the Applicant in the application, and at the public hearing before the Board of County Commissioners, shall be conditions of approval, unless altered by the Board of County Commissioners. 2. The classes may only be conducted using the property owner's horses. No outside horses may be brought to the property for the purposes of horse message training or in other connection with this Home Occupation. 3. With exception to the sale of items pertaining to the approved Home Occupation, no retail or wholesale sales shall be allowed to take place at the property. 4. All operations of the home occupation shall be conducted within the dwelling or accessory building. 5. No class may exceed ten students. 6. Class occurrence is limited to seven classes per month. 7. All classes must take place between the hours of 9AM and 5PM. 8. No signs advertising the home occupation may be placed anywhere on the subject property. 9. No additional outdoor lighting associated with the Home Occupation may be installed. 11. In the event any representations made in the application for which this permit is granted, change and are no longer consistent with the representations in this application, the applicant shall be required to submit a new permit application to the County addressing the changes by the Applicant. 12. Prior to issuance of the Conditional Use Permit, the Applicant shall demonstrate that a stop sign has been installed on Ponderosa Pines Way at the entrance to County Road 100 in accordance with the MUTCD (Manual on Uniform Traffic Control Devices). 13. Prior to issuance of the Conditional Use Permit, the Applicant shall provide a new well permit indicating that the well water can legally be used for the requested Home Occupation. Please note, now that the Board has made a decision regarding the Conditional Use request, the BOCC Chairman will sign a Resolution of Approval at the next available BOCC meeting date. Following the Board's approval, this office will issue the Conditional Use Permit to the Applicant. If the Board's approval includes specific conditions of approval to be met, this office will not issue the Official Conditional Use Permit certificate until the Applicant has satisfied all relevant conditions of approval. The Conditional Use Permit approval is not finalized until this office has issued the Official Conditional Use Permit certificate signed by the Chairman of the BOCC.
