AISD©RF, RECORDER At a regular meeting of the Commissioners for Garfield, Colorado, held at Glenwood Springs on Monday , the 11th 19 83 , there were present: when Eugene "Jim" Drinkhouse Larry Velasquez Flaven J. Cerise (absent) Earl Rhodes Mildred Alsdorf Board of County the Commissioners' Annex in day of July A.D. , Commissioner Chairman Commissioner , Commissioner , County Attorney Clerk of the Board the following proceedings, among others were had and dome, RESOLUTION NO. 83-152 o -wit A RESOLUTION CONCERNED WITH THE APPROVAL OF A CONDITIONAL USE PERMIT APPLICATION BY KRISTEN WEIGAND, WHEREAS, the Board of County Commissioners of Garfield County has received an application from Kristen Weigand for a conditional use permit for a day nursery; more specifically, a .temporary summer day camp on the following described tract of land: A parcel of land known as Lots 3, 4 and:the East 1/2 of Lot 5, -- situated in Lot 1 of Section 31 and Lot 4 of Section 32, all in Township 7 South, Range 87 West of the Sixth Principal Meridian, said parcel being described as 'follows: Beginning at a point on the Northerly line of said Section 32, whence a rock found in place and properly marked for the Witness Corner to. the Northwest corner of said Section 32, being the same as the Northeast corner of said Section 31, bears: S.89°49'14"W. 277.26 feet and S.89°44'OG"W. 660.00 feet; thence 5.00°17'49"E. 437.87 feet; thence West 498,60 feet; thence N.00°17'49"W. 435.97 feet to a point on the Norcher11, line of said Section 31; thence N.89°44'00"E. 221:34 feet along the Northerly line of 'said Section 31; thence N.89°49'1,4"E. 277.26 feet along the Northerly line of said Section 32 to the point of begirning. Together with an easement or right-of-way 20 feet in width for access purposes from Colorado State Highway No. 82 to the above described property. Said easement or right-of-way generally to be located and constructed by said grantee along the Wert boundary line of the East 306.5 feet of Lot 5 in Section 32 and aio..g the Southerly boundary lines of Lot 4 in Section 32 and Lot 1 in :'ection 31, all in Township 7 Sout'', Ranee 87 West of the 6th Principal Meridian. Also, together with an easement for the locations of a Waterwell site in the East 306.5 feet of Lot 5 in Section 32, Township 7 South, Range 87 West, 6th Principal Meridian to be drilled and located by grantee as close to the East boundary of the aforesaid road right-of-way as possible. WHEREAS, the Board has considered the recommendation of the Garfield County Planning Director that a public hearing is not necessary upon the question of whether the above described conditional use permit should be granted or denied; and WHEREAS, the Board, on the basis of the .said recommendation, has made the following determinations of fact: 1. The proposed use is compatible with.the permitted in the district in which it is to certain hereinafter contained conditions be uses existing and be located, (provided that complied with.) NOW,.THEREFORE, BE IT RESOLVED by the Commissioners of Garfield County, Colorado, that a conditional use permit be and hereby is authorized permitting the use of the above described tract of land for a day nursery; more specifically, a summer day camp upon the following specific conditions: BOOK 630 Phg57 1. That the use of the tract of land comply with all present and future regulations of Garfield County relating to a day nurser in the zone district in which the property is now or may later be located. 2. That all proposals of the applicant shall be considered conditions of approval unless otherwise expressly stated below. 3. That prior to the issuance of the subject Conditional Use Permit, the applicant shall obtain and submit to the Garfield County Department of Development/Planning Division, copies of it's permits from all other government agencies. 4. The Garfield County Buiding Division has inspected the church for cc,npliance with the mechanical, fire, life, safety and building code requirements for a day care facility. The following conditions must be met prior to a release for a day care facility type use: a. Panic hardware must be installed on the main front door exit; or a sign of an approved size and structure can be placed next to the door. b. Smoke detectors must be installed at the front upstairs exit and in the front, center and rear basement level-. c. The exit lights must be operational. d. The rear exit door must have tempered glass. e. A shut-off valve must be installed on the cook stove. f. The propane appliances in the basement must have the L/P gas supply removed because the basement does not have a grade level exit required by the Uniform Building Mechanical Code for such uses; or natural gas can be used. g. The propane tank must be removed from the stair well area. 5. All operations associated with the Conditional Use Permit are limited to July 11 — September 1, 1983. 6. That upon a verified allegation of a violation of this permit received from the appropriate person or agency, the Board shall investigate compliance with the conditions of approval, as provided for in Section 9.01.06 of the Garfield County Zoning Resolution of 1978, as amended. 7. That the well shall be d:' -.infected and . hydrofeed chlorinator be installed to assure water quality to the camp participants; or bottled water can be used by the camp participants.
