This property consists of an existing Kingdom Hall (place of worship) with `off street' parking that was constructed approximately 30 years ago. Zoning regulations and guidelines that are in force today did not exist at that time. As owners of this property, we requested approvals from the Garfield County Zoning Department to remodel or rebuild our Kingdom Hall in November of 2005, and as of January 2006, were informed by Mr. Richard Wheeler, from your office, that this property requires a `conditional use permit' to proceed with any future site improvements or new construction. We hereby submit the following written information as regards the existing improvements on this property as outlined in items #1, #2, and #8 of the Application submittal requirements: The existing property is located on Lions Ridge Road, 250 feet east of Catherine Store Road, and 1000 feet north of Highway 82, in Carbondale, Colorado. This property is zoned A/R/RD and contains 41,382 square feet (0.95 acres) of land. The existing improvements (lot coverage) including building, parking, and walkways is 23,930 SF or 57.8% of the total property. A 30' right-of-way has been dedicated for a portion of Lions Ridge Road that runs through the south side of the property. The existing building is a one story wood frame Church with an Auditorium seating 130 people, a Foyer, Library, Conference room, Restrooms, Literature & Magazine room, and several storage closets. Attached to the building is a Minister's apartment that was added in 1989. The total area of the building is 4075 SF. The site includes 16,000 SF of paved and gravel `off-street' parking for 38 cars, with access to Lions Ridge Road. Kingdom Hall Conditional Use Permit Page 2 The utilities for this property consists of overhead electrical service from 'Holy Cross Energy', underground gas service from `Kinder Morgan Energy', and water service provided by a potable well system belonging to the `Lions Ridge Estates Homeowner's Association, of which the church is a member. The building is provided with a private septic tank & drainfield located under the gravel parking area located on the west side of the building that was installed at the time of the original construction. The Kingdom Hall is used by two congregations every week for religious meetings as follows: 1. Sunday: 10:00 am - 12:O0am and 1:OOpm - 3:OOpm (40 cars per meeting) 2. Monday: 7:30pm - 8:30pm (10 cars) 3. Tuesday: 7:30pm — 9:30pm (35 cars) 4. Wednesday: no scheduled meetings 5. Thursday: 7:30pm — 9:30pm (35 cars) 6. Friday: no scheduled meetings 7. Saturday: 9:OOam— 10:OOam (10 cars) Based on this information, there are approximately 170 vehicles accessing this property on a weekly basis which include privately owned passenger cars & vans, SUV's, and pick-up trucks. All persons attending these meetings (members &/or visitors) arrive by vehicle with no pedestrian traffic. We are including an architectural site plan of the property showing the existing improvements and area calculations for the individual items on the property. An architectural floor plan of the building as well as a topographic survey prepared by Mike Sorensen, L.S. dated 03/03/04, are also included as part of this submittal. The purpose of this letter is to provide answers to the 4 items listed in your letter. We hope this information will be helpful in processing our application. ITEM #1 As indicated in our initial letter dated August 11, 2006, this is an existing church that is connected to the Lions Ridge Estates Homeowners Association water service. We were able to obtain a copy of the "Limited Member Water Service Agreement" from the Homeowners Association that was prepared and approved in 1998, and registered with Garfield County on June 19, 1998. ITEM #2 The existing church was constructed in the mid 1970's and an underground septic tank and drainfield was installed at that time to accommodate an occupancy of 120 people. As of this date we have not been able to fund any records regarding the description, size, or capacity of the septic system. The existing septic system has worked properly without any problems or disruption in service since the project was first constructed. We were informed by past members of the congregation that the septic tank was serviced a number of years ago, but we have been unable to find any written documentation to confirm this. Kingdom Hall Conditional Use Permit Page 2 ITEM #3 This project is situated at the beginning of the Lions Ridge Estates development on the north side of Lions Ridge Road which exits onto Catherine Store Road and is approximately 500 feet north of Highway 82. There are 14 other residential properties in this development that are serviced by these roads. Lions Ridge Road is a 24 foot wide two lane paved asphalt roadway constructed within the requirements and standards of Garfield County. The church property has 3 vehicular entry points from Lions Ridge Road which allows for convenient entry and exit to the 3 off-street parking areas, which can accommodate a total of 35 cars. As of this date, there have never been any vehicular or pedestrian accidents involving members of the church, or with any of the residents in the development. ITEM #4 This church was originally designed with a `residential' architectural style to fit into the neighborhood and the property is landscaped to minimize the impact of the public use of the property. Based on the hillside features of this property and the present landscaping, there has never been a need for fencing or man-made barriers. There are a number of mature deciduous trees surrounding the parking areas to the east, and natural planting and grasses that surround the smaller parking area to the west. The property has a severe uphill slope behind the building & parking areas that has natural & undisturbed landscaping. Several large pine trees are situated along Lions Ridge Road to provide privacy from the road as well as reducing the impact of the building for the residents of the development. There is a `project sign' facing Lions Ridge Road as you enter the property from the west that is 42" high by 84" long, set within the landscaping with ground lighting to illuminate at night. Two 16' high pole lights illuminate the parking areas and several wall mounted lights on the building to illuminate the walkways. The exterior light fixtures are connected to automatic timers to activate the lighting only when night time meeting are being held. Based on our previous `variance' application for this property and subsequent telephone conversations over the past few months, you are aware that our ultimate goal is to be able to demolish the existing building, parking areas and underground septic system and construct a new church with off-street parking and utilities that will satisfy our present needs, as well as comply with the present codes, regulations and building standards. We also are considering the option of remodeling the existing building and upgrading the utilities, parking areas, and landscaping. To do this we need to receive a Conditional Use Permit before we can undertake any future construction. We also understand that any additional expansion for this property will require zoning variances. If it would help, we would be glad to meet with you and your staff to discuss our application further. As water travels over the surface of the land or through the ground, it dissolves naturally occurring minerals and, in some cases, radioactive material, and can pick up substances resulting from the presence of animals or from human activity. This evaluation is based on our understanding and limited observation of the site conditions, septic tank and review of available permit information for use in supporting the CUP application to the Garfield County. Our evaluation and opinion is provided as a response to item No. 3 in your written request for additional information letter to George Winne, dated December 12, 2006. Our opinions and recommendations are in accordance with Garfield County and the State of Colorado ISDS Regulations. Conclusions The existing septic system is currently in use and adequately functioning. Therefore we recommend that its use continue to accept wastewater from the existing restrooms and small 1 bedroom lodging unit only. The existing 1250 gallon two compartment septic tank is adequate for the estimated design flows at the facility. No problems have been reported or observed regarding the function of the interior or exterior drain lines, septic tank or absorption field. We recommend that use continue with periodic inspection until the new facility is constructed with a new replacement OWS. It is our understanding that the replacement septic tank was installed approximately 17 years ago. The septic tank is a modern style two compartment concrete tank manufactured by Copeland Concrete. This type of tank is very durable and should function without failure unless damaged by extreme load pressure from above or earth movement from below. No evidence has been observed to suggest that the tank may be functionally compromised. We calculated the average and peak effluent flows at the facility to be 552 gpd and 828 gpd respectively based on a peak day occupancy factor of 70%, usage rate of 60% and a reduction factor of 20% for water conserving fixtures. The calculated required minimum peak day septic tank capacity is therefore 1035 gallons. The existing 1250 gallon septic tank is adequate to provide primary treatment for the calculated peak day effluent flow. Findings The church building has been remodeled and contains a total of 3 toilets, 1 urinal, two lavatory sinks and 1 utility sink in two restrooms. In addition the building includes a small 1 -bedroom lodging apartment utilized approximately 12 weeks a year. The small apartment has a kitchenette with a full bath. There are no other kitchen facilities in the church. All fixtures in the facility have been upgraded and are newer type water conserving fixtures. Effluent flow in the cleanout was observed and appeared to free flowing without any evidence of backup between the tank and the building. It is our understanding the entire facility will be razed and a new building of similar capacity will be constructed in the near future. The new building is scheduled to be built in August of this year. The new building construction will include a new OWS to be designed with respect to the proposed site and facility improvements. The existing facility is primarily used 3 days a week with a single 2 -hour meeting on Tuesday and Thursday and two 2 -hour meetings on Sunday. Therefore Sunday is the peak day. The peak day average and peak attendance is 150 and 180 total persons respectively. Based on the limited congregation time for each meeting we assume a usage factor of 60%. We have calculated the peak daily effluent flow as follows. Existing Design Flow Analysis The following analysis is based on current state design guidelines. The design flow for the existing system is based on a single bedroom apartment and the peak daily attendance of 180 total persons. From the State of Colorado I. S. D. S. It is noted that no problems have been reported or observed to indicate failure of the assumed pip and gravel leach field. No seepage, unusual vegetation, depression or other evidence has been observed. Based on our general knowledge of the geotechnical conditions in the area we assume that the soils are adequate for subsurface secondary treatment of effluent utilizing a conventional absorption system. Therefore we recommend that the use of the system be continued until the site work begins and a new OWS is constructed to serve the new facilities. System Recommendations We have reviewed the information forwarded to us, observed certain OWS system components, inspected indoor plumbing fixtures and have presented recommendations for the continued use of the system to accommodate existing uses on the property as a part of our scope of work. The septic tank and sewage effluent line should be periodically inspected, maintained and repaired if needed during the short term before a replacement system is constructed. All fixtures should be maintained leak free with water conserving devices in place to limit the daily flow rates. The water usage rates should be metered and recorded for future evaluations. The expected life of absorption systems vary per use. We would recommend additional evaluation of the site and the existing absorption system to determine the feasibility of replacement and/or relocation of a new system within 2-5 years in the future. The Limited Members' Line shall consist of the tap starting from the curb stop/meter pit location and all related items from the tap to the building receiving service. The Limited Members shall, upon the sale or transfer of the Limited Members' Property, transfer an ownership interest in the Limited Members' Water Line and responsibility for its repair and maintenance to the new owners of the Limited Members' Property so that the owner of the Limited Members' water tap is also the owner of the Limited Members' Water Line and responsible for repairing and maintaining same. C. The Limited Members shall install one water meter, one curb stop, one backflow device and one meter pit at the Limited Members' sole cost and expense. Water Pressure and Quantity. Lion's Ridge does not warrant the delivery of specific quantities of water, and it does not undertake, guarantee or warrant to maintain water pressure sufficiently high to operate fire sprinkling systems, automatic household equipment or other equipment depending upon water pressure for operation. No reduction in minimum charges will be allowed by reason of reduction in quantities of water normally delivered caused by failure of supply, line breaks, low pressure or restrictions placed on the use of water during times of shortage. Lion's Ridge agrees to use its best effort to provide the Limited Members with a constant flow of water under adequate pressure for normal household use and for limited irrigation of no more than 5,000 square feet of lawns and gardens for the parcel described in Exhibit A, and agrecs to use its best efforts to restore water service with diligence and with all possible speed following any interruption thereof 9. This is critical. The rate of absorption is called the percolation rate and it determines the size of the leach field needed for a particular flow of sewage and in some cases even determines the feasibility of the installation of a septic tank and leach field system. AN EIGHT (8) FOOT PROFILE HOLE IN THE LEACH FIELD AREA IS REQUIRED IN THE STATE OF COLORADO TO DETERMINE THE PROX- IMITY OF GROUND WATER AND BEDROCK. In some cases the profile hole may be waived but only by specific approval of the Environmental Health Department. PERCOLATION TESTS MUST BE DONE AT THE GROUND DEPTH WHERE ABSORPTION WILL TAKE PLACE. STANDARD SEEPAGE BEDS (LEACH FIELDS) ARE INSTALLED THREE FEET DEEP, SO THE PERCOLATION HOLES ARE DUG FOUR FEET DEEP, AT LEAST 20 FEET APART; THE PERCOLATION TEST IS DONE IN THE BOTTOM ONE (1) FOOT OF THE HOLE. Post Hole 8"-12" I + 4' I 3' Back Hoe Hole Ground Level A post hole digger, auger, or back hoe can be used to dig the percolation test holes. If a back hoe is used, dig the back hoe hole 3 feet deep and put a test hole 1 foot deep and 8 to 12 inches in diameter in the bottom. Installation of absorption areas (i.e. drywells) deeper than three feet requires the permission of the Environmental Health Department. Saturation with water will affect the percolation rate, and since the system will be expected to operate when the soil is saturated with water, THE HOLES MUST BE FILLED WITH WATER AT LEAST 8 HOURS BEFORE THE TEST, AND ALLOWED TO STAND. More water will need to be used to perform the percolation test, so AT LEAST 10 GALLONS OF WATER SHOULD BE ON HAND WHEN THE TEST IS PERFORMED.
