when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 82-149
A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION BY DAVID,
ANN, AND EUNICE NICHOLSON.
WHEREAS, the Board of County Commissioners of Garfield County has received an
application from David, Ann and Eunice Nicholson for a special use permit for a Guest
House on the following described tract of land:
A Tract of land in the Nt of the SW% of Section 12, Township 6 South, Range 92
West of•the 6th P.M., in Garfield County, Colorado, and being more particularly
described as follows: -
Beginning at a point from which the N Corner of Section 7, Township 6 South,
Range 91 West bears N. 57°21'39" E. a distance of 7128.11 feet;
thence N. 11°29'01"W. a distance of 810.42 feet to r. point on the approximate
South bank high water line of the Colorado River;
thence N. 15°59'31" E. a distance of 279.06 feet to a point on the centerline of
the Colorado River;
thence N.62°12'41" W. and along the centerline of the said Colorado River, a
distance of 328.92 feet;
thence S. 27°47'19° W. a distance of 261.59 feet to a point on the approximate
South bank high water line of the said Colorado River;
thence S.27°47'19" W. a distance of 294.74 feet to a point on the Northerly
right-of-way line of County Road No. 335;
thence S. 66°48'03" E. and along the Northerly right-of-way line of said County
Road No. 335 a distance of 134.11 feet;
thence continuing along said Northerly right-of-way line, along a curve to the
right having a central angle of 29°42'12", and a radius of 558.78 feet, for an
arc length distance of 289.68 feet;
thence S. 37°05'51" E. and continuing along the said Northerly right-of-way line,
a distance of 218.75 feet;
thence continuing along the said Northerly right-of-way line, along a curve to the
right having a central angle of 16°42'35", and a radius of 817.82 feet for an arc
length distance of 238.38 feet;
thence S. 20°23'16" E. and continuing along said Northerly right-of-way line for
a distance of 66.54 feet;
thence continuing along said Northerly right-of-way line along a curve to the left
having a central angle of 16°00'30" and a radius of 185.79 feet for an arc length
distance of 51.91 feet more or less to the True Point of Beginning.
EXCEPT all that portion thereof lying Northerly of the Southerly meander line of
the Colorado River.
WHEREAS, pursuant to required public notice, the Board conducted a public hearing on
the 5th day of April, 1982, upon the question of whether the above described special
use permit should be granted or denied, at which hearing the public and interested
persons were given the opportunity to express their opinions regarding the issuance of
said special use permit; and
WHEREAS, the Board on the basis of the evidence produced at the aforementioned hearing,
has made the following determinations of fact:
1. The proposed use is compatible with the uses existing and permitted in the
district in which it is to be located, provided that certain hereinafter contained con-
ditions be complied with.
2. That neither the impact on traffic volume and safety or on utilities, or any
other impact of the special use will be injurious to the established neighborhood or
zone district in which the special use is to be located.
NOW, THEREFORE, BE IT RESOLVED by the
Colorado, that a special use permit be and
of the above described tract of land for a
conditions:
1. That the use of the tract of land
-regulations of Garfield relating to a Guest
property is now or may later be located;
2. That, prior to the issuance of the authorized special use permit, the above
described tract of land shall be severed from any other tract of land upon which there
may exist a principal use, unless such other such principal use has been terminated at
the time of the issuance of the special use permit.
