Colorado Revised Statute 30-28-110 (1)(a) -(e) requires the Planning
Commission to approve any road, park or public way, ground or space,
public building or structure or public utility prior to construction.
If for some reason the Planning Commission were to deny an
application, the decision could be overruled by the Board of County
Commisioners. If the Board of County Commissioners were to uphold the
denial, the Board of any public entity whose authorization or
financing does not fall within the province of the Board of County
Commissioners may overrule the County decision.
III. RECOMMENDATION
APPROVAL, based on the assumption that the line will be removed after
construction is completed in 6-9 months.
