Peter Simmons & Dorothy Simmons. The enclosed application if for an accessory dwelling on their property for a caretaker. This unit is to be remodeled from an existing building already located on their property. The Simmons wish for me to inform you that they are an older couple whose health is getting worse. They find themselves in need of readily available help. This cottage will be for the lady that cares for them now. She currently commutes from the Carbondale/El Jebel area to assist them at any time she is needed. The building in question is a 30' x 34' existing building located on the northwest corner of their property with driveway access through lot 3 to the north of their property. Water will be provided by the well located on the property and sewage will be handled by a newly installed septic tank and infiltration system as per plan. The structure will be brought up to county building code at the time of permit and remodel. Please find a list of adjacent property owners attached. DANIELSON State Engineer /,Utir,q eur2.4.4k14) Re: Arnove Exemption Section 28, T6S, R88W We have reviewed this proposal to separate 60 acres into tracts of 4.1, 5.4, 15.1 and 35+ acres. There are homes on the 5.4 and 15.1 acre tracts already. Well number 31599 (issued August 1, 1967) is the proposed source of water for the three smaller tracts. The applicants will seek a new well on the 35 acres. Our comments follow: 1. We have no authority to recommend expanded use of well 31599 and as a general policy, we would discourage an expanded use of such a well. however, the proposed use is not illegal and would remain within the standards of an exempt well. 2. If a domestic well is used to serve more than one lot, we would recommend joint ownership, an operation and maintenance agreement, and any necessary easements. 3. We can make no indication concerning the availability of a domestic well on 35 acres other than to say that these wells are available pursuant to CRS 1973, 37-92-602(3)(b)(II). 4. Thirty—five acre parcels are not subject to SB -35, therefore, if the county approved this proposal, we could not object and the avail— ability of a well on the 35—acre tract would not be adversely affected. We would make a well permit available with a condition that it could only serve one single—family dwelling since it involves an exemption. PURPOSE: To split a 60 acre tract into 4 tracts of 4.1, 5.4, 15.1 and 35 acres each. QUALIFICATION: Owned 5+ years; also, split to son and daughter ZONING: A/R/RD WATER: Proposed shared domestic well on 3 smaller tracts; proposed new well on 35 acre tract. SEWER: Individual septic systems ACCESS: County Roads 115 or 114. 1. RELATIONSHIP TO THE COMPREHENSIVE PLAN: This parcel lies within District B (Subdivisions/Rural Serviceable Areas 0 to 1/2 mile radius) of the County Comprehensive Plan. District B density may be the same as the existing subdivision, but should not exceed three (3) units per acre. Developments within District B shall connect to an existing central water system or construct its own central water system. The proposed density is consistent with the Plan, but the individual wells proposed are not consistent with Plan language for technical services. II. MAJOR ISSUES AND CONCERNS: A. Staff Comments: 1. There are existing residences on the proposed 5.4 and 15.1 acre tracts. These are currently served by the existing domestic well and individual septic systems. 2. In June, 1981, the Garfield County Board of Commissioners passed a resolution determining that further subdivision in the Spring Valley area of Garfield County impacting County Road 115 was premature unless an applicant was able to demonstrate to the satisfaction of the Board that such division would not add traffic to that portion of County Road 115, known as the Red Canyon Road, or otherwise impact the Garfield County road system in the Spring Valley area (see Resolution 81-175, page 53 ). The Board will need to make a determination of the impacts of this exemption on the area road system in relation to that previous resolution. B. Review Agency Comments: In a phone conversation with Keith Kepler of the State Division of Water Resources on March 30, 1983, he indicated that shared use of the existing domestic well would be approved; and it appears that the applicant will be able to serve an additional well permit for the remaining 35 acre tract.
