2.0 Supplemental Application Materials
Mineral Owners The mineral rights owners to parcel #212734200161 were identified by the employees at the Garfield County Clerk and Recorder's office in Glenwood Springs. The copy purchased from the County Clerk's Office was the copy of the Warranty Deed that was written when the Watkins (the original owners of the property that currently own the mineral rights) sold the property, excluding the mineral rights. Teresa Watkins also sent a picture of the front page of the Oil and Gas Lease she had in her files to Cori. The County Clerk's Office said there is no file showing that Watkins had sold the mineral rights of the property. Greg and Teresa Watkins are in association of Trever and Cori Rider and they speak on the phone periodically with each other. This is how their address was found. Greg and Teresa Watkins will be notified in writing when told to do so according to the timeline. Their address is: Greg & Teresa Watkins 1639 W. Deborah Drive Greensburg, IN 47240 Project Description The number of dogs allowed at a time at the kennel will vary. There will be 14 pens. One large dog per pen. In some cases there may be 2 or 3 small dogs instead of a large dog. The average daily number of dogs will vary from day to day. An expected average of 12 dogs daily, but on holiday weekends they may reach their maximum number of dogs. The kennel will be able to house a maximum of 20 dogs. The state has no limits, only that the number of dogs being housed is properly and safely contained according the their standards and inspections. Signage There will be a sign at the start of the driveway. Approximately 36" X 36" with the name "Cozy Little Kennel" on it. This will be used for people to know where to turn off the county road. There may be one or two small directional signs on the kennel owners property (maybe 24" X 24" at the most) and one on the front of the kennel building (2' X 12') with an arrow so people will know where to go when entering the building. We plan to stay low key and not distractive. We are willing to follow guidelines and advice on whatever rules there are in the ways of having signs. Impact Analysis Property discription: Our property is a primarily flat, except for the dog play yard on the north side of the kennel. It is on a small hillside. The east half of the property consists of irrigated yard (on nearly 3/ of the dogs play yard areas). There are several of all kinds of trees dispersed throughout the property (mostly in the dog play yard areas) consisting of aspen, cottonwood, crab apple, apple, willow, spruce and ash. There is a small pond 5' deep that is supplied by irrigation. The west side of the property of the kennel is not irrigated. A horse pasture that consists of a grass that grows on its own here. What is known as the Pump Canal Ditch runs through our property and has no access to us in any way. The Pump Canal Ditch is completely bordered by a 10 -12' high deer fence that runs East to West along the ditch, keeping people and all animals away from the water. The structures on the property consist of house, garage (becoming the kennel building), livestock and hay structures. The adjacent property to the North of our property is a horse pasture (half just dirt and weeds and the other half trees (russian olives, willows and cottonwoods) and wild grasses. There is also horse shelter and small hay barn. Further north and on top of hill is a dwelling unit on the property and more horse pastures. The property to the East is all property not being used at all. It consists of primarily flat land, a few cottonwood trees, sagebrush and a small gully wash area that runs through that piece of property, also having grasses and weeds that grow on its own. To the West is a dwelling unit completely surrounded by sprinkler irrigated horse pastures. Only small willow bushes are on the property besides the pasture grass and two yard trees (spruce and aspen). This property has an irrigation stream consisting of irrigation overflow, just over our property line. This is the opposite side of the property from the dog area. To the South East where just the corner of the two properties meet is used currently for nothing at all. It too has part of the gully and some sage brush and cotton wood trees. Further southeast and on the other side of the large trees and brush is an irrigated hay field. South of the property is a Targe hay field. There is a residents house and this half of the property where the house is, is mostly rock and cheatgrass. There are no trees. Flora & Fauna: The use of the property for a kennel is not going to affect the flora and fauna. Our fence in the kennel area is considered deer high fence, keeping all large animals out. Very small rabbits, squirrel type and mice should be the only animals in the area that could get through the fence. There will be no chemical use of any kind that would affect the adjacent properties to ours. Anything we do here will not affect the land, plant life or animals adjacent to the property. Everything we plan to do to control urine and urine odor on our own property will be biodegradable or it goes into the septic, such as after mopping. There will be random and seldom (no more than once per year on average) weed, rodent and bug control at times when necessary, while the kennel is closed. Noise Compliance: Hankard Environmental has completed a noise study showing that the kennel will be in compliance with the required State Noise Standards if the "barking" dogs are within 25 feet of the property line between the hours of 7AM-7PM and 200 feet from the property line during the hours of 7PM-7AM. The plan for dealing with "barking" dogs during these times and within their boundaries will either be on leash or have to wear a noise control device such as a bark collar. Some dogs are quite when let out alone as well, instead of with other dogs. All dog owners bringing dogs to the kennel will have to sign a waiver stating that when necessary, they give permission to the kennel workers to use a noise control device. We will do whatever we can to keep things peaceful with those around us. Keeping the dogs quiet in consideration of the properties owners around us is of high priority. We will be willing to make adjustments if complaints come to the rise due to noise. Hours of Operation: The kennel will have strict customer drop-off and pick-up times to get their dogs. Noise from the dogs, while out at playtimes, will get loud if dog owners are allowed to come and go with vehicles during playtime, so we have adjusted the times of dog pick-up/drop-off accordingly. The dog's pick-up/drop-off times schedule is as follows to keep things quiet as possible are listed below. If the hours of operation become a nuisance to the neighbors, we are willing to make adjustments (possibly by appointment dispersed at different hours throughout the day). Hours of operation (when customers are free to come and go): 8am - 9am & 4pm - 5pm Traffic Study A representation of the number of Average Daily Trips (ADT) that will be created by the proposed use is below: Customers 4 per day = 8 ADT 2 Employees = 4 ADT One Dwelling Unit = 9.57 Total ADT= 21.57 Water Supply and Distribution Plan Attached is a copy of the well permit application for the well that will be drilled as a Condition of Approval. We will conduct a water quality test and quantity test of the well also as Conditions of Approval, if requested. Parking Attached is a site plan for parking. Overall, there is enough parking to comfortable park and maneuver around 14 vehicles if were to be necessary. There is plenty of room for all vehicles to back up without struggle and turn around with ease, even if all vehicles parking places are filled. There is one tree in the driveway which all branches will be trimmed to a minimum of 8 feet high from the ground, completing a clear view and path for the vehicles which park next to it. Snow Removal & Driveway Maintenance We have a tractor with a loader and grader for snow removal and proper care of the driveway and parking lot. Gravel and sand will be ordered for delivery when necessary to keep it in good shape. There are several acres on the property to dump snow. Lighting All lighting is what is currently on what will be the kennel building. There are Tight features all the way around the building. All of the lights point downward or inward and not facing toward any of the neighboring properties, they all have shields, there are no flashing lights, they don't create a traffic hazard and none of the lights are 40' foot high or taller. This well is known as Watkins Well #I (aka Rider Well). 5) The pumping rate of this well shall not exceed 15 GPM. 6) The annual amount of ground water to be withdrawn shall not exceed 0.99 acre-foot (322,592 gallons). 7) The owner shall mark the well in a conspicuous place with the well permit number and name of aquifer as appropriate, and shall take necessary means and precautions to preserve these markings. 8) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request. 9) Pursuant to Rule 6.2.3 of the Water Well Construction Rules, the well construction contractor shall submit the as -built well location on work reports required by Rule 17.1 within 60 days of completion of the well. The measured location must be accurate to 200 feet of the actual location. This section of the statutes continues with provisions that will allow the issuance of a well permit in the event there are other wells within 600 feet. One of those provisions, an exception found in 37-90-137(2)(b)(11)(C)1, states that the permit may be issued if "the proposed well will serve an individual residential site and the proposed pumping rate will not exceed fifteen gallons per minute." The objective of this policy is to clarify the types of uses that are allowed on an "individual residential site" for that site to qualify for the exception to the 600 -foot spacing requirement in 37-90-137(2)(b)(11)(C). Policy Section 37-90-137(2)(b)(I1)(C) states that a well permit considered according to 37-90-137(2) may be issued without regard to the 600 -foot spacing provision of that same section as long as "the proposed well will serve an individual residential site and the proposed pumping rate will not exceed fifteen gallons per minute." For the purposes of applying this statutory exception to 600 -foot spacing only, the qualifier "serve an individual residential site" will be taken to mean serving a residence along, with uses that meet the following limitations: 1. Uses that do not exceed those identified in 37-92-602(1)(b); or more specifically, uses that do not exceed: ordinary household purposes inside three single-family dwellings; fire protection; the watering of poultry, domestic animals, and livestock; and the irrigation of not more than one acre of home gardens and lawns. Uses beyond those described will require 600 -foot spacing considerations that are required by 37-90-137(2), or 2. Uses that will not result in greater than three acre-feet of pumping on an annual basis. Note that this provision in the statutes was renumbered in 2009 due to the passage of HB09-1303. At the time, it was most likely that non-exempt well permits would be for high-capacity commercial, industrial, municipal, and irrigation wells. In these cases, it was less likely that other wells would be located within 600 feet and, due to the large volumes and pumping rates associated with the high-capacity wells, it was a reasonable measure. However, in the following years, land development practices included small -lot residential subdivisions in locations with no municipal water supply economically available. Due to the passage of Senate Bill 35 in 1972 and Senate Bill 7 in 1975, a developer could not use individual on -lot wells permitted as exempt wells for the water supply. Therefore, it became common to develop augmentation plans to allow individual on -lot wells in subdivisions. The permits for those wells were necessarily issued for non-exempt welts under 37-90-137(2) and were, therefore, subject to 600 -foot spacing considerations. Because the parcels in the subdivisions were relatively small, many of these wells would be within 600 feet of each other. This resulted in the unintended effect of requiring that lot owners in these subdivisions follow the 600 -foot spacing notice provision of the statutes, which was time-consuming, costly, and usually unnecessary. The exception for wells serving "an individual residential site" was originally codified in 37-90- 137(2)(b)(III) as a result of House Bill 92-1008. Some well permit applicants have argued that they should be allowed to take advantage of the exception for their wells, even in cases where the well is used for commercial or non-traditional residential uses, regardless of the volume pumped, due to the fact that there is a residence on the site and the well, therefore, serves an "individual residential site." However, in Senate Ag Committee hearings for House Bill 92-1008, then State Engineer, Jeris Danielson, stated that there was a need to remove the 600 -foot spacing requirement for small individual residential wells. He spoke further about the difficulty for subdivisions with lots of one, two, or three acres, to meet the 600 -foot spacing requirements. It would seem, therefore, that the application of the exception considered by the General Assembly was intended to be limited to typical residential wells. One reasonable approach to setting a limit for those wells' uses is to use the limit set forth in 37-92-602(1)(b). Such a limit would prevent a well permit applicant from using the exception for a well that could supply an unusually large volume of water, even under the 15 gallon per minute limitation, to commercial or non-traditional residential uses, such as the filling of a large pond or the irrigation of multiple acres, while claiming that it qualifies for the exception due to the fact that there is a residence on the site. A second reasonable approach would recognize that it is not unusual for residential homes served by non-exempt wells to include a small-scale commercial business that consumes a small amount of water, or non-commercial features that the State Engineer has not historically regarded as residential, such as hot tubs or small private swimming pools. In consideration of the fact that a typical residential site may have these uses, while not diverting more than a domestic well might, an alternative to the first, would allow the exemption from the 600 -foot spacing provisions based on a limit to the volumetric amount as the only criterion other than the requirement that there be a residence on the site. In the event the Applicant develops and adjudicates its own augmentation plan to utilize the water allotted hereunder, Applicant shall not be obligated to pay any amount under Paragraph 19 below. In any event, the District shall have the right to approve or disapprove the Applicant's augmentation plan and the Applicant shall provide the District copies of such plan and of all pleadings and other papers filed with the water court in the adjudication thereof. 6. Contract Payment-. Non-refundable, one time administrative charge, in the amount determined by the Board of Directors of the District from time to time, shall be submitted with the application for consideration by the District. 2 # 9 04214 Annual payment for the water service described herein shall be determined by the Board of Directors of the District. The initial annual payment shall be made in full, within thirty (30) days after the date of notice to the Applicant that the initial payment is due. Said notice will advise the Applicant, among other things, of the water delivery year to which the initial payment shall apply and the price which is applicable to that year. Annual payments for each year thereafter shall be due and payable by the Applicant on or before each January 1. If an annual payment is not made by the due date a flat $50 late fee will be assessed. Final written notice prior to cancellation will be sent certified mail, return receipt requested, to the Applicant at such address as may be designated by the Applicant in writing or set forth in this Contract or Application. Water use for any pail of a water year shall require payment for the entire water year. Nothing herein shall be construed so as to prevent the District from adjusting the annual rate in its sole discretion for future years only. If payment is not made within fifteen (15) days after the date of said written notice, Applicant shall at District's sole option have no further right, title or interest under this Contract without further notice, and delivery may be immediately curtailed. The allotment of water, as herein made, may be transferred, leased, or otherwise disposed of at the discretion of the Board of Directors of the District. Upon cancellation of this water allotment Contract with the District, the District shall notify the Division of Water Resangees. offices in Denver and Glenwood Springs. The Division of Water Resources may then order cessation of ail water use. 7. Additional Fees and Costs: Applicant agrees to defray any expenses incurred by the District in connection with the allotment of water rights hereunder, including, but not limited to, reimbursement of legal and engineering costs incurred in connection with any water rights and adjudication necessary to allow Applicant's use of such allotted water rights. 8. Assignment., This Contract shall not inure to the benefit of the heirs, successors or assigns of Applicant, without the prior written consent of the District's Board of Directors. Any assignment of Applicant's rights under this Contract shall be subject to, and must comply with, such requirements as the District may hereafter adopt regarding assignment of Contract rights and the assumption of Contract obligations by assignees and successors. Nothing herein shall prevent successors to a portion of Applicant's property from applying to the District for individual and separate allotment Contracts. No assignment shall be recognized by the District except upon completion and filing of proper forms for assignment and change of ownership. In the event the water allotted pursuant to this Contract is to be used for the benefit of land which is now or will subsequently be subdivided or held in separate ownership, the Applicant may only assign the Applicant's rights hereunder to: I) No more than three separate owners all of whom shall be party to a well sharing agreement satisfactory to the District; or 2) A homeowners association, water district, water and sanitation district or other special district properly organized and existing under the laws of the State of Colorado, and then, only if such parties, association or special district establishes to the satisfaction of the District that it has the ability and authority to perform the Applicant's obligations under this Contract. In no event shall the owner of a portion, but Tess than all, of the Applicant's property to be served under this Contract have any rights hereunder, except as such rights may exist pursuant to a well sharing agreement or through a homeowners association or special district as provided above. Upon the sale of the real property to which this Contract pertains, Applicant shall make buyer aware of this Contract and proper forms for assignment and change of ownership must be completed. 3 9. Other Rules: Applicant shall be bound by the provisions of the Water Conservancy Act of olorado; by"'the rules and regulations of the Board of Directors of the District; and all amendments thereof and supplements thereto and by all other applicable law. Operation and Maintenance Agreement: Applicant shall enter into an "Operation and Maintenance Agreement" with the District under terms and conditions determined by the board of Directors of the District, if and when, the Board of said District determines in its sole discretion that such an agreement is required_ Said agreement may contain, but shall not be limited to, provisions for additional annual monetary consideration for extension of District delivery services and for additional administration, operation, and maintenance costs; or for other costs to the District which may arise through services made available to the Applicant. 11. Change of Use: The District reserves the exclusive right to review, re -approve or disapprove any proposed change in use of the water allotted hereunder. Any use other than that set forth herein or any lease or sale of the water or water rights allotted hereunder without the prior written approval of the District shall be deemed to be a material breach of this Contract. 12. Use and Place of Use: Applicant agrees to use the water in the manner and on the property described in the documents submitted to the District at the time this Contract is executed, or m any operation and maintenance agreement provided by Applicant. Any use other than as set forth thereon or any lease or sale of the water or water rights herein, other than as permitted in paragraph 8 above, shall be deemed to be a material breach of this agreement. 13. Title: It is understood and agreed that nothing herein shall be interpreted to give the Applicant any equitable or legal fee title interest in or to any water or water rights referred to herein. 14. Conservation: Applicant shall use commonly accepted conservation practices with respect to the water and water rights herein, and hereby agrees to be bound by any conservation plan adopted hereafter by the District for use of District owned or controlled water or water rights. 15. Restrictions* Applicant shall restrict actual diversions to not exceed the contract amount for ordinary household purposes, the watering of domestic livestock, fire protection, and the irrigation of lawn and garden as specified in the Application. Applicant shall also comply with all restrictions and limitations set forth in the well permit obtained from the Colorado Division of Water Resources. Watering of livestock shall be restricted to Applicant's domestic animals not to be used for commercial purposes unless Applicant obtains approval from the Colorado Division of Water Resources for commercial use/livestock watering, provided that in no event shall actual diversions exceed the amount of water provided by this Contract. Violation of this paragraph 15 shall be deemed to be a material breach of this Contract. 16. Well Permits If Applicant intends to divert through a well, then Applicant must provide to District a copy of Applicant's valid well permit before District is obligated to deliver any water hereunder. 17. Your treatment system features a pH boosting filter post treatment that is utilized to ensure the highly purified water is not acidic when entering the house. The system should be producing 7.2-8.2 pH but it is currently producing product water that has a much higher pH. This can be solved quickly by a simple adjustment to the pH filter. To that end, I have informed our service department and they have opened a service ticket to resolve this issue. You should be receiving a call in the next 48 hours to schedule this service. Water is not typically classified as acidic unless the pH gets below 6.6-6.8 and your water does not fall into this range. The reason your water can get to this level post reverse osmosis is because it is almost completely pure H20. Pure H2O is acidic by nature and thus why we need the pH boosting tank, the current problem is the tank is working too well and boosting the pH to over 10.0. Again, this is a simple adjustment to the post treatment pH tank and I will have our service department reach out to you in the coming days to schedule a service visit for this adjustment. Decrees and Delivery: Exchange releases made by the District out of storage from Ruedi Reservoir, Green Mountain Reservoir, Alsbury Reservoir, or other works or facilities of the District, or from other sources available to the District, shall be delivered to the Applicant at the outlet works of said storage facilities or at the decreed point of diversion for said other sources, and release or delivery of water at such outlet or points shall constitute performance of the District's total obligation. Delivery of water by the District from Ruedi Reservoir or Green 1 # 9504279 Mountain Reservoir shall be subject to the District's lease contracts with the United States Bureau of Reclamation. Releases from other facilities available to District shall be subject to the contracts, laws, rules, and regulations goveming releases therefrom. Fun 3 �: hereby expressly reserves the right to store water and to make exchange releases from structures that may be built or conro eHyL1 e s tstnct in the future, so long as the water service to the Applicant pursuant to this agreement, is not impaired by said action. Any glla(ltit}laf�th pplicant's LOIT allocation not delivered to or used by Applicant by the end of each water year (October 1), shall revert to the water supplies of the District. Such reversion shall not entitle Applicant to any refund of payment made for such water. Division 5 Water Resources Glenwood Springs Water service provided by the District shall be limited to the amount of water available in priority at the original point of diversion of the District's applicable water right, and neither the District, nor those entitled to utilize the District's decrees, may call on any greater amount at new or alternate points of diversion. The District shall request the Colorado Division of Water Resources to estimate any conveyance losses between the original point and any alternate point, and such estimate shall be deducted from this amount in each case. Water service provided by the District for properties located within the Bluestone and Silt Water Conservancy Districts is provided pursuant to Agreements with said Districts. The Intergovernmental Agreement between the District and the Silt Water Conservancy District, dated January 25, 2001, is recorded as Reception No. 575691, Garfield County Clerk and Recorder's Office. The Intergovernmental Memorandum of Understanding between the District and the Bluestone Water Conservancy District, dated April 26, 2001, is recorded as Reception No. 584840, Garfield County Clerk and Recorder's Office. 5. Alternate Point of Diversion and Plan of Aulunentation., Decrees for alternate points of diversion of the District's water rights or storage water may be required in order for Applicant to use the water service contemplated hereunder. Obtaining such decree is the exclusive responsibility of Applicant. The District reserves the right to review and approve any conditions which may be attached to judicial approval of said alternate point of diversion as contemplated or necessary to serve Applicant's facilities or lands. Applicant acknowledges and agrees that it shall be solely responsible for the procedures and legal engineering costs necessary for any changes in water rights contemplated herein, and further agrees to indemnify the District from any costs or losses related thereto. Applicant is solely responsible for providing works and facilities necessary to obtain/divert the waters at said alternate point of diversion and deliver them to Applicant's intended beneficial use. Irrespective of the amount of water actually transferred to the Applicant's point of diversion, the Applicant shall make annual payments to the District based upon the amount of water allotted under this Contract. In the event the Applicant intends to apply for an alternate point of diversion and to develop an augmentation plan and institute legal proceedings for the approval of such augmentation plan to allow the Applicant to utilize the water allotted to Applicant hereunder, the Applicant shall give the District written notice of such intent. In the event the Applicant develops and adjudicates its own augmentation plan to utilize the water allotted hereunder, Applicant shall not be obligated to pay any amount under Paragraph 19 below. In any event, the District shall have the right to approve or disapprove the Applicant's augmentation plan and the Applicant shall provide the District copies of such plan and of all pleadings and other papers filed with the water court in the adjudication thereof. 6. Contract Payment; Non-refundable, one time administrative charge, in the amount determined by the Board of Directors of the District from time to time, shall be submitted with the application for consideration by the District. Division 5 Water Resources Glenwood Springs Annual payments for each year thereafter shall be due and payable by the Applicant on or before each January 1. If an annual payment is not made by the due date a flat $50 late fee will be assessed. Final written notice prior to cancellation will be sent certified mail, return receipt requested, to the Applicant at such address as may be designated by the Applicant in writing or set forth in this Contract or Application. Water use for any part of a water year shall require payment for the entire water year. Nothing herein shall be construed so as to prevent the District from adjusting the annual rate in its sole discretion for future years only. If payment is not made within fifteen (15) days after the date of said written notice, Applicant shall at District's sole option have no further right, title or interest under this Contract without further notice, and delivery may be immediately curtailed. The allotment of water, as herein made, may be transferred, leased, or otherwise disposed of at the discretion of the Board of Directors of the District. Upon cancellation of this water allotment Contract with the District, the District shall notify the Division of Water Restes_ offices in Denver and Glenwood Springs. The Division of Water Resources may then order cessation of all water use. 7. Additional Fees and Costs: Applicant agrees to defray any expenses incurred by the District in connection with the allotment of water rights hereunder, including, but not limited to, reimbursement of legal and engineering costs incurred in connection with any water rights and adjudication necessary to allow Applicant's use of such allotted water rights. 8. Assignment; This Contract shall not inure to the benefit of the heirs, successors or assigns of Applicant, without the prior written consent of the District's Board of Directors. Any assignment of Applicant's rights under this Contract shall be subject to, and must comply with, such requirements as the District may hereafter adopt regarding assignment of Contract rights and the assumption of Contract obligations by assignees and successors. Nothing herein shall prevent successors to a portion of Applicant's property from applying to the District for individual and separate allotment Contracts. No assignment shall be recognized by thc District except upon completion and filing of proper forms for assignment and change of ownership. In the event the water allotted pursuant to this Contract is to be used for the benefit of land which is now or will subsequently be subdivided or held in separate ownership, the Applicant may only assign the Applicant's rights hereunder to: 1) No more than three separate owners all of whom shall be party to a well sharing agreement satisfactory to the District; or 2) A homeowners association, water district, water and sanitation district or other special district properly organized and existing under the laws of the State of Colorado, and then, only if such parties, association or special district establishes to the satisfaction of the District that it has the ability and authority to perform the Applicant's obligations under this Contract. In no event shall the owner of a portion, but less than all, of the Applicant's property to be served under this Contract have any rights hereunder, except as such rights may exist pursuant to a well sharing agreement or through a homeowners association or special district as provided above. Change of Use: The District reserves the exclusive right to review, re -approve or disapprove any proposed change in use of the water allotted hereunder. Any use other than that set forth herein or any lease or sale of the water or water rights allotted hereunder without the prior written approval of the District shall be deemed to be a material breach of this Contract 12. Use and Place of Use: Applicant agrees to use the water in the manner and on the property described in the documents submitted to the District at the time this Contract is executed, or m any operation and maintenance agreement provided by Applicant. Any use other than as set forth thereon or any lease or sale of the water or water rights herein, other than as permitted in paragraph 8 above, shall be deemed to be a material breach of this agreement. 13. Conservation: Applicant shall use commonly accepted conservation practices with respect to the water and water rights herein, and hereby agrees to be bound by any conservation plan adopted hereafter by the District for use of District owned or controlled water or water rights. 15. Restrictions; Applicant shall restrict actual diversions to not exceed the contract amount for ordinary household purposes, the watering of domestic livestock, fire protection, and the irrigation of lawn and garden as specified in the Application. Applicant shall also comply with all restrictions and limitations set forth in the well permit obtained from the Colorado Division of Water Resources. Watering of livestock shall be restricted to Applicant's domestic animals not to be used for commercial purposes unless Applicant obtains approval from the Colorado Division of Water Resources for commercial use/livestock watering, provided that in no event shall actual diversions exceed the amount of water provided by this Contract. Violation of this paragraph 15 shall be deemed to be a material breach of this Contract. 16. Well Permit; If Applicant intends to divert through a well, then Applicant must provide to District a copy of Applicant's valid well permit before District is obligated to deliver any water hereunder. 17. Measuring Device or Meter. Applicant agrees to provide, at its own expense, a measuring device deemed acceptable by the District's Engineer after consultation, or a totalizing flow meter with remote readout to continuously and accurately measure at all times all 4 9504279 water diverted pursuant to the terms of Applicant's water right and the terms of this Contract Applicant agrees to provide accurate r��// e��adin from such device or meter to District upon District's request. Applicant acknowledges that failure to comply with this parag fe3uegal action to terminate Applicant's diversion of water by the State of Colorado Division of Water Resources. Representations: By executing this Contract, Applicant agrees that it is not relying on any legal or engineering advice that Applicant may believe has been received from the District. Applicant further acknowledges that it bas obtained all necessary legal and engineering advice from Applicant's own sources other than the District. Applicant further acknowledges that the District makes no guarantees, warranties, or assurances whatsoever about the quantity or quality of water available pursuant to this Contract Should the District be unable to provide the water contracted for herein, no damages may be assessed against the District, nor may Applicant obtain a refund from the District. 19. Costs of Water Court Filing and Augmentation flan; Should the District, in its own discretion, choose to include Applicant's Contract herein in a water court filing for alternate point of diversion or plan of augmentation, then Applicant hereby agrees to pay to the District, when assessed, an additional fee representing the District's actual and reasonable costs and fees for Applicant's share of the proceedings. Applicant shall be assessed a pro -rata share of the total cost incurred by the District in preparing, filing and pursuing to decree the water court case. The pro -rata share shall be calculated by dividing such total cost by the number of contractees included in the filing. To the extent that the District is caused additional costs because of objection filed specifically due to the inclusion of Applicant's Contract in the filing, such additional costs may be charged specifically to Applicant and not shared on a pro -rata basis by all contractees. 20. Binding Agreement: This agreement shall not be complete nor binding upon the District unless attached hereto is the form entitled "Application to Ip-acr Water From West Divide Water Conservancy District" fully completed by Applicant and approved by the District's engineer. Said attachments shall by this reference thereto be incorporated into the terms of this agreement. All correspondence from the District to Applicant referring to or relating to this agreement is by this reference incorporated into this agreement as fiuther terms and conditions of this agreement. 21. Warning: IT IS THE SOLE RESPONSIBILITY OF THE APPLICANT TO OBTAIN A VALID WELL PERMIT OR OTHER WATER RIGHT IN ORDER TO DIVERT WATER, INCLUDING THE WATER ACQUIRED UNDER THIS CONTRACT. The property currently has an existing single family residence, access road and utilities in place. The applicant does not propose to create a new lot or change the size of the existing lot, The current water supply to the residence and for the proposed kennel on the lot is water hauled to the property from the town of Silt water supply. The applicant has not identified the irrigation water source for the yard (which includes part of the dog play yard) or the small pond. The applicant has indicated constructing a well on the property for the kennel if their current water supply is not acceptable. The application indicates an existing individual septic system serves the existing single family dwelling and will serve the proposed kennel. According the submittal, the applicant states that they currently haul water to the property and that the lawn is currently supplied by irrigation water_ According to our records, Well Permit No. 80654-F was issued on March 6, 2017, to construct a well in the SW1/4 of the NW1/4 of Section 34, Twp. 5 South, Rng. 92 West of the 6`" P.M. The objective of this policy is to clarify the types of uses that are allowed on an "individual residential site" for that site to qualify for the exception to the 600 -foot spacing requirement in 37-90-137(2)(b)(I I)(C). Policy Section 37-90-137(2)(b)(II)(C) states that a well permit considered according to 37-90-137(2) may be issued without regard to the 600 -foot spacing provision of that same section as long as "the proposed well will serve an individual residential site and the proposed pumping rate will not exceed fifteen gallons per minute." For the purposes of applying this statutory exception to 600 -foot spacing only, the qualifier "serve an individual residential site" will be taken to mean serving a residence along, with uses that meet the following limitations: 1. Uses that do not exceed those identified in 37-92-602(1)(b); or more specifically, uses that do not exceed: ordinary household purposes inside three single-family dwellings; fire protection; the watering of poultry, domestic animals, and livestock; and the irrigation of not more than one acre of home gardens and lawns. Uses beyond those described will require 600 -foot spacing considerations that are required by 37-90-137(2), or 2. Uses that will not result in greater than three acre-feet of pumping on an annual basis. Note that this provision in the statutes was renumbered in 2009 due to the passage of HB09-1303. At the time, it was most likely that non-exempt well permits would be for high-capacity commercial, industrial, municipal, and irrigation wells. In these cases, it was less likely that other wells would be located within 600 feet and, due to the Targe volumes and pumping rates associated with the high-capacity wells, it was a reasonable measure. However, in the following years, land development practices included small -lot residential subdivisions in locations with no municipal water supply economically available. Due to the passage of Senate Bill 35 in 1972 and Senate Bill 7 in 1975, a developer could not use individual on -lot wells permitted as exempt wells for the water supply. Therefore, it became common to develop augmentation plans to allow individual on -lot wells in subdivisions. The permits for those wells were necessarily issued for non-exempt wells under 37-90-137(2) and were, therefore, subject to 600 -foot spacing considerations. Because the parcels in the subdivisions were relatively small, many of these wells would be within 600 feet of each other. This resulted in the unintended effect of requiring that lot owners in these subdivisions follow the 600 -foot spacing notice provision of the statutes, which was time-consuming, costly, and usually unnecessary. The exception for wells serving "an individual residential site" was originally codified in 37-90- 137(2)(b)(III) as a result of House Bill 92-1008. Some well permit applicants have argued that they should be allowed to take advantage of the exception for their wells, even in cases where the well is used for commercial or non-traditional residential uses, regardless of the volume pumped, due to the fact that there is a residence on the site and the well, therefore, serves an "individual residential site." However, in Senate Ag Committee hearings for House Bill 92-1008, then State Engineer, Jeris Danielson, stated that there was a need to remove the 600 -foot spacing requirement for small individual residential wells. He spoke further about the difficulty for subdivisions with Tots of one, two, or three acres, to meet the 600 -foot spacing requirements. It would seem, therefore, that the application of the exception considered by the General Assembly was intended to be limited to typical residential wells. One reasonable approach to setting a limit for those wells' uses is to use the limit set forth in 37-92-602(1)(b). Such a limit would prevent a well permit applicant from using the exception for a well that could supply an unusually large volume of water, even under the 15 gallon per minute limitation, to commercial or non-traditional residential uses, such as the filling of a Targe pond or the irrigation of multiple acres, while claiming that it qualifies for the exception due to the fact that there is a residence on the site. A second reasonable approach would recognize that it is not unusual for residential homes served by non-exempt wells to include a small-scale commercial business that consumes a small amount of water. or non-commercial features that the State Engineer has not historically regarded as residential, such as hot tubs or small private swimming pools. In consideration of the fact that a typical residential site may have these uses, while not diverting more than a domestic well might, an alternative to the first, would allow the exemption from the 600 -foot spacing provisions based on a limit to the volumetric amount as the only criterion other than the requirement that there be a residence on the site.
