Gentlemen:
In compliance with county zoning regulations for Special Use Permit in an
Agricultural/Residential/Rural Density District, application is hereby re-
quested for a permit to extract materials to build roadway from materials
pit designated as the Dalrymple Heavy Riprap Pit.
As per Section 4.03.07 (Industrial Operations) of the County Zoning Resolution:
Location of area for which applied
Description on attached "Option to Buy Material" forms, both as
a map form and legal description.
Scope of work -
To include removal of materials from locations as described on pit
sketches. Material to be used for construction of Interstate Pro-
jects 1 70-1(39) and 1 70-1(41). Sequences of work performed by
contractor will be as designated by the Division of Highways, as
authorized in the Standard Specification book, under Section 105.
Schedule of construction -
The contract was awarded January 10, 1974 and the work to be completed
within 200 working days after contract time starts. The weather con-
ditions will govern the starting date.
All work by forces governed by this contract shall be in compliance with all
applicable laws and regulations of the County, State and Federal Governments,
as described in the Standard Specification book under Sections 107.01 - Law''"
to be Observed; 107.23 - Air and Water Pollution; and/or all other sections
of the Specification book that pertain.

Gentlemen:
This letter is your notice that the Colorado Division of Highways hereby appeals
the decision made by the Board of Commissioners of Garfield County April 30,
1974 refusing the application for a special use permit for the Dalrymple heavy
riprap pit.
This appeal is made on the grounds that (1) the Division has met all the neces-
sary requirements of the County zoning regulations; (2) that the environmental
impact of the proposed pit will be negligible; (3) that the Division has taken
all reasonable precautions to satisfy the objections of persons residing near
the County roads to be used as haul roads, and (4) that the Division's contractors
have the legal right to use the County roads as long as legal loads and all per-
tinent traffic laws are observed. •
The Division agrees to the following stipulations:
1. Speed limit for haul trucks shall be 30 mph.
2. Load limits shall be 7 cu. yds. (approximately 12 ton net weight).
Rock shall be placed in trucks in such a manner that no rock can
fall from the trucks.
3. Total quantity of material to be removed from the Dalrymple heavy
riprap pit is 7700 cu. yds. Days of actual haul shall be limited
to 90 (not necessarily consecutive). Haul will be limited to
Projects I 70-1(39) and I 70-1(41) which are currently under con-
tract. Each contractor will haul material to his respective project
in accordance with his own equipment schedule; therefore, haul may
not be continuous,
4. The Division agrees to require its contractors to repair any damage
caused to Garfield County roads or bridges by the hauling of material
from the Dalrymple pit; said roads and bridges are to be left in as
good a condition as existed prior to the haul. Each contractor shall
be require4 to make necessary repairs immediately upon completion of
his portion of the haul.

5. The Division's contractors shall he required to maintain the
existing gates on County Secondary Road 325 as necessary during
the haul to protect livestock.
6. The Division's contractors shall be required to adequately protect
the utility lines and irrigation pipes which cross County Secondary
Road 325 from damage during the haul. The Division's contractors
will be liable for crop damage resulting from their negligent
interruption of irrigation water during the haul.
7. County roads used as haul roads shall be adequately maintained by
the Division's contractors during the hauling period; dust shall
be carefully controlled by the use of water or other suitable means
as required by Subsection 209.05 of the Division's Standard Specifi-
cations.
8. Warning signs conforming with the Standard Specifications and project
plans and Special Provisions shall be erected and maintained during
haul.
9. The contractor shall be required to respect the rights of citizens
using the County roads with regard to movement of livestock and
farm machinery on said roads.
10. Haul shall be limited to daylight hours.
11. Contractor shall not be periitted to haul material from the Dalrymple
heavy riprap pit on the County roads during the hours that school
buses are using said roads.
The Colorado Division of Highways respectfully requests an immediate reconsidera-
tion of the Board of Commissioners' decision so that further costs will not be
incurred on our construction projects due to delay of our contractors' operation.

of Highways, State of Colorado, to make application on my behalf
for a Special Use Permit to operate a riprap pit on my property
as described in the Option to Buy Material between myself and the
Department of Highways dated August 15, 1973.

Plan for rehabilitation of area as described above:
This area will include extraction of materials and other movements
of equipment in Pit Area as designated on Pit Sketch. The contractor
shall confine his activities and equipment within the limits of the
pit. These limits will be so marked prior to construction operations.
All cedar trees cleared from the area being worked shall be disposed of
by the contractor in compliance with State and local laws.
Upon completion of the contractor's operation, the area shall be graded
and seeded as directed by the Engineer.
The owner shall be paid on the basis of cubic yards of riprap measured
in place on the project; no measurements shall be taken in the pit.
The contractor's attention is called to the gas pipeline crossing this
property. Within the 60 foot width of the pipeline easement, the con-
tractor shall limit his operation to the gathering of surface boulders,
and shall not engage in any excavation. The contractor shall exercise
all possible precautions to avoid damage to the pipeline.
After completion of all operations within the limits of the pit the
Department will require the contractor to leave the entire area in a
neat condition.
Final cleaning up and Protection and Restoration of Property and Landscape
as described in the Standard Specification book, Section 104.06 and
Section 107.12 will also be applicable in their entirety.
All rehabilitation plans, as stated above, are in agreement with property
owners.
One copy of the Standard Specifications for Road and Bridge Construction,
January, 1971 edition, has been submitted to the County Zoning Office for
reference.

IMPACT STATEMENT
Location:
Parts of the WZ SE's and E' SW4 Sec. 35, T. 6 S., R. 94 W. in
Garfield County.
The area is approximately 8 miles southwest of Rifle located on
Porcupine Creek.
Scope:
Basalt boulders will be gathered from the surface of the pit area,
loaded into trucks, and transported to the I 70-1(39) and I 70-1(41)
projects. The haul routes are designated on the construction plans
(copies attached) and involve county roads. Proper signing will be
required and flagmen furnished as deemed necessary by the Engineer.
If the contractor desires to haul overweight, overlength, or over -
height loads, authorization from the County Commissioners will be
required.
When the required material has been taken from the pit area, it will
be cleaned up and reseeded as designated by the Engineer.
Design and Construction Schedule:
The quantity and quality of this material has been determined suit-
able by the Highway Department.
Construction Schedule is estimated to be:
Gathering, loading, and hauling boulders: 60 Days
Clearing trees and brush damaged by the gathering
operation: 5 Days
Grading and seeding the area worked: 5 Days

ferred to as the.Owner, and the DEPARTMENT OF HIGHWAYS, STATE OF COLORADO, here-
inafter referred to as the DEPARTMENT. (The term "DEPARTMENT" shall be construed
to include Department employees, agents and contractors.)
WITNESSETH THAT:
WHEREAS, the Department desires to_obtain construction materials of satis
factory quality and quantity for use in construction,, improvement and maintenance
of its highways, which material is available from land .owned ,by_the "Owner" and,. ;_%

NOW, THEREFORE, IT IS AGREED BY THE PARTIES:

the date of this Agreement until the 31st day of August , 19 75 .-.

(a) Rinrap at Sixteen Cents ( G) per frincric (cu.yd.)
(b) at Cents ( G) per (ton) (cu.yd.)
or for a lump sum of $ . If the Department exercises this Option
within the time aforesaid, the Department shall then have the right to purchase and
remove all material necessary for construction of Department. projects in the. area.,
and for adequate maintenance stockpile. If the Department exercises this Option,
the Owner shall.be paid a minimum. of $25.00. _...
The Department shall have the right of ingress and egress to and from the sub-
ject
ubject premises and to erect any temporary structures, such as: - screening and
crushi.g plants, and asphalt plants; and to employ any,reasonable methods for remov-
al of material. After the Department has completed its removal operations, it will
leave the premises in a neat condition.
This Agreement is for removal of material for use on Department projects,.and
maintenance only, and removal by any other persons including the Department's
contractor.or contractors for any purpose other than as herein provided, shall be
under a separate agreement with•the,Owner and only with written approval of the
Department.
It is understood and agreed that, upon the letting of a contract by the Depart-
ment to a contractor for the construction, improvement and maintenance of highways,
the Department shall assign to the contractor all its right, title'and interest
under this instrument, insofar as the same shall be applicable to the projects let
to the contractor, and the contractor may reassign such option to subcontractors
working on said projects. If the option is exercised by the contractor or any
subcontractor, said contractor or subcontractor shall have a right ,to extract all
material needed for the projects covered by the contract let by the Department, sub
ject to all the terms of the Option.

4. The contractor's attention is called to the gas pipeline crossing this
property. Within the 60 foot width of the pipeline easement, the contractor
shall limit his operation to the gathering of surface boulders, and shall
not engage in any excavation. The contractor shall exercise all possible
precautions to avoid damage to the pipeline.
5. The contractor shall pay the property owner for all material removed.
Payment therefore shall be in monthly installments, each monthly payment
shall be based upon the quantity included in the D partmeat's progress
estimate for the preceding month, and the same shall be Cade on or &efore
the twentieth (20th) day of each month. The contractor shall retain ten
(10) percent of the money due the property.owner until final yardage or
tonnage is determined by the Department.
6. Payments made to the owners shall be by check made in the name of Jc:cs P.
Dalrymple. The owners shall divide the payment according to their agreement,
and shall hold the Department harmless of any responsibility in this respect.
