RESOLUTION No. 79-130
WHEREAS, the Board of County Commissioners of Garfield
County has received an application from the Upper Colorado
River Community Center Board (UCRCCB) for a Special Use Permit
to permit the U.C.R.C.C.B. to establish and use a residential
care facility for mentally retarded adults on the following
described tract of land:
A tract of land situated in the SE 1/4 NE 1/4 of
Section 21, Township 6 S., Range 89 W., 6th P. M.,
Garfield County, Colorado, described as follows:
Beginning at a point on the Southerly line of
said SE 1/4 NE 1/4 whence the East Quarter Corner
of said Section 21 bears S. 87°05' E. 820.90 feet;
thence N. 87°05' W. 341.20 feet along the southerly
line of said SE 1/4 NE 1/4 to a point on the easterly
line of a road as constructed and in place; thence
N. 12°14' W. 251.37 feet along the Easterly line of
said road; thence S. 87°05' E. 322.42 feet; thence
S. 16°17' E. 256.91 feet to a point on the Southerly
line of said SE 1/4 NE 1/4, the point of beginning.
and
WHEREAS, pursuant to requred public notice, the Board
conducted a public hearing on the 9th day of October, 1979, upon
the question of whether the above-described Special Use Permit
should be granted or denied, at which the public and interested
agencies were given an opportunity to express their opinions
regarding the issuance of the said Special Use Permit, and
WHEREAS, the Board on the basis of the evidence adduced
at the aforementioned hearing, has made the following determi-
nations of fact:
1. That the proposed use is appropriate to the physio-
graphic and general environmental character of the District in
which it is to be located;
2. That the proposed use does not create any more
hazard to or alteration of the natural environment than the
minimum amount normally resulting from other uses permitted
in the District in which it is to be located, provided that
certain hereinafter contained conditions are complied with;

3. That the proposed use does not create any more
offensive noise, vibration, dust, heat, smoke, odor, glare,
or other objectionable influences or more traffic hazards
than the minimum amount normally resulting from the other
uses permitted in the

NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners of Garfield County, Colorado, that a Special Use
Permit be and hereby is granted relating to the above-described
tract of land, upon the following specific conditions:
1. That the requested use of the described property
shall not be commenced until all necessary state permits are
issued authorizing the proposed use.
