1. All installation must comply with all requirements of the Colorado State Board of Health individual Sewage Disposal Systems
Chapter 25, Article 10 C.R.S. 1973, Revised 1984.
2. This permit Is valid only for connection to structures which have fully complied with County zoning and building
requirements. Connection to or use with any dwelling or structures not approved by the Building and Zoning office shall
automatically be a violation of a requirement of the permit and cause for both legal action and revocation of the permit.
3. Any person who constructs, alters, or Installs an individual sewage disposal system in a manner which involves a knowing
and material variation from the terms or specifications contained in the application of permit commits a Class I, Petty Offense

Dear Chuck:
Don Owens, of this office, was at the Jim Rose property Tuesday (8/20/91) to inspect the SB2
leach field, which Mr. Rose has installed. The installation had apparently been completed (ie.
covered up). This covering prevents our visual inspection of amount, depth and product
installed as required by the State of Colorado - Health Department rules and regulations.
If Mr. Rose will provide this office with a copy of the receipt for the material he has installed,
the septic permit (# 1862) can be fmaled and the system excepted as sufficient with no further
verification needed.
I appreciate your cooperation in this matter and await a response.

Mr. Rose:
After reviewing the leach field documentation submitted and the
percolation results of our field test, we have these results:
1. The perc rate is 15 minutes /inch.
2. Based on the Colorado Department of Health calculations, a
three bedroom dwelling with a 15 minute perc rate requires a
732 square foot field. An assumption of three bedrooms, as
opposed to the four bedrooms on your application, was made
upon the belief that one of the bedrooms was in the single -
wide trailer, which is to be removed.
3. Every linear foot of SB2 is equivalent to three square feet of
leach field, which requires you to have 244 ,parr feet of
SB2.
4. The documentation you provided from Dodson Engineering
Receipts establishes the SB2 in the ground to be 50 feet. If
this is the case, then your leach field needs to be increased
by 194 linear feet of SB2.
Practically, this undersized field could possibly not handle the
flow backing it up into your septic tank. This would stop the
degradation of solids in the tank and these solids would then be
applied to your field, which would clog it further decreasing its
capacity.
Legally, both Garfield County and the State of Colorado have laws
prohibiting the use of a dwelling which is not served by an
adequate sewage disposal system. If within 30 days, you could
inform us of how and when you plan to remedy this problem, it would
relieve Garfield County from its obligation to legally pursue these
violations.

P.S. Jim, there is a product on the market called Infiltrator ",
when this is used, it cuts the leach field area by 50 %. I
believe that Dodson, Grand Junction Pipe Basalt) or Coplan
Concrete Rifle) handles this product.

Gentlemen:
In an effort to confirm our discussion of Thursday morning, January24, 1991, topic by topic:
1. Septic System - upon review, the documentation you have
furnished us in the way of drawings and receipts seem to
be adequate to establish what was installed by Mr. Rose
to service both of the accessory dwellings currently on
his property. The sufficiency of this installation will
be judged after a percolation test. This percolation
test is covered under our $150.00 permit fee and will be
performed by us after the weather allows Mr. Rose to
excavate test holes as near to the field as possible.
Configuration and number of these holes are outlined in
the information enclosed.
2. Double Wide Mobile Home as mentioned, we have no
problems with this unit other than a building permit was
not issued at the time of installation. This single item
will be addressed upon receipt of a check in the amount
of $60.00 which will allow us to issue said permit.
3. Single Wide Unit - the use of this unit can be addressed
in three (3) ways:
a. Sold and removed from the property.
b. Converted into an agriculturally related shop or
used as a storage area. As discussed, it's use as
an office or a residential unit is not an option.

c. Documentation from a Registered Profession Engineer
P.E.) that certifies this unit, as it stands,
conforms to the 1988 revision of the Building Code.
On this point, I can provide further clarifica-
tion. There is a Federal law (Public law 93 -383,
Title VI, 42 U.S. Code, Section 5401 -5426) which
prohibits structural modifications to mobile units.
Based on this information, any determination that
the unit does conform must be without exceptions or
modification recommendations.It would also be
necessary for our review that this determination be
accompanied by the calculations and analysis use to
reach this conclusion.

Mr. Rose:
After a citizen complaint this office investigated your property on
County Road 109, legally described as in the N.W. 1/4 of Section
12, Township 7, Range 89 with Garfield County Assessors #2395 -122-
00 -067. It was found that this property has on it two mobile homes
and an R.V. No building permits were taken out for the placement
of either of the mobile homes, the R.V. is not allowed to be
occupied and no septic permits or sewage disposal systems were
dedicated to these units. This activity is in violation of the
revised 1978 Garfield County Zoning Resolution and Section 25 -10 of
the Colorado Revised Statutes.
Please be advised that the provisions of the Garfield County Zoning
Resolution of 1978, as amended, and Section 30 -28 -124 (a) -(c) CRS,
as amended, provide that it is unlawful to use any building,
structure, or land in violation of any County Zoning Resolution, or
amendment, duly adopted by the Board of Commissioners. Any person,
firm, or corporation found to have violated such zoning regulations
is guilty of a misdemeanor and, upon conviction, shall be punished
by a fine of not more than $100 or by imprisonment in the County
Jail for 10 days, or by both fine and imprisonment. Each day is
considered a separate violation. The County also has civil legal
remedies available to it, including the initiation of legal
proceedings to obtain the injunction or abatement of any unlawful
use of land in violation of the County Zoning Resolution.
If the above noted violations are not corrected within 30 days of
the receipt of this letter, the Building and Zoning Department will
turn all information over to the Garfield County Attorney's office
for legal action. Your Cooperation in this matter is appreciated.
