The issuance of this permit does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from seeking relief in a civil court action. 2) The construction of this well shalt be in compliance with the Water Well Construction Rules 2 CCR 402.2, unless approval of a variance has been granted by the State Board of Examiners of Water Welt Construction and Pump Installation Contractors in accordance with Rule 18. 3) Approved pursuant to CRS 37.92-602(3)(c) for the relocation of an existing well, permit no. 92777. The old well must be plugged in accordance with Rule 16 of the Water Well Construction Rules within ninety-one (91) days of completion of the new well. The enclosed Well Abandonment Report form must be completed and submitted to affirm that the old well was plugged. The issuance of this permit hereby cancels permit no. 92777. 5) The use of ground water from this well is limited to fire protection, ordinary household purposes inside not more than one (1) single family dwetting(s) and the irrigation of not more than one (1) acre of home gardens and (awns. This well is to be located in that portion of Sec. 6, Twp. 6 South, Rng. 91 West of the 6th P.M., Garfield County, more particularly described as Exhibit A in the permit file. 6) The pumping rate of this well shall not exceed 15 GPM. 7) This well shalt be located not more than 200 feet from the location specified on this permit. If this well is not operated in accordance with the terms of said decree, it will be subject to administration including orders to cease diverting water. WDWCD contract #170420LMH(a), 4) The use of ground water from this well is limited to commercial uses of two guest houses, 7,000 square feet of commercial space and watering of 28 head of livestock. 15) The pumping rate of this welt shall not exceed 15 GPM. 6) The annual withdrawal of ground water from this well shall not exceed 1 acre-foot. 7) The return flow from the use of this well must be through an individual waste water disposal system of the non -evaporative type where the water is returned to the same stream system in which the welt is located. 8) The owner shalt mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case number (s) as appropriate. The owner shall take necessary means and precautions to preserve these markings. 9) This welt shall be constructed not more than 200 feet from the location specified on this permit. 10) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request.
