HomeMy WebLinkAbout10.0 Director's Determination 04.03.2018Garfield County April 3, 2018 David Rasmussen 826 Highway 133, Suite C Carbondale, CO 81623 Reference: Admin Review — Mountain Shadow Place — Two -Unit Dwelling on Lot 1, Lot 2, and Lot 3 (File No. GAPA-02-18-8617, GAPA-02-18-8618, and GAPA-02-18-8619) Dear Mr. Rasmussen; This letter is provided to you, as the authorized representative for Garfield County File No. GAPA-02-18-8617, GAPA-02-18-8618, and GAPA-02-18-8619. This letter is notification that your request for 3 applications for Two -Unit Dwellings on Lot 1, Lot 2, and Lot 3 (one application per Lot) within the Mountain Shadow Place Minor Subdivision has been reviewed by the Community Development Department and the Director hereby issues a determination conditionally approving the requests. The conditions of approval are as follows: Conditions of Approval 1. All representations of the Applicant within the application shall be considered conditions of approval unless otherwise modified by the Board of County Commissioners. 2. All development shall comply with the requirements of the Subdivision Improvements Agreement (SIA) (Reception Number 903164) and Mountain Shadow Place Minor Subdivision Plat (Reception Number 903163). In addition, in accordance with Paragraph 11 of the SIA, no certificates of occupancy shall be issued for any habitable. building or structure, including residences, within the Subdivision until all Subdivision Improvements have been completed and are operational as required by the SIA. 3. A 6 foot privacy fence shall be constructed, within the limits of the existing easements and setback requirements, along the residential development area of the western and southern boundary of Lot 1 and the southern boundary of Lots 2 1 and 3. Demonstration of completion of the fence shall be provided to the Building Department prior to issuance of any Certificates of Occupancy for Lot 1, 2, or 3. 4. All residential buildings shall have fire sprinklers installed prior to issuance of the Certificate of Occupancy. 5. Any utility taps or other disturbance within a County Road shall obtain a Utility Permit from Garfield County Road and Bridge. 6. All exterior lighting shall be downcast and shielded and comply with Section 7-304, Lighting Standards, of the Land Use and Development Code of 2013, as amended. 7. All dwelling units within Mountain Shadow Minor Subdivision shall be served by City of Glenwood Springs water. The property owner(s) shall comply with all requirements from the City of Glenwood Springs for connection to the municipal water system. 8. All dwelling units within Mountain Shadow Minor Subdivision shall be served by the West Glenwood Sanitation District for wastewater. The property owner(s) shall comply with all requirements of the West Glenwood Sanitation District for connection to the District's wastewater system. 9. All residential buildings shall be constructed using Radon Resistant New Construction (RRNC) standards. 10. Building/foundation design shall comply with the geotechnical investigation conducted at the time of Subdivision approval. A copy of this geotechnical investigation shall be included with all building permit applications for all residential buildings and compliance with this investigation shall be demonstrated at that time. Notice of this decision will be provided to the Board of County Commissioners who has the ability to `call-up' the application for review at a public hearing. You will be notified of the Board decision once it is received or upon expiration of the 10 day notice period.
