L. The Appl icant has submitted to the County an appiication for
Amendment to Approved Land Use Chanqe Permit
2. The Applicant understands and agrees that Garf¡eld County Resolt¡tion No. 20L4-60, as
amended, establishes a fee schedule for each type application, and the guidelines for the
administration of the fee structure.
3. The Applicant and the County agree that because of the size, näture or scope of the
proposed project, it is not possible at this time to ascertain the full extent of the costs
invcllved in processing the application. The Applicant agrees to rnake payment of the Base
Ëee, established fr¡r the Project, and to thereafter permit aclditional costs to be billed to the
Applicant. The Applicant agrees to make additional payments upon notification by the
County, when they are necessary, as costs are incurred.

consulting service determined necessary by the Board of County Cornmissioners for the
consideration of an application or additional County staff time or expense not covered by

Dear Dave
Thank you for issuing a Pre-Application Conference Summary for a Minor Amendment to
the,tpproved Land Use Change Permits fot the Eastbank Veterinary Clinic (GAPA-05-16-8453) and
a Vehicle Repair Facility (GAPA-05-16-8454). By these applications, we are requesting z one-ye r
extension of Condition 13 of both permits.
The proposed new language for Condition 13 of both permits is as follows:

plans and representations made witltin the application.
We appreciate the County's consideration of this 1,2-month extension. Eastbank, LLC is
^w^reof the environmental cost associated with each OWTS installed in this area. As such, it is making
every effort to connect to the RF!øSD system. In furtherance of this effort, it has installed, at great
cost, the infrastructure necessary to connect both buildings to the RF\)øSD water and sewer system.
But completion of terms of the connection are ongoing and somewhat complicated by (i) the
ftnaltzat:.on of all in-ground and below-ground easements with both RFWSD and the RE-1 School
District with regard to the new in-place infrastructure (including the service lines, lift station, fire
hydrants and other system facilities); and (ii) an ongoing PUD planning process for the entirety of
both Eastbank "lots" (inclusive of the two commercial buildings). Even so, we believe an agreement
is imminent; and, by coincidence, expect to be on the RF\X/SD Board agenda on April 1,7'h for action
on the final easements and Pre-Inclusion Agreements (and requested "Can and \ü/ill Serve" letter for
the PUD application).
However, under the circumstances we do not foresee interconnection by April 1.9,
2018. Therefore, Eastbank, LLC, hereby requests an additional 1.2 months to either connect the
utilities to Rtr\X/SD or install a permanent OWTS system. Given that the Garfield County Code

requires that"every effort" be made to secure a public se\Ãi'er extension (see GCULUR S 7-105@)(1)),
we believe it would be contrary to the public interest, as well as the intent of both the Code and
Comprehensive Plan, to require Eastbank, LLC install a permanent OWTS, when negotiations are still
underway and infrastructure to connect to a public system is already in the gtound.
Additionally, this request for extension is a Minor Modifìcation to ân approved Land Use Change
Permit as defined in Section 4-106(C) because:
(1) It complies with all requirements of the Code;
Q) It does not conflict with the Comprehensive Plan;
(3) It does not change the character of the development;
(4) It does not alter the basic relationship of the development to adjacent property;
(5) It does not require an amendment or abandonment of any easements or rights of way;
(6) It does not increase the density;
(7) It does not increase the zone district dimensions to ân âmount exceeding the maximum
dimensions in the applicable zone district; and
(8) It does not decrease the amount of open space, alter the location, lighting, ot orientation of
signs, or ^ny zone district dimension.

primary Drinking Water Regulations (water) and/or the Colorado Water Quality
Controi Act (wastewater). The submittal shall be reviewed and accepted by the
County Designated Engineer prior to issuance of the Land Use Change Permlt'
6. The Applicant shall provide soils characteristics and slope information for the
wastewater absorption area to ensure compliance with County OWTS rules and
regulations for the proposed permanent OWTS system. This information shall be
reüiewed and accepted by the County Designated Engineer prior to issuance of
the Land Use Change Permit.
7. The Applicant shall provide a draft wastewater system sharing agreement between
the veierinary clinic and vehicle repair facilíty priorto execution to be reviewed and
accepted Oy ihe County Altorney's Office prior to issuance of the Land Use Ghange
Permit.
g. The Applicant shall meet with the Glenwood Springs Fire Department to come to
an agreement on (1) necessary fire flow water and pressure to suppotl firefighting
operations, and (2) the number and location of hydrants on site. The Applicant
shdl provide evidence of the consultation with the Fire Department and written
documentation of the agreement regarding the aforementioned ilems to the

Directors Determination issued on September 15,2076 for a Vehicle Repair Facility and a Veterinary Clinic.

Within one yeor from the dote of íssuance of the County OWTS permit for the vault ond hqul system, the system
shall be removed and reploced with either: (7) connection to dnd service provided by the Roaring Fork Water
ond sanitotion District (RFwsD), or (2) instøilation of o permonent owTs consistent with the site plons ond
representotions møde within the opplicotion.
It has been represented that the property owner is still in negotiations with RFWSD for connection to their
system for wastewater. Based on the ongoing nature of these negotiat¡ons, an additional year has been
requested to either connect to RFWSD or install a permanent oWTS. lt has been determined that the
amendments as proposed qualify as a Minor Amendment under Section 4-106 of the LUDC.
The Vehicle Repair facitity was approved on September 15, 2016 as application GAPA-05-L6-8454 and the
permit is memorialized under reception number 882420. The septic permit was issued by the Garfield County
Building Department on April t9,2Ot7 under Permit Number SEPT-04-17-4681'

The Applicant will need to provide a description of the request and the reason for the extension, ln addition,
the Applicant will need to respond to each of the Minor Amendment standards and specifically demonstrate
that each standard will be met with the proposed amendment. Draft amended language for Condition #13
will also be necessary within each application.
Since each of the uses were issued indivídual Land Use Change Permits, one applícation for a Minor
Amendment will need to be submitted for each use (one application for the Vehicle Repair Facility, and one
application for the Veterinary Clinic).
