Dear Dave:
Thank you for issuing a Pre-AppLication Conference Summary for a Minor Amendment to
the Approved Land Use Change Permits for the Eastbank Veterinary Clinic (GI\PA-05-1,6-8453) and
a Vehiile Repair Faciliry (GÄPA-05-1,6-8454). By these applications, we âre requesting a one-yeàr
extension of Condition 13 of both permits.
The proposecl new language for Condition 13 of both permits is as follows:

We appreciate the County's consideration of this 12-month extension. Eastbank, LLC is tware
of the environmental cost associated with each O\øTS installed in this atea' As such, it is making
every effort to connect to the RFìØSD system. In furtherance of this effort, it has installed, at great
cost; the infrastructufe necessâry to connect both buildings to the RFWSD watef and sewer system.
But completion of rerms of the connection are ongoing and somewhat complicated by (i) the
finzltzanon of all in-ground and below-ground easements with both RFSØSD and the RE-1 School
District with regard to the new in-place infiastructure (including the service lines, lift station, fire
hydrants ,.rd oth., system facilities); and (ii) an ongoing PUD planning process for the entirety of
both Eastbank "lots" (inclusive of the two commercial buildings). Even so, we believe an âgreement
is imminen t; and,by coincidence, expect to be on the RFSTSD Board agenda on April 17'h for action
on the fi.nal easements and Pre-Inclusion Agreements (and requested "Can and \ü/ill Serve" letter for
the PUD application).
However, under the circumstances we do not foresee interconnection by ,A.pril 19,
2018. Therefore, Eastbank, LLC, hereby requests an additional 1,2 months to either connect the
utilities to RtrWSD or install a permanent O!øTS system. Given that the Garfield County Code

requires rhat "every effort" be made to secure a public sewer extension (see GCULUR $ 7-105(B)(1)),
we believe it would be contrary to thc public interest, âs well as the intent of both the Code ancl
comprehensive plan, to require EastbanÈ, LLC install a permânent o'v7TS, when negotiations are still
,rnd.'r-"y and infrastructure to connect to a public system is already in the ground'
Additionally, this request for extension is a Minor Modifìcation to an approved Land Use Change
Permit as defined in Section 4-106(C) because:
(1) It complies with all requirements of the Code;
(2) It doernot conflict with the Comprehensive Plan;
(3) It does not change the character of the development;

(6) It does not increase the density;

I. GENERAT DESCRIPTION
The Applicant's representative, Chad Lee of Balcomb and Green, proposes to amend Condition 1"3 of the
Directors Determination issued on September L5,2OL6 for a Vehicle Repair Facility and a Veterinary Clinic.
One Land Use Change Permit was issued per use, although the uses are on the same parcel. Both Permits have
the same Condition #13 related to the temporary use of a vault and haul wastewater system. Condition f13
on both permíts read as follows:
Within one yeor from the date of issuonce of the County OWTS permit for the voult and hsul system, the system
shatl be removed ond repløced with eíther: (7) connection to and service provided by the Roaring Fork Woter
qnd 1onítation District (RFWSD), or (2) instollation of o permonent OWTS consistent with the site plans ond
representotions made within the applicotion.
It has been represented that the property owner is still in negotiatíons with RFWSD for connection to their
system for wastewater. Based on the ongoing nature of these negotiationt an additional year has been
requested to either connect to RFWSD or install a permanent OWTS. lt has been determined that the
amendments as proposed qualify as a Minor Amendment under Section 4-106 of the LUDC.
The Vehicle Repair facility was approved on September L5, 2016 as application GAPA-05-16-8454 and the
permit is memorialized under reception number 882420. The septíc permit was issued by the Garfield County
Building Department on April 19,2077 under Permit Number SEPT-04-17-4681,

The Veterinary Clinic was approved on September 15, 2016 as application GAPA-05-16-8453 and the Permit
is memorialized under reception number 882419. The septic permit was issued by the Garfield County Building
Department on April 79,2oL7 under Permit Number sEPT-04-1.7-4680.
The Applicant will need to provide a description of the request and the reason for the extension. ln addition,
the Applicant will need to respond to each of the Minor Amendment standards and specifically demonstrate
that each standard will be met with the proposed amendment. Draft amended language for Condition #13
will also be necessary within each application,
Since each of the uses were issued individual Land Use Change Permits, one applícation for a Minor
Amendment will need to be submitted for each use (one application for the Vehicle Repair Facility, and one
application for the Veterinary Clinic).
il. REGULATORY PROVISIONS APPLICANT lS REQUIRED TO ADDRESS
Section 4-106 determínes the process for an amendment to an approved Land Use Change permit.
III. REVIEW PROCESS
To process a request for an Amendment to an Approved Land Use Change Permit, the applicant shall
schedule a pre-application conference. Within L0 days of the conference and after receiving all necessary
information, the Director shall make one of the following determinations:

b. Substantial Modification.
c. Determination bY the BOCC
