Facility(GAPA-02-18-8608) Gianinetti Lodging Facility (LIPA-02-18-8614) Dear Glenn: Below please find my responses to your letter of March 22, 2018. 1. Change in ownership to LLLP. The application forms have been updated to reflect the ownership as an LLLP. 2. A statement of authority has been signed and recorded. Find recorded document attached. 3. Site plan - updated to indicate Cowen Drive. The right-of-way has been relabeled to show Cowen Drive. In addition, the property boundary has been clarified to show that the Gianinetti property has legal access directly from that public right-of-way – which is a Town of Carbondale right-of-way. Note: a portion of the site directly adjacent to Cowen Drive was once annexed into the town and part of the Gianinetti subdivision. This area was de -annexed in the early 1990s. The site plan is being provided under separate cover. 4. Mineral rights. The property owners (LLLP) own all mineral rights associated with the property. I search records at the Garfield County Clerk and Recorder's office on March 29. Previous owners, Ben and Alphonsine Gianinetti assigned 3 oil and gas leases over time. These did not produce within the defined time period of the lease and were not assigned to other persons or entities. Ben and Alphonsine deeded the property to Ernest and Carol Gianinetti in 1961 (deed recorded at Book 333, Page 504). They reserved one half interest in oil, gas and other minerals. Ben and Alphonsine never assigned these mineral rights. Documentation was provided as part of a Petition for Abatement (BOCC 811 Garfield Avenue Carbondale, CO 81623 Ph 970.309.3655 Fax 970.963.2916 mchain@sopris.net Mark Chain Consulting, LLC Page 2 Resolution # 96-013) that the grantors (Ben and Alphonsine) are deceased and that the mineral interests are no longer severed. Resolution attached. 5. Property owners within 200 feet. We have double checked the list of adjacent property owners and generated a new list. Attached. We will also check for changes mailing any public notices. 6. Complete Water Supply Plan. A private well will be drilled in order to provide water for both the Event/Meeting area as well as the Lodging/Guest ranch. We will order pump testing and water quality testing as a condition of approval. Therefore, we are submitting a waiver request per Section 4 — 202. Below are the criteria outlined for a submittal waiver and responses. C. Review Criteria (Section 4 — 202 C). 1. The Applicant shows good cause for the requested waiver; Response: The owner's request that pump testing and water quality testing be proposed as a condition of approval. The well has not yet been dug. The Giannetties own numerous wells in the area may have had no trouble obtaining water. The Roaring Fork River bottom land has plentiful groundwater. 2. The project size, complexity, anticipated impacts, or other factors support a waiver; Response: the size of the proposed project is consistent with rural/agricultural uses in the area. It would appear that there would be no negative impacts associated with drilling another well. 3. The waiver does not compromise a proper and complete review; and Response: An adequate review can be undertaken with the land use change permits. 4. Applicant has already applied for an allotment from the Basalt Water Conservancy District. There is enough information for Review Agencies to comment on the application. 7. Preliminary details related to contract with Basalt Water Conservancy District. Contract attached. 8. Wetlands Report/analysis. Being provided under separate cover. 9. Representation of acreage proposed for each land use. Map overlaid on air photo image outlining acreages is attached. Rough acreage estimates are: • Event Center — 4.8 acres • Guest cabin/lodging - 2.66 acres • Remaining Ag/rural: 75.98 acres 10. Wetlands Boundaries. Boundary of the wetlands area in the vicinity of the existing Pavilion and proposed Performance Barn is shown on an exhibit provided with other engineering documents. The Pavilion structure is not a structure with walls etc. is essentially a pole barn. This lies within 35 feet of the wetland boundaries; however, it is an existing situation. The Performance Barn is approximately 35 feet from the wetlands boundaries. Unless the wetlands boundaries are changed during final review with the Army Core of Engineers, no waiver from setback requirements is required. 11. Nuisance Mitigation. Nuisance Impacts. The goal of the Gianinetti Family is to minimize and prevent nuisances related to any proposed land -use activities. The potential nuisance issue that we have been asked to address based on concerns expressed in previous applications is noise. Some comments. Past history. Events have been held at this location for approximately 10 years. There has been no history where the Carbondale police have been asked to investigate or discuss operations with the family. Often times, any music is acoustic and not amplified. There has been amplified events in the past. At that time, the band is located in the area of the Pavilion and the bands have been facing the south to southeast area. This has helped with some of the noise mitigation as any noise generated is directed more towards the ranching and very low density ag/rural areas in the Roaring Fork River bottom land. Distance. The location of any band or any event helps in any nuisance mitigation. The existing Pavilion and the proposed Barn are located relatively far away from other structures. For example, the nearest structure is a residence along Cowen Drive. This residence is approximately 710 feet from the activity area. The other nearest structure is the Comfort Inn. This is 732 feet from the existing Pavilion. Time frame for events. Address previously. All music will be shut down at the end of daylight hours. Noise Standards. All activities will comply with standards set out by C.R.S. 25- 12-103 or as set out by regulations adopted by Garfield County. The standard is presently 55 db (A) between 7 AM to 7 PM and at 50 db (A) from 7 PM to 7 AM at the property line according to state guidelines. We are confident that the general location and surrounding land uses, and distance (generally noise level declines with distance) will result in there being no nuisance complaints of any kind. Noise Testing. We are presently measuring ambient noise at the property to establish local baselines. We are using a Reed Sound Level Meter — Model ST - 805. Background noise measurement. We have done initial ambient noise level test on March 27 and March 29. We initially examined background noise on the db (A) scale between 9 AM and 10 AM on March 27. Sitting at the Events Pavilion, background noise was generally in the high 50s dB and spikes going anywhere from 64.1 up to 72 dB. The noise generation in this area is from traffic generated by State Highway 82. Please note that at the end of rush hour, noise at the Event Center itself sometimes violates state criteria. We visited the site on March 29 to do additional background noise readings. This time, we took ambient noise levels in the same location (Pavilion) at 9:30 AM. Background noise range from high 50s to low 60s on the db (A) scale, with spikes going to approximately 68 dB. We also investigated what we would consider the "worst case". Specifically, we used a Sea Sense Airgun which can be heard up to 1 mile away. This is a shrill sounding, synthesizing horn blast. For these tests, we took measurements of the edge of the Cowen Drive right-of-way, which is where citizens and residential units exist. Ambient noise levels in this case existed in the mid to high 50s db on the (A) scale. Please note that with the availability of the Performance Barn and the distance to the neighbors that be concerned with noise levels, we are confident that noise 811 Garfield Avenue Carbondale, CO 81623 Ph 970.309.3655 Fax 970.963.2916 mchain@sopris.net Mark Chain Consulting, LLC Page 5 levels will not be violated by any activities as part of the Gianinetti Event/Meeting Center or through the Lodging/Guest ranch operation. 12. Hours of Operation. All Event/Meetings/meetings and/or other gatherings will have any music - amplified or acoustic -shut down at the end of daylight hours. As some of these events are a real family or community celebrations, the Gianinetti family does ask that people be allowed to linger and sit with quiet conversation etc. either in the Event Barn or the Pavilion area. This is how the operation has been managed for many years and we think it is appropriate to continue this management style. Noise or other nuisances have never been a factor with lingering of the guests in these areas. 13. Lodging Facility Application form. As discussed during the Compliance Review meeting, the wrong application form was submitted for the Lodging facilities/Guest Ranch. The correct application is now included. Attached. 14. The site plan (Sheet C.1) is properly scaled. The Pavilion/Gazebo concrete pad and the proposed Event/Performance Barn are shown in actual and propose sizes. The one and two-bedroom cabins are properly scaled, but precise dimensions are not known. The one -bedroom units will be approximately 400 to 450 ft.2 in size, and the two-bedroom units approximately 600 to 650 ft.2 in size. Please note that proposed finish floor elevations for each of the units is shown. I hope this information addresses all your comments from March 21, 2018.
