Recitals
A. The Board of County Commissioners of Garfield County, Colorado, "Board" received
a request for a Land Use Change Permit to allow for a Material Handling facility, as further
described in Exhibit A, Site Plan.
B. The Material Handling Facility, will be located on an approximately 13.69 acre parcel
owned by BJ Services LLC.
C. The subject property is located within unincorporated Garfield County in the
Commercial/General zone district and east of the City of Rifle, Colorado and accessed offof State
Highway 6 &,24.

D. A Material Handling Facilþ may be permitted in the CommerciaVGeneral zone district
with a Limited Impact Review.
E. The Board is authorized to approve, deny or approve with conditions a Limited Impact
application resulting in issuance of a Land Use Change Permit pursuant to the Garfield County
Land Use and Development Code of 2013, as amended.
F. The Board opened a public hearing on the 15ü day of January, 2018 for consideration
of whether the proposed Land Use Change Permit should be granted or denied, during which
hearing the public and interested persons were given the opportunity to express their opinions
regarding the request.
G. The Board closed the public hearing on the 15û day of January, 2018 to make a final
decision.
H. The Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determinations of fact:
1. That proper public notice was provided as required for the hearing before the Board of
County Commissioners.
Z.The hearing before the Board of County Commissioners was extensive and complete,
that all pertinent facts, matters and issues were submitted and that all interested parties
were heard at that meeting.
3. That for the above stated and other reasons the proposed Land Use Change Permit
application by BJ Services LLC, for a Material Handling Facility is in the best interest of
the health, safety, çonvenience, order, prosperþ and welfare of the citizens of Garfield
County.
4. That with the adoption of conditions, the application is in general conformance with
the2030 Comprehensive Plan, as amended.
5. That with the adoptions of conditions and granting of waivers from Section 7-1001,
Indushial Use Standards related to Concealing and Screening the application has
adequately met the requirements of the Garfield County Land Use and Development
Code, as amended.

RESOLUTION
NOW THEREFORE, BE IT RESOL\IED by the Board of County Commissioners of Garfield
County, Colorado, that:

A. The forgoing Recitals are incorporated by this reference as part of the resolution.
B. The Land Use Change Permit for a Maærial Handling facility is hereby approved subject
to compliance with the following conditions:
Prior to the fssuance of the Land Use Change Permit
1. Prior to the issuance of the Land Use Change Permit, the applicant shall submit a well
pump test that meets the standards in Section 4-203(MXl)(b)(S)(a). A statement from a
qualified professional shall be submitted to Community Development that states the well
will be adequate to supply water for the proposed uses. The pump test shall be reviewed
and accepted by the Community Development Department and the County designated
engineer.
2. Prior to the issuance of the Land Use Change Permit, the applicant shall submit a water
quallty test that meets the stantlards in Sectiott 4-203(M)(lXbXSXc). If arty cont¿¡ninant
exceeds required standards the applicant shall provide a letter from a qualified professional
that details how the well can be brought into compliance. Any recommended upgrades or
system changes to the water distribution system from that letter shall be required to be
installed prior to the issuance of the Land Use Change Permit. The water quality test shall
be reviewed and accepted by the Community Development Department.
3. Prior to the issuance of the Land Use Change Permit, the applicant shall obtain an Onsite
Wastewater Treatment System (OWTS) Permit from Garfield County Community
Development for any OWTS on the property.
Operational Conditions
4. All representations made by the Applicant in the application shall be conditions ofapproval
unless specifically altered by the conditions of approval of the Board.
5. The facility shall be operated in accordance with all applicable Federal, State and local
regulations governing the operation ofthis type of facility.
6. The applicant shall comply with all Division of Water Resources well permit requirements.
7. During construction the applicant shall utilize temporary storm water infrastructure as
indicated in the application to address potential runoffissues.

8. The use shall comply with applicable County and State noise requirements.
9. The height of the silos shall not exceed zone dishict height requirements.
10. Hours of operation for the use shall be 7:00 AM to 7:00 PM Monday through Saturday.
11. The applicant shall obtain any required Garfield County Building Permits.
12. No fugitive dust from the use shall impact adjacent properties
