In 2005, Garfield County adopted a resolution (Resolution 05-05) that accepted public road rights-of-way, for public use as roads, alleys and utility easements. ACG understands this resolution did not accept the roads and Garfield County considers the Road to be "Private Roads". In 2010, a Travelers Highlands Subdivision Public Improvement District was approved by Garfield County BOCC (Reception # 7957t8) for the primary purpose as stated below: "...mainly the construction and maintenance of streets, drainage, utilities, and other public improvements needed to serue the Travelers Highland Subdivision (Development)." The Garfield County Land Development Code (LUDC), section 7-L07 -Access and Roadways, requires all roads to be designed to provide for "adequate and safe access" and reviewed by the designed County Engineer. As stated previously, Garfield County considers the roads to be Private Road, which are required to meet Countyb Road Standards as defined in Table 7'107.F of the LUDC. poficy 0!-14, Waiver for Roads and Demonstration of Compliance, allows projects located on roads that do not fully comply with Table 7-t07.F of the LUDC to request a waiver of this requirement by a qualified professional engineer if they meet the criteria outlined in Section 4-118, including a Statement of Adequacy that addresses the following: 1. Geometry of Road 2. Safety / Structural Issues 3. Maintenance 4. Travel Demands 5. Parcel has Access to Public Right-of-Way (Table 7-t07.A) 6. Parcel has Safe Access (Table 7-107.8) 7. Adequate Capacity to Serue Proposed Use (Iable 7-107.C) 8. Roadway Rights-of-Way dedicated (Table 7-L07.D) 9. Impacts Mitigated (Table 7-t07.E) Mr. Patrick Waller November 6,20t7 Page 3 of 6 Waiver Analvsis: Listed below are the specified in Policy 01-14 waiver analysis points along with responses addressing the criteria: 7, Geometry of Road Response: The roadways utilized by the proposed Pro Gas Bulk Propane facility are 4th Street and Scarrow Avenue all of which are industrial roadways currently in use within the Travelers Highland Subdivision. These local industrial streets consist of a 20-ft gravel suface with little or no side drainage ditches. Listed below are photos of the current roadways: 4th Street Looking Notth from Highway 6 4th Street Looking South To Highway 6 Mr, Patrick Waller November 6,20t7 Page 4 of 6 Scarrow Avenue @ 4th Street Intersection looking No¡theast It is ACG's opin¡on the current roadways are adequate to service the proposed Pro Gas Bulk Propane facility as the industrial subdivision currently has approximately 20 businesses currently operating in the industrial subdivision that use these two roadways on a rout¡ne basis and the Grand Valley Fire Protection District did not have any objections to using the roadways as they currently exist. 2, Safefi / Structural fssues Response: The existing safety and structural section for 4th Street and Scarrow Avenue are adequate for the proposed Pro Gas Bulk Propane facility. These gravel roads have been in use since 2005 and were primarily used by the oil and gas service industries with heavy loaded equipment. The roadways have demonstrated they can support heavy truck traffic access. 3, Maintenance Response: The Travelers Highlands Subdivision Public Improvement District was approved by Garfield County BOCC (Reception # 7957L8) is respons¡ble for the maintenance of the roadways within the subdivision. Mr. Patrick Waller November 6,2017 Page 5 of 6 4, Travel Demands Response: 4th Street and Scarrow Avenue are adequate to meet the travel demands for the proposed Pro Gas Bulk facility. As described in the Limited Impact Review application (LIPA-06-17'8562), the proposed Pro Gas Bulk Propane facility is not open to the public. Vehicle trips to and from the facility will consist of bi-weekly semi-truck deliveries to fill the bulk propane tank and Progas daily trips to the facility to fill their local service trucks. 5. Parcel has Access to Public Right-of-Way (Table 7'lO7'A) Response: The proposed Progas Bulk propone facility has access to public rights-of-way along 4th Street and Scarrow Avenue. The Travels Highlands Subdivision plat (Reception #758309) and Resolution 05-05 provide the documentation that demonstrates the public rights-of-way for the proposed project. 6, Parcel has Safe Access (Table 7'707,8) Response: The proposed Progas Bulk Propane facility has safe access. This is supported by the fact that several existing businesses operate using this existing roadway and there were no objections from the Grand Valley Fire Protection district for the proposed use. 7, Adeguate CapaciU to Serue Proposed Use (Table 7-107,C) Response: 4th Street and Scarrow Avenue has the capacity to efficiently and safely seruice the additional traffic generated by the proposed Progas Bulk Propane facility and the new use will not create traffic congestion or unsafe traffic conditions. 8. Roadway Rights-of-Way dedicated (Taþle 7-LO7'D) Response: The road rights of way were dedicated in the Travels Highlands Subdivision plat (Reception #758309) and Resolution 05-05 9. Prior to the issuance of the Land Use Change Permit, the applicant shall supply a demonstration that the roads from Highway 6 & 24 to the use meet the Roadway Standards as detailed in Table 7-107 of the Garfield County Land Use and Development Code of 2013, as amended. lf the roads do not meet these standards the applicant shall choose to either upgrade the roads to meet the standards or submit a Roadway Waiver that demonstrates conformance with Garfield County Community Development Policy, 01-14 Waivers for Roads and Demonstration of Compliance. A demonstration that this condition has been met shall be reviewed and accepted by the Community Development Department and the County designated engineer. Response; A waiver of Roads for Pro-Gas is included in this response 2. Prior to the issuance of the Land Use Change Permit, the applicant shall address inconsistencies between the geotechnical report and the tank plans. The tank plans call for soil bearing pressures of greater than 2,000 psf, while the geotechnical report limits allowable pressure to 1,500 psf. A demonstration that this condition has been met shall be reviewed and accepted by the Community Development Department and the County designated engineer. Response; Jacob Noel McNutt of SGM a structural Engineer has been retained to engineer the necessary changes to accommodate the 2,000 psf needed to install the 30,000 gallon Bulk Propane tank and the plan is included in this response. 3. Prior to the issuance of the Land Use Change Permit, an Amended Final Plat that combines the lots as represented in this application will be executed and recorded with Garfield County. A demonstration that this condition has been met shall be reviewed and accepted by the Community Development Department. Response; The revised Amended Final Plat for Pro-Gas is included with the response. 4. Prior to the issuance of the Land Use Change Permit, the applicant shall address inconsistencies between the site plan submitted for the Land Use Change Permit and the state approved LP-Gas lnstallation Application. The distance from the storage container to both the north-western and south-eastern property lines are different for the two submittals. A demonstration that this condition has been met shall be reviewed and accepted by the Community Development Department and the County designated engineer. Response; The state approved LP-Gas lnstallation Application and the Site Plan have been revised and are consistent with one another. 5. Prior to the issuance of the Land Use Change Permit, the applicant shall change General Note #4 on the site plan to state, "The facility will contain a skid mounted 30,000 gallon propane tank used to supply the delivery truck for customers." A demonstration that this condition has been met will be reviewed by the Comm u n ity Development Department. Response; Note #4 has been revised from 3,000 Gallons to the correct 30,000 Gallons. Other Conditions 6. All representations made by the Applicant in the application shall be conditions of approval, unless specifically altered by the Board of County Commissioners. The operation of the Bulk Sales of Propane use shall be done in accordance with all applicable Federal, State, and local regulations and restrictions governing the operation of this type of facility, including but not limited to the NFPA 58 - Liquefied Petroleum Gas Code and the Emergency Planning and Community Right to Know Act.
