Parcel No. 218105300294 ACRES 75.018 Acres ZONING Rural I. DESCRIPTION OF THE PROPOSAL The Applicant is requesting a Land Use Change Permit for a Public Gathering on an approximately 75 acre parcel located in the Rural zone district between the Towns of Silt and New Castle. The Applicant is proposing to hold a music festival with approximately 2,000 to 3,000 attendees during Memorial Day Weekend in 2018. The festival would include camping, a vendor village, and a stage on site. Water would be trucked to the event and available at multiple locations on site for free. Wastewater will be handled by 100 regular portable toilets and 4 handicapped portable toilets on the festival grounds and will be serviced daily as indicated by the applicant. Food will be available onsite via a vendor village. The applicant has proposed that camping will be associated with the event as part of the public gathering. The site will be accessed via the River Frontage Road, a CDOT maintained road. The applicant proposes to use transit to serve the event, but has also reserved a parking area on the site. An upgraded interior loop road has been included as part of the application, to better direct interior pedestrian and vehicle traffic. During the remainder of the year, the applicant is proposing to utilize the site as a park. II. DESCRIPTION OF THE SITE The site is split by the interior road that the applicant has identified as the shuttle entry. To the east is a relatively flat meadow that the applicant plans to use for a parking area. It generally slopes toward the river at mild grades. The western portion of the site is significantly below the eastern end, but access is provided via the internal existing ranch road. At the bottom of the significant grade change, slopes are generally mild and drain towards the river. The southern end of the parcel, has cottonwood trees and 11Page Peach Valley River Park — Public Gathering BOCC Call-up December 18, 2017 other riparian vegetation. The Lower Cactus Valley Ditch is located on the property close to the Colorado River. Historically, the site has been primarily used for agricultural purposes. Aerial View of the Property SUPPLEMENTAL SUBMITTALS The applicant has submitted additional information on this application in response to received referral comments and public comments. Those items have been included in the packet to the Board of County Commissioners however, because of the lateness of the submittal, those items were not included as part of staffs initial review of the application. Those items are generally summarized below and included as exhibits: Updated Site Plan (Exhibit 23) - The applicant updated the site plan to include locations of toilets, generators, and water stations. An emergency service location near the concert stage area and emergency vehicle turn -around. - Locations of portable Tight towers. A 200 foot buffer from the neighboring property line. Security fencing around the ditch. - Designated Car Camping Areas and total parking counts for the Meadow area. - Proposed 40 foot culvert to be designed by a structural engineer to cross the ditch. 2 Peach Valley River Park—Public Gathering BOCC Call-up December 18, 2017 Applicant Response to Referral Comments Submittal (Exhibit 24) - The applicant changed their request for the Public Gathering to be held only over the Memorial Day Weekend (3 Days — Saturday, Sunday and moving out on Monday). - The applicant is requesting approval for a total time on site of 7 days total. - Updated the grading and drainage plan with a supplemental statement - Included decibel readings taken by the applicant Indicated that the proposal will not use RFTA Park and Ride areas. Applicant Response to Public Comment (Exhibit 25) - The applicant included a response to public comment included as Exhibit 19, discussing proposed adjustments to decrease impacts on the neighboring property. PUBLIC AND REFERRAL COMMENTS The Applicant has provided documentation that all required notice mailings have been completed in accordance with the LUDC. Four public comments were received as a result of the Public Notice, from three different members of the public. They identified multiple concerns with the application including noise, traffic, wildlife and compatibility issues. They are attached in their entirety as Exhibit 19, Exhibit 27, Exhibit 30, and Exhibit 31. All four comments were opposed to the application. Referral Comments received on the Application are attached as Exhibits and summarized below: Colorado Department of Transportation, Dan Roussin (Exhibit 10) The year round recreational use will require new access permits for the change in use, but does not anticipate any issues with the new use. Needs a special events permit administered by Colorado State Patrol The County should identify the total number of events that the applicant is applying for. Colorado Parks and Wildlife, Taylor Elm (Exhibit 9) - No concerns with the proposed festival/public events Garfield County Emergency Manager, Chris Bornholdt (Exhibit 8) - Did not identify any concerns Colorado State Patrol, Richard Duran (Exhibit 11) Colorado State Patrol (CSP) will review the application for a special event and address any issues/concerns as it relates to traffic flow on a State or Federal Highway. Will supply Uniform Traffic Control if needed - Will consider the railroad crossings in consideration of the application Garfield County Public Health, Morgan Hill (Exhibit 12) The applicant has addressed applicable water and wastewater supply management standards for the events planned in 2018. Supportive of the idea to connect to municipal water and wastewater utilities if the park becomes more consistently utilized as an event location. Proper stormwater management is needed if there are more permanent facilities installed in the future. - Impacts to vegetation and increased use of the gravel roadway has the potential to create fugitive dust emissions. Festival managers should take measures as appropriate to limit the release of dust during the event. Lower Cactus Valley Ditch, Leeroy Chelewski (Exhibit 13) Recommends that the applicant be required to mitigate the ditches concerns by installing fencing on both sides of the ditch, or piping the ditch. The applicant needs to address any unintended drainage into the ditch from the events north of the ditch. Lower Cactus Valley Ditch, Supplemental Referral Comment, Leeroy Chelewski (Exhibit 18) 5 Peach Valley River Park— Public Gathering BOCC Call-up December 18, 2017 Concerned with the applicant proposing to cross the ditch. Any ditch crossing needs to be designed by a qualified engineer and approved by the ditch company. Mountain Cross Engineering, Chris Hale (Exhibit 14) The applicant should provide more details for the anticipated design of the road entrances - The applicant should provide more information on how they calculated the increase in traffic trips that will be generated. The applicant should provide more information on the distribution of potable water. The applicant should provide more information on wastewater. The applicant should provide approval from Coal Ridge High School if they plan on using the facilities The applicant should update the site plan with new information. - The applicant should provide further details regarding how the parcel will be accessed by boaters. The applicant should provide additional information on the portable generators that will be used. The applicant should provide additional information on the noise impacts at the site. Grading and drainage should be further addressed at the site. Roaring Fork Transportation Authority, Jason White and David Johnson (Exhibit 15) - While the applicant has had a conversation with the RFTA Director of Operations, there has not been a commitment from RFTA to serve future events. Event parking will be forbidden in areas designated as RFTA Park and Rides. Garfield County Sheriffs Office, Lou Vallario (Exhibit 16) - The Sheriffs Office does not object to the Public Gathering Deputies may not be used for private security, the applicant will have the option to hire a private security company to manage the concerns within the event. - The Sheriff's Office does not provide planning and logistical assistance with a private gathering. Colorado River Fire Rescue, Orrin Moon (Exhibit 17) Access Road into the site needs to be designed to demonstrate that it supports the weight of fire apparatus. - All weather driving surface along with engineered emergency roads are required to access all areas of the site. Recommends that a meeting be set-up with Colorado River Fire Rescue to discuss fire apparatus access around the entire festival area. - Vendor Village tents shall be anchored to meet tent specifications and or CRFR requirements. Festival tents shall meet the same requirements. If weights are used then CRFR will require specific weight determined to the size of tents. All food vendors need to supply their own Class K Fire Extinguishers. Fire extinguisher location plan will need to be submitted prior to any activities on site. Inclement Weather plan should be developed. RV/Camp spaces are not on the site plan. Access to the island is shown on the site plan. Fencing or barricades to keep people from falling into the river or irrigation canal. Plan reviews and site inspections will need to be conducted prior to each event to insure fire and life safety requirements are followed. 6 Peach Valley River Park— Public Gathering BOCC Call-up December 18, 2017 Town of Silt, Janet Aluise (Exhibit 20) - The Town of Silt identified no issues with the application. Town of New Castle, Tim Cain (Exhibit 26) Indicated various objections to the proposal, including issues with the non -compatibility of the proposed use and the agricultural and rural feel of the area. Provided quotes from the Planning and Zoning Commission member who expressed concerns about the application. - Included a public comment on the application. Staff's recommendation is that the application, "is not in the best interest of the Town of New Castle". Ware and Hinds Ditch Company, Gabe Chenoweth (Exhibit 28) Indicated that the Ditch Company's easement does not lie near the subject property however, overflow from the ditch had historically flowed through the property. - Wanted to make sure it was considered as part of the application. Agencies that did not respond to the referral request: Garfield County Public Health, Garfield County Vegetation Manager, Army Corps of Engineers IV. STAFF ANALYSIS In accordance with the Land Use and Development Code, the Applicant has provided detailed responses to the Submittal Requirements and applicable sections of Article 7, Divisions 1, 2, and 3. The application materials include an Impact Analysis and related plans. While the Public Gathering use is included as a use in the Land Use and Development Code, this use is only proposed for Memorial Day Weekend. Staff is contemplating an updated special events permitting system to deal with events like this in the future. DIVISION 1. GENERAL APPROVAL STANDARDS. The following standards apply to all proposed Land Use Changes, including divisions of land, unless elsewhere in this Code a use is explicitly exempt from one or more standards. 7-101. ZONE DISTRICT USE REGULATIONS. The Land Use Change is permitted by Administrative Review in the Rural zone district and it appears that the site is otherwise compliant with the zoning regulations. The Garfield County Community Development Director determined to call this application up to the Garfield County Board of County Commissioners pursuant to the Land use and Development Code. 7-102. COMPREHENSIVE PLAN AND INTERGOVERNMENTAL AGREEMENTS. The property is designated as Residential Medium -High, with a recommended residential density of 2-6 acres per dwelling unit. Because the proposed use is temporary, it will not have an impact on residential density. The Comprehensive Plan is supportive of a Public Gathering use, particularly in Section 4 — Economics, Employment, and Tourism. This section discusses the importance of Tourism, something that could potentially be boosted by the proposed use. Other than the festival during Memorial Day Weekend of 7 Peach Valley River Park — Public Gathering BOCC Call-up December 18, 2017 2018, the applicant is not proposing any development on the site besides a park. No permanent structures are proposed as part of the Public Gathering permit, and the open space on site will be preserved. 7-103. COMPATIBILITY. The applicant has responded to this standard by stating: The PVRP plan is located in an area with diverse neighbor use. The majority of adjacent property owners are homes/ small ranches on 5-15 acre parcels. There is a commercial presence in the area with an industrial park to the east, which has served the heavy machinery industry for years. A greenhouse operation X mile to the west operates a small retail stand but serves mostly bulk clients. Our plan to secure private and for public use is compatible with the State of Colorado and local municipalities to secure use of riverfront. Adiacent Land Uses The use will have a major impact on Memorial Day Weekend of 2018 when it is proposed. Particularly, with noise and traffic. To deal with traffic impacts, the applicant has indicated that they will work with Colorado State Patrol so traffic moves safely on the frontage road. This is discussed further in this staff report in section 7-107. With regards to noise the applicant has submitted a waiver request that indicated: The site is in rural Garfield County but lies adjacent to the area's largest noise polluters, 1-70 and the Colorado River. Our temporary use of the property and increased noise shall have minimal effects on the surrounding area. Applicants have requested a variance from noise DB limits from 7-10 PM for the event weekend. Said noise shall be above state levels at that period but shall not 8 Peach Valley River Park — Public Gathering BOCC Call-up December 18, 2017 severely impact adjacent owners. The area used for event space is recessed from the highway level and not viewable. Applicant has chosen said location for special use due to the external factors that already affect the land. The land is bordered on the north by 1-70 and the railroad corridor. 1-70 highway noise is quite loud in the area. This constant noise of cars and trucks is 24 hours a day with trains contributing nearly hourly. To the South is the Colorado River with a large hillside of BLM. The river acts as a noise break for local residents in the area as highway noise can only be muffled once in close proximity to the water. The temporary use of the property does not severely impact the long term goals or planning of the area. Said noise levels shall impact the area with increased levels for only 6-9 hours out of the year. Such impacts do not negatively impact the rural nature but do assist local community in tourism based economy. A complete Compatible Design for Noise does not fit the approval for said use of the property. Said use shall be a natural park with public river access for 360 plus days a year. Buffering shall be used for the 3-6 days of increases noise levels during events. The applicant will not be able to meet County noise standards and has requested a waiver, which the Board of County Commissioners may choose to grant. Staff has included a suggested condition of approval that the applicant supply a noise study from a qualified professional that details proposed mitigation measures. Those mitigation measures shall be implemented prior to or during the proposed festival times. The applicant has provided hours of operation, and indicated that the event will be over by 9:00 PM, but has requested a noise waiver until 10:00 PM to address when event attendees are leaving the site. 7-104. SOURCE Of WATER, The Applicant proposes to truck water into the site for the event. They have indicated: Fresh water shall be supplied to visitors of the park only during event times. Water supplied by the event shall only be for drinking. Water will be trucked in and available at multiple locations for free. There will be no outdoor showers located on site unless fully contained, such as the port - a -potties. The Garfield County designated engineer reviewed the application and stated: The Applicant should provide more information on the distribution of potable water. Some discussion and/or letters from licensed water haulers would be in order: how much water would be necessary, the source of the water, and what equipment will be necessary for distribution. Staff has included a suggested condition of approval that the applicant provide updated information on potable water, including a letter from a licensed water hauler that commits to providing adequate water to the event or an indication from the applicant as to how they will supply water to the site. 9 Peach Valley River Park — Public Gathering BOCC Call-up December 18, 2017 7-105. CENTRAL WATER DISTRIBUTION AND WASTEWATER SYSTEMS. The applicant has indicated: The equivalent of 100 regular access (+ up to 15 ancillary units "outside of the site) including 4 handicap toilets will be provided on the festival grounds for the general public and serviced daily (based on capacity increase adjustment). Also, we will have a service truck on-site at all times throughout the event ensuring service to units when needed as well as fresh supplies when needed. Future PUD work would most likely include a connection to the Town of Silt Wastewater which is located one mile and downhill to the west. During non festival hours, the park will have one portable toilet to service the public. This plan mimics the upstream boat ramp at the Dino Rest stop on 1-70. The Garfield County designated engineer reviewed the application and stated: Some letter from a portable toilet companies would be in order: how many toilets, where they will be located and dump locations. The applicant has already indicated how many toilets will be on site, this was reviewed by the Garfield County Environmental Health Department who stated: Water and wastewater: The applicant has addressed applicable water and wastewater supply management standards for the events planned in 2018. Staff has included a suggested condition of approval that the applicant indicate on the site plan the location of toilets handwashing stations and dump locations as well as obtaining a will -serve letter from a qualified wastewater service provider. The applicant has indicated that they will provide 100 portable toilets on-site, including 4 handicapped toilets. Any proposed decrease in this number shall include a statement of adequacy from a qualified wastewater service provider. 7-106. PUBLIC UTILITIES. The Applicant proposes that electricity be provided to the facility by portable generators. This was reviewed by the County designated engineer who stated: The Applicant states that power will be provided by portable generators. The Applicant should evaluate the power demands and contact companies to determine size and number of generators that would be necessary and where they would be located on the site. The applicant has indicated: Power will be supplied through generators contracted through PVRP. Through closing each night, the area surrounding the site will be appropriately lit via light towers in order to avoid confusion and mishap. An overnight security team will be on-site throughout the festival weekend. 10 Peach Valley River Park—Public Gathering BOCC Call-up December 18, 2017 Staff has included a suggested condition that states the applicant shall provide adequate lighting for the use. 7-107- ACCESS AND ROADWAYS;. The applicant has shown on the site plan three access points directly onto the River Frontage Road that will be utilized during the event. The River Frontage Road is under the jurisdiction of CDOT. Dan Roussin, Permit Unit Manager for CDOT, provided the following -comment in review of the application (Exhibit 10): Access to the parcel of land is on CDOT Frontage Road. All access is control by the State Highway Access Code. There really is 2 things being requested. The first request is to make it in to a public park to allow fishing, recreational use of the land. The second use is to have the park facility be used as a large event. Peach Valley River Park Recreational Use - This will require new access permits for the change in use. CDOT doesn't see any red flags for this new use. CDOT will be documenting the traffic volume for the new use. Peach Valley River Park Festival - This would appear to need a special events permit administered by Colorado State Patrol. Through this permit process, CSP would coordinate with CDOT on the traffic control plan for the event. 1 think the county needs to be very specific on the number of events in their permit. It appears the application is only asking for back-to-back weekend and for large events. Will this Garfield County land -use permit allow for smaller events that won't require a Special Events for CSP? This application is quiet on this issue. If smaller events are allowed, then there should be stipulations in the land -use permit what will be allowed. This needs to be vetted. In response to the issues raised by the referral comment, the application is only for a Public Gathering Permit for Memorial Day Weekend. No other uses or events are being permitted. If the applicant wants to routinely hold events on the site, they will be required to obtain a Community Meeting Facility Land Use Change Permit from Garfield County. CDOT's comments indicated that the applicant would need to work with Colorado State Patrol on a traffic control plan for the event. The application was forwarded to CSP for their comments. They responded (Exhibit 11): CSP will review the CSP application for a special event and address any issues/concerns as it relates to traffic flow on a State or Federal Highway. If Uniform Traffic Control is needed, CSP will provide that service to support the safety of the event traffic and the rest of the motoring public surrounding the event. We also work directly with CDOT as it relates to the Highway System. The railroad crossing is something we will consider during the process. 11 Peach Valley River Park— Public Gathering BOCC Call-up December 18, 2017 The process for us starts with the event coordinator submitting a CSP application for review complete with a traffic plan, anticipated size, number of participants, number of days, sign placement/plan, medical plan, security plan, and communications to name a few items. During the site visit staff observed that both accesses to the site across Interstate 70 would require event attendees to cross an at -grade rail road crossing that had warming lights, but no gates. After the site visit, a referral request was sent to Union Pacific, however no response has been received at this time. Colorado State Patrol indicated that the railroad crossing would be something that they will consider during their review process. Staff has included a suggested condition of approval that the applicant supply an approved special event permit from Colorado State Patrol prior to the issuance of the Land Use Change Permit. His referral comments included: The Applicant should provide more details for the anticipated design of the road entrances. The applicant has requested a waiver from Table 7-107 of the Land Use and Development Code that discusses Roadway Standards. However, the applicant has not identified that the proposed accesses and roads will be adequate for the proposed use. Staff has included a suggested condition of approval that the applicant provide more details for the road accesses as well as a statement that describes the adequacy of those accesses from a professional engineer. Additionally, comments from the fire district have requested that the applicant have an engineer provide a demonstration that all roads on the site will be able to support a fire apparatus. These issues have been included as suggested conditions of approval. 12 Peach Valley River Park — Public Gathering BOCC Call-up December 18, 2017 Internal Access Road View 7-108. USE OF LAND SUBJECT TO NATURAL HAZARDS. The applicant has indicated in their site plan the approximate location of the flood plain on the parcel. The applicant has located all temporary structures and activities outside of the floodplain. Garfield County hazard mapping indicates that the parcel could have septic system constraints. This is not an issue for the site as the applicant has proposed to handle wastewater through portable on site toilets. No other hazards are indicated. 7-109. FIRE PROTECTION. The application was reviewed by Colorado River Fire Rescue, who identified the following issues: (staff response to comments is in italics below each issue) 1. Access road into the site as designed shall be engineered to carry the weight of fire apparatus. The road section shows 6" of compacted pit run and 3" of compacted road base. I am requesting to see Engineer Reports that the road will support the weight of fire apparatus. This has been included as a suggested condition of approval and corresponds to the request from the Garfield County designated engineer. 2. The plans show a narrow access from Transit Area to Vendor Village and then to the South/East corner of the Green and across the ditch to the Island. In your packet you make reference to "Fire and Emergency lanes to be provided to grounds and back stage" but none are shown on site plan. All weather driving surface along with engineered emergency roads are required to all areas of the site. I suggest that a meeting be set up to discuss fire apparatus access around the entire festival area. This has been included as a suggested condition of approval. The applicant shall have a meeting with Colorado River Fire Rescue that identifies access throughout the festival area that meets the requirements of the fire department. 13 Peach Valley River Park— Public Gathering BOCC Call-up December 18, 2017 3. The Vendor Village will have vendor supplied tents that shall be anchored to meet tent specifications and or CRFR Anchoring requirements. Festival tents shall meet same requirements. If weights are used then we will require specific weight determined to the size of the tents. This has been included as a suggested condition of approval. 4. Food vendors if cooking with oil will be required to supply their own Class K Fire extinguisher. As noted in your permit, "fire extinguishers will be in all appropriate structures". Fire extinguishers may be needed in areas that are not close to a structure. A fire extinguisher location plan will need to be submitted to my office for review prior to any activities on site. This has been included as a suggested condition of approval. A fire extinguisher location plan shall be submitted to CRFR prior to the issuance of the Land Use Change Permit. 5. I have concerns about the parking lot being in the field and what will happen if heavy rains were to occur during the scheduled events. Is there an Emergency Plan for inclement weather? How about a plan for heavy rains in the area, is there a plan for lighting in the area and where people will seek shelter in a lighting storm? I think an inclement weather plan should be developed. A suggested condition of approval is included that requires the applicant to supply an inclement weather plan for approval by CRFR. Additionally, staff has included as suggested condition of approval that the applicant provide an engineering statement that discusses the adequacy of drainage and soils on the site for the proposed use. 6. RV/Camp spaces are not shown on the site plan. Is there a specific location for this area? Is there adequate access around the RV parking area for emergency vehicles? Camp fires in RV parking are not addressed if allowed. I need more information on the RV parking area. A suggested condition of approval has been included that the applicant provide additional information on the RV/Camping area. The applicant did not indicate that any campfires would be on site. Staff has included a suggested condition of approval that no campfires are permitted. 7. Access to the Island is shown on the site plan. Is anything happening on the island? Your proposed events are happening during our high water season. Is there any fencing or barricades to keep people from falling into the river or irrigation canal (Lower Cactus Valley Ditch). This has been addressed in response to the Lower Cactus Valley Ditch's Referral Comments (See Section 7-201). 8. Plan reviews and site inspections will need to be conducted prior to each event to insure fire and life safety requirements are followed. This has been included as a suggested condition of approval. Colorado River Fire Rescue identified no other potential issues with the site. Provided the applicant complies with CRFR's recommendations, it is staff's opinion that adequate fire protection will be provided. 14 Peach Valley River Park — Public Gathering BOCC Call-up December 18, 2017 DIVISION 2. GENERAL RESOURCE PROTECTION STANDARDS. The following resource protection standards apply to all proposed Land Use Changes, including divisions of land unless elsewhere in this Code a use is explicitly exempt from one or more standards. 7-201. AGRIC'ULTURA!L LANDS. Historically, the site has been used for agricultural uses. The applicant has proposed to install a loop road in the field which does have the potential to impact the agricultural viability of the site, however, this should not impact adjacent agricultural activities. The applicant has represented that they shall have no impact on agricultural activities. The Lower Cactus Valley Ditch was identified on the property and a referral was sent to the ditch company. The Ditch Company responded, identifying the following issues: 1. Activities proposed by the application during the major events will undoubtedly include participants' consumption of alcohol/drugs/marijuana which makes their proximity to the now -open ditch a major danger for possible drownings, etc. The proposed application states the following: "E. Ditches. Ditches located on the property shall be fenced in areas of safety concerns and operations Land Use Change does not affect ditch operations." It does not, however, detail the fact that the easement will need to be approximately 60' in width the entire length of the ditch through the property to allow for ditch maintenance' nor that the fence shall be constructed to eliminate the possibility of event patrons accessing the ditch. 2. The activities proposed also may result in unintended drainage into the ditch which is prohibited by the current bylaws to prevent contamination of the irrigation water. Nothing in the proposed application addresses this potential. Grand River Ditch Company respectfully requests that the applicant be required to mitigate the above concerns by installation of appropriate fencing of both sides of the ditch with no possible access from the event participants, or as an alternative, piping the ditch through the entire property. Either plan would be at the sole expense of the applicant. If the fencing option would be selected, the applicant would still, need to address any unintended drainage into the ditch from the events north of the ditch. The first referral comment details possible safety issues and the requirement that maintenance areas be kept clear. Staff has included a suggested condition of approval that the applicant either pipe the ditch, or fence the ditch along the length of the property to prohibit event attendee access. The second referral comment discusses the potential for drainage issues into the ditch. The Land use and Development Code requires applicants to address drainage issues if there are improvements located adjacent to or below grade of an irrigation ditch. The proposed use does not at this time propose any improvements to be located next to the ditch. If further improvements are proposed, the applicant may need to address possible drainage issues from impermeable surfaces. Staff has included a suggested condition of approval that the applicant provide an engineering analysis as to the adequacy of drainage on site for the proposed use. 15 Peach Valley River Park — Public Gathering BOCC Call-up December 18, 2017 The Grand River Ditch Company provided a supplemental referral comment that stated (Exhibit 18): It appears that the project proposes a crossing on the ditch to provide access to the Colorado River to the south. The ditch company requires that any crossing of the ditch be designed by a qualified engineer and be approved by the ditch company prior to the construction of such crossing. As part of a supplemental submittal the applicant has indicated that they will install a culvert approved by the Ditch Company and designed by a professional engineer. With the condition that the ditch is adequately fenced to restrict access, it is staffs opinion that the applicant adequately addresses Section 7-201. View of the Lower Cactus Valley Ditch 7-202. WILDLIFE HABITAT AREAS. The application was referred to Colorado Parks and Wildlife (Exhibit 9). CPW responded, "I spoke with Brian Gray on this proposal, and he informed me that he has been working with the applicants regarding the greater vision of a public river park. He does not have any concerns at this time with the proposed festival/public events. He's encouraged with their efforts to provide some public access along this stretch of the river. " 16 Peach Valley River Park— Public Gathering BOCC Call-up December 18, 2017 Because of the temporary nature of the Public Gathering, staff does not anticipate significant impacts to wildlife. 7-203. PROTECTION OF WATERBODIES. The Applicant indicated that they will place all structures to comply with County setback regulations. There is an irrigation ditch on the site, however the Land Use and Development Code does not include irrigation ditches as waterbodies. The applicant has provided a site plan that keeps all event infrastructure out of the flood plain and away from the river. A suggested condition of approval is included that the applicant keep all structures at least 35 -feet from the typical and ordinary high water mark of the Colorado River. View to the Colorado River from the Parking Area 7-204 DRAINAGE AND EROSION. To address draining and erosion, the applicant stated: PVRP LLC has added a plan for grading a road base surface in our internal drive and parking areas. A road grading plan is located on the bottom of the Event Site Plan above. All existing internal roads shall be improved to these standards. The Vendor Village are will also see raised road base surface for entry and exit of vehicles and also a high ground or path for pedestrians during events. Exact location TBD with placement in the middle third of the field. Areas of foot traffic will be clearly marked and suitable for wet travel. The applicant also provided an NRCS soil map for the site. The application was reviewed by the Garfield County Designated Engineer who stated: 17 Peach Valley River Park — Public Gathering BOCC Cali -up December 18, 2017 The site plan does not show how the site will be graded and the impacts of this grading on drainage. The applicant should provide some evaluation on adequacy of drainage on the areas that would not be disturbed. Staff agrees with the Garfield County Designated Engineer's analysis and has included a suggested condition of approval that the applicant needs to address the adequacy of drainage and soil conditions on the site for the proposed use. The analysis will be required to be from a Professional Engineer. 7-205. ENVIRONMENTAL QUALITY. It is staffs opinion that the temporary use of the site for a public gathering should not impact air quality or water quality. The applicant's site plan shows that all event infrastructure will be located outside of the flood plain and away from the river. Additionally, no infrastructure is proposed next to the irrigation ditch. If this changes as the applicant's plans are upgraded, a suggested condition of approval has been included that the applicant needs to address possible drainage into the ditch. 7-206. WILDFIRE HAZARDS. According to Garfield County's Community Wildfire Protection Plan, the property is a mixture of Not Rated, Moderate, and High Wildfire susceptibility. No long-term development is proposed as part of this Land Use Change Permit. It is staffs opinion that the Wildfire Hazards are manageable on the site. Additionally, the application has been reviewed by Colorado River Fire Rescue and suggested conditions of approval have been included that address those concerns (See Section 7-109). 7-207. NATURAL AND GEOLOGIC HAZARDS. No geologic hazards are associated with the property according to Garfield County Hazard mapping. There Is a significant slope splitting the middle of the site, however the applicant is not proposing any event infrastructure in the area and the slope is already improved with an access to the lower western end of the parcel. The applicant has shown the 100 year flood plain on the site plan and shown that all major activities associated with the event will be kept outside of this area. The public will still have access to the "island" however no event services are located there. View from the proposed event space to upper bench parking area 18 Peach Valley River Park — Public Gathering BOCC Call-up December 18, 2017 7-208. RECLAMATION. The use is not anticipated to need reclamation as the use is temporary and no long-term impacts are anticipated. The application was sent to the Garfield County Vegetation Manager and no comment was received. DIVISION 3. SITE PLANNING AND DEVELOPMENT STANDARDS. Unless a use is explicitly identified elsewhere in this Code as being exempt from 1 or more standards, the following standards shall apply to all uses, divisions of land and PUDs. Single-family dwelling units, are specifically exempt from these Division 3 standards. 7-301. COMPATIBLE DESIGN. The applicant has submitted a waiver for the Land Use and Development Code's noise standards. In that waiver submittal the applicant stated: The site is in rural Garfield County but lies adjacent to the area's largest noise polluters, 1-70 and the Colorado River. Our temporary use of the property and increased noise shall have minimal effects on the surrounding area. Applicants have requested a variance from noise DB limits from 7-10pm for the event weekend. Said noise shall be above state levels at that period but shall not severely impact adjacent owners. The area used for event space is recessed from the highway level and not viewable. Applicant has chosen said location for special use due to the external factors that already affect the land. The land is bordered on the north by 1-70 and the railroad corridor. 1-70 highway noise is quite loud in the area. This constant noise of cars and trucks is 24hrs a day with trains contributing nearly hourly. To the south is the Colorado River with a large hillside of BLM. The river acts as a noise break for local residents in the area as highway noise can only be muffled once in close proximity to the water. The event plan has taken into account residents to the East and West by utilizing these portions of the property for storage and parking. All efforts will be made to accommodate local homeowners through sound and sight mitigation practices. The noise will have an impact on nearby properties while the event is occurring. The use will not meet Garfield County noise standards, but the BOCC may choose to grant a waiver from this standard based on the temporary nature of the use. Staff has included as a suggested condition of approval and as support for the applicant's waiver request, that the applicant provide a noise analysis from a qualified professional that identifies practicable noise mitigation measures. 7-302. OFF-STREET PARKING AND LOADING STANDARDS. The applicant has indicated on the site plan that they are anticipating being able to park 1,400 cars on 19 Peach Valley River Park — Public Gathering BOCC Call-up December 18, 2017 site. Also, the application indicates that shuttles will be used from New Castle and Silt to limit parking on site. Parking standards are not included in the Land Use and Development Code (LUDC) for a Public Gathering use similar to the one proposed. If not listed, the LUDC does allow for the Community Development Director to make a determination as to how many parking spaces are needed to accommodate the proposed use. Staff research, based on Federal Highway Administration information, has determined that with the proposed use, the applicant can anticipate 2.25 people per vehicle. With the maximum attendance of 3,000, the applicant shall provide 1,334 parking spaces, plus parking for vendors, performers, and other event staff. The applicant shall submit a parking plan that designates parking for the corresponding number of vehicles (on-site and of -site) that are anticipated by the ratio. It shall also identify compliance with ADA parking requirements. If all parking cannot be contained on-site, the applicant shall be required to identify off-site parcels that will be used (as well as the number of parking spaces provided at the off-site location), provide agreements with the land owner, and provide a will serve letter from a qualified transit operator. The applicant did indicate that RFTA parking areas may be used for event parking. However, in referral comments, RFTA indicated that event parking at their park and ride areas would be forbidden. View of the Proposed Parking Area 20 Peach Valley River Park — Public Gathering BOCC Call-up December 18, 2017 7-303. LANDSCAPING STANDARDS. The Applicant submitted a waiver from the Landscaping Plan submittal requirements. The applicant is not proposing any development for the site and the site already has significant established vegetation. Screening has not been identified as an issue because the Public Gathering use is temporary. 7-304. LIGHTING STANDARDS. The applicant has stated that the surrounding site will be appropriately lit via light towers. A suggested condition of approval has been included that the applicant comply with all Garfield County lighting standards. 7-305. SNOW STORAGE STANDARDS. The snow storage area appears to be sufficient and the event is proposed for late May or early June. 7-306. TRAIL AND WALKWAY STANDARDS. Trails and walkway standards are not relevant for this application as there is no connection to schools, shopping areas, or other public facilities. VI. STAFF CONCERNS Noise The applicant has requested a waiver from the Noise standards in the Land Use and Development Code. As the use is short-term, it is staffs opinion that a waiver request may be granted by the BOCC. Staff has included a suggested condition of approval to support the waiver request with a sound study from a qualified professional that details mitigation measures to help decrease noise impacts to adjacent properties. Access from the River The applicant indicates that the park will be used extensively by boaters. However there is no indication of how the park will supply river access. There is no developed river take-out on the site and event attendees would not be able to remove rafts from the site, as personal vehicles will be limited to the parking area. Additional permitting is necessary for this use. A suggested condition of approval has been included that no access is permitted from the Colorado River as part of this permit. Sheriff's Office This application was referred to the Garfield County Sheriff's Department who indicated that they did not object to the public gathering and would handle traffic and criminal activity as they are routinely addressed. (Exhibit 16). However, the application states that they will work with the Sheriff's Department to create plans. The Sheriff's department has indicated that they do not provide planning and/or logistical assistance for a private gathering. Camping The applicant has indicated that there will be camping offered on-site. Camping on this parcel shall only be associated with the event. No camping shall be permitted outside of event times. The site plan does not identify where the camping areas may be located. Staff has included a suggested condition of approval that the applicant update the site plan to show where camping may be located. Colorado River Fire Rescue 21 Peach Valley River Park — Public Gathering BOCC Call-up December 18, 2017 has requested more information on the camping use to ensure that it can adequately be served by emergency services. VII. REC'ONITVI,'ENDATIOaN'S — BOARD OPTIONS' OPTION A: Continue the public hearing and request that the applicant address some of the outstanding issues identified through referral comments, including but not limited to a noise analysis detailing the impacts and mitigation measures. OPTION B: Board Approval of the Land Use Change Permit for the Laidlaw Public Gathering also known as the Peach Valley River Park Festival subject to the following conditions of approval and findings. Suggested Findings 1. That proper public notice was provided as required for the Public Hearing before the Board of County Commissioners. 2. The hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons the proposed Land Use Change Permit application by Tom and Naomi Laidlaw, for a Public Gathering is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That with the granting of a waiver from Section 7-107 Roadway Standards, Section 7-301(B)(2) Noise Standards and compliance with conditions of approval the application is in general conformance with the 2030 Comprehensive Plan, as amended. 5. That with the granting of waivers from Section 7-107 Roadway Standards, Section 7-301(6)(2) Noise Standards, and compliance with conditions of approval the application has adequately met the requirements of the Garfield County Land Use and Development Code of 2013, as amended. General Suggested Conditions of Approval 1. All representations of the Applicant contained in the application shall be considered conditions of approval unless specifically modified by the Board of County Commissioners. This includes representations that adequate water, wastewater, waste management, security, and generators shall be provided. 2. The Applicant shall comply with all local, state and federal regulations regarding uses of this type. Prior to the Issuance of the Land Use Change Permit 3. Prior to the issuance of the Land Use Change Permit, the applicant shall supply Garfield County Community Development with an approved special event application from Colorado State Patrol. 22 Peach Valley River Park—Public Gathering BOCC Call-up December 18, 2017 Demonstration of compliance with this condition shall be reviewed and accepted by the Community Development Department. 4. Prior to the issuance of the Land Use Change Permit, the applicant shall comply with the following requirements from Colorado River Fire Rescue's referral comments dated November 20, 2017. a. The applicant shall meet with Colorado River Fire Rescue to discuss fire apparatus access around the entire festival area via an all-weather driving service with engineered emergency roads. Any improvements identified by Colorado River Fire Rescue during that meeting shall be constructed prior to the festival. The site plan shall be updated to include fire lane accesses. The updated site plan shall be reviewed and accepted by Colorado River Fire Rescue, Garfield County Community Development and the Garfield County designated engineer. b. An inclement weather plan shall be developed. This plan shall be reviewed and accepted by the Community Development Department and Colorado River Fire Rescue. c. Camp spaces need to be shown on the site plan. Adequate access around the camping area should be shown for emergency vehicles. Once the site plan is updated to indicate this area it shall be reviewed and accepted by the Community Development Department, County designated engineer, and Colorado River Fire Rescue. 5. Prior to the issuance of the Land Use Change Permit, the applicant shall comply with the following engineering comments as identified by Mountain Cross Engineering's referral comments dated November 17, 2017: a. The applicant shall provide a will -serve letter from a qualified potable water provider, indicating that they will provide water for the use. Compliance with this condition will be reviewed and accepted by the Community Development Department. b. The applicant shall provide a will -serve letter from a qualified wastewater disposal company to serve the event. The applicant has indicated that they will provide 100 portable toilets including 4 ADA accessible toilets on site. Any decrease in this number shall require a statement of adequacy to be included in the will serve letter from the qualified wastewater disposal company. Compliance with this condition shall be reviewed and accepted by the Community Development Department and the County designated engineer. c. The applicant shall supply a noise analysis from a qualified professional that identifies mitigation measures that can be implemented to the extent practicable to mitigate noise from the event. Any identified mitigation measures shall be installed or implemented prior to the event. Compliance with this condition shall be reviewed and accepted by the Community Development Department and the County designated engineer. d. The applicant shall supply a parking plan for the site, based off of 2.25 people per vehicle, as well as other event staff, vendors, and performers. This plan shall indicate what 23 Peach Valley River Park — Public Gathering BOCC Call-up December 18, 2017 percentage of vehicles will park on site and if any off-site parking is required. It shall also address the multiple types of parking the applicant is proposing (short term, camping, ADA, etc.) Compliance with this condition shall be reviewed and accepted by Community Development and the County designated engineer. 6. Prior to the issuance of the Land Use Change Permit, if off-site parking is necessary per the applicant's parking plan, a will serve letter shall be required from a qualified professional transit company. Additionally, evidence of a written agreement allowing for event parking between any property owner and the applicant shall be required. Compliance with this condition shall be reviewed and accepted by the Community Development Department. 7. Prior to the issuance of the Land Use Change Permit, the applicant shall supply an analysis from a professional engineer detailing the adequacy of the ditch crossing for the proposed use. If the analysis determines that the ditch crossing needs to be upgraded, the applicant shall complete the update prior to the event and provide a demonstration of approval from the ditch company. Compliance with this condition shall be reviewed and accepted by the Community Development Department and the County designated engineer. 8. Prior to the issuance of the Land Use Change Permit, the applicant shall supply an analysis from a professional engineer that details the adequacy of proposed accesses, gives details about any needed improvements to those accesses, and provides a statement of adequacy for the interior roads and their ability to support emergency services. Compliance with this condition shall be reviewed and accepted by the Community Development Department, Colorado River Fire Rescue, and the County designated engineer. 9. Prior to the issuance of the Land use Change Permit, the applicant shall update the site plan to include different identified parking zones (short-term, ADA accessible, vendor parking, etc.), the location of the proposed camping areas, updated fire lane accesses, and portable toilet locations. Compliance with this condition shall be reviewed and accepted by the Community Development Department. 10. Prior to the issuance of the Land Use Change Permit, as determined necessary by the Community Development Department and the County designated engineer based on further site improvements, the applicant shall supply a drainage plan from a professional engineer that addresses whether drainage from the site shall will impair the operation of the ditch if any additional impermeable surfaces are installed that may impact the ditch. Any identified mitigation measures shall be completed prior to the event. Compliance with this condition shall be reviewed and accepted by the Community Development Department and the County designated engineer. 11. Prior to the issuance of the Land Use Change Permit, the applicant shall provide a demonstration from a professional engineer that analyzes the adequacy of onsite drainage, any potential grading, and soils in regards to the proposed uses on the site including but not limited to designated parking and camping areas. This should address potential inclement weather issues. Any identified improvements shall be completed prior to the event. Compliance with this condition shall be reviewed and accepted by the Community Development Department and the County designated engineer. 24 Peach Valley River Park— Public Gathering BOCC Call-up December 18, 2017 Operational Conditions 12. All exterior lighting shall be downcast and shielded in compliance with Section 7-304, Lighting Standards, of the Land Use and Development Code of 2013, as amended. 13. As indicated in the application, adequate lighting shall be provided on the site for egress when the festival is finished. 14. A fire extinguisher plan shall be submitted and approved to Colorado River Fire Rescue prior to any activities on site. 15. All events on site shall be finished by 9:00 PM. The Public Gathering Permit shall only allow event attendees onsite, Saturday, Sunday, and Monday. Music shall not begin until 1:00 PM. 16. The applicant shall obtain all permits as needed to operate the vendor village, including, but not limited to any applicable food safety permits, and liquor licenses. 17. The applicant shall either pipe the Lower Valley Cactus Ditch, or fence the ditch along the entire property with adequate fencing to ensure event attendees shall not access the ditch. 18. All temporary event structures shall be located outside of the Garfield County Waterbody setback from the Colorado River and the floodplain. 19. The applicant shall obtain any applicable Garfield County building permits for the use. 20. No access from the Colorado River to the event is permitted by this Land Use Change Permit. The applicant has discussed rafting to the park in the application. There shall be no rafting access granted as part of this permit. 21. This Public Gathering permit is only for Memorial Day weekend in 2018. No additional events are being permitted by the application. Any additional events that qualify as a Public Gathering shall be required to obtain another Land Use Change Permit. 22. Vendor Village tents shall be anchored to meet tent specifications and or Colorado River Fire Rescue Anchoring Requirements. Festival tents shall meet the same requirements. If weights are used then Colorado River Fire Rescue will require specific weights determined by the size of tents. 23. Vendors cooking with oil shall supply their own Class K Fire Extinguisher. 24. A site inspection by Colorado River Fire Rescue and Community Development shall be conducted prior to the event weekend to ensure fire and life safety requirements are followed and that operational conditions are being met. Colorado River Fire Rescue and Community Development shall have the ability to cancel the event during this inspection or during the event if identified issues have not been addressed. 25 Peach Valley River Park— Public Gathering BOCC Call-up December 18, 2017 25. No campfires shall be permitted in camping areas. 26. The applicant shall control fugitive dust on the site during the event. 27. Event attendance shall not exceed 3,000 attendees a day. 28. Camping on the site is only permitted as part of the Public Gathering Permit. No long-term camping is permitted on the site by this permit. No camping is permitted outside of designated festival days. OPTION C: Continue the public hearing and direct staff to prepare findings and a resolution for the Board's consideration for denial of the Land Use Permit request including a finding that the Access to the parcel of land is on CDOT Frontage Road. All access is control by the State Highway Access Code. There really is 2 things being requested. The first request is to make it in to a public park to allow fishing, recreational use of the land. The second use is to have the park facility be used as a large event. Peach Valley River Park Recreational Use - This will require new access permits for the change in use. CDOT doesn't see any red flags for this new use. CDOT will be documenting the traffic volume for the new use. Peach Valley River Park Festival - This would appears to need a special events permit administered by Colorado State Patrol. Through this permit process, CSP would coordinate with CDOT on the traffic control plan for the event. I think the county needs to be very specific on the number of events in their permit. It appears the application is only asking for back-to-back weekend and for large events. Will this Garfield County land -use permit allow for smaller events that won't require a Special Events for CSP? This application is quiet on this issue. If smaller events are allowed, then there should be stipulations in the land -use permit what will be allowed. This needs to be vetted. In operation since 1897, the ditch company is incorporated to provide irrigation water to more than 140 shareholders (including the Town of Silt) with 50 CFS water from the Colorado River. The proposed project poses a danger to the ditch in two major areas: 1. Activities proposed by the application during the major events will undoubtedly include participants' consumption of alcohol/drugs/marijuana which makes their proximity to the now -open ditch a major danger for possible drownings, etc. The proposed application states the following: "E. Ditches. Ditches located on the property shall be fenced in areas of safety concerns and operations. Land Use Change does not affect ditch operations." It does not, however, detail the fact that the easement will need to be approximately 60' in width the entire length of the ditch through the property to allow for ditch maintenance, nor that the fence shall be constructed to eliminate the possibility of event patrons accessing the ditch. 2. The activities proposed also may result in unintended drainage into the ditch which is prohibited by the current bylaws to prevent contamination of the irrigation water. Nothing in the proposed application addresses this potential. Grand River Ditch Company respectfully requests that the applicant be required to mitigate the above concerns by installation of appropriate fencing of both sides of the ditch with no possible access from the event participants, or as an alternative, piping the ditch through the entire property. Access road into the site as designed shall be engineered to carry the weight of fire apparatus. The road section shows 6" of compacted pit run and 3" of compacted road base. I am requesting to see Engineer Reports that the road will support the weight of fire apparatus. 2. The plans show a narrow access from Transit Area to Vendor Village and then to the South/East corner of the Green and across the ditch to the Island. In your packet you make reference to "Fire and Emergency lanes to be provided to grounds and back stage" but none are shown on site plan. All weather driving surface along with engineered emergency roads are required to all areas of the site. I suggest that a meeting be set up to discuss fire apparatus access around the entire festival area. 3. The Vendor Village will have vendor supplied tents that shall be anchored to meet tent specifications and or CRFR Anchoring requirements. Festival tents shall meet same requirements. If weights are used then we will require specific weight determined to the size of the tents. 4. Food vendors if cooking with oil will be required to supply their own Class K Fire extinguisher. As noted in your permit, "fire extinguishers will be in all appropriate structures". Fire extinguishers may be needed in areas that are not close to a structure. A fire extinguisher location plan will need to be submitted to my office for review prior to any activities on site. 5. I have concerns about the parking lot being in the field and what will happen if heavy rains were to occur during the scheduled events. Is there an Emergency Plan for inclement weather? How about a plan for heavy rains in the area, is there a plan for lighting in the area and where people will seek shelter in a lighting storm? I think an inclement weather plan should be developed. 6. RV/Camp spaces are not shown on the site plan. Is there a specific location for this area? Is there adequate access around the RV parking area for emergency vehicles? Camp fires in RV parking are not addressed if allowed. I need more information on the RV parking area. 7. Access to the Island is shown on the site plan. Is anything happening on the island? Your proposed events are happening during our high water season. Is there any fencing or barricades to keep people from falling into the river or irrigation canal (Lower Cactus Valley Ditch)? 8. Plan reviews and site inspections will need to be conducted prior to each event to insure fire and life safety requirements are followed. I am the owner of, and live on, the property immediately west of the Laidlaw parcel. A change in land use designation for the PVRP proposal would significantly impact my home and land. We are disappointed at not being contacted at an earlier date and asked about our concerns or ideas regarding the proposal by either the Owner or their Representative. We didn't officially know about the applicants request for the land use change, and specifically the festival proposal, until I picked up the certified letter (on which my last name was omitted) on November 215t about the Dec. 4th Board of Commissioner's public meeting. This has given us only 12 days to review as a family, retain legal counsel, if needed, and analyze the impact to my property. Knowing my property and home would be within 50 yards of the intended festival stage, I will undoubtedly be the most negatively impacted adjacent land owner should this application be approved. We, the Moulton family request this application be denied. It is our understanding that the parcel has been in and out of contract for the last 3 years, plenty of time to formulate a plan that would be better suited for a predominantly agricultural area. Following are some of my concerns with this application. • I am gravely concerned over the security of my property, it's out buildings, and my home. Having the possibility of 3,000 — 5,000 people within a stones throw is very unsettling, not to mention future projected crowds of up to 30,000. The Applicant does not specifically address our common property boundary which I believe makes us extremely vulnerable and unsafe both from people accessing my property from the festival site and vice versa. Given recent events, Las Vegas as an example, I feel that security of a venue of this magnitude is of extreme importance and is a safety concern. • The applicant states that the area is already noisy with Interstate 70, access roads, and the railroad nearby and that festival music would not add to the noise impact in the Valley. My home is so close to the venue that the noise will be a nuisance and will have a definite impact to my quality of living. • PVRP intends to continue farming operations on the site in coordination with festival events? I am unclear on how they will do this without creating a major source for weeds and dust due to heavy foot traffic and vehicle use. My home, being so close to the concert site would be severely affected by blowing dust and the ever -encroaching weeds. • This change in land use will have a negative impact to my property value. • New Castle, Silt and the Rifle communities already have dedicated public access to the Colorado River. Increased public access to this parcel could easily lead to trespassing on my property, not only on my portion north of the river during festivals, but on my portion of the large river island at other times. I have paid for, and continue to pay for, my family's access to the Colorado River through property taxes on land our family has owned since 1939. • The applicants' traffic analysis doesn't specifically address what will be dangerously increased volume on River Frontage Road, particularly during festival dates. They intend to mitigate this with remote busing yet have designated parking for 1,400 vehicles. In conclusion, I take the concerns listed above very seriously and thank you for considering our position regarding this application. The Moulton family historically has been pro development and growth since their arrival to the Valley in 1936 bringing a Phillips 66 Bulk Plant to Rifle. My late husband, Bill Moulton served on the Garfield County Airport Board and devoted 17 years to an environmental impact study for the Rifle Ski Corporation. He was also one of the original founders of a community bank which is now Wells Fargo in Rifle. I share this bit of history because he operated truthfully with integrity and transparency when interacting with neighbors, property owners and the community. Bill and I did the same when it was time for us to sell the upper piece of our property and build on the lower parcel because of our age and mobility. We met with the county, talked to our neighbors, and shared our intentions of living out our final years peacefully on the river and providing our sons the same birthright. We took into consideration the natural topography of the land, the CDOT approved access, the agricultural use, and developed our site plan. We were able to place our new house by using the Laidlaw's access with their permission. As you can see, there were many opportunities for the Laidlaw's and the Segal Development Group to be neighborly and share their intentions for the parcel, but they did not. For these reasons my confidence has been shaken that the prospective buyers will be good neighbors in the future. I believe that if the current Application is approved for review, PVRP will be proposing more and more concert dates and public amenities consequently amplifying the impact on me, my property, and the surrounding areas. "The Green", on the PVRP Slte Plan was excavated in the late 70's for road base in the construction of I-70 and then topped with a top soil for ranching. I am the owner of, and live on, the property immediately west of the Laidlaw parcel. A change in land use designation for the PVRP proposalwould significantly impact my home and land. We are disappointed at not being contacted at an earlier date and asked about our concerns or ideas regarding the proposal by either the Owner or their Representative. We didn't officially know about the applicants request for the land use change, and specifically the festival proposal, until I picked up the certified letter (on which my last name was omitted) on November 21st about the Dec. 4th Board of Commissioner's public meeting. This has given us only 12 days to review as a family, retain legal counsel, if needed, and analyze the impact to my property. Knowing my property and home would be within 50 yards of the intended festival stage, I will undoubtedly be the most negatively impacted adjacent land owner should this application be approved. We, the Moulton family request this application be denied. It is our understanding that the parcel has been in and out of contract for the last 3 years, plenty of time to formulate a plan that would be better suited for a predominantly agricultural area. Following are some of my concerns with this application. • I am gravely concerned over the security of my property, it's out buildings, and my home. Having the possibility of 3,000 - 5,000 people within a stones throw is very unsettling, not to mention future projected crowds of up to 30,000. The Applicant does not specifically address our common property boundary which I believe makes us extremely vulnerable and unsafe both from people accessing my property from the festival site and vice versa. Given recent events, Las Vegas as an example, I feel that security of a venue of this magnitude is of extreme importance and is a safety concern. • The applicant states that the area is already noisy with Interstate 70, access roads, and the railroad nearby and that festival music would not add to the noise impact in the Valley. My home is so close to the venue that the noise will be a nuisance and will have a definite impact to my quality of living. ■ PVRP intends to continue farming operations on the site in coordination with festival events? I am unclear on how they will do this without creating a major source for weeds and dust due to heavy foot traffic and vehicle use. My home, being so close to the concert site would be severely affected by blowing dust and the ever -encroaching weeds. • This change in land use will have a negative impact to my property value • New Castle, Silt and the Rifle communities already have dedicated public access to the Colorado River. Increased public access to this parcel could easily lead to trespassing on my propefi, not only on my portion north of the river during festivals, but on my portion of the large river island at other times. I have paid for, and continue to pay for, my family's access to the Colorado River through property taxes on land our family has owned since 1939. • The applicants'traffic analysis doesn't specifically address what will be dangerously increased volume on River Frontage Road, particularly during festival dates. They intend to mitigate this with remote busing yet have designated parking for 1,400 vehicles. In conclusion, I take the concerns listed above very seriously and thank you for considering our position regarding this application. The Moulton family historically has been pro development and growth since their arrivalto the Valley in 1936 bringing a Phillips 66 Bulk Plant to Rifle. My late husband, Bill Moulton served on the Garfield County Airport Board and devoted 17 years to an environmental impact study for the Rifle Ski Corporation. He was also one of the original founders of a community bank which is now Wells Fargo in Rifle. I share this bit of history because he operated truthfully with integrity and transparency when interacting with neighbors, property owners and the community. Bill and I did the same when it was time for us to sell the upper piece of our property and build on the lower parcel because of our age and mobility. We met with the county, talked to our neighbors, and shared our intentions of living out our final years peacefully on the river and providing our sons the same birthright. We took into consideration the natural topography of the land, the CDOT approved access, the agricultural use, and developed our site plan. We were able to place our new house by using the Laidlaw's access with their permission. As you can see, there were many opportunities for the Laidlaw's and the Segal Development Group to be neighborly and share their intentions for the parcel, but they did not. For these reasons my confidence has been shaken that the prospective buyers will be good neighbors in the future. I believe that if the current Application is approved for review, PVRP will be proposing more and more concert dates and public amenities consequently amplifying the impact on me, my property, and the surrounding areas. We will contiune agricultural activities on the parcel, much like goes on today. Different than a subdivision of which produces daily trips, traffic should be at a minimum year round. Our funding mechanism in order to turn the parcel into a park for 355 days a year has been modified to assist in your parcels value and privacy. Our plans for a public park began in 2014, even before your home was built. We applogize there was not a converstion with the Laidlaws ( or us) on the goals for the poperty. Please take our responses to your concerns as a starting point. Your property adjoining this beautiful park hopefully can be an asset, not a liability. We have made modifications to the plan to better suit the neighbors and the community. One big change is just one event over the Memorial Day Weekend, vs. back -to back weekends. Site plans have also been improved to better suit neighbors and emergency services. We have created a 200 ft green belt in which no people or equipement will be permitted between our properties. Then from there, another 100ft of just working personel. Measured on our scaled print, you home lies about 500 ft. from our new stage location, almost two football fields. As the park evolves, we shall install semi -mature trees and landscape features as desired to better shield the area. • Distance from Stage: From the beginning we have used our property line are as a staging area for production. No public were ever going to be permitted near you land. Our original layout had our stage approximitly 100 yards form your home. Our improved plan places the stage about 500 ft from your home. The stage direction is to the East to minimize sound polution as the noise tavels typically with the westerly prevailing winds. • Noise shall exceed the Garfield Couty Decibel allowance from 7-10pm on two nights this spring and potential 2 nights in the fall. That is a total of 6 hours this spring and 6 hours in the fall. We feel our movement of stage further from your home, along with the fastly moving Colorado River in May, sound pollution should be a minimum. We have recently taken decibel readings from both of our driveway entrances and also in our pastures near your home. These decibel amounts (nealry an 86 average at the driveway entrances) are quite loud for rural standards. During the event, we will take readings in order to better understand the impact of an event compared to existing noise pollution. • PRVP will maintain the agrigultiural nature of the property exactly as it is done today. • Proertry Value decline? Your poperty located next to a 78 acres open space and park may actually increase your property value. Your riverfront property is beatiful but lacks the trees and topography that the Laidlaw's enjoys. The best marketing point of your home, for value purposes, would be the ability to walk, boat and fish right out of you front door. Also, it is difficult to access the river from your home with the steep rocky bank? We would gladly add a fence gate on the western portion of the park so you abd your family could be afforded private, locked dedicated entrance to the park. • Access to the river, our areas single most vital resource is very limited. Please see our public access map from Mike Shook in our Administrative Review Application highlighting the lack of public access. Garfield County and surrounding communites must increase public access to natural resources if they wish to accommodate a tourism based economy. Transportation to and from the site is accomplished with a combination of buses and on site parking. Our area is serviced by two state highways which can accommodate vehicles traveling to and from 1-70 with ease. We have reached out to CDOT, Colorado State Patrol, and Garfield County Sherriff on the matter. The entities feel the roads are more than adequate to accommodate the traffic and we will work with them as the event nears for a direct plan of action. Peach Valley River Park is a plan to make the community a better place to live, work and recreate. There are plentry of developers who come to our area and try to place too many homes on too little land in the rural outskirts of Garfield County. Your families extensive experience in the construction industry should bring to light the over development of parcels in our area. There are very few developers wishing to divide a parcel like the Laidlaw's into 2 to 7 homes. Garfield County Comprehensive Plan designation has the Laidlaw property as one home per two acres or 39 homes. We at PVRP LLC wish for all involved to see the benefit of this beautiful property becoming the foremost natural park on the western slope, staving the direction of a 39-100 home subdivision next door to your family ranch. Again, we appologize for the lack of communication through the planning process as your was being built. Background: The Application referred to New Castle is a request submitted by Tom & Naomi Laidlaw for a Land Use Change Permit for Public Gathering that include Public Concerts, Public Festivals, Vender and Concession Facilities, large scale parking areas, shuttlebus drop off area, performance stage, production area, sound and light systems, boat landing area, nature park area, restroom facilities, large scale camping in the common parking area, etc. This is a music event somewhat like Country Jam in Mack, CO. The Applicant's representative, Jason Segal, met with New Castle's Planning & Zoning Commission at its regularly scheduled meeting on November 29, 2017 The Application states there will be music events hosting 2000 -3000 people, or potentially much larger are anticipated to be scheduled between the months of May to Oct. Yet, the application has conflicting and confusing information and it was quite different from the presentation Mr. Segal provided to the Town's PNZ. It appears in the application there could be events hosted every weekend, however, Mr. Segal told the PNZ Commission they were requesting to have one (1) major event only. The events may include on-site camping of up to 3,000 people on a portion of the 79 -acre parcel which is located 3.5 miles west of New Castle along River Frontage Rd and the Colorado River. The application calls for the 79 -acre parcel to be converted into a park which along with hosting public events would serve as a low traffic fishing and nature park with a focus on wildlife. In order to host large public events, the applicants intend to use public transportation as much as possible. Part of their plan is to have concert -goers park on private vacant property within New Castle town limits, and utilize a RFTA Park N Ride system / Shuttle Bus system. Staff Comment: The application request, which asks for Peach Valley River Park to be developed as a Public Use low traffic fishing and nature park seems to be in extreme conflict with the developers desire to have a music event in order to purchase the properties. It is the opinion of staff that, although there may be the possibility of increased sales tax revenue to the Town during the large events hosted by PVRF, the application and development of such a venue is not consistent with the rural nature of the Town of New Castle, or with the desire of the Town and Garfield County to maintain the historically agricultural and natural feel of the Colorado River Basin along the valley between New Castle and Silt. Staff & PNZ Commission members are in support of a park with a boat ramp that is open to rafting and fishing along the southern property border with the Colorado River. It is also noted that without the addition of the required building and infrastructure to the site, it is not feasible to host such large events on a regular basis. The foreseeable needed infrastructure would most likely include stages. parking lots, transit bus lots, park and ride shelters, ticket booths, security booths, camping facilities, production facilities, lighting, and sound equipment, handicap parking and facilities, restroom facilities, concession facilities, offices, waste facilities, roads, sidewalks, and so on. The addition of the infrastructure needed in order to properly and safely host such events would certainly mark a permanent change to the desired rural and agricultural feel of this area along Hwy. 6, I-70, and the Colorado River frontage Rd.. The applicant desires to use land within the Town of New Castle as a commuter park and ride / shuttle location to serve concert and festival goers. It is unclear how having the Town act as a staging area for a venue outside of Town will benefit the Town. In fact, it is possible that most all the revenue generated during such events will remain outside of Town limits and will not act to benefit the Town. The New Castle Comprehensive Plan Future Land Use Map states this area is within our three (3) mile "area of influence" and it is zoned "rural" meaning we would like to see no more than one dwelling unit per ten acres. After PNZ Commission members had time to digest the presentation, this staff requested comments in writing the following day. PNZ Commission members had this to say: • "As a representative and chair of the New Castle Planning & Zoning Commission, I am making a recommendation of denial of the requested use" and "the presentation and application submittal to GARCO seems to have several conflicts of information." • "There are too many discrepancies between the presented information and what he said (Mr. Segal). The packet presents parking in New Castle at the temporary over flow lots that have been dismantled. He mentioned that there were many private land owners' options for parking. He could not name one." In addition, "He failed to notify the adjacent land owner. Terrible business practice." • "If you want a simple answer, I would say it's a no go." • "I liked the idea of another boat ramp and park, but since it wasn't exactly what they applied for on the permit, I wouldn't want to approve anything. I would want more info. in writing, and more concrete plans." • "Above all, I feel that this Change of Use is directly in conflict with the Town's Comprehensive Plan. New Castle's Identity would be compromised if the rural aspect of the Town is altered. We must preserve and take pride in the rural contribution to the Town of New Castle, and this proposal would diminish this characteristic of the Town," Mr. Cole Moulton and his mother own the ranch property between the Laidlaw and Logan property. They attended the PNZ meeting. The following are Cole Moulton comments: Mr. Moulton said the letter that was sent certified mail to Ms. Moulton was not addressed properly. There was plenty of time for PVRP to personally meet and talk with us about the project and get our thoughts. Not once has PVRP come to the house. The problem is there is nothing defined on the application such common property boundary, just shows the park. If appears wanting to make money to buy the land. Our property has been in the Moulton family for 75 years and have paid for the access to the river all of those years. We don't have a problem with people stopping on the river on our property. There is access on the south side of the river for people to put in and take out lf, you would have come in with a top development with real money behind it and creating something special, instead of coming in with bits and pieces. We would have a lot less problem with it. But, when stated in the application there will be a six foot chain length fence around the festival area, how will you keep us secure from people access our property and people pulling into the driveway to tum around in order to access PVRP. There is a lot of issues since we are right next to the property. We are the closest neighbor and will be the most impacted. Town of New Castle Recommendations: The long-range goals of both the Town and the County do not appear well served by this application when viewed in light of more than just a nature park. It is apparent that with this application comes permanent changes to this area of the valley that will have a serious impact on the planned agricultural and rural nature of this area. An entertainment venue for thousands of people requires urban services that only a metropolitan area is capable of providing. A venue of this nature is out of place in a rural and small-town environment. Such a large and permanent public event venue must come with great consideration to all affected, including the neighboring towns, property owners, master plans, future development, and property values. Agricultural land uses are our heritage and are part of our identity. New Castle "Authentically Colorado" created this tag line to identify that New Castle was a true westem small town surrounded by ranching and farming. Taking the Laidlaw and Logan properties out of ranching and haying operations and turning it into an entertainment venue is contrary to the goals of New Castle. This change will also cause stress to adjacent and area agricultural uses and be used as a reason to change from existing agricultural uses to suburban land uses both commercial and residential, which will further degrade our agricultural heritage and make it more difficult for existing ranches and farms to maintain their operations. Based on the information available in this application and from Mr. Segal's presentation to the Town's PNZ Commission, and the lack of conformity to Town considerations for this area, it is staff's recommendation that the applicant's proposal as presented is not in the best interest of the Town of New Castle. Garfield Healthy Communities Coalition Coordinator Dana Wood confirmed Monday that the Great Outdoors Colorado Board will award $1,570,541 to the Get Outdoors Garfield County coalition The award will be presented at a GOCO Board meeting later this month. One of the coalition's first tasks will be to hire a full-time hub coordinator who will be shared between both the Garfield Re -2 and Garfield 16 School Districts. Wood said there is still a lot of work to be done, but she expects some of the programs and pathways proposed will start as early as 2018. Youth leaders from New Castle, Rifle and Parachute presented alongside officials with Asper Community Foundation, the Buddy Program and Rocky Mountain Youth Corps. Their shared goal: connecting western Garfield County youth to the outdoors. "It was clear to us that Garfield County has spectacular outdoor opportunities (the Colorado River, a world-class rock climbing area in Rifle Mountain Park, and three State Parks!), yet so many of cur youth lack access their own backyard assets," states the Get Outdoors Garfield County coalition vision summary. It remains to be seen how quickly the proposed programs and pathways will be implemented Local groups such as CSU Extension, Roaring Fork Outdoor Volunteers and Colorado Mountain College have volunteered to provide education programs to students. In fact, the local outdoor and recreation organizations that have agreed to long-term commitments for the initiative also helped with the application. He responded saying "Our application is for 3,000 not 30,000," and when I showed him where I found the reference to 30,000 (page 23 of the online pdf), he revised his comment to say they are looking at slowly growing the space from about 3000 to about 10,000 — which frankly makes only a little difference to my , level of concern. With a couple days to settle the surprising news of this proposed development, I'm realizing that part of my challenge with this proposal is that I haven't seen a current, cohesive summary of the application — one that accounts for all the changes made along the way. I read most of the application on the GarCo site and found it very confusing... and it was unclear whether it was even up to date. I might support greater access to the river nearby, but the fact that it's tied to events designed to attract thousands of people converging on the area raises lots of red flags. I simply want — and I believe the community deserves — the chance to review and comment on the proposal before it comes to a vote. I do have a couple of other questions. I believe there's at least one bald eagle nest on one of the parcels (the Logan parcel, I think). Has that been addressed? Also, the two bridges over I-70 that access the parcels between New Castle and Silt both cross over railroad tracks. Does the application address potential impacts to traffic on Hwy 6 when the bridges close for trains during high traffic times? As a neighbor to this site, I strongly oppose this said venture/proposal. In starting, it should be aptly named, "Peach Valley Country or Rock Jam" because that is what it amounts to at this stage. Tiny Peach Valley has been my home and slice of heaven for 54 years. My grandparents, Deyoe and Frances Green started buying land here for farming and ranching in the 1950s. My parents, Daun and Lillian Hill bought in with them and continued to farm and ranch. Myself along with my brother and mother still live on part of the originally acquired property. My mother and brother's property adjoins the The Peach Valley River Park property on the east side. As you all are aware, Peach Valley has changed greatly since the 1950s, the biggest being 1-70 in 1974 (I believe) which was an endeavor no one could halt. It took precious land from farmers and ranchers and added noise and air pollution but it's permanency and consistency makes it a necessary evil just as the train tracks were that were already here. That being said, we do not need more noise and air pollution added if it can be stopped. Newer changes are all the larger acreages being sold into smaller parcels for family home and one subdivision of 2-3 acres lots at the west end of the valley. These changes are to be expected but are still heartbreaking. The families moving here are doing so for a high price but a price that is worth it for the laid back lifestyle, peace, tranquility and friendly neighbors. They are not moving here to listen to blaring music, numerous (50-100 or more?) generators (campers), bright utility lights (ran by generators), stinking portable toilets windblown litter and dust from once farmable fields turned into dust bowls. The newest change that was widely fought against was the new high school being built in the valley. That was a hard change as we now have the bright lights at night and the sound of the outside activities announcers voice being carried over the loudspeakers to our homes. I live approximately a mile away and can hear a football game in its entirety if the evening air is just right. Not to mention the additional traffic and noise it created on Highway 6. The Peach Valley River Park owners and planners are wanting its neighbors and the general public to think that this is a great idea because it will remain open space that will still be farmed/pastured and that there will be public access for dog walking, walkers, family picnics/events, fishing and river access, etc. What they -re not revealing is that all public access will come with a price and not free like many of the other river parks - nearby such as in New Castle, Silt and Rifle. If the owner is truly wanting to preserve the open space, sell it to AVLT. The application in its entirety is very confusing and falsified. I could explain in this letter but feel I could not explain well without a very lengthy letter that would not be desirable to read. 1 would like to discuss all tliis with either Mr. Martin or Mr. Samson as 1 have had the opportunity in meeting and knowing each of you for quite a long time.
