HomeMy WebLinkAbout1.0 Application9/1/2010 Michele Soet & Patrick Apodaca 3953 County Road 342 Silt, Co 81652 Garfield County Building & Planning Dept 108 Eighth Street Ste 401 Glenwood Springs, Co 81601 Dear13 & P Department, I am submitting this package to apply for the option of having an "Animal Sanctuary" located on our property @ 3953 County Road 342, Sift, Colorado, Parcel#2455-023-00-042(Exhibit A & A-1). This acreage consist of 40 acres making us compliant with standard —A for an "Animal Sanctuary" First I would like to explain what we currently have. I have Australian Cattle Dogs, which I show, train and on occasion have a litter of pups. I compete across the United States in American Kennel Club confirmation shows, putting Champion titles on our dogs. I then move individuals on to herding cattle. After the pretty part is earned (confirmation titles), we get down in the dirty part(working cattle), which the dogs love the most and so do I. We compete nationwide in herding trials. Herding trials are showing the ability of the dog to control cattle. As a dog advances to gain titles they put cattle through courses, that get more complicated and in-depth as they advance. All of our dogs have been imported from Australia, from the top show and working lines. Within this package, I would like to explain what we have to offer for an "Animal Sanctuary". I will first describe the "Barn", which is where my dogs will be housed. They shall be in their respective pens by sunset, and shall be outdoors in exercise runs at sunrise. We will feed upon putting them to bed @ sunset. The "Barn" (refer to Exhibit B)is a building that is 40'x80', with 2"blue board sound and thermal insulation within the walls, R-30 insulation within the ceiling(Standard- B), constructed on a post and beam frame with a full concrete floor, including drains that empty into an ISDS(Individual sewage disposal system)(Standard-D). There are three horse stalls on the south end of the building providing 20'x50' runs with each stall. There is a tack room where horse equipment is stored. An alley runs through the barn to provide access for the tractor to get to pens for cleaning, snow removal etc. There is a Y2 bath with heat, a feed storage room, vet room for care, a wash and grooming area, and at the current time enough indoor pens to house twelve dogs. All solid waste shall be cleaned up manually and disposed of in a sealed container with lids and then disposed of at the county dump. Urine that may occur during the night, shall be washed down, scrubbed with cleaner, and rinsed into the floor drains that go to the ISDS.(Standard-D) For sunrise to sunset daycare we have(Exhibit-C), four -100'x100' day runs, two -20'x32' day runs off the north end of the barn, and 2-5'x10' concrete runs off the west side of the barn. For acclimating weather there is also a covered 40' round day run. All day runs are sloped to provide proper drainage so they will not affect off-site water supplies.(Standard-E) There is a Targe pond on the southwest corner of my property which provides swimming for the dogs. For training and working the dogs I have several corrals situated off the south end of the barn to practice different levels of herding. There is also approximately a 10 acre pasture which is connected to the corrals and is used for sending the dogs out to gather the cows and bringing them in to sort, work, etc. The dogs are fed a 75% raw diet which consist of chicken, beef, lamb, tripe, organ meats, and other raw meats upon availability. Feeding a raw diet, is very healthy for our dogs, and provides very little fecal matter, which dries quickly, as the dog absorbs most all of the nutrients. Being as the Australian Cattle Dog has a percentage of Dingo bred in them, therefore this diet suits them well. The entire property is fenced and cross fenced. My dogs DO NOT run free. We currently have 8 Australian Cattle Dogs, 5 American Quarter Horses, 3 Holstein steers, and a few cats. The cattle are rotated (spring to fall), and vary in number, as I do not keep them too long, due to getting sour with the dogs.(Standard-C) We do not plan to hold any special events that would attract more than 25 participants.(Standard-F) All being said above, I do believe we are compliant with: Section 7-804 Additional Standards Applicable to an Animal Sanctuary. A. All facilities shall have a minimum of 35 acres of land. B.. No dust, noise in excess of the Residential Zone District standards contained in CRS § 25-12-103, with the exception that no noise in excess of 55 db(A) from sunrise to sunset and 50 db(A) from sunset to sunrise as defined above will be allowed, odors or source of filth shall emanate from the property. C. A facility may have in excess of 40 domesticated animals, including dogs and cats, provided all animals are contained on the property. D. Individual sewage disposal system shall be capable of handling all feces and urine waste from kennel of building in which animals are kept, or the feces and urine waste shall be stored in a sealed container capable of being pumped for disposal by a commercial hauler to dispose of the feces and urine waste at an approved solid waste disposal site. E. Any fenced corrals or pasture for keeping animals will be required to demonstrate that no drainage will affect off-site water supplies or water quality. F. Special events that attract more than twenty-five (25) participants shall be prohibited on-site unless the proposed special events are well defined as a part of the permitting process and approved as a part of the original permit ALL of our animals have the best of care including diet, housing, exercise routine and work. We believe that it is a perfect place to be an "Animal Sanctuary". Thank you for the time to consider my request! The two issues I have been asked to respond to are: 1. Can the existing septic system which is connected into barn be utilized to serve as a waste facility for animals proposed to reside in the barn? 2. Review the swale provided around the barn to protect the adjacent creek from potential waste from the animals. Based on the request I have worked with the property owner to produce some data and generate some design information about the existing septic system as well as review the constructed swale. The drywell was pumped and cleaned to maximize the effectiveness of the drywell. I directed the owner to run a test on the drywell to assess the percolation rate of the drywell and ultimately the max available use. The system was soaked for 24 hours prior to running the test. The owner filled the tank with approximately 3' of water and measured the drop in the manhole over a period of three hours and measured the drop at 14" which is equivalent to 12.85 minutes per inch. Garfield County Building and Planning Page 2 Existing Drywell Photo Assuming only the volume of the drywell and no surrounding gravel the volume of the 6' of perforated sections would be 117.75 cubic feet or 880 gallons or 12.2 gallons per inch. Over a 24 hour period the drywell can percolate 112 inches which would be equivalent to 1367 gallons per day. Per State regulations a dog kennel will generate 30 gallons per day per dog. Using the 1367 gallons per day divided by 30 gallons per dog would allow a usage of up to 45 dogs. Drainage Swale Shown in the pictures on the following pages is the swale which has been constructed along the fence approximately 18"-24" deep and 3-4' wide which should be effective in directing any potential waste runoff away from the creek. Garfield County Building and Planning Page 2 Garfield County Building and Planning Page 2 Conclusion Based on the above information the existing drywell would be capable of providing for 45 dogs if maintained properly. HCE recommends adding an effluent filter to the septic tank to reduce the amount of solid which would enter the drywell. Additionally based on the pictures it appears that the swale which has been cut in will adequately direct the runoff to a low lying flat area and allow it to disperse. This will help protect the creek from potential waste runoff from the dog pens. Thank you for your review of this project. Please contact me if you have any questions or comments. We never decided to charge Ms. Soet for this application in the beginning nor did we ever imply that a fee was required, so I sure as hell don't want to go back after it is all said and done to ask for a fee. Michele Soet 2 Soet/Apodaca -Admin Approval for Animal Sanctuary November, 2010 ADMINISTRATIVE PERMIT REQUEST REQUEST Michele Soet and Patrick Apodaca, (the Applicant) owners of a 40 acre parcel at 3953 County Road 342 (Fairview Road), request Administrative Approval for an Animal Sanctuary in the Rural Zoning District. The Applicants operate a small farm used primarily for training and breeding Australian Cattle Dogs, but also provide for several horses, cattle and other animals left to their care. DESCRIPTION OF THE PROPOSAL The Applicant's request carne about as a result of a code enforcement complaint about the barking from a number of dogs kept in outside pens. The Applicant since then has reduced the number of dogs to less than ten and has provided plans and a narrative to describe how the operations are being modified to house the dogs inside of a 3,600 sq. ft. barn. At night the dogs will be kept inside and during daylight hours they are let out to confined dog runs adjacent to the barn. The dogs are often being worked or trained during daylight hours for competitive showing and herding trials. Access is on a private drive off CR 342. There will be no outside advertisements and no special events which would draw up to 25 people. This facility operates no differently than many of the surrounding ranches and farms other than being a training facility for cattle dogs which are shown in national competition. Currently, there are only 8 Australian cattle dogs kept on site and plans are for only the occasional litter of pups with a maximum of 12 dog pens. The property has been fenced and crossed fenced to prevent the dogs from leaving the property. The barn is post and beam construction with concrete floors throughout and floor drain system which is piped to an ISDS. The dogs are fed a "75% raw diet" which produces very little solid waste. Solid waste from the dog kennels is picked up and deposited in containers for disposal at the landfill. Any other waste is washed down floor drains to the ISDS. The ISDS has been inspected and tested by High County Engineering (HCE) and found capable of handling 1,367 gallons per day; far in excess of what is needed for "housing" the dogs and horses presently using the facility. HCE recommends that an effluent filter be added to the septic tank to reduce the amount of solid waste that would enter dry well. The barn is insulated with 2 inch "blue board" for sound and thermal insulation. There are two 20' by 32' dog runs on the north side of the structure and three 20' by 50' horse stalls on the south side of the building. A drainage swale has been graded around the east side of the barn to prevent any stormwater runoff going to Alkali Creek. All drainage and retention areas have also been reviewed and approved by High County Engineering. APPLICABLE REGULATIONS The Land Use Table contained in Article III of the ULUR designates an Animal Sanctuary as a Use by Right in the Rural Zoning District. Standards for this use are under Section 7- 804 in the Unified Land Use Resolution of 2008 as amended. All requirements of this section have been met.
