The mineral rights, title, and interest in to all oil, gas, and other minerals, if any, on an under, and
that may be prãduced from, any lands located on the area of the proposed small contractor's yard
as detailed in the November 4,2015 Title Commitrnent prepared by Commonwealth Title
Company of Garfield CountY, Inc.
Schedule B of the policy has a number of documents describing the history ofthe mineral rights.
Reception Numbei 739966 conveyed the mineral rights for the properly to Laramie Energy II,
LLCIn 2007. This appears to account for 50Yo of the mineral rights on the land in question.
Reception Number 802206 described a o'clouded" s}yoportion of the mineral rights on the
propérty and a prepared a document providing the terms to split the interests in the mineral rights
between Laramie Energy II, LLC Q5W and the land owner's Taani L. Martinez, Steven Strouse
and Gloria Strouse ps;/"¡. This applies to the areas in area where Lot28-31in Block 8 of the
Rifle Village South Subdivision.
The rest of land within parcel I of the Amended Rifle Village South Subdivision properfy upon
which the contractor,s yard is contained was detailed on a Stipulation of Interest document
Reception Number lsdg4ir found by HCE t the Garfield County Clerk and Recorder's office.
This àocument provided the terms to split the interests in the mineral rights between Jody
Hoffrneister eiW) and the land owner's Taani L. Martinez, Steven Strouse and Gloria Strouse
(2s%).

Land Use Change Application- Administrative Review of a Small Contractor's Yard
Request for a Modification in Conditions of Approval
The applicant is asking for a modification of the land use change conditions of
approval in order to have time for County Staff to review the applicant's response to the
conditions of approval during the Garfield County Commissioners on August 13, 2018. The
applicant would ask that if the proposed response to the conditions of approval is acceptable to
the County Commissioners, that approximately 45 days be given to the applicant to construct
the improvements and have aftnal inspection from County Staffthat the storage uses on site
are in line with a small contractor's yard, that all of the conditions of approval are met in the
field, and that the revegetation procedures have been implemented.
The other land use change application for this site is for development within the 100-
yr floodplain. This application is also under review with County Staff and the applicant is
awaiting a staff report. Any permit work to address the erosion control requirements for the
proposed small contractor's yard site is dependent on a County approval of development
within the I 0O-year floodplain.
As a representative acting on behalf of the Martinez farrily we would like to request
that a modification request be addressed at the August 13,2018 for an extension of the land
use change timeline with the Garfield Cowrty Board of County Commissioners as well as to
review the responses to the conditions of approval for both applications during the meeting.
We would like to do this in order to have the opportunity to present how we are addressing the
concems of County Stafl neighbors, and the Garfield County Board of County
Commissioners.

Revised Erosion Control Measures
Parcel I Rifle Village South Filing I Amended Plat
The proposed small contractor's yard on Parcel I of the Rifle Village South Filing I
subdivision will include a number of measures to prevent impacts to the neighboring
properties.
The contractor yard site will be maintained by the owner of Parcel I who lives on Parcel4 to
the south. The operation of the contactor's yard will be limited to the storing of equipment
ancl materials. The site will not include a shop where smoke, dust, and vibrations would be
created other than the infrequent deliveries and departures of materials.
The majority of the site slopes to the north with a slope of 2-8o/o. There is a deep draw on the
west side of the proposed yard that srts 7-25 feet below the upper bench of the property. A
steep ramp allows for 4WD vehicles to access this lower draw. A man made ski pond is
located about 420' to the northwest of the proposed yard and at an elevation of 65' lower than
the yard. There are no surface water features on Parcel l.
The attached Erosion Control Plan shows the revised design relocating the yard further from
the north and east properly lines as requested by the County Commissioners and Planning
Staffand reducing the overall area of the yard. The area of disturbance is much smaller than
the I acre minimum that would require a State of Colorado Stormwater Management Permit.
The review comments required that some additional treatment be provided to protect against
the transport of the contaminants to the north and east. The previous plan was to prevent
concenfiation of runoffby sheet flowing to the access road to the east. However, this previous
plan did not allow for the interception of contaminants. The current design has added a l' tall
berm within the 5' landscape screening strip between the yard and the access road. This berm
wilt direct the contractor yard's runoffnorúr to a proposed retention pond within the contactor
yard setback area from the Alleman property to the norttr. The use of a pond will allow for the
installation of a floating absorbent boom to collect any contaminants from the contactor's
yard. The operator of the yard is also restricted from storing any petoleum products or
hazardous materials and will not be allowed to perform repairs or salvage operations within
the boundary ofthe contractor yard.

This retention pond will include an impermeable 30 millimeter thick polyethylene liner that
will prevent the infiltration of runoffbelow the pond surface which has been fbund to generate
sink holes this and the surrouncling properties. The pond will have a 20' long lincd wcil cdgc
along the east side and portions of the north edge of the pond. The weir will provide for a
sheet flow out of the pond over a longer length dwing storm events so a point discharge is
avoided.
The retention pond will need to be inspected and maintained as necessary monthly and after
every significantrunoffevent observed. This includes the removal of sediment above the liner
and the verification that the weir is set level to provide the sheet flow pattem designed. The
pond will have no impact on wildlife due to the 2' maximum depth. The pond liner
specifications must be smong enough to prevent tearing from deer and elk hooß.
The new grading plan now allows for a low point at the properly boundary to help reduce the
amount of materials that may be moved dwing a major storm event. The use ofthe berm with
the screening trees should also direct any materials toward the pond. The floodplain analysis
of this area shows the contractor's yard in a higþ section of the mapped floodplain and there is
not anticipated to be the flow depth anticipated in the FEMA maps at this point. The property
owner has also agreed not to add any additional storage in the draw located to the west of the
proposed confactor's yard.
The site will also that secliment control fence along the properly line on the east side of the
landscape screening berm, along the back of the screening berm behind the retaining wall,
along the east edge of the onsite draw, and along the north property line as necessary.
Erosion conffol logs will also be installed along the flowline at the west edge of the berm and
in front of the sediment control fence behind the proposed retaining walls.
The vegetation on the site is a mix of sage brush and weeds with poor coverage on most of the
area. The applicant is proposing the reseeding of the disturbed land outside of the areas of
gravel driveway with a dry seed mix specified on the erosion control plan that will be placed
upon completion of the grading and then annually until the revegetation has retumed to its
eiistittg coroerage. The preferred method of placement of the seed is drill seeding and is
appropriate since the last effort using hydroseeding was not successfrrl. The property owner
aso nas access to inigation water that will be used to help with the revegetation process.

G. The Board opened a public hearing on the 4ú day of Decernber for consideration of
whether the proposed Land Use Õtrang" Permit should be granted or denied, during which hearing
the public an¿ intereste¿ persons were given the opportunity to express their opinions regarding
the iequest. The publio hearing was continued to December 18, 2018.
H. The Board closed the public hearing on the t8ü day of Dece'n¡ber, 2018 to make a final
decision.
I. Tte Board on the basis of substantial compet€nt evidence produced at the
aforementionedhearing, has made the following determinations of fact:
1. Thatproperpublic notice was provided as required forthe hearing before the Board
of County Commissioners.
2. The hearing before the Boa¡d of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all interested
parties were heard at that meeting-
3. That for the above stated and other reasons the proposed Martinez
Adminishative Review Land Use Change P€rmit Application for a Small

c. Revisions to the access driveway as reflected on the Applicant's Revis€d Site Plan
inoluding legal access. The proposed 14 ft. driveway expansion that is fully located on the
Applicant's property shatl be clearly delineated on the site plan.
B. That the Applicant provide a Supplemental Engineering Report and an updated
glading ,and drainage plan to address _mitigæion for soil enosion, revegetation, soil
ãtabilizaiion, sink hole ãevelopment, and prevention of transport of materials and debris
offsite affecting down gradient property o\ilners. Said plans shall be subject to review and
æceptance by the Countyos consulting engineers and shall specifically address the
following requirements :
a. ftte ãirtwUed areas should be adequateþ revegetated and erosion protection
meas1¡€s shall be erected and remain in place until a stable vegetative cover is established.
b. Appropriate stormwater filtering must be providcd to ensure that minimal sediment
andno cooturnin*tr leave theproperly. Theuse ofdetentionponds shouldbe discouraged,
unless lined, due to sinkhole potential in the underlying geology.
c. Parking of equipment shall be p€rmitted provided that protection from transport of
contaminants iuch as oil, grease, radiator fluid, etc. shall be incorporated in the drainage
plan.
d. No petoleum products or hazardous materials shall be stored in the contractor's
yard.
g, Maintenance and repair of vehicles and salvage operations shall not be permitted
ïvithin the contractor's yard. Storage of vehicles shall be limited to operable vehicles that
are casily moved zurd not zubject to flood daruage.
10. That the Applicant shall obtain any Stormwater lvfanagement Pemrits as may be
required by the State.
ll. No additional disturbance or storage shatl be allowed within the draw located
centrally on tlre site.
12. The Applicant shall provide a noxious weed map and inventory for the property
and a noxious weed management plan that will address noxious weed treatments.
13. Consistent with. the Application submittals there shall be no lighting of the

14. The Applicant shall comply withthe Industrial Use Standards, contained in Section
7- I 001 except where waivers are approved for location within a residential subdivision and
setbacks. Compliance wíth all other standards including those regarding Industial Wasteso
Noise, Ground Vibration, Hours of Operation and Interference, Nuisance, or Hazard shall
be complied with.
15. All conditions of apprcval shall be met including completion of revegetation,
installation of soil stabilization mea$rres, and initial weed trealment within six months of
the Director's Decision but in no car¡e later than May 31, 2018.
16. If the Applicant is not able to demonsüate ongoing compliance withthe Conditions
of Approval and Land Use and Development Code, the Cormty will proceed with
withdrãwal of the Land Use Change P€rmit in accordance with Section l2-103(E) of the
Land Use and Development Code, which proc€ss will include a public hearing before the
Board of County Commissioners.
17. Prior to issuance of the Land Use Change Permit, the Applicant shall zubmit a
supplemental engineering statelnent/report on the proposed access-roadway in accordance
with the County's Roadway Waiver Policy #14-l including a determination by a qualified
engineer that the access foadway is adequate for the proposed use.

I. GENERAL PROJECT DESCRIPTION
The Applicant proposes an amendment to the conditions of approval to allow for an
extension for completion of all conditions of approval and installation of soil erosion
protection measures for the small contractor's yard. The original deadline was May 31,
2018.
II. REGULATORY PROVISIONS APPLICANT IS REQURED TO ADDRESS
Pursuant to Section 4-106 modification to a specific condition of approval implemented by a
