The applicant would ask that if the proposed response to the conditions of approval is acceptable to the County Commissioners, that approximately 45 days be given to the applicant to construct the improvements and have aftnal inspection from County Staffthat the storage uses on site are in line with a small contractor's yard, that all of the conditions of approval are met in the field, and that the revegetation procedures have been implemented. The other land use change application for this site is for development within the 100- yr floodplain. This application is also under review with County Staff and the applicant is awaiting a staff report. Any permit work to address the erosion control requirements for the proposed small contractor's yard site is dependent on a County approval of development within the I 0O-year floodplain. As a representative acting on behalf of the Martinez farrily we would like to request that a modification request be addressed at the August 13,2018 for an extension of the land use change timeline with the Garfield Cowrty Board of County Commissioners as well as to review the responses to the conditions of approval for both applications during the meeting. We would like to do this in order to have the opportunity to present how we are addressing the concems of County Stafl neighbors, and the Garfield County Board of County Commissioners. Suite 401 Glenwood Springs, CO 81601 RE:LandUse Change Application- Small Contactor's Yard Revised Erosion Control Measures Parcel I Rifle Village South Filing I Amended Plat The proposed small contractor's yard on Parcel I of the Rifle Village South Filing I subdivision will include a number of measures to prevent impacts to the neighboring properties. The contractor yard site will be maintained by the owner of Parcel I who lives on Parcel4 to the south. The operation of the contactor's yard will be limited to the storing of equipment ancl materials. The site will not include a shop where smoke, dust, and vibrations would be created other than the infrequent deliveries and departures of materials. The majority of the site slopes to the north with a slope of 2-8o/o. There is a deep draw on the west side of the proposed yard that srts 7-25 feet below the upper bench of the property. A steep ramp allows for 4WD vehicles to access this lower draw. A man made ski pond is located about 420' to the northwest of the proposed yard and at an elevation of 65' lower than the yard. There are no surface water features on Parcel l. The attached Erosion Control Plan shows the revised design relocating the yard further from the north and east properly lines as requested by the County Commissioners and Planning Staffand reducing the overall area of the yard. The area of disturbance is much smaller than the I acre minimum that would require a State of Colorado Stormwater Management Permit. The review comments required that some additional treatment be provided to protect against the transport of the contaminants to the north and east. The previous plan was to prevent concenfiation of runoffby sheet flowing to the access road to the east. However, this previous plan did not allow for the interception of contaminants. The current design has added a l' tall berm within the 5' landscape screening strip between the yard and the access road. This berm wilt direct the contractor yard's runoffnorúr to a proposed retention pond within the contactor yard setback area from the Alleman property to the norttr. The use of a pond will allow for the installation of a floating absorbent boom to collect any contaminants from the contactor's yard. The operator of the yard is also restricted from storing any petoleum products or hazardous materials and will not be allowed to perform repairs or salvage operations within the boundary ofthe contractor yard. The pond will have a 20' long lincd wcil cdgc along the east side and portions of the north edge of the pond. The weir will provide for a sheet flow out of the pond over a longer length dwing storm events so a point discharge is avoided. The retention pond will need to be inspected and maintained as necessary monthly and after every significantrunoffevent observed. This includes the removal of sediment above the liner and the verification that the weir is set level to provide the sheet flow pattem designed. The pond will have no impact on wildlife due to the 2' maximum depth. The pond liner specifications must be smong enough to prevent tearing from deer and elk hooß. The new grading plan now allows for a low point at the properly boundary to help reduce the amount of materials that may be moved dwing a major storm event. The use ofthe berm with the screening trees should also direct any materials toward the pond. The floodplain analysis of this area shows the contractor's yard in a higþ section of the mapped floodplain and there is not anticipated to be the flow depth anticipated in the FEMA maps at this point. The property owner has also agreed not to add any additional storage in the draw located to the west of the proposed confactor's yard. The site will also that secliment control fence along the properly line on the east side of the landscape screening berm, along the back of the screening berm behind the retaining wall, along the east edge of the onsite draw, and along the north property line as necessary. Erosion conffol logs will also be installed along the flowline at the west edge of the berm and in front of the sediment control fence behind the proposed retaining walls. The vegetation on the site is a mix of sage brush and weeds with poor coverage on most of the area. The applicant is proposing the reseeding of the disturbed land outside of the areas of gravel driveway with a dry seed mix specified on the erosion control plan that will be placed upon completion of the grading and then annually until the revegetation has retumed to its eiistittg coroerage. The preferred method of placement of the seed is drill seeding and is appropriate since the last effort using hydroseeding was not successfrrl.
