Specifically, floodplain development permits are needed for the Community Event Barn, and the Onsite Wastewater Treatment Facility (OWTS). A few of the lodging units were previously located in the 100-year floodplain but the intention is to move all lodging units outside of the floodplain. Regardless, this is also being addressed with this application. A. Brief Introduction and Project Narrative The Floodplain Permit Documentation presents relevant engineering information and background for the Gianinetti Spring Creek Ranch Community Event/Meeting and Lodging facilities. This application is being prepared per the Pre-application Conference Summary dated 5/2/18 including all relevant County regulations. The project site is 83.4 acres in size and is located in Garfield County abutting the northeast edge of the town of Carbondale. The site is bounded by State Highway 82 on the north and on the west is bounded by the Town of Carbondale , Corporate Limits, including the Gianinetti subdivision and the Cowen Drive right-of-way. Vicinity map included with engineering plans. The Roaring Fork River runs along the northern boundary line of the property. The property has historically been used for agricultural purposes. Current land use includes irrigated pasture’, livestock, equipment storage and agricultural accessory buildings. An agricultural barn has recently been constructed in the southern portions of the property. A gazebo/Pavilion structure along with the grass surface volleyball court and playground areas are located along the northern and northwest portions of the site. These development plans include the Event Center and guests cabin/lodging facilities. The proposed Event Center/Barn is approximately 4800 ft.² in size. The Event/Meeting facilities are intended to be used for weddings, meetings, and celebrations accommodating up to 200 persons. The lodging portion of the LUCP proposes a maximum of 12 total bedrooms composed of a mix of 1 and 2-bedroom guest cabins southeast of the existing gazebo. These cabins will range from 400 to 700 ft.² in size. Boundaries Unlimited has designed a code compliant OWTS to serve the Event/Meeting and lodging components. B. Application Forms and Related Ownership Documents The following ownership and application documentation is provided and attached to this application: • Floodplain Permit Application Form and signatures • Current Title Commitment • Letter of Authorization to represent the Gianinetti Family LLLP • Recorded Statement of Authority and relevant background documents • Agreement to Pay Form • List of Property owners within 200 feet • Mineral Rights Owners. GENERAL PROJECT DESCRIPTION The Applicant will need to obtain flood plain development permits for the Community Meeting Barn, the onsite waste water treatment facility and any lodging units located within the 100 year flood plain. Staff understands that the Applicant may choose to relocate lodging units to shift them outside the 100 year flood plain. This would remove the need for a flood plain development permit for the lodging units. Detailed mapping and elevation confirmation by the Applicant's Engineer will be required to confirm the revised locations are outside the 100 year flood plain. The Applications will also need to address any placement of fill and grading that may occur within the 100 year flood plain. II. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS Garfield County Land Use and Development Code, as amended (LUDC) including the following Sections: PRE-APPLICATION CONFERENCE SUMMARY . Section 3-301 - Floodplain Overlay Regulations Section 3-301, including but not limited to Table 3-301 Floodplain Overlay Use Restriction Table, Section 3-301(B), General Standards, Section 3-301(C) Specific Standards, and Section 3-301(E) including ensuring drainage shall not adversely impact adjacent properties. . Section 4-109 - Development in the 100 Year Floodplain, including review criteria. o Table 4-102 - Common Review Procedures and Required Notice o Table 4-201- Submittal Requirements. Section 4-203 - Submittal Requirements . Section 4-203 (O) - Flood Plain Analysis III. REVIEW PROCESS The Floodplain Development permit will be processed pursuant to Section 4-103, Administrative Review Process and consistent with Table 4-102 Common Review procedures for Floodplain Development, summarized as follows:- A. Pre-application Conference (completed) B. Application SubmittalC. Determination of Completeness D. Schedule the Director's Decision Date E. Application sent to referral agencies F. Director's Decisionl. 10 day call up period, after which the Director's Decision become final unless the decision is called up the BOCC for their review J. Once all conditions of approval have been satisfied the Flood Plain Development Permit can be issued. IV PUBLIC HEARINGS AND NOTICE Public Hearing notices shall be posted, mailed and published pursuant to Section 4-101.8. Floodplain Analysis - meeting the requirements of the Land Use and Development Code including Section 3-301, Review Criteria in Section 4-109, and Flood Plain Analysis in Section 4-203 (O). The Flood Plain Analysis needs to be completed by a qualified licensed professional engineer and needs to include the engineer's stamp. E. The Flood Plain Analysis will need to specifically address standards for placement of the proposed structures including any analyses needed to demonstrate code comPliance. F. lnformation needs to be provided on infrastructure (water, sewer, electric, etc.) to ensure that it is protected from flood waters. G. Preliminary designs for the onsite waste water treatment system need to be provided demonstrating its protection from flood waters. H. Preliminary information on the foundation designs for the Community Meeting Barn and the lodging units (if located within the 100 year flood plain) demonstrating compliance with standards and protection from flood waters needs to be provided. L lf available pre-construction elevation certificates should be provided. An additional pre-application meeting with staff is an available option to address submittal requirements and preview how key topics are addressed. Meetings with or inquiries from the Applicant's Engineer are encouraged. The Application submittal needs to include 3 hard copies of the entire Application and I Digital PDF Copy of the entíre Application (on a CD or USB Stick). Both the paper and digital copies should be split into individual sections and properly labelled. Please refer to the pre- application summary for submittal requirements that are appropriate for your Application. VI APPLICATION REVIEW FEES This application will be subject to the following fees and deposit requirements: Planning Review Fees: $ 400 (Additional Staff time charged at hourly rate of $40.50) Referral Agency Fees: $ tOO (Review fees associated with consulting engineer review) J Total Deposit:$ 400 (additionalfees to be determined by hourly rates) VII. GENERALAPPLICATIONPROCESSING The foregoing summary is advisory in nature only and is not binding on the County. The summary is based on current zoning, which is subject to change in the future, and upon factual representations that may or may not be accurate. This summary does not create a legal or vested right. The summary is valid for a six month period, after which an update should be requested. The Applicant is advised that the Application submittal once accepted by the County becomes public information and will be available (including electronically) for review by the public. Proprietary information can be redacted from documents prior to submittal.
