This is an application for an ADU on a 3 acre parcel located at 0188 Willow Lane, Carbondale.
The application is for a 9ü) square foot, one bedroom residential unit.
Water will be supplied by existing well on property which has been approved by the Basalt Water Conservancy
District. Upon approval a ¿l-hour pump test and quality test will be preformed.
An engineered OWTS desþn in accordance with Garfield County regulations will be designed upon approval of
application. The system will meet all minimum horizontal distances and set backs and will be designed for high water
table.
Proposed driveway to ADU is accessed direct from Willow Lane. Referring to Table 7-107 Roadway Design Standards
Willow Lane (after the construction of proposed unit) is a rural access road. With the proposed unit the ADT will be

with less than a 5% slope.
There are two ditches passing through the propefi the Union ditch and the Slough d¡tch. Both ditches are
unincorporated. Additionally the proposed structure is setback over 35' from any d¡tch.
The plan for the proposed ADU is a small (900 sq ft), unobtrusive, one bedroom unit which will conform to all
applicable standards of Art¡cle 7, Divisions 1,2, and 3.

I. GENERAL PROJECT DESCRIPTION
The applicant is requesting a permit for an Accessory Dwelling Unit (ADU) on a 3 acre parcel located
within the Rural zone district. The property is over the 2 acre minimum lot size for an ADU in the
Rural zone district. As the property is under 4 acres, the ADU is limited to 1500 square feet. The
Garfield County Comprehensive Plan of 2030 identifies the parcel within the Medium High
designation. This suggests a density of 2-6 acres per dwelling unit.
The property is understood to be served by an individual septic. The applicant has indicated that a
new system is to be installed, and that they are working with an engineer to ensure that the system
meets required setbacks. A demonstration that the system can located on the property should be
provided as part of the application.
It is understood that the unit would be served by an individual well on the property. The Applicant
will have to demonstrate that the existing well is legally and physically able to serve the ADU and the
primary dwelling unit. A well permit or application will need to be provided that demonstrates that
each unit on the property is legally served by water. A 4-hour pump test and water quality test are
required, but may be done as a condition of approval (however, please submit any supporting
information available). Please note that the water quality test does not need to include testing for

Alpha / Beta as it is no longer a part of the CDPHE Deluxe testing package. Similar to the 4-hour pump
test, this water quality test may be done as a condition of approval if requested in the application.
Demonstration of conformance to Section 7-107 and specifically Table 7-107, Roadway Design
Standards, needs to be provided. This demonstration should include all private driveways and roads
from the proposed ADU to public right of way. Please respond to each of the items in the Roadway
Design Standards Table (7-107) to show compliance with these parameters (ROW width, Lane width,
Shoulder width, etc.). In addition, should the access driveway cross adjacent properties before
reaching the public right of way, then easements or other demonstration of legal access needs to be
provided. Should the roadway not meet one or more of the dimensional standards identified in Table
7-107, then the Applicant will need to have a professional engineer evaluate the roadway and make
a determination as to whether it is adequate despite not meeting one or more specific stand ards.
Note: please identify which Average Daily Trip (ADT) category this access road may fall within with
each dwelling unit accessing this driveway counting as 9.57 ADT (all homes and other development
planned and existing off the driveway).
For public notice requirements, the Applicant will need to provide a list of names and mailing
addresses for all adjacent property owners within 200’ as well as the owners of the mineral estate
under the subject parcel (See attached memo from the County Attorney’s Office).
The property has been identified as having a high water table according to Garfield County mapping.
This usually requires an engineered OWTS system, which the applicant has indicated is their plan,
once the ADU has been approved. This should be addressed in the application.
The applicant has indicated that there are ditches on the property. The Land Use and Development
Code requires that ditch companies need to be included as referral agencies. The applicant should
provide contact information for any ditches on the property. A dditionally, the applicant should
respond specifically to Section 7-203 Protection of Waterbodies in the Land Use and Development
Code. Staff understands from the applicant’s representations that there may be floodplain issues on
the property. The applicant should address this as part of their submittal.
Please respond to the Standards as identified in Article 7: Standards, Division 1, 2 and 3 and for ADUs,
Section 7-701. These are the standards by which the application will be determined to be approved,
approved with conditions or denied. A short response to these items ensures that 1) the applicant
has read and understands the standards upon which a determination will be based, and 2) allows the
applicant and staff to work through any possible issues early on in the application process.

III. REVIEW PROCESS
The review process shall follow the steps as contained in Table 4-102 and Section 4-103,
Administrative Review (see attached flow chart).

request that the pump test and water quality test are completed as Conditions of
Approval.

Description of septic system (OWTS). The applicant should provide a letter from an
engineer indicating that a new OWTS could fit on the property.
Soils information (attached)
Statement and demonstration of conformance with Section 7-107, Access and Roadways
(Specifically conformance with Table 7-107 for driveway from County roadway to
proposed ADU). Provide copies of easements or other demonstration of legal access if
the driveway crosses adjacent properties. A roadway waiver is attached that must be
completed by a professional engineer if the existing roads to the property do not meet
roadway standards.
Submit three paper copies and one digital for applications. Additional copies will be
requested upon determination of completeness. See the land use code for additional
information on submittal requirements.

of the Community Development Department. The Director’s decision is subject to a 10-day call-up
period. The pre-application meeting summary is only valid for six (6) months from the date of the
written summary.

IMPACTANALYSIS
The proposed ADU is a 900 square foot one bedroom home being built for applicant's elderly father. The proposed
structure is being built on a 3 acre parcel in the Jack Sharp subdivision, a rural, single family home, residential area.
The proposed structure will be located at least 5t/ from the north and east lot lines and is obstructed from view by
existing mature spruce trees and other landscape features. The building and use of this unit should pose no glaring
nuisance or disturbance to surrounding property owners.
This property is located in a high ground water area. The proposed structure is a slab on raised compacted structural
fill over undisturbed existing grade.
The OWTS will be engineered as per Garfield County requirements. S¡nce the property is in a high ground water area,
a mound will need to be constructed. The property allows for the required setbacks. The mound will be landscaped
for aesthetic appeal.
Only naturalgrasses will be disturbed during construction and all disturbed areas will be revegetated. Due to the
available water on the property and the rich sandy loam the grass will be reestablished quickly.
This unit will not create adverse geological or environmental impacts. This unit is not a potential hazard to the
property or adjacent properties,

As requested, this letter has been prepared to be submitted to Garfield County to request a road standard waiver from
Garfield County for Willow Lane located just outside of Carbondale, Colorado. lt is our understanding that you are
requesting to add an accessory dwelling unit (ADU) to the north side of your property located at 0188 Willow Lane. lt is also
our understanding that currently there are 10 single family residences, one of which has an ADU for a total of 1 1 residences
whose driveways access Willow Lane past your property.
The Garfield County Land Use Development Code (LUDC) requires all roads within the County be designed to provide for
"adequate and safe access" and meet the minimum design standards within Section 7-107 Access and Roadways. Within
that section, Table 7-107: Roadway Standards defines the different roadway categories and the design requirements for
each. ln order to determine which category Willow Lane follows into we calculated the Design Capacity (ADT) utilizing the
lnstitute of Transportation Engineers, (lTE), Trip Generation 9th Edition. The ITE states that a single family home has an
Average Daily Trip (ADT) of 9.52 per unit on a weekday. Therefore, as Willow Lane currently exists beyond the subject lot,
there are 104.724DTs and falls into the Rural Access (101-200 ADTs) category. Adding the ADU to your property will
increase the ADTs by an additional 9,52 to a total oÍ 114.24, remaining within the Rural Access category,
As the road cunently exists, it does not meet all of the requirements of a Rural Access roadway outlined in Table 7-107:

ROW and the road is easily maintained within the ROW. lt is therefore our opinion that there is no reason
to increase the ROW width. The applicant will be seeking a waiver from this design requirement,
Lane Width-The existing gravel roadway is a total of 18.5-feet wide, equating to 9,25-foot wide lanes which
does not meet the l1-foot requirement of a rural access, HoweVer, it is ôur understanding that there have
not historically been any issues with the existing lane widths for either emergency vehicles or trash trucks
and we therefore see no reason to increase the lane widths. The applicant will be seeking a waiver from
this design requirement.
DitchWidth- Based u pon our recent site visit, there does not appear to be any existing roadside borrow
ditches associated with Willow Lane, The drainage sheet flows into adjacent fields/landscape infiltrating
into the ground which is very common in rural neighborhoods and we see no issues with drainage
remaining to function this way. The applicant will be seeking a waiver from this design requirement.
Cross glope- Based upon our recent site visit, it appears as though the existing road may not meet the
minimum 3% cross slope, However the existing surface shows no signs of rutting, soft spots or other
forms of deterioration that may result from inadequate surface slope. The applicant will be seeking a
waiver from this design standard.
Shoulder WidthlSlope-Based upon our recent site visit the existing roadway does appear to have a
shoulder. However we are not aware of any issues with the lack of shoulder and see no reason to increase
the roadway width to accommodate a shoulder. The applicant will be seeking a waiver from this design
standard.
Minimum Radius- There is one curve on Willow Lane which has approximately at 40-45' radius, which does
not meet the 8Q.foot requirement of a rural access. Based upon communication with Bill Gavette, Deputy
Chief of the Carbondale and Rural Fire Protection District, the existing radius is not a problem for their
apparatus, With life safety not being an issue, it our opinion that the existing radius is adequate. The
applicant will be seeking a waiver from this design standard.
Maximum Grade- The existing roadway has longitudinal grades less than 12%.
Surface-The existing roadway has a gravel surface which meets the requirements of a Rural Access roadway
Garfield County Policy 01-14 allows for potential waivers of specific design standards within the LUDC provided the following
criteria are met, according to Section 4-1 18:
1) An alternative design achieves the intent of the subject standard to the same or better degree;-We are
proposing no changes to the existing roadway which has functioned it its current state for many years.
It is our opinion that the road will continue to function well even with the addition of one ADU.
The proposed alternative will impose no greater impacts on adjacent properties than would occur through
compliance with the specifìc standard. -lt is our opinion that upgrading the existing roadway to meet the
County Standards will impose greater impacts on the adjacent properties than allowing it to remain as
is.

Dear Mr- Trede:
On March 13, 2018, the Board of Directors of the Basalt Water Consewancy District
approved your application for a water allotment contract. I enclose three allotment contracts to
each of .which is attached the Districls Order granting the application. Please execute the
enclosed contracts before a notary and refurn one (1) fully executed signed contract to me (vou
should keep one copy for your records, and another for obtaining a valid well permit, if needed,
for water releases under the contract). The effective date of the contract will be the date of the
Order granting application, but deliveries will not be made under the contract until we have
received a fully signed copy.
Your particular attention is directed to the conditions to which the allotment contract is
subiect, induding as set forth in the Districfs Order. Please read these documents carefully; as
they contain requirements that you must satisfy before the District will deliver water under the
contract. Also enclosed is a notice regarding the requirement of a valid well perrnit for water
releases under the contract. A Memorandum of Water Contract, a copv of which is
attached, vr'ill need to be executed by you, notarized, returned to me along with a check in the
amount of $18.00 made payable to the Gartield County Clerk and Recorder and we will ttren
the same in Garfieid
Please refer to paragraph 3 of the Contract. In vou¡ application for this contract, you
requested to be inciuded in the District's umbrella plan for augmentation decreed in Case No.
02CW77 ("Umbrella Plan"). The Dstrict obtained this court-approved Urnbrella Plan for the
benefit of contractees like yourself, and the decree in this case allows the District to augment the
depletions associated with your water use with the supplies available under this water contract.
The District has assessed $1,200.00 to include the water supply and services under this contract
within the Umbrella PIan. Additional information regarding the Umbrella Plan and its puqpose
is contained on the enclosed three-page memorandum from Resource Engineering, Inc. Please
retum a check payable to the District in this amount with the signed documents. If you require

does not assure the applicant that no injury will occur to enother vested water righl or jreclude another owner of a vested

of a variance has been granted Þy the state Board of Examiners of waterwell construstion and pump lnstallation

3) Approved pursuant to cRS 37-92-602(3)(c) for the relocation of an existing well, perm¡t no. 235460. The otd well must beplugged in accordance with Rule 16 of the Water well Conslruction Rules within ninety (9O) days of completion of the newwell. The enclosed WellAbandonment Report form must be complêted and submitted to affirm hal the old wellwasplugged.
4) The use of ground water from this well is limited to fire prolection, ordinary household purposes inside not more than one(1) single family dwelling, the watering of poultry, domestic animals and livestock on a farm or ranch and the irrigation ofnot more than 5,000 squale feet of home gardens and lawns. This well is located on a 3.0 acre trac{ being idenlilTed as0188 Willow Lane, Carbondale, CO 8162A.
5) The maximum pumping rate of this well shall not exceed 15 GpM.6) This well shall be constructed nol more than 200 feet from the location specified on this permit.

As requested, ALL SERVIGE septic, LLC is submitting a proposalfor a subsurface investigation and an
onsite wastewaterteaÍnent system (OWTS) design for a single family residenæ.
ALL SERVICE septic, LLC proposes to conduct a subsurface investigalion and prepare an OlIt/TS design
according to Gunnison County regulations. The design will take approximately 15 business da¡rs to
complete after receipt of the signed proposal and results from the subsurface investigation. The design
package, stamped by a registered professional engineer, will be delivered by email as a pdf llle unless
another format ls requested. Hard copies will be provided, upon request. An installation obsen¡ation
report is required by Gunnison County upon installation of the OWTS. Assuranæ of installation in
accordance wilh design specificalions and best installation practices will be dependent on severalfactors,
including, but not limited to experlise of the installer, design ænsiderations, weather ændilions, and soil
