The application is for a 9ü) square foot, one bedroom residential unit. Water will be supplied by existing well on property which has been approved by the Basalt Water Conservancy District. Upon approval a ¿l-hour pump test and quality test will be preformed. An engineered OWTS desþn in accordance with Garfield County regulations will be designed upon approval of application. The system will meet all minimum horizontal distances and set backs and will be designed for high water table. Proposed driveway to ADU is accessed direct from Willow Lane. Referring to Table 7-107 Roadway Design Standards Willow Lane (after the construction of proposed unit) is a rural access road. With the proposed unit the ADT will be 105.27. Willow Lane is a flat gravel road measuring 18'w¡th grassy shoulders on both sides measuringT'at minimum, with less than a 5% slope. There are two ditches passing through the propefi the Union ditch and the Slough d¡tch. Both ditches are unincorporated. Additionally the proposed structure is setback over 35' from any d¡tch. The plan for the proposed ADU is a small (900 sq ft), unobtrusive, one bedroom unit which will conform to all applicable standards of Art¡cle 7, Divisions 1,2, and 3. lncluding little disturbance to existing landscape and the revegetation of disturbed areas with drought resistance grasses. GENERAL PROJECT DESCRIPTION The applicant is requesting a permit for an Accessory Dwelling Unit (ADU) on a 3 acre parcel located within the Rural zone district. The property is over the 2 acre minimum lot size for an ADU in the Rural zone district. As the property is under 4 acres, the ADU is limited to 1500 square feet. The Garfield County Comprehensive Plan of 2030 identifies the parcel within the Medium High designation. This suggests a density of 2-6 acres per dwelling unit. The property is understood to be served by an individual septic. The applicant has indicated that a new system is to be installed, and that they are working with an engineer to ensure that the system meets required setbacks. A demonstration that the system can located on the property should be provided as part of the application. It is understood that the unit would be served by an individual well on the property. The Applicant will have to demonstrate that the existing well is legally and physically able to serve the ADU and the primary dwelling unit. A well permit or application will need to be provided that demonstrates that each unit on the property is legally served by water. A 4-hour pump test and water quality test are required, but may be done as a condition of approval (however, please submit any supporting information available). Please note that the water quality test does not need to include testing for 2 Alpha / Beta as it is no longer a part of the CDPHE Deluxe testing package. Similar to the 4-hour pump test, this water quality test may be done as a condition of approval if requested in the application. Demonstration of conformance to Section 7-107 and specifically Table 7-107, Roadway Design Standards, needs to be provided. This demonstration should include all private driveways and roads from the proposed ADU to public right of way. Please respond to each of the items in the Roadway Design Standards Table (7-107) to show compliance with these parameters (ROW width, Lane width, Shoulder width, etc.). In addition, should the access driveway cross adjacent properties before reaching the public right of way, then easements or other demonstration of legal access needs to be provided. Should the roadway not meet one or more of the dimensional standards identified in Table 7-107, then the Applicant will need to have a professional engineer evaluate the roadway and make a determination as to whether it is adequate despite not meeting one or more specific stand ards. Note: please identify which Average Daily Trip (ADT) category this access road may fall within with each dwelling unit accessing this driveway counting as 9.57 ADT (all homes and other development planned and existing off the driveway). For public notice requirements, the Applicant will need to provide a list of names and mailing addresses for all adjacent property owners within 200’ as well as the owners of the mineral estate under the subject parcel (See attached memo from the County Attorney’s Office). The property has been identified as having a high water table according to Garfield County mapping. This usually requires an engineered OWTS system, which the applicant has indicated is their plan, once the ADU has been approved. This should be addressed in the application. The applicant has indicated that there are ditches on the property. The Land Use and Development Code requires that ditch companies need to be included as referral agencies. The applicant should provide contact information for any ditches on the property. A dditionally, the applicant should respond specifically to Section 7-203 Protection of Waterbodies in the Land Use and Development Code. Staff understands from the applicant’s representations that there may be floodplain issues on the property. The applicant should address this as part of their submittal. Please respond to the Standards as identified in Article 7: Standards, Division 1, 2 and 3 and for ADUs, Section 7-701. These are the standards by which the application will be determined to be approved, approved with conditions or denied. A short response to these items ensures that 1) the applicant has read and understands the standards upon which a determination will be based, and 2) allows the applicant and staff to work through any possible issues early on in the application process. II. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS  Garfield County Comprehensive Plan 2030 (Designated Medium High, 2-6 Dwelling Units per acre)  Garfield County Land Use and Development Code, effective July 15, 2013  Accessory Dwelling Unit (7-701), following Administrative Review (Section 4-103)  Table 4-102, Common Review Procedures and Required Notice;  Table 4-201, Application Submittal Requirements 3 III. REVIEW PROCESS The review process shall follow the steps as contained in Table 4-102 and Section 4-103, Administrative Review (see attached flow chart). SUBMITTAL REQUIREMENTS Please refer directly to Table 4-201 and the list of General Application Materials in section 4-203. These application materials are generally summarized below:  Application Form  General project description  Vicinity Map  Ownership Documentation (deed)  Fee Payment and Payment Agreement Form  Pre-Application Conference Summary  Names and addresses of all property owners within 200 feet of subject parcel and all mineral owners under the subject parcel (demonstrated through a search of Clerk and Recorders database and/or Assessors database – Adjacent property owners can be conducted using the Garfield County Geographic Information System website at http://gis.garfield- county.com/LandExplorer/index.html and use Buffer Tool to 200’ from subject parcel).  Improvements Agreement / Development Agreement (may be waived upon request)  Site Plan  Grading and Drainage Plan demonstrating positive drainage off the site (topo map)  Impact Analysis – Please respond to the identified impacts in Section 4-203(G)  The applicant indicated that floodplain could be a potential issue on the property. Additional information should be submitted regarding floodplain.  The Applicant should supply contact information for any ditch companies that are located on the property.  Copy of Code, Covenants, Restrictions (if applicable)  Respond to Standards fully described in Article 7, Divisions 1 -3 and, for an ADU Article 7, Section 701.  The applicant should specifically address the waterbody setback on the property.  Demonstration of Legal and Physical Water (Well permit or applciation, augmentation plan, 4-hour pump test, and water quality test per Section 4-203(M)). The applicant may request that the pump test and water quality test are completed as Conditions of Approval. 4  Description of septic system (OWTS). The applicant should provide a letter from an engineer indicating that a new OWTS could fit on the property.  Soils information (attached)  Statement and demonstration of conformance with Section 7-107, Access and Roadways (Specifically conformance with Table 7-107 for driveway from County roadway to proposed ADU). Provide copies of easements or other demonstration of legal access if the driveway crosses adjacent properties. A roadway waiver is attached that must be completed by a professional engineer if the existing roads to the property do not meet roadway standards. Submit three paper copies and one digital for applications. Additional copies will be requested upon determination of completeness. See the land use code for additional information on submittal requirements. IV. APPLICATION REVIEW a. DitchWidth- Based u pon our recent site visit, there does not appear to be any existing roadside borrow ditches associated with Willow Lane, The drainage sheet flows into adjacent fields/landscape infiltrating into the ground which is very common in rural neighborhoods and we see no issues with drainage remaining to function this way. The applicant will be seeking a waiver from this design requirement. Cross glope- Based upon our recent site visit, it appears as though the existing road may not meet the minimum 3% cross slope, However the existing surface shows no signs of rutting, soft spots or other forms of deterioration that may result from inadequate surface slope. The applicant will be seeking a waiver from this design standard. Shoulder WidthlSlope-Based upon our recent site visit the existing roadway does appear to have a shoulder. However we are not aware of any issues with the lack of shoulder and see no reason to increase the roadway width to accommodate a shoulder. The applicant will be seeking a waiver from this design standard. Minimum Radius- There is one curve on Willow Lane which has approximately at 40-45' radius, which does not meet the 8Q.foot requirement of a rural access. Based upon communication with Bill Gavette, Deputy Chief of the Carbondale and Rural Fire Protection District, the existing radius is not a problem for their apparatus, With life safety not being an issue, it our opinion that the existing radius is adequate. The applicant will be seeking a waiver from this design standard. Maximum Grade- The existing roadway has longitudinal grades less than 12%. Surface-The existing roadway has a gravel surface which meets the requirements of a Rural Access roadway Garfield County Policy 01-14 allows for potential waivers of specific design standards within the LUDC provided the following criteria are met, according to Section 4-1 18: 1) An alternative design achieves the intent of the subject standard to the same or better degree;-We are proposing no changes to the existing roadway which has functioned it its current state for many years. It is our opinion that the road will continue to function well even with the addition of one ADU.
