Project Description:
We are Bruce and Pam Wood, we own Above lt All Balloon Co., lnc. We have been
providing hot air balloon rides to area locals and visitors for over Z?years; we have also
assisted in balloon festivals within the valley for many of those years. We have always
operated out of our home as a home occupation, answering phones and ma¡ntaining an
otfice within our home. We want to store our equipment on the same property that we
live, it will prevent us from additional trips along highway 82, thus reducing tratfic in the
area. We expect to have 6-8 trips per day which are not much increase from a typical
single family dwelling.
We have purchased this property located at 16695 Highway 82; it has a rural residential
existing use with a single family home, adu and an artist studio aþove the three car
garage. We intend to live and work here while storing our vehicles and trailers on the
property, the best category we could fit in is the small contractors storage yard. We plan
to park 6 enclosed utility trailers with six hot air balloons in them, along with 4 vans and
trucks used to tow the trailers when necessary. Typically we are utilizing 1-3 vehicles
and 1-2 trailers each day throughout the Summer; Fall, Winter and Spring are not as
busy so activity is not as frequent. We willfuel hot air balloons with propane on the
property. Hot air balloons have been fueled in this manner for many decades; we are
very careful and follow all safety requirements. We would like to place the storage lot
area on the West side of the property, it is the best location as it is flat and does not
have many trees. This area will require a waiver since the properly is long and narrow
and this area is adjacent to a neighbor's driveway easement. We intend to use the
western most entrance for the small contractor's storage yard. We applied for an
access permit with CDOI thus updating the previous access permit from 1991, copies
are included. On April 14,2018 we received the access permit from Daniel Roussin
with CDOT. A copy is included, CDOT ís granting access as long as we widen the
access to 25 feet and pave the access for 20 feet. We would also like to build a þarn/
building along the northwest edge of the property within the small contractor's storage
yard. This building will conceal the yard from the frontage road while blocking some
highway noise for our property. Our contractors storage yard will be considered an
unmanned facility; we will not be hosting customers and our employees will be limited to
4 people, most of whom live on the property. We will install a 6'fence along the south
side of the storage yard while the rest has several trees and berms that disguise much
of the area from the neighbors. We will add green fabric along the fence if necessary to
hide the vehicles but most of the view is already blocked by trees and berms. We
intend to place the propane tank a little further east on the property where it will be
hidden from view and farther from neighboring properties. This location for the propane
tank will not require a waiver. There is an existing berm separating the driveway from
the proposed tank location. The tank will be installed and maintained by Ferrellgas.

2. The Applicant understands and agrees that Garfield County Resolution No. 20L4-60, as
amended, establishes a fee schedule for each type application, and the guidelines for the
administration of the fee structure.
3. The Applicant and the County agree that because ofthe size, nature or scope ofthe
proposed project, it ¡s not possible at this time to ascertain the full extent of the costs
involved in processing the application. The Applicant agrees to make payment of the Base
Fee, established for the Project, and to thereafter permit additional costs to be billed to the
Applicant. The Applicant agrees to make additional payments upon notification by the
County, when they are necessary, as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the
consideration of an application or additional County staff time or expense not covered by
the Base Fee. lf actual recorded costs exceed the initial Base Fee, the Applicant shall pay
additional billings to the County to reimburse the County for the processing of the Project.
The Applicant acknowledges that all billing shall be paid prior to the final considerat¡on by

Mineral Rights:
On April 5,2018 Pam Wood visited the Garfield County Clerk and !_ecgrder's otfice and
researched the mineral rights for 16695 Highway 82 Carbondale, CO 81629. Bev
assisted her in researching the oil and gas leases that were attached to my title worlc on
the property. There ïì,ere no mineral rights declared on the title work received from the
sale transaôtion. The title work did show an oil and gas lease between Theodore Cerise
(lessor) and Joe T. Juhan (lessee) dated Dec. 1, 1936 and signed on Aug. 26, 1937,
w¡tn¡n a tract of land that may contain the current parcel of 16695 Highway 82
Carbondale, CO. 81623. The may contain comment is due to the lease stating Sec 31
lotl andSecS2 |ots3,4,6,11,& 12andastripof theeasts¡deof lotsS&13, The16695
Highway 82 property is Sec 32, lots 6, 7, & 19. Title work also showed an oil and gas
leãse OáteO May 13, 1960 þetween Floyd A Johnson&Katherine A Johnson (lessor) alq
Francis W. Chriêtensen (lessee); this lease may also involve the current parcel of 16695
Highway 82. The reason that it seems uncertain is the documents sight Sec 31 lot 1
anã Seó 32 bts 3&4 and part of lots 5,6,11 ,12,13; the 16695 Highway 82 properly is in
sec 32 lots 6,7,&19. Francis W. Christensen then assigned the lease to Pan American
Petroleum Corporation on July 11, 1960.
On June 22,1979 Floyd A. Johnson, now a widower, sells and quit claims to Harvey
Finks, Trustee of the Floyd Albert Johnson Revocable Trust dated Oct. 16, 1978 all of
the right, title and interest of the Grantor in and to all of the minerals and mineral rights
which he owns in Garfield County, Colorado. On Auguslz7, 1981 Harvey Finks,
Trustee of the Floyd Albert Johnson Revocable Trust dated Oct. 16, 1978 signed a
Deed providing the right of entry to the following property A tract of land situated in lots 4
and 5 of Sectión 32, Township 7, South, southerly of and adjacent to the Northerly
boundary line of said Lot 4 being more particularly described...to Portia A Carlson
The addiess that was found for Mr. Harvey Finks, Trustee of the Floyd Albert Johnson
Revocable Trust is PO Box 1897 Sun CiIy, A285372. Upon research of Ms. Portia A
Carlson no address was found beyond Garfield County Colorado.

CONSTRUCTION
1. Construct¡on may not begin until a Notice to proceed isapproved. (Code subsection 2.41
2. The conslruction of the access and its appurtenances as
required by the Terms and conditions of the'permit shall becompfeted at the expensê of the permittee excêpt âsprovided in subsection 2.j4. All materials used iñ theconstruction of the access within the highway right-of-way oron permanent easements, become public property. Ânyrnatsrials removed from the highway right-óf_way *iff nå,disposed,ol onty as directed by the Dåpañment. Atif;;ing,guard rail, träffic control devices and bther equipment anä

CHANGES IN ACCESS USE AND PEHMIT VIOLATIONS
1. lt is ihe responsibility of the property owner and
oermittee to ensurè that the use of the access to the property
ir noiìnuiàfution of the Çode, permit terms and conditions or
the Act. The terms and conditions of any permit are binding
uþon all assigns, successors-in-inlerest, heirs and

Gradlng and drainage Plans:
The property already has a dry well that has been set up to dra¡n any excess water on
the property. No further grading or drainage plans are necessary as we will be keeping
the existing drainage plan in force. We will add gravel to the already flat areas where
the vehicleê will bsstored. The storage yard area is a high flat level area on the West
side of the property, it has adequate drainage to lower ditch lines along the property.

cDoT has recenfly granted an Access Permit No. 318034 for the proposed use of a
Small Contractor's Storage Yard for 16695 Highway 82 Carbondale, CO 81623, copy is
included.
16695 Highway 82 Carbondale, CO 81623 is located near Catherine's Store which is
considerãd an existing Village Center, according to the Garfield County Comprehensive
Plan 2030 , pg24,31, and future land use map. The property is along highway 82, of
which construction yards, equipment repair, and storage yards have been
recommended to bá within close proximity to highway 82 or 170, to be considered as the
Rural Employment Centers, sited also from page 24. This property is in an area that
could be ðonsidered Mixed-use; with the Waldorf school located .5 miles West,
Catherine Store 1 mile West, Alpíne Animal Hospital 1 mile East, Crown Mountain Park
about 2.3 miles East, and a variety of homes and properties with a wide range of
outdoor storage and business/commercial/agricultural uses. The surrounding properties
of the proposıd contractor's storage yard are homes, a school, a polo facility and other
agricuituràUcommercial mixed use properties. The proposed contractors yard will
function as a storage facility for a small business owner's equipment. The barn
structure, once it hás been built, will be used to repair equipment as needed while
providing storage when necessary. We will have a small office within the structure that
wiU navãa batllroom facility for employee use when necessary. We plan to fuel hot air
balloons on the property with propane. We have been fueling balloons in this manner
for over 20 years, we aie very careful and follow all safety reguiremellg. We intend to
place the piopane tank a littlé further East on the property where it will be hidden from
v¡ew and iartñer from the few neighboring propert¡es. This location for the propane tank
will not require any waivers.

The proposedärea for the SmallContractors Storage Yard is a high.flatarea with gentle
åbó¡;g i"p"grapny áway from the yard to the West and South. To the East of the yard
anå in-troñt ıt tneihree bar garagsthere is a dry well that provides adequate drainage
and will continue to be utilized añd maintained. The area has grass and other
vàgetation that helps to maintain proper drainage and protection from erosion. we are
cuirently adding gävetto the driveways on the property to reduce any risk of erosion.
7 -2O5. Environmental Quality
We shall adhere to the a¡r añd water quality standards. The propane tank will be
installed by professionals from Ferrellgas or another propane gas provider and only
utilized nyþiopane fueling certificated-personnel. This tank is just like any tank one
might install for the use of their dwelling.
7-206. Wildfire Hazards
The property is not within a severe wildfire area. The land use change will not increase
tfre ¡jotent¡ai or duration of a wildfire, or adversely atfect wildfire behavior or fuel
composition. The roof on the future building will be metal or asphalt shingle.
7-207. Natural and Geological Hazards
We will adhere to any reqúirements; otherwise there are no known hazards to the
property.
7-208. Fìeclamation and Disturbed Areas
We willfollow all recommendations to restore a natural appearance to all areas that are
disturbed during the building and set up of the Small Contractors Storage Yard and
building. lf we ñave to make any changes to the existing driveway we will also insure
that al¡?isturbed areas shall he ievegetated to a desired plant community with
compos¡tion of weed-free species and plant cover typica¡ to the site.

We intend tó ptace the fúture building at the northwest location on the property to take,
advantage of solar south-facing gain with future plans to install solar panels on the roof.

We will adhere to ai¡ standards within this section as applicable. We will revegetate any
area that is disturbed and continue to maintain all existing vegetation. We might have to
remove some vegetation along the driveway if required by CDOT'

The proposal needs to demonstrate compliance with Sectlon 7-1001 standards
including setbacks (unless waivers are requested) and screening.
A. Residential Subdlvislons - This parcel number 2391-322-00-006 is not in a platted
subdivision.
B. Setbacks - The 2.09 acres have approximately 600+ feet of highway 82 frontage
road and is only 150 feet deep; this influences the setbacks required for 7-1001 B.
This is why we are requesting a waiver, as the stCIrage yard area is within 100 feet of
a neighboiing driveway easement, The storage area is still a considerable area from
the aótual dwellings of those neighboring properties. The area is hidden
considerably by trèes and the properly is slightly higher than the neighboring
properties, inuð it is more concealed from their viewpoints. We can build a fence
ärolnO the storage yard to conceal it from any neighbors. We willfollow all other
requirements of Section 7-1001 . Viewpoint photos are included'
C. Concealing and Screening - There is a fair amount of existing screening 9f þ9rm¡.

D. Storing - All materiáb stored will be in a manner that will not be transferred otf the
proper[r. All products will be stored in compliance_with all national, state and local
codes. We are requesting a waiver for the Small Contractors Storage yard as it will
be within 100 feet d tne ad¡acent driveway easement. The propane tank used for
fueling the balloons, which is like any propane tank used on a rural/residential
property, will þe mainta¡ned and kept up to date with all standards and safety
ieqirirements. The propane tank will be on the north side of the property so no
waiver is needed toi ¡ts location. Photos of proposed area for propane tank included.
we will store approximately six hot air balloons in six enclosed trailers and three to
four vans and irucXs in thestorage yard. We will be using 2-4 vans and trailers each
day throughout the Summer, mucfi iess during the Fall, Winter and Spring. We will
nave an otfice in the building, once it is built, of which approximately 1-4 employees
willwork. The employees witt be living on site in the residentialdwellings already
existing on the property. Most business is conducted during the summer with much
less aãtivity duiing the remaining I months of the year, ln the rare event that an
employee ärrive ty vehicle we w¡ll have parking spaces available in the storage yard,
there will be no street Parking.
E, lndustrial Wastes - Any industrial wastes will be recycled following all standards.
F. Nolse - No significant noise will be allowed on site.
G. Ground Vlbration - No ground vibration is expected to be onsite.
H. Hours of Operation - Añy activity that will generate noise, odors or glare beyond the
property line will be conducted between the hours of 7am and 7pm.
l. intérrcience, Nuisancen or Hazard - We do not expect to cause any of these issues
and we willfollow this standard.

Section 4-118 Waiver of Standards
The proposed alternative achieves the intent of the subiect standard to the same or
better degree than the subject standard.
The proposed alternative imposes no greater impacts on adjacent properties than would
occur through compliance with the specific requirements of this Code.
Waiver of Standards Requested for Section 7-1001 B' Setbacks
We request a waiver to the setback reguirement of the minimum 100 feet from an
adjacent residential property line. The property line in quest¡on is a driveway access to
thé neighboring residences. The access corridor is approximately 25-50 feet wide and
the neighboring homes are an additional 25-100's of feetfartherfrom the corridor. We
intend to place a fence along our property line, which is an allowed use, and the storage
yard will be along the dr¡veway corridor on the Western most portion of the property.
The property', as stated previously, is only 150 feet deep with many healthy older trees.
Unless we place the storage yard along Highway 82 on the North side of the property
and cut down many trees we are unable to adhere to the standard setback
requirements. This North location would still be close to needing a waiver of standards
due to the limited width of the property. Placing the storage yard within 100 feet of the
adjacent property lines to the east of the property will not be any different than placing it
as a narrow yard along highway 82. lt may actually be more visible on the north side
rather than the west side of the property, as the western area has a berm and trees
providing natural vegetation to disguise the yard. Viewpoint photos have been included.
