RANCHES RANCH 17) 35.87acres County Road 120 Rural Approval with Conditions I. BACKGROUND. PROCESS A requestwas received on September 28,2016 forAdministrative Review of an Accessory Dwelling Unit (ADU) to be located approximately 5 miles east of Glenwood Springs at727 County Road 120 (Lot 17 of Lookout Mountain Ranches). The ADU has been constructed without necessary Building or Land Use Permits and was issued a Notice of Violation. This application for a Land Use Change Permit is to correct this zoning violation. A request for an ADU in the Rural Zone District is an Administrative Review pursuant to Section 4-103 of the Garfield County 2013 Land and Development Code, as amended (LUDC). This process grants the decision-making authority to the Director of Community Development. This process also allows for call-up of that decision for review by the Board of County Commissioners. A Director Decision of approval with conditions was issued on Decembet 12,2016 and a request for call-up was received from Wayne Rudd, an adjacent property owner, on December 22,2016. Due to certain water rights issues identified during the application review, the approval requires that adequate and legalwater be obtained. As a result, the Directors Determination included one Condition of Approval to be satisfied prior to issuance of the Land Use Permit, which is to obtain a new well permit, drill a new well and test the water from that well in accordance with the requirements of the LUDC. The Board of County Commissioner's then reconsidered the Directors Determination in accordance with Section4-112 of the Land Use and Development Code in a noticed public hearing on March 61h,2017. The outcome of this hearing is memorialized in Resolution 2017-14. ln accordance with Condition 1(a), the property owner has decided to drill a newwell on the property to provide legal and adequate water to the primary dwelling unit while the existing well will be utilized to serve the ADU. Since the March 6, 2017 hearing, the property owner has provided an explanation as to how each dwelling unit on the property will be served by water (Exhibit 5 - Condition 1(a)(i) of Resolution2OlT-14), a 4-hour pump test (Exhibit 6 - Condition 1(a)(iii) of Resolution 2017-14), and a water quality test (Exhibit 7 - Condition 1(a)(iv) of Resolution 2017-14). Staff understands that a monitoring well permit has been issued, but the final well permit from the Division of Water Resources has not yet been issued (Condition 1(a)(ii) of Resolution2OlT-14). While the Applicant has obtained a monitoring well permit, the finalwell permit has not yet been issued. As is explained in the request for extension from the Applicant, issuance of this well permit is expected by the end of May. As a result, an extension to the end of May to obtain the final well permit from the Division of Water Resources has been requested. II. STAFF RECOMMENDATION Considering the progress that has been made to obtain the appropriate permits and satisfy the conditions of approval, such a request appears reasonable to Staff. As a result, Staff recommends that Condition 1 of Resolution 2017-14 be amended as follows. Conditions Prior to lssuance of the Land Use Chanoe Permit: 1. Obtain a well permit and drill a new well as permitted by the State of Colorado Division of Water Resources for the proposed ADU per Garfield County regulations. Prior to issuance of the Land Use Change Permit, the Applicant shall provide the following information and documents. This information and documents shall be reviewed and accepted by the Community Development Department and designated engineer.i. An explanation as to how each dwelling unit on the property will be served by water and how these wells are impacted by any well sharing agreements and/or split ownership.ii. The approved well permit for the well to serve the ADU from the Division of Water Resources.iii. A 4-hour pump test for the new well in conformance with Section 4- 203(MX1XbXs)iv. A water quality test for the new well in conformance with Section 4- 203(MX1XbXs) III. PUBLIC COMMENTS No further public comments were received as a result of the public notice for this extension request. M. RECOMMENDED FINDINGS 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners. 2. The hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at a the meeting. 3. That for the above stated and other reasons the proposed Land Use Change Permit for the Leable Accessory Dwelling Unit is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the proposed Accessory Dwelling Unit is in conformance with the Comprehensive Plan of 2030, as amended. The Board is authorized to approve, deny or approve with conditions an Administrative Review Land Use Change Permit that has been called up to the Board. The application then will result in issuance of a Land Use Change Permit pursuant to the Garfield County Land Use and Development Code, as amended. F. The Board of County Commissioners opened a public hearing on the 6ft day of Marctu 2017 for consideration of whether the proposed Land Use Change Permit should be granted or denied, during which hearing the public and interested persons were given the opportunity to express their opinions regarding the request. We are asking to be extended through the end of May to allow for the state to issue us our final well production permit. We anticipate receiving our permit as soon as the next three weeks, but according to Dwight Whitehead at the state, they are not obligated to act for up to six weeks, which is the ultimate reason for our extension. We have turned everything in as requested, but sadly the process takes longer than was anticipated to complete. We will be using the existing water well, that is a shared well with Wayne Rudd, permit# 202863, to service the domestic water needs at our new ADU location. Through this configuration, there will be no conflicts of interest between the well sharing agreement and the final users. Furthermore, through our new legal "Leable Well" usage description, we could use it as the Solo Source of water for up to 3 dwellings, agricultural, and landscape needs as allowed under an exempt well permit by the State of Colorado. We do not want to do this however, because we want to keep our water rights open / in use and valid with respect to the shared well / shared well agreement we purchased with our land purchase in 2OO7 . (RESOURCE) analped the water quality of a new well (a/Ua Leable Well) for your Garfield County Land Use Application. This letter report presents the technical analysis of the water quality for the Leable Well located on Ranch 17 Lookout Mountain Ranches, commonly known as727 County Road 120, Glenwood Springs, Colorado. More specifically, the Leable Well is located in the NW1/4, NW1/4, Section 19, Township 6 South, Range 88 West of the 6th P.M. at a distance of 1,100 feet from the North section line and 495 feet from the West section line. WATER QUALITY A water sample for the existing well was obtained by RESOURCE on February 22,2018. The sample was shipped by overnight delivery under proper chain of custody to Colorado Analytical Laboratories, lnc. (results attached). ln accordance with the criteria established by the Garfield County Land Use and Development Code, the well was tested for inorganic compounds including metals, coliform, alkalinity, corrosivity, hardness, pH, total dissolved solids, and radionuclides. The attached results indicate that the well water meets the basic EPA primary and secondary drinking water standards. The water quality results show several parameters that result in taste and aesthetic issues related to hardness. The well water hardness is 163 mg/|, which is considered hard. The hard water can cause scale to build up in boilers, water heaters, and on water fixtures, and lessen effectiveness of soaps. Although the water is hard, it is also slightly corrosive and could result in long term corrosion of metal pipes and fixtures. CONCLUSION The laboratory results for the water quality analysis indicate that the water meets all primary and secondary drinking water standards.
