I. DESCRIPTION OF THE PROPOSAL
The Applicant is requesting a permit for an Accessory Dwelling Unit (ADU) on a 35.87
acre parcel located within the Rural zone district. As the properly is over 4 acres, the ADU
is limited to 3,000 square feet. The Glenwood Springs Comprehensive Plan identifies the
property as Low Density Residential (<10 acres/dwelling unit). Access to the site is an
existing driveway and private roadways f rom County Road 120. The site has adequate
areas for off-street parking and snow storage for the proposed ADU and other existing
uses on the property,
The ADU to be permitted is an existing 1 ,134 square foot single family home. A separate
primary single family home exists on the property as well. Documentation for legal and
adequate water, access, and an adequately sized Onsite Wastewater Treatment System
(OWTS) have been provided for the ADU.
A letter from Wayne Rudd, an adjacent property owner, was submitted on October 14,
2016 (See Exhibit 6). This letter expressed concerns regarding a restriction on ADUs in
the Lookout Mountain Ranches Covenants, Conditions, and Restrictions (See Exhibit 7)
as well as ownership of the water well located on the subject parcel.
II. DESCRIPTION OF THE SITE
The site is currently developed with one single family primary dwelling unit and one single
family ADU. The ADU was built without the necessary Land Use Permit, which this
application is intended to rectify. The property appears to have positive drainage and is
a mix of graded areas and native vegetation with moderate slopes. Uses within 1500 feet
include primarily residential and agricultural.

III. WAIVER REQUESTS FROM STANDARDS
The Applicant has not requested any waivers from the Standards'
IV. AUTHORITY - APPLICABLE REGULATIONS
A. The Land Use Tables contained in Section 3-403 of the Land Use and
Development Code, designates an Accessory Dwelling Unit within the Rural zone district
as requiring Administrative Review.
B. Section 4-103 of the Land Use and Development Code sets forth the
Administrative Review Procedures by which the current Application is being considered.
C. The Application submittal requests two waivers from submittal requirements.
These waiver requests are from submittal requirements included an improvements
agreement and development agreement. Submittalwaivers have been accepted as paft
of the completeness review.
D. Article 7 of the Land Use and Development Code sets forth General approval
standards in Division 1, General Resource Protection Standards in Division 2 and Site
Planning and Development Standards in Division 3. Accessory Dwelling Units are also
subject to Section 7-701. The standards are addressed in the Application submittals and
in the Staff Analysis section of the Staff Report.
V. PUBLIC AND REFERRAL COMMENTS
The Applicant has provided documentation that all required notice mailings have been
completed in accordance with the LUDC. One letter of Public Comments was received
for this application, which is outlined below. Referral Comments received on the
Application are attached as Exhibits and summarized below:
A. Garfield County Consulting Engineer, Chris Hale, Mountain Cross Engineering
(Exhibit 4): Mr. Hale noted that "The review generated no comments."
B. Colorado Division of Water Resources (DWR) (Exhibit 5):
According to our records, Well Permit No. 202863 was issued on June 27,
1997, for an existing well located in the NEl/4 of the NWl/4 of Section 19,
Twp. 6 South, Rng. 88 West. The use of groundwater from the well was
approved for ordinary household purposes inside 3 single family dwellings,
the irrigation of 1 acre of home gardens and lawns, and the watering of
domestic animals. The pumping rate of this well shall not exceed 15 gpm.
Per our records, the well was constructed on 5/8/1997 to a depth of 453
feet, under monitoring hole notice MH-30367, and the current permit is valid.
The applicant's land use change request indicates that the well currently
serues a single family residence and ADU. The ADU would be considered,
for the purposes of well permitting, to be an additional single family dwelling.
As tong as the uses of the well do not exceed those allowed under the
permit, this office has no obiection to the well also seruing the ADU.
C. Garfield County Road and Bridge (Exhibit 3): Road and Bridge has no concerns
with the request.
D. Wayne Rudd, Adjacent Propefty Owner (Exhibit 6): This letter expresses concerns
regarding a restriction on ADUs in the Lookout Mountain Ranches Covenants, Conditions,
and Restrictions (See Exhibit 7) as well as ownership of the water well located on the
subject parcel (See Exhibits 8,9, and 10).
VI. STAFF ANALYSIS
Article 7, Division 1: General Standards
1. Section 7-101: Compliance with Zone District Use Regulations
The development on the property is in general conformance with the dimensional
standards for the Rural zone district.
The property currently has one primary dwelling unit on the propefty. The Applicant
constructed the ADU without proper Land Use Permits and has submitted this application
in hopes of correcting this violation.
2. Section 7-102: Conformance with Comprehensive Plan and compliance with lGAs
The County Comprehensive Plan identifies the property as Low Density (<10 acres per
dwelling unit). As the property is over 30 acres, the residential density identified within the
Comprehensive Plan would be satisfied including the ADU.
Please see SectionT-104, below, regarding legal water.
3. Section 7-103: Compatibility
The proposed use is located in a rural area and is unlikely to significantly alter or impact
this character of the area. The areas surrounding the subject property are predominantly
residential and agricultural in nature.
A letter was received from Mr. Rudd, an adjacent properly owner, indicating that the
Lookout Mountain Covenants, Conditions and Restrictions (CCRs) do not permit ADUs.
Staff subsequently located the CCRs for this portion of Lookout Mountain Ranches (See
Exhibit 7) and there does appear to be a restriction on such development within this
subdivision. While it appears that such a restriction exists, the County does not enforce
private covenants. As a result, such an infringement on these CCRs is a private civil
matter.
4. Section 7-104: Sufficient, Adequate, Legal and Physical Source of Water
The ADU is to be served by an existing well on the propefiy. This well, Permit Number
202863, states that "The use of ground water from this well is limited to fire protection,
ordinary household purposes inside 3 single family dwellings, the irrigation of not more
than one (1) acre of home gardens and lawns, and the watering of domestic animals".
Referral comments received from the Division of Water Resources (See Exhibit 5)
indicate that "The applicant's land use change request indicates that the well currently
serues a single family residence and ADU. The ADU would be considered, for the
purposes of well permitting, to be an additional single family dwelling... As long as the
uses of the well do not exceed those allowed under the permit, this office has no objection
to the well also serving the ADU."
The Applicant submitted a water quality test from the well in use for the ADU. This well
test was analyzed by Michael Erion of Resource Engineering in January 2016. As a result
of the water quality testing, Mr. Erion concluded that "the laboratory results for the water
quality analysis indicate that the water meets all primary and secondary drinking water
standards. The well water quality is suitable for domestic uses and outside irrigation."
A pump test was also conducted on the subject well. This well pump test, conducted by
J & M Pump lnc. on September 2,2015, shows that the well produced 15 gallons per
minute with a 1OO% recovery in 14 minutes. As a result, it appears that the quantity of the
water being produced by the subject well is adequate.
Comments were received from Wayne Rudd (See Exhibit 6), an adjacent property owner,
indicating that the subject well is !/z owned by Ranch 17 (Leable property) and Yz owned
by Ranch 14 (Rudd property). As a result of this letter, Staff research found a Quitclaim
Deed to Rudd Aviation, lnc. (See Exhibit 8) which provides "An undivided one-hall (112)
interest in the water well located on Ranch 17, Lookout Mountain Ranches, Lookout
Mountain Ranch, in Garfield County Colorado, said well having been constructed under
Monitoring Hole Notice MH-30367 and being the subject of Well Permit No. 202863,
together with any and all water rights appurtenant thereto." ln addition, a Well Sharing
Agreement (See Exhibit 9) was located which states that the "Purchaser shall be entitled
to not more than 5 gpm, or onethird of the actual well capacity, whichever is less, and
Purchaser may use such water only for in-house dgmestic use in one single family
dwelling located upon the Property, and for the irrigation of not more than 5000 square
feet in the aggregate of lawn and garden on the Propefty." This ownership documentation
and well sharing agreement combined with the letter from Mr. Rudd (Exhibit 6) stating
that "l strongly object to the approval of a second dwelling on Ranch 17 Lookout Mountain
Ranches..." leads Staff to the conclusion that the Subject Property owner, Leable, does
not own enough water rights in the well identified as Well Permit Number 202863 for two
dwelling units and the owner of the other lz of lhe well rights, Rudd, is not supportive of
allowing additional use of the well. As a result, it is Staff's opinion that the Subject Property
owner does not have adequate legal water rights to serve the proposed ADU.
Through conversations with the Applicant, it is understood that the Applicant wishes to
pursue drilling a new well on the property in order to serue the ADU. Should the ADU be
served by a different well than the one analyzed as a part of this application, then a new
pump test and water quality test will need to be provided. ln addition, the Applicant will
need to provide an approved well permit for the new well from the Division of Water
Resources and represent how each of the dwelling units on the property will be served
by water (new well or existing well).
5. Section 7-105: Adequate Central Water Distribution and Wastewater Systems
The Applicant is proposing to utilize an existing Onsite Wastewater Treatment System
(OWTS) for the proposed ADU. The Applicant has provided evidence that the existing
OWTS is adequate to serve the existing ADU.
6. Section 7-106: Adequate Public Utilities
Adequate public utilities currently exist at the subject parcel.
7. Section 7-107: Access and Driveways
a. The application was referred to the Garfield County Road and Bridge
Department (see attached). Wyatt Keesbery of Garfield County Road and Bridge
indicated Road and Bridge has no concerns with the proposed ADU, but did not
that CR 120 is a limited maintenance County Road.
b. The Applicant has stated that the driveway and private access roads meet the
design standards found in Section 7-107.
8. Section 7-108: Natural Hazards
No natural hazards have been identified on the subject parcel.
9. Section 7-109: Fire Protection
The impact area within the subject parcel has been identified as having a Very High level
of Wildfire Susceptibility in accordance with Map 7 of the Community Wildfire Protection
Plan. The parcel is located within the Garfield County Sheriff's service area. The
application was referred to the Sheriff's Office, however no comments were received.
Article 7, Division 2: General Resource Protection Standards
10. Section T-20l Agricultural Lands
The proposed development is an existing dwelling unit on the subject property. lt is not
anticipated that the proposed development would adversely affect neighboring
agricultural uses or agricultural uses on the subject parcel.
11. Section 7-202 Wildlife Habitat Areas
The ADU is expected to have impacts on wildlife similar to a single family dwelling unit.
As a result, no significant impact to wildlife habitat is expected.
12. Section 7-203 Protection of Waterbodies
No waterbodies have been identified on the property.
13. Section 7-204 Drainage and Erosion
The Applicant has provided a topographic map of the subject property that shows general
positive drainage from the propefiy. As the driveways are currently in place, no significant
change to the topography or drainage from the propefiy is expected.
14. Sections 7-205 Environmental Quality
No water or air quatity issues are anticipated from the proposed project.
15. Section 7-2OO Wildfire Hazards
The impact area of the subject property is identified as Very High according to Map 7,
Wildland Fire Susceptibility lndex of the Community Wildfire Protection Plan (CWPP). ln
addition, no slopes over 30% have been identified and no fire chimneys are known to
exist on the property. The parcel is located within the Garfield County Sheriff's service
area. The application was referred to the Sheriff's Office, however no comments were
received.
16. Section 7-207 Natural and Geologic Hazards
As noted in Section 8 of this Staff Report, no natural and geologic hazards have been
identified on the subject property.
17. Section 7-208 Reclamation
Minimal disturbance is anticipated as a result of the proposed ADU. The driveways are in
place and the dwelling unit to be designated as the ADU is existing.
Article 7, Division 3, Site Planning and Development Standards
18. Section 7-301 Compatible Design:
The ADU use is generally compatible with surrounding residential land uses.
19. Section 7-302 Off- Street Parking and Loading Standards:
The Applicant has demonstrated through site plans that adequate off-street parking exists
for the ADU and primary dwelling unit.
20. Sections 7-303 Landscaping Standards:
The LUDC specifically exempts ADUs from Section 7-303.
21. Section 7-304 Lighting:
Staff recommends a condition of approval that any exterior lighting comply with the
Standards outlined in Section 7-304.
22. Section 7-305 Snow Storage Standards:
The property has adequate snow storage areas that are in compliance with County
standards.
23. Section 7-306 Trail and Walkway Standards:
No recreational or community facility access areas are proposed.
Article 7, Division 7, Accessory Dwelling Unit
24. Maximum Floor Area:
As the property is over 4 acres, the ADU is required to be limited to 3,000 square feet.
Staff suggests a condition of approvalthat the ADU be limited to 3,000 square feet or less
in size.
25. Ownership Restriction:
The Applicant and Owner understand that the ADU is restricted to leasehold interests and
may be used for residential or Home Office / Business use only.

26. Compliance with Building Code:
The ADU was built without Land Use or Building Permits. The Applicant has submitted
this application to obtain the necessary Land Use Permit. ln addition, the Applicant has
submitted documentation to the Building Department to obtain the necessary Building
Permits. Staff recommends a Condition of Approval requiring the Applicant to obtain all
necessary building permits from Garfield County for future development.
27. Minimum Lot Area:
The Applicant has 35.59 acres and as a result the minimum lot area requirement of at
least 2 acres in the Rural zone district is satisfied.
28. Entrance to Dwelling Unit:
The Applicant is proposing the ADU to be a separate building from the primary dwelling
unit. As a result, the ADU as it exists will comply with this standard.
VI!. SUGGESTED FINDINGS AND RECOMMENDATION
Staff recommends a finding that the proposed Accessory Dwelling Unit is in conformance
with the Comprehensive Plan of 2030 and the Land Use and Development Code.
Specifically, Staff finds that while the Applicant does not currently have sufficient legal
water to serue the proposed use and as a result is not in compliance with Section 7-104:
Sufficient, Adequate, Legal and Physical Source of Water, should the Applicant obtain a
well permit to drill a new well that can legally serve the ADU and has adequate water
quantity and quality, then a finding of conformance with the Code may be made. Since
the existing ADU is a Code violation, the deadline to obtain legal and adequate water for
the ADU is recommended to be limited to 6 month. Staff, therefore, recommends Approval
with Conditions of the Leable ADU application.
Suggested Findings
1. That proper public notice was provided as required for the Administrative Review
Land Use Change Permit.
2. That with the adoption of conditions, the application is in general conformance with
the 2030 Comprehensive Plan, as amended.
3. That with the adoption of conditions, the application has adequately met the
requirements of the Garfield County Land Use and Development Code of 2013, as
amended.

Conditions Prior to lssuance of the Land Use Change Permit:
1. Within 6 months from the date of the Directors Determination, the Applicant shall
obtain a well permit and drill a new well as permitted by the State of Colorado
Division of Water Resources for the proposed ADU per Garfield County
regulations. Prior to issuance of the Land Use Change Permit, the Applicant shall
provide the following information and documents. This information and documents
shall be reviewed and accepted by the Community Development Depafiment and
designated engineer.
a. An explanation as to how each dwelling unit on the propefty will be
served by water and how these wells are impacted by any well
sharing agreements and/or split ownership.
b. The approved well permit for the well to serye the ADU from the
Division of Water Resources.
c. A 4-hour pump test for the new well in conformance with Section 4-
203(MX1XbXs).
d. A water quality test for the new well in conformance with Section 4-
203(MX1XbXs).
Conditions of Approval:
2. All representations of the Applicant contained in the application shall be considered
conditions of approval unless specifically modified by the Board of County
Commissioners.
3. The Applicant shall comply with Additional Standards for Residential Uses
contained in Section 7-701, Accessory Dwelling Units, of the Land Use and
Development Code o1r2013, as amended.
4. The Floor Area for the Accessory Dwelling Unit shall not exceed 3,000 square feet.
5. The ADU shall be subject to all Gar{ield County Building Code Requirements. The
property owner shall obtain any necessary Garfield County Building Permits for
modifications and/or expansions to the ADU structure.
6. All exterior lighting shall be downcast and shielded and comply with SectionT-304,
Lighting Standards, of the Land Use and Development Code of 2013, as amended.
7. An ADU is restricted to leasehold interest in the dwelling unit and is for residential
or Home Office/Business use only, as described in the Land Use and Development
Code of 2013, as amended.
L Approval of a Land Use Change Permit for this use is in no way intended to
supersede any other requirements placed on this property such as a matter of
private covenant or othenruise.

We have reviewed the proposal to rectify a violation of an existing Accessory Dwelling Unit
(ADU) on a parcel of approximately 36 acres in size, located in part ol the E112 of lhe E112 oI
Section 35 and in part of the E1l2 ol the E1l2 of Section 19, in Township 6 South, Range 88
West; part of the SE'l/4 of the SE1/4 ol Section 13, in Township 6 South, Range 89 West; part
of the NE1/4 of the NE1/4 of Section 24, in Township 6 South, Range 89 West, all of the 6th
P.M., at 0727 County Road 120, Lookout Mountain Ranches, Lot 17 (parcel no.
218719202017). The property currently has an existing single family residence, access road
and utilities in place. The applicant does not propose to create a new lot or change the size of
the existing lot. The current water supply to the lot is provided by a well, currently permitted
under Permit No. 202863, which the applicant has indicated is shared between the single family
dwelling and the ADU. The application also indicates an existing onsite wastewater treatment
system currently serves the existing single family dwelling and ADU.
According to our records, Well Permit No. 202863 was issued on June 27,1997, for an existing
well located in the NE1/4 of the NW1/4 of Section 19, Twp. 6 South, Rng. BB West. The use of
groundwater from the well was approved for ordinary household purposes inside 3 single family
dwellings, the irrigation of 1 acre of home gardens and lawns, and the watering of domestic
animals. The pumping rate of this well shall not exceed 15 gpm. Per our records, the well was
constructed on 5/8/1997 to a depth of 453 feet, under monitoring hole notice MH-30367, and the
current permit is valid.
The applicant's land use change request indicates that the well currently serves a single family
residence and ADU. The ADU would be considered, for the purposes of well permitting, to be
an additional single family dwelling.
As long as the uses of the well do not exceed those allowed under the permit, this office has no
objection to the well also serving the ADU.

I strongly object to the approval of a second dwelling on Ranch 17 Lookout Mountain Ranches
for two reasons.
1. The parcel is in the Lookout Mountain Home Owners Association which has covenants
restricting a second dwelling. The real reason for this was due to the area's arid
conditions and an attempt to not over use the available water supplies.
2. I agree that there is an existing well, but Ranch t6 only owns % of that exempt well.
Ranch 14 Red Ridge Ranches (14RRR) owns the other Yz of that well. Ranch 17 does not
own water to serve the second dwelling. I happen to own Ranch 14 Red Ridge Ranches.
Additionally, I own Ranch 13 south of Ranch 17. I have allowed minimal use of my
exempt well on Ranch 13. A neighbor who is Yzmile south has no water, so I allow him
to fill a small truck from the Ranch l3 well. About six weeks ago that well went dry,
and further water challenges will come to this area. Zancanella and Associates
Engineers has a log of all former water levels in the six wells that are within about 1,000
feet of this well on Ranch 17. I know it is dry. All wells should be tested to see how
much depletion has occurred. I Ranch 17 wants a second house, a lot line adjustment
should be done, and Ranch 17 should have to drill a new well 600+ feet from the current
well and Ranch 15's well.
