HomeMy WebLinkAbout4.0 Director's Determination 12.12.16Gaffield Coulnty December 12,2016 3SE Planning c/o Keith Ehlers 2662 Lookout Lane Grand Junction, CO 81503 DIRECTOR DETERMINATION - Administrative Review Land Use Change Permit - Leable - Accessory Dwelling Unit - Garfield County File Number GAPA-09-16- 8488 Dear Mr. Ehlers; This letter is being provided to you in regard to a General Administrative Review Application for an Accessory Dwelling Unit on your property. The proposed use is ^i'lZl County Road 120, located approximately 5 miles east of the City of Glenwood Spiings with access off private roadways and County Road 120 and also known by Assessor's Parcel No. 218719202017. The Director's Determination on the Application is based on the following findings and subject to the Applicant's representations and conditions of approval. 1. That proper public notice was provided as required for the Administrative Review Land Use Change Permit. 2. That with the adoption of conditions, the application is in general conformance with the 2030 comprehensive Plan, as amended. 3. That with the adoption of conditions, the application has adequately met the requirements of the Garfield County Land Use and Development Code of 2013, as amended. A Director's Decision is hereby issued approving the Application with the following conditions. 1. Within 6 months from the date of the Directors Determination, the Applicant shall obtain a well permit and drill a new well as permitted by the Siate of Colorado Division of Water Resources for the proposed ADU per Garfield County regulations. Prior to issuance of the Land Use Change Permit, the Applicant shall provide the following information and documents. This information and documents shall be reviewed and accepted by the community Development Depaftment and designated engineer. a. An explanation as to how each dwelling unit on the property will be served by water and how these wells are impacted by any well sharing agreements and/or split ownership. b, The approved well permit for the well to serue the ADU from the Division of Water Resources. A 4-hour pump test for the new well in conformance with Section 4-203(MX1 Xb)(5).A water quality test for the new well in conformance with Section 4-203(MX1 )(bxs). Conditions of Approval: 2. All representations of the Applicant contained in the application shall be considered conditions of approval unless specifically modified by the Board of County Commissioners. 3. The Applicant shall comply with Additional Standards for Residential Uses contained in Section 7-701, Accessory Dwelling Units, of the Land Use and Development Code of 2013, as amended. 4. The Floor Area for the Accessory Dwelling Unit shall not exceed 3,OOO square feet. 5. The ADU shall be subject to all Garfield County Building Code Requirements. The propefiy owner shall obtain any necessary -Garfield County Building Permits for modifications and/or expansions to the ADU structure. 6. All exterior lighting shall be downcast and shielded and comply with Section 7-304, Lighting Standards, of the Land Use and Development Code of 2013, as amended. c. d. An ADU is restricted to leasehold interest in the dwelling unit and is forresidential or Home Office/Business use only, as described in the Land Useand Development Code of 2013, as amended. Approval of a Land Use Change Permit for this use is in no way intended to supersede any other requirements placed on this property such as a matter of private covenant or othenarise. This Determination will be fonrarded to the Board of County Commissioners for aperiod 9f 1-0 days so that they may determine whether or not to call up the application for further review. According to the Land Use and Development Code,section 4-112(A), "a call-up may be lnitiated by the Bocc, the birector, theApplicant, or any affected Adjacent Property Owner." Should this time period pass with no request for review or public hearing, the decision shall be final.
