In accordance with and pursuant to provisions of the Garfield County Land Use and
Development Code ol 2013, as amended, and a Resolution of Approval (Resolution
Number 2018-221of the Board of County Commissioners of Garfield County, State of
Colorado, the following activity is hereby authorized by Land Use Change Permit:
A Contractor's Yard, Small, with tndoor and Outdoor Storage as shown on the
Site Plan Aftached as Exhibit "A" (GAPA-I2-17'8601)
This Land Use Change Permit is issued subject to the conditions contained in the
Resolution of Approvai (Exhibit B) and shall be valid only during compliance with such
conditions and- other applicable provisions of the Garfield County Land Use and
Devetopment Code, as amended, Building Code, and other regulations of the Board of
County Commissioners of Garfield County, Colorado.

the call-up reguest in a nodced publio hearing.

. D. Contractors Yard, Small may be permittcd in thc Runal zone disrict rvith an
Administrativc Review land Use Chonge Penuit The Directors Determination of Approval with
Conditions was modilied by tlr Board in a noticed public hearing on April 16, 201 8.
E. The Board is authorizrd to oppmvc, dcny or approve with conditions on Administmtirre
Rsview Land Use Change Pemrit thst has been called up to the Board. The application then will
result in issuance of a land Use Change Pemit pursuant to the Garfield County Land Usc and
Development Codc as amended.
F. The Boad of County Cornrnissioners opened a public hearing on the 16ft day of April,
2018 for consideratlon of whelher the proposed Land Use Change Permit should bc granlcd or
deniod, during which hcaring the public and interested persons rvere gilrn the opportunity to
erprcss their opinions reganling the request.
G. The Board of County Commissioncrs closcd ths public hcaring on the 16t day of April,
2018 to make a final decision.
I'I. The Board on the ba.sis of subsantial comFetent cvidcncc pmduccd at thc
aforcmcotioncd hcaring, has rnadc the following determinations of fact:
l. That proper public notice was providcd as rcqui:ed for the hearing beforc the Board of
County Cornmissi oners.
2. The hcaring bcforc thc Board of County Cornmissioners wui extcrsive and complete, that
all pcrtincnt facls, matters and issues werc submittcd and that all interested parties rvere
heard at a the meeting.
3, that for thc above stated and other reasons the prsposed Land Use Changc Pcrmit for tbe
Funsten Contractors Yard, Smsll is iu the best interest of tire health, safety, convenience,
order, proqperity and u,rlfare of the citizens of Garlicld County.
4. That n'ith the adoplion of conditions, the application is iu general conformuce with the
2030 Comprehcnsive Plan, ss amended.

with thc following conditions:
Conditions Prior to Issuance of the Innd Use ChanqE Psrmit
1. 'Ihe Applicant shall obtain a &ivervay permit from Road and Bridge and construct any
rcquircd improvcments prior to issuance of the Land Use Changc Permit- In additiorr, the
Applicant shall instsll s slop sign at the &ivcway for vehicles entering CR 100.
Demonstation that thc drivcrvay pcrmit rws issucd, stop sign was installed, and aU
rquired improvcmcnts have bccn completed shall be submilted to thc Community
Development Department prior to issuance of Oe Land Use Change Permit.
Gsncral Conditions
2. AII representations ofthe Applicant contained in thc application including the site plan and
ovcnrll dimensions of lhe contraclor's yanl shall bs considcrcd conditions of approval
unless specifically modified by the Director Decision-
3. ThEt the operation of lbc contractor's 1,ard shall bc donc in accordaoce with all applicablc
Federal, State, and local regulations governi:rg the operation of this type of facility
including, but not limitcd to, fucl and hazardous materials storage.
4- All activity and sEircturcs associate with the Contractors Yard, rvith exception to [te access
road, shall be containcd within the arca identified on the Site Plan and be at least 50 feet
back from all propcrty lines. Thc rcquired 50' setback sball only apply to the arca idcntified
in tlre site plan lo be used as the Contractor's Yard. Standard County setbac]s for thc
undalying zone district shall apply to all other uses outside the Contractors Yard area and
not associatcd with the Contractors.Yard usc.
5- Alt indoor stonage areas, covered parking and garages associated with the Conlractor
Yard usemust comply rvith all applicable building code requircments and be located rvi&in
the area identificd on the Site Plan for lhc Contractors Yard and be at least 50 fcet back

Uses as descriircd in Section 7-1001 and os outlined or otberwise modified belorv:
a. Materials shafl be storcd on the property in a fonn or marmer that rtill not be
tr&sfered o{fthe property by any rcasonably forcsccable naluml cause or force.
b.' All prcducs shall be stored in compliance u'ith all nalional, State, and local codes.
c. Petroleum and hazanlous producls shsll be stored in an imperviots spill

non-conforming sutL of the uses on the property as identified rvithin the lctter from Mark
Bean, Director 6fCu.fi"la County Building, Sanitation and Planning Dcparulsnt and datcd
November 25, 1987, are hereby tcminatcd.
