This past Sept. 8th lwas diagnosed with Chronic Lymphocytic Leukemia and will require long term chemotherapy. ! haven't found much time to work on some of my projects such as this exemption. Please ask the County Commissioners to consider a 6 month extension on my exemption. Thanks for your time and help. Box 2503 Glenwood Springs, CO 81602 RE: Subdivision Exemption Conditional Approval Dear Rudy: On Monday, June 16, 1997, the Garfield County Board of Commissioners granted conditional approval to your request for an exemption from the definition of subdivision. The conditions that must be met prior to final approval are as follow: .r- 1. That all representations ofthe applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval. 2. A Final Exemption Plat shall be submitted, indicating the iegal description of the property, dimension and area of the proposed lots, access to a public right-of-way, and any proposed easements for setbacks, drainage, irrigation, access or utilities. 3 . That the applicant shall have 120 days to present a plat to the Commissioners for signature, from the date of approval of the exemption. The Board may grant extensions of up to one (1) year from the original date of approval. 4. That the appl,icant shall submit $200.00 in School Site Acquisition Fees for the creation of the exemption parcel. 6. That, prior to the authorization of an exemption plat, the applicants receive an approved driveway permit, for the proposed access, from the Garfield County Road and Bridge Department. 7. That the weil be driiled and pump-tested for four (4) hours with the results presented to the Planning Department along with a statement by the individual conducting the pump test that the well is capable of supplying the intended uses. Additionaily, the water quality shail be tested for nitrate, nitrite and fecal coliform bacteria content. 8. That the recording fees for the exemption plat and all associated documents be paid to the County Clerk and Recorder prior to the signing of a Final Plat by the Board of County Commissioners and a copy of the receipt be provided to the Planrung Department. 109 Sth Street, Suite 303 (e70) 94s -8212128 s -7 et 2 Glenwood Springs, CO 81601 9. That the exemption plat submittal inciude a copy of a computer disk of the plat data, formatted for use on the County Assessor's CAD system. 10. The applicant shall abide by the recommendations contained in the Oddo Engineering letter dated February 3,1997. 11 That al1 proposed lots shall comply'with the Garfield County Zoung Resolution of 1978, as amended, and any buiiding shall comply with the 1994 Uniform Building Code, as adopted. 12. That the following plat notes be included on the exemption plat: "Prior to issuance of a building permit, the owner shall prepare and submit a soils and foundation report, an I.S.D.S. design, and a grading and drainage pian prepared and certified by a professional engineer. All improvements shall be constructed in accordance with such measures, which shall be a condition of the building permit." "The minimum defensible space distance for structures shail be 30 feet on level terraiii, plus appropriate modification to recognizethe increased rate of fire spread at sloped sites. The methodology described in "Determining Safety Zone Dimensions, Wildfire Safety Guidelines for Rural Homeowners," (Colorado State Forest Service) shall be used to determine defensible space requirements for the required defensible space within building envelopes in areas exceeding five (5) percent grade. "The individual lot owners shall be responsible for the control of noxious weeds." "One (1) dog wiil be allowed for each residential unit within an exemption and the dog shall be required to be confined within the owner's property boundaries, with enforcement provisions allowing lorthe removal of a dog from the area as a final remedy in worst cases." "No open hearth solid-fuel firepiaces will be allowed anp.vhere within an exemption. One (l) new solid-fuei burning stove as defined by C.R.S. 25-'7-401, et. seq., and the regulations promulgated thereunder, will be allowed in any dwelling unit. All dweiling units will be allowed an unrestricted number of natural gas burning stoves and appliances. " "A1l exterior iighting shall be the minimum amount necessary and that all exterior lighting be directed inward, towards the interior of the subdivision, except that provisions may be made to allow for saibty lighting that goes beyond the property boundaries." Box 2503 Glenwood Springs, CO 81602 January 3,1997 RE: Exemption Subdivision SE Job No. 97001.01 Dear Rudy: We have reviewed the topographic information that was supplied by River City Surveys, LLC at five foot contour intervals for your two-lot exemption subdivision along Mitchell Creek, just above the Colorado Division of Wildlife's fish hatchery. It is also our understanding that the contours are from the City of Glenwood Springs aerial photographic mapping. The southern lot has an existing house so no building site was reviewed for this lot. Attached is a drawing showing a 1.48 acre building site on the northern lot with 30%o or less slope. This building site is easily accessed with the existing driveway cut. The building site is large enough that the ISDS can be placed within the building site also. I would recommend that the ISDS be designed by a Registered Engineer at the time of your building permit process, so the site specifics are known and the ISDS can be sized and designed properly. I agree with you that these fire protection items should be installed. Unfortunately, according to our codes, we cannot require that these items be furnished without knowing what is going to take place on the site. Our codes specify that the mentioned requirements be installed when there are two or more R-3 units proposed. At this time, there is no proposal for what will eventually be on the site. Mr. Steele has stated that no more than one dwelling unit will be built on the site and that this could be years away. I have requested that Mr. Steele provide us with an engineers analysis of the bridge to insure that our apparatus will be able to use it. If the bridge is to be used to provide emergency vehicle access (only access to the site) it will have to support the loads of the fire apparatus. As 'far as water supply and the access road, we strongly recommend that when construction takes place, that the roads meet county standards and that some form of fire protection water supply is furnished to the site. Again, we cannot require these items until we know what will be placed on the site. We highly recommend that any structures that are built within our jurisdiction be provided with adequate access, water for fire flows and that the wildland fire threat is taken into consideration when constructing buildings.
