FINDINGS OF FACT
1. Melanie Backes appeared for the applicants, Michael and
Valerie Spychala (Applicants). Linda Preslan appeared for the staff
of the State Engineer's Office (Staff). No other parties appeared
even though notj-ce of the hearing was served on the owners of wells
located less than 500 feet from the proposed wel1.
2. The Applicants seek a permit to construct a well on a 3.5 acre
lot being iplit from the 7 acres they currently own. The Applicants
have a contract with the West Divide Water Conservancy District to
provide replacement water for the use of the proposed weII.
3. The proposed well will be located less than 600 feet from
existing wells on Applicants own property and on adjacent parcels.
The Applicants do not object to the new well being less than 600
feet from own their existingr we1I.
4. The Applicants contacted the owners of the other existing
wells located less than 600 feet from the proposed weII to advise
them of the application and to seek their consent for the proposed
weII. None of these well owners waived their right for a hearing
in this matter nor did they appear and participate in these
procedures.

a new well operated under a rep'lacement agreement with the West Divide Water
Conservancy D'istrict. The appl i cant has subm'itted a wel I permi t appl 'icati onto this office and a copy of their contract, Contract No. 2139, with theDistrict. Before the permit can be issued, the applicant must establish that
no other well(s) is located within a 600-foot radius of the proposed well, orobtain consent from the owners with a well(s) with'in 600 feet or demonstrate'in a hearing that there wjll not be injury to the well(s). We can recommend
approval conditjonal upon the appf icant obtain'ing the required well permit.
