I. REI,ATIONSHIP TO THE COMPREHENSIVE PLAN
The site is located in District C, Rural Areas with Ivlinor
Environmental Constraints, as designated on the Comprehensive
PIan Management District Map.
II. DESCRTPTION OF THE PROPOSAL
A. Site Description: The site is in a relatively flat,rural residential area of the County. There are a numberof large lot residences and agricultural operations inthe area. There is an existing house on one of the
proposed parcels.
B. Project Description: It is proposed to split a 7.5 acretract into two (2) parcels of 3.75 acres each. Theexisting house is served by a well and individual sewagedisposal system. The new lot will have a weII and ISDS
developed for a proposed house. Access wiII be off ofc.R. 225.
III. MAJOR ISSUES AND CONCERNS
A. The improvement survey used for the site plan indicatesthat the existing C.R. 225 is within the existingproperty boundaries. The exemption plat should designateall C.R. 225 right-of-way shown as "Apparent Co. Rd.
R.O.W. " as dedicated right-of-way.
B. Soils information indicates that the soils are limited byIow strength and shrink-sweI1 potential. The exemptionplat should include a note stating that engineeredfoundations and individual sewage disposal systems may berequired.
C. Proof of a legal adequate source of domestic water has
been demonstrated by an approved West Divide Water
Conservancy District contract for augmentation water.
The exemption plat should include a plat note stating
that the new parcel is subject to annual payments and
contractual obligations to the West Divide ConservancyDistrict by contract #900117-I,15.

IV. SUGGESTED FINDINGS
1. That proper posting and public notice vras provided as
required by law for the meeting before the Board of
County Commissioners.
2. That the meeting before the Board of County Commissioners
was extensive and complete, that all pertinent. facts,matters and issues were submitted, and that aII
interested parties were heard at that meeting.
3. That for the above stated and other reasons, the proposed
exemption is in the best interest of the health, safety,
morals, convenience, order, prosperity and welfare of the
citizens of Garfield County.
V. RECOMMENDATION
APPROVAL, with the following conditions:
l-. That all representations of the applicant, either within
the application or stated at the meeting before the Board
of County Commissioners, shall be considered conditions
of approval.
2. That the applicant submit $200 in School Impact Fees forthe creation of one new Iot.
3. That within 120 days of the conditional approval of the
request for exemption from the definition of subdivision,
an exemption plat shall be submitted to the Board of
