Pursuant to C.R.S. (.l973) Section 30-28-'101(10)(a) - (d) as amended,
and the Subdivision Regulations of Garfield County, Colorado, adopted
September 1, 1972 and amended April .l4, 1975, Sections I.02.17(d) and
3.0?.0.l , the undersigned Richard Lee $tampp
respectfully petitions the Board of County Conunissioners of Garfield
County, Co'f orado, to exempt by reso'lution w. 625' of S. l/Z Sectio 4,
township 7 South, Range 88 West, 6th p.M.
more fully hereinafter described, from the definitions of "subdivision"
and "subdivision land"'as'the terms are used and defined in C.R.S. (1973)
Section 30-28-101(a),- (d) and the Garfield County Subdivision Regu'lations,
for the reasons stated be'low:
This subdivision presents no problems related to intensive use ofland or provision of utilities and services, and is not part ofa potential larger land development project. Telephone. and elec-tric lines serve property adjacent to the north. The undersignedwill construct a road to county specifi-cations from Road ll2 throughadjacent lands for which easements exist. A map of the protrfosedsubdivision is attached. A domestic water well permit his 6eenapplied for to serve the property.

EASEMENT
For valuable consideration, CARBONDALE LAND DEVELOPMENT CORPORATION,
a Colorado Corporation, (grantor) hereby grants to RICHARD t. STAMpp,
his heirs, executors, personal representatives and assigns (grantee),
a perpetual non-exclusive easement, for access purposes, 60 feet
in width, over and across such of its lands located in Garfield
County, Colorado:
Township 7 South, Range BB West, 6th p.M.i7T-Sectj-on 232 NW l/4 NE L/4
The precise allignment of such easement shall be approved by grantor
prior to any use thereof shall be made.
Grantor further grants and assigns to grantee the non-exlucsive
right to use the specific access easements granted reserved or
described in documents recorded in Book 451 at page 583.

Re: Stamp Exemption
Dear Mr. Baldwin:
ly1le have reviewed the above referenced exemption application.
The wells proposed as the water supply would intercept ground water
which is tributary to Cattle Creek, an over-appropriated stream. Since
new wells would cause injury to senior vested water rights, well permits
cannot be issued by this office to each lot and we cannot recommend
approval of the Stamp Exemption.
