Recorder R E S O L U T I O N -* 78-30 uuUf;5 2 PAGE 497, WHEREAS, WILLIAM A. and VELETA JO. ROGERS, have petitioned the Board of County Commissioners. of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and 3.02.01, for the division of a 2.28 acre tract of land into three tracts of .937, .59, and .689 acres, more or less, and said 2.28 acre tract is more particularly described as follows: A tract of land situated in the NWQSE' and the NEaSWQ, Section 5, Township 6 South, Range 89 West, of the 6th Principal Meridian, and more fully described as follows: Beginning at a point on the Southerly line of the County Road whence the Southwest Corner of Section 35, Township 5 South, Range 89 West of the 6th Principal Meridian bears N. 59° 10' W., 2601.2 feet; thence N. 010 51' E. 316.4 feet to the north line of said NWaSE4; thence N. 89° 1' W., 386.67 feet along the north line of said NWQ SEa and NE'SW4; thence S. 010 51' W., 193.72 feet to the Southerly line of the County Road; thence S. 71° 20' E., 408.7 feet along the Southerly line of the County Road to the point of beginning, containing 2.28 acres, more or less. WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that they desire said exemption for the purpose of re -sale into single-family residential acreage; and, WHEREAS, there are single-family residential uses with individual sewage treatment systems on the proposed .689 and .937 acre tracts; and, WEHREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners that municipal service is available to the proposed .59 acre tract, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and should therefore, be exempted from the definition. of the terms "subdivision: and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) - SOUK512 RAZE 496 • (d) as amended; NOW THEREFORE, upon motion of p . l: . JOS tki • seconded by rr(� ue J . and carried, said 2.28 acre tract of land is hereby _exempted from such definition and transfer of said tract may be made by division into three tracts of .937, .59, and .689 acre, more or less, all as is more fully described above, said exemption is conditioned upon obtaining municipal water and sewer service for said .59 acre tract of land and further, that said .689 and .937 acre tracts obtain a variance for minimum lot size as stipulated in the Garfield County Zoning Resolution; and further that a proper legal description be obtained prior to conveyance thereof. A copy of the instrument(s) of conveyance when recorded shall be filed with this Resolution.
