PETITION FOR EXEMPTION
Pursuant to C.R.S. (.|973) Section 30-28-l0l(.|0)(a) - (d) as amended,
and the Subdivision Regulations of Garfield County, Co]orado, adopted
September 1, 1972 and amended April .l4, "l975, Sections I .02."17(d) and
3 .02 .0.l , the unders i gned JAMES L. ROSE
respectfully petitions the
County, Colorado, to exempt
Board of County Commissioners of Garfield
by resolution
more fulIy hereinafter described, from the definitions of "subdiv'ision"
and "subdjvision land" as the terms are used and defined jn C.R.S. (.1973)
Section 30-28-l0l(a) - (d) and the Garfield County Subdivision Regulations,
for the reasons stated below: Due to geographic location the herein
described property is the on'ly portion suitable for residential
development and only suitable as one residential site. Alsoo
due to other residential development the site has now become
useless as spring cattle grazing for my cattle operation.
The property joins county road 109 for access and also is adiacent
to the Ken Nelson property which has well water and a newly
constucted house. Land use and architectual design restrictions
will be included to protect other property owners.

RE: Access road to 3.83 acre lot l-1/? miles south of
County Road .l09, Gartield County, Colorado
Dear Sir:
0n August .l3,.l97fi I investiilated the referenced property for the purpose
of determining the feasibility of constructing an access road into Lhe
proposed honre s i te .
I understand that the present land ovrner, Jim Rose, is agreeable to
dedicatinq an access roari easenent rvhich would carnnence at the existingqravel roail ond traverse the property for rvhich tie rr,ill retain olnership
and which lies immediatel.:r north of the subject property.
There appears to tre no unusual crarie problem involved in prov'iding this
access. The apnarent fictential problern relates to bujlrling the road
direct'ly,behinc! anC uphi1l fron an existinrr rcs'idence.
It is my opin'ion that the existing residence can be adequately protected
by insr-rrinq that proper clrai naq: orovi sions be incor1.roi^atecl into the pro-
posed access roail. The drainaqe provisions should 'include a vridened
ditch on the uplrill side large enouqh to carry surface drainage including
spring runoff.
Judging from the hillsicle cuts in the immediate area and the steep back
slopes of these cuts there should be no unusua'l problems related to thestabilfty of the proposed road.
I ttould recommend that at the time a building pernrit is applied for, aplan for tite access roacl be required hy the Cor.rnty to substantiate that
the aforerneniioned drainage provisioi'is be rnaiie.
