ASSOCIATION GRANTING A VARIANCE TO THE PROTECTIVES/
A RESOLUTION OF THE PANORAMA RANCHES HOMEOWNER'S
COVENANTS OF THE PANORAMA RANCHES SUBDIVISION

Whereas, the Board of Directors of the homeowner's
association has the authority to grant a variance to
the covenants and;
Whereas, section # 34 of the subdivision covenants
recorded with Garfield County, Colorado in.Book 536
Page 809 allows for variances from compliance with any
of the terms or provisions of the covenants and;
Whereas, due to the topography and natural
obstructions on lot # 13 a variance is justified and;
Whereas, on July 5, 1987 the Board of Directors
held a board meeting and unanimously approved a
variance;
Therefore, be it resolved that a variance has been
granted to lot # 13 to allow for encroachment into the
equestrian and conservation easement be granted upon
the following conditions:
1) That the encroachment not exceed 40 feet in
depth (north to south) by 150 feet in width (east to
west).
2) That the following described property:
A parcel of land beginning at the NW corner of
homestead 12, thence N. 53 45" 00" E. 56.64 feet to the
south boundary of Buck Point Road right of way; thence
easterly along said south right of way boundary to a
point due north of a point' 150 feet west of the NE
corner of homestead 13; thence west along the north
boundary line of homesteads 13 and 12 a distance of
571.15 feet to the point of beginning.

conservation and equestrian easement.
3) That access to the conservation and equestrian
easement not be restricted by fencing or any other
means.
4) That power to the site be obtained from the
power poles to the east near the existing water tank
and that the power poles not be placed any farther west
than the east property boundary of lot # 13.

5) That a copy of the easement be recorded with
the Garfield County Clerk and Recorder and a copy of
the recorded easement be provided to the Homeowner's
Association.
