The Board of County Commissioners of Garfield County, Colorado (Board) received a request for a Land Use Change Permit to allow for a Boat and Recreational Vehicle Storage Yard (Storage Facility) submitted by Mike and Tami Kalmon as further described in Exhibit A, Site Plan (File No. LIPA-02-17-8519). B. The Storage Facility is also known as River Frontage Storage and is proposed to be located on approximately one acre of property owned by Mike and Tami Kalmon located at 32956 River Frontage Road, Silt, Colorado. The subject property is located within unincorporated Garfield County in the Rural Zone District approximately N miles west of the Town of Silt Interstate 70 Interchange, and accessed by private drives off of River Frontage Road. D. Storage facilities may be permitted in the Rural zone district with a Limited Impact Review. E. The Board is authorized to approve, deny or approve with conditions a Limited Impact Review application resulting in issuance of a Land Use Change Permit pursuant to the Garfield County Land Use and Development Code, as amended. F. The Board opened a public hearing on May 15, 2017, for consideration of whether the proposed Land Use Change Permit should be granted or denied during which hearing the public and interested persons were given the opportunity to express their opinions regarding the request. The Board continued the public hearing to June 12, 2017. G. On June 12, 2017, the public and interested persons were given the opportunity to express their opinions regarding the application. H. The Board of County Commissioners closed the public hearing on the 12th day of June, 2017 to make a final decision. I. The Board on the basis of substantial competent evidence produced at the aforementioned hearing has made the following determinations of fact: 1. That proper public notice was provided as required for the hearing before the Board. 2. The hearing before the Board was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons the proposed Land Use Change Permit application by Michael and Tami Kalmon, for a Storage Facility is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That, with the adoption of conditions, the application is in general conformance with the 2030 Comprehensive Plan, as amended. 5. That, with the adoptions of conditions and granting of waivers from Section 7-1001, Industrial Use Standards related to screening, setbacks, and hours of operation and from Section 7-107 Access & Roadway Standards regarding right-of-way width, the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended. 2 1111 lei I11h1.111KPInliklmil Mid 11 11 1 Reception#: 894003 0612612017 11:33:22 RN Jean Alberico 3 of 6 Rec Fee:$0.00 Doc Fee:0.00 GARFIELD COUNTY CO RESOLUTION NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that: A. The foregoing Recitals are incorporated by this reference as part of the resolution. B. The Land Use Change Permit for a Storage Facility also known as River Frontage Storage is hereby approved subject to compliance with the following conditions: 1. That all representations made by the Applicant in the application shall be conditions of approval unless specifically altered by the conditions of approval of the Board. 2. Prior to issuance of the Land Use Change Permit, the Applicant shall verify the location of the 100 year flood plain outside the area of the Storage Facility and the 100 year flood plain location shall be staked on the site prior to construction. 3. Prior to issuance of the Land Use Change Permit, the Applicant shall provide a landscaping and screening plan for the Storage Facility to mitigate for the reduction in the 100 ft. industrial use setback standard. The plan shall meet the following standards: a. Based on adjoining land uses no landscaping screening shall be required on the northerly perimeter. The security fence on the northerly perimeter shall not be required to include screening, however inclusion of a sight obscuring element such as mesh screening or similar features is preferred. b. A vegetative buffer with trees or shrubs with a minimum anticipated mature height of 6 ft. shall be planted along the outside of the fence but within the Applicant's property, on the southerly and easterly perimeter of the Storage Facility. c. Plantings shall meet the standards contained in Section 7-303 of the Garfield County Land Use and Development Code, as amended. d. The number of plantings will be consistent with one tree or two shrubs for every twenty five feet of the southerly and easterly perimeter of the Storage Facility (i.e. 16 trees or 32 shrubs). e. The Landscaping plan can adjust the tree and shrub locations for the best screening effect and grouping in strategic areas is recommended. f. The Applicant shall preserve existing trees on the site and trees located along the southerly and easterly perimeter shall be credited toward the landscaping requirement along those perimeters. g. The landscaping and security fence shall be built and installed prior to operation of the Storage Facility. h. The landscaping plan shall include provisions for irrigation. j. No additional screening is required for the westerly perimeter of the facility based on existing vegetation, fencing, and distance from the adjoining property. 4. Prior to the issuance of the Land Use Change Permit, the Applicant shall provide a statement from a licensed professional engineer that the existing right-of-way widths, including Segment 2 of the roadway, are adequate for the proposed use. 5. The Storage Facility shall be limited to an ADT generation of not more than 10. 6. Prior to issuance of the Land Use Change Permit, the Applicant shall provide a basic grading and drainage plan for the Storage Facility prepared by a licensed professional engineer addressing mitigation for soil erosion, drainage improvements and stormwater best management practices. The plan shall include provisions for stock piling and reuse of top soil. Prior to construction of the Storage Facility, the Applicant shall obtain a grading permit from the County and a stormwater management permit from the State, if required. Should the Storage Facility cease operations, stormwater management improvements shall be maintained on the site or the site reclaimed with native or pasture type vegetation. 7. The building permit for the fence shall address operation of the electric gate including solar power, or if necessary, extension of electrical service to the gate and obtaining any applicable state electrical permits. 8. Prior to operation of the Storage Facility, the Applicant shall document that a Knox Box keyed entry system is installed on the security gate meeting the Colorado River Fire Rescue standards and requirements. 9. Lighting for the facility shall be limited to low level solar lighting at the access driveway to facilitate operation of the access gate and Knox Box. Normal business hours of operation shall be limited to 7:00 a.m. to 7:00 p.m., 7 days a week. 10. The Applicant shall monitor the site for county listed noxious weeds and manage any weeds found. Treatment records shall be provided by September 30, 2017 if noxious weeds are found. 11. All recreational vehicles or trailers for hauling recreational vehicles and Boats stored within the Storage Facility shall be required to be currently registered, licensed, and operational. No maintenance or servicing shall be permitted within the storage facility.
