GENERAL PROJECT DESCRIPTION The applicant is requesting a Substantial Modification to an Approved Land Use Change Permit for the Glenwood Caverns Adventure Park, memorialized in the Board of County Commissioners Resolution of Approval (2012-15). The applicant is proposing to upgrade the gondola that is used for visitor access to the site. The resolution of approval included Condition #4, which states: The ultimate build out capacity for the gondola is 36 gondola cars in 12 groups of 3 with each gondola car having a 6 passenger capacity. The applicant has requested that this condition be modified to allow for a Gondola upgrade that would permit 44 detachable cabins to be spread out along the Gondola. Because the requested change would alter a condition of approval, it is required that the applicant submit a new application. For a substantial modification, the Community Development Director is permitted to determine the submittal requirements. The review of the application may result only in an approval, approval with conditions or denial of the amendment. The application was heard in front of the Garfield County Planning Commission on March 14, 2018. At that time, the Planning Commission unanimously recommended Approval of the Amendment request. Existing Conditions & Proposed Upgrade The Park was opened to the public in 1999. Both Garfield County and the City of Glenwood Springs regulate land use of the facility - the lower terminal, located at Devereaux Road and Highway 6 is within City jurisdiction and consists of the parking lot, ticket office and the lower tramway terminal. The applicant is currently proposing upgrades in the City to this base area. The upper terminal 1,300 feet above the City on top of Iron Mountain, is located within unincorporated Garfield County. The upper terminal is the current gateway to the area containing recreational uses subject to the Special Use Permit. 1 resolution from 2012 allowed for this bus/van Glenwood Caverns Adventure Park Board of County Commissioners — April 9, 2018 PW Public access to the site currently occurs primarily via the tramway which can transport approximately 300 guests per hour, subject to weather conditions. Peak periods of park use result in sometimes lengthy waits to board the tramway and weather events (high winds or lightning) can extend this wait time. The tram has been shut down periodically due to weather and in these instances the guests are shuttled in busses and vans down Transfer Trail (BLM road) to Travers Trail (City of Glenwood Springs) to SH 6 and the lower tramway terminal. The guest transport. Staff understands that in warmer months (approximately March —October), the wastewater is pre-treated on the mountain and then pumped to the City for discharge via utility lines in place. In the winter months effluent is treated on -mountain via a septic tank and leach field. Domestic water, irrigation, and fire protection water, is provided by the City of Glenwood Springs. The proposed Gondola upgrade will increase the hourly capacity to 1,000 people per hour. The gondola would also be able to operate in more variable weather, the applicant has indicated that depending on icing conditions, the Gondola will be able to operate in winds up to 100 miles per hour. The proposed upgrade will utilize existing towers and sheave assemblies, but will replace the haul rope. The drive system will be switched from the bottom to the top. Permit History Garfield County issued a Special Use Permit (SUP) in 1999 (Resolution 99-065) for a Commercial Recreation Facility/Park in which access to the site was limited to up to 30 van trips per day, based upon a weekly average, and with a maximum capacity of 100 persons using on-site facilities at any given point during hours of operation. An Amendment to the SUP was issued in 2002 (Resolution 2002-47) which permitted the gondola to be used as access to the site. Another amendment to that SUP was approved in 2004 (Resolution 2004-56) which permitted specific uses such as a snack shop, amphitheater, roller coaster, banquet facility, paragliding, a teepee, etc., along with expansion of hours of operation. A SUP was issued in 2007 (Resolution 2007-67) for a `Commercial / Recreational Facility / Park which superseded and replaced prior approvals. This Permit established operations (hours and capacity) as well as permitted activities on the site. Capacity was increased to allow a maximum of 1,551 guests. 2 Glenwood Caverns Adventure Park Board of County Commissioners — April 9, 2018 PW Winter on the Mountain concept and more This permit was amended (administratively) in 2010 and 2011 to revise location of uses on the site. The first was to allow relocation of the zip line, the bungee jump and the maintenance building. The 2011 amendment was to locate the magic carpet and slide within the site as well as to create a new portal for exiting the cave. The 2012 Amendment allowed for more flexibility in the uses permitted at the Adventure Park and carried other operational conditions forward. The applicant has used the process from the 2012 permit twice, once to permit the recently to permit the Mine Drop Ride. II. LOCATION, ZONING AND ADJACENT USES Located atop Iron Mountain the site is adjacent to Public Lands (BLM) as well as the City of Glenwood Springs. Natural resources are prevalent in the area including several nearby limestone quarries, one of which is still in operation north of the Caverns property. The property is zoned Rural. III. PUBLIC AND REFERRAL AGENCY COMMENTS Comments have been requested from the following agencies and comments received are integrated throughout this memorandum as applicable. No Public Comments have been received on the application. 1. Colorado Department of Transportation (Exhibit 9) • Had no concerns with the application 2. Garfield County Emergency Management (Exhibit 10) • Had no concerns with the application 3. County Designated Engineer (Exhibit 11) and (Exhibit 18) • Once utility concerns were addressed by the applicant's engineer, no concerns were identified. Further correspondence indicated that the applicant would need to be subject to limitations of water and wastewater system operations during the winter. 4. Glenwood Springs Fire Department (Exhibit 12) • No concerns were identified with the current proposal, however the department asked that they be included as a referral agency if there is a request for increased capacity 3 Glenwood Caverns Adventure Park Board of County Commissioners — April 9, 2018 PW 5. Garfield County Public Health (Exhibit 13) • No concerns, but if there is additional disturbance, proper dust mitigation and storm - water management protocols should be used. 6. Garfield County Road and Bridge (Exhibit 14) • Had no concerns with the application. Agencies that did not respond to the Referral Request: Parks and Wildlife, Tramway Board, BLM, City of Glenwood Springs IV. Staff Comments and Analysis Prior applications and approvals granted for the Glenwood Caverns determined that the project was in compliance with the general development standards. Pursuant to the Land Use and Development Code's Substantial Modification to an approved Land Use Change Permit, the Community Development Director has waived some submittal requirements that were not applicable to this review. The code sections related to the request have been analyzed below: 7-101: Zone District Regulations The proposed use, as permitted demonstrates general conformance with applicable Zone District provisions contained in the Land Use and Development Code and in particular Article 3 standards for the Rural zone district. 7-102: Comprehensive Plan and Intergovernmental Agreement The Comprehensive Plan designates the Parcel as Residential Medium. The proposed amendment does not involve any residential density. The project has previously been found to be in general conformance with the Garfield County Comprehensive Plan. The parcel is located directly adjacent to the City of Glenwood Springs, however it is not included in their Urban Growth Boundary. The application was referred to the City and no comments were received. 7-103: Compatibility The proposed amendment to the Land Use Change Permit should have limited impact on compatibility with adjacent land uses. Compatibility was addressed as part of the previous County approval and the Gondola is already in place. 7-104: Source of Water The applicant has indicated that domestic water is provided through the City of Glenwood Springs via pipelines and stored above the facility. This storage is required for domestic water and fire suppression. 4 Glenwood Caverns Adventure Park Board of County Commissioners — April 9, 2018 PW 7-105 Waste Water Systems The County designated engineer was concerned that the proposed Amendment could have an impact on water and wastewater usage, if the facility was not connected to the City's systems. The applicant's engineer clarified that both water and wastewater are handled through City services (Exhibit 15). Further research indicated that in the winter, wastewater is handled through a septic tank as it is too cold to run the effluent through the utility lines in the winter (past applications indicate the system operates approximately from November to March). Past approvals and staff reports have indicated that the overall capacity on the site was not limited because of wastewater, but rather because of the emergency plan, particularly with regards to fire. While there are significant wait times for the tram in some summer months, in winter, when the OWTS is in use, there is rarely a wait. The number of visitors is significantly less in the winter time and the gondola is not the limiting factor. The applicant is not requesting an increase in overall capacity of the site or to alter any conditions besides the ultimate build -out of the gondola cabins. Currently, the applicant has approval to operate the site at a capacity of 1,551 persons at one time. The Wastewater Management Plan was approved in 2012 and deemed sufficient at that time, which included a seasonal use of the OWTS. The applicant is subject to any wastewater limitations that were indicated at that time, with the system in place as well as current capacity limitations. This was also indicated by the County designated engineer's review (Exhibit 18). The Applicant's engineer has indicated that the applicant is currently working to install a gravity sewer line that ties into the sewer system of the City (Exhibit 17). That system is anticipated to be in place this summer and once in place, there will be no limitation on wastewater year round. 7-106: Public Utilities It is staff's opinion, the substantial amendment application should not have an impact on Public Utilities. Utilities were examined and approved as part of the most recent approval. 7-107: Access and Roadways The application was referred to both the Colorado Department of Transportation and Garfield County Road and Bridge. Neither agency identified any issues with the proposal. It is staff's opinion that the proposal to upgrade the gondola could lessen traffic impact on access roads, as the gondola will be able to operate under more variable weather conditions. 7-108: Natural Hazards The substantial amendment application does not impact this standard and was deemed satisfied as part of past approvals. 7-109: Fire Protection The application was referred to Glenwood Springs Fire District (Exhibit 12). The district indicated that it did not have any issues with the proposal as the applicant was not requesting to change the overall capacity of the park. 5 Glenwood Caverns Adventure Park Board of County Commissioners — April 9, 2018 PW 7-201: Agricultural Lands The substantial amendment application does not impact this standard and was deemed satisfied as part of a past approval. 7-202: Wildlife Habitat Areas This Standard is not part of the Substantial Amendment application and was deemed satisfied as part of the original approval. The application was referred to Colorado Parks and Wildlife. No comments were received. The resolution of approval has conditions regarding wildlife that the applicant will still be subject to. 7-203: Protection of Water Bodies The substantial amendment application does not impact this standard and was deemed satisfied as part of a past approval. 7-204: Drainage and Erosion (Stormwater) The Substantial Amendment request should not impact this standard. The applicant has indicated that the upgrade will use the existing towers in place. 7-205: Environmental Quality The Application was referred to Garfield County Public Health (Exhibit 13). Morgan Hill responded that there would be very minimal environmental or public health impacts as a result of the project. She did indicate that if construction leads to additional land disturbance, proper dust mitigation and storm -water management protocols should be use. 7-206: Wildfire Hazards The application was referred to the Glenwood Springs Fire Department who did not indicate any issues with the proposal, provided they were a referral agency if there is any subsequent increase in capacity. An emergency management plan is in place for the site. 7-207: Natural and Geologic Hazards It is staff's opinion, the substantial amendment application does not impact this standard and was 6 Glenwood Caverns Adventure Park Board of County Commissioners — April 9, 2018 PW deemed satisfied as part of a past approval. 7-208: Reclamation It is staff's opinion, the substantial amendment application does not impact this standard and was deemed satisfied as part of a past approval. 7-301: Compatible Design It is staff's opinion, the substantial amendment application does not impact this standard. 7-302: Parking and Loading It is staff's opinion, the substantial amendment application does not impact this standard and was deemed satisfied as part of a past approval. 7-303: Landscaping It is staff's opinion, the substantial amendment application does not impact this standard and was deemed satisfied as part of a past approval. 7-304: Lighting it is staff's opinion, the substantial amendment application does not impact this standard and was deemed satisfied as part of a past approval. 7-305: Snow Storage It is staff's opinion, the substantial amendment application does not impact this standard and was deemed satisfied as part of a past approval. 7-306: Trails It is staff's opinion, the substantial amendment application does not impact this standard and was deemed satisfied as part of a past approval. V. STAFF DISCUSSION The applicant is requesting an amendment to change a Condition of Approval to allow for up to 44 cabins on the Tram. This amendment would not require them to be in groups of three as stated in the resolution from 2012 and would increase total number of cabins at build -out by 8. The hourly capacity of the gondola would increase from approximately 300 guests to 1,000. Staff is in favor of an Amendment to the condition however, staff recommends that rather than amending the condition, it be removed entirely. Staff research shows that this condition was required in 2002 and it appeared to have been included because it indicated ultimate anticipated build -out of the gondola. Past staff reports did not indicate any reason for the Condition of Approval besides describing the ultimate build -out of the gondola. The Staff 7 Glenwood Caverns Adventure Park Board of County Commissioners — April 9, 2018 PW Report from 2002 did mention that the Tram was put in place above the existing trees to lessen the visual impact on the hillside, however there is no discussion of why the gondola was required to be in groups of three and if this condition had anything to do with compatibility issues. It is staff's opinion that the change of the total number of cars on the gondola and requiring them to be grouped, does not need to be subject to a condition of approval. This is further supported by Glenwood Springs Fire Department referral comments that indicated there were no issues with the upgrade to the tram (Exhibit 12). The Glenwood Springs Fire Department indicated that they should be a referral agency if the applicant requests an increase in capacity in the future. The applicant is also going through an approval process with the City of Glenwood Springs, the City was included as a referral agency and did not respond with any comments. The upgrades to the tram will allow operation in more variable weather. It is staff's opinion that this could ultimately result in a decrease in vehicle trips to the Caverns property, as the Adventure Park would not need to shuttle guests via vehicles as often. The Amendment is not requesting a change in overall capacity, and is only requesting to alter the condition regarding the ultimate build -out of the tram. The applicant would still be required to meet all other conditions and limitations as outlined in the Resolution of Approval 2012-15 as well as any additional water or wastewater limitations. This includes limitations on wastewater or water throughout the year, and limitations on overall site capacity. Water and wastewater was reviewed as part of the most recent approval in 2012 and was deemed adequate to serve the use, with the current capacity limit. The Applicant's engineer has indicated that the applicant is currently working to install a gravity sewer line that ties into the sewer system of the City and has indicated that this work will be completed this summer (Exhibit 17). Once the upgrade is in place, there will be no limitation on wastewater year round. VI. SUPPLEMENTAL AND ADDITIONAL STAFF ANALYSIS No supplemental materials were submitted after the application was heard by the Planning Commission. VII. SUGGESTED FINDINGS The following recommended conditions of approval are provided for the Board of County Commissioners consideration. 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted or could be submitted and that all interested parties were heard at that meeting. 8 Glenwood Caverns Adventure Park Board of County Commissioners — April 9, 2018 PW 3. That for the above stated and other reasons the Substantial Amendment to the Land Use Change Permit for Glenwood Caverns Adventure Park is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is generally compliant with the Garfield County 2030 Comprehensive Plan. 5. That the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended. VIII. PLANNING COMMISSION RECOMMENDATION If the board chooses to approve the Substantial Modification the motion should state that the Land Use Change Permit should be amended with the removal of Condition 4 as referenced in Resolution 2012- 15. The other conditions as referenced in the resolution shall remain. The Planning Commission recommended approval of the Substantial Modification to an Approved Land Use Change Permit Application with the following conditions. 1. Refuse kept in non bear -proof containers should be kept within secure structures that are not likely to be broken into by bears; c. There shall be no dumps or underground disposal of refuse on site; d. Except for bird feeders, the feeding, baiting, salting, or other means of attracting wildlife to site is prohibited; e. Bird feeders should be strategically placed to avoid being an enticement for bears; f. Tourists and other users to the site should be made aware of the local wildlife community by utilizing information provided by the Division of Wildlife. 7. The Park shall be limited to a maximum guest capacity of 1,551 persons at one time; 8. If the tramway becomes obsolete or inoperable for any period exceeding twelve months, the applicant shall remove the tramway at their own expense; 9. Bus/van guest transport shall be limited an average of 30 vehicle trip ends per day; 10. The Applicant shall maintain a total of 35,000 gallons of water on-site for fire protection; 11. Parking of personal vehicles belonging to employees residing on-site during the months of May, June, July, August and September shall not be allowed on the subject property; 12. An emergency management plan shall be submitted to Building and Planning, prior to installation of additional Tram cabins or December 1, 2012 whichever applies first. They based the design on the previous year's peak winter usage of 1600 gpd, estimated for growth to 1995 gpd, then multiplied that times 1.5 and designed the OWTS on 2992 gpd. FYI: We are currently working to install a gravity sewer lateral that ties into the sewer system of the City. This should be completed by summer and the leach field will then be abandoned.
