Colorado, held in the CommissionersrMeeting Roomn Oarfield County Administration Building
in Glenwood Springs on Monday, the 3rd day of December A.D. 2}Iï,there were present:

8,393 ACRE PROPERTY O\ilNED BY STR.A,TEGIC ONE FINANCIAL INC., EAST OF
TTIE CITY OF RIF'LE. THE PROPERTY IS LOCATED AT 552 COUNTY ROAD 352,
RrFLE CO,81650 AND rI{ SECTION 19, TO1ryNSHIP 6 SOUTH, RANGE 92 \ryEST OF
THE 6TH PRINCIPAL MERIDIAN, GARFIELD COIINTY

Recitals
A. The Board of County Commissioners of Garfield County, Colorado, crg6erd" received
a request for a Land Use Change Permit to allow for a Waste Transfer Facility, as fi¡rther described
in Exhibit A, Site Plan.
B. The rüaste Transfer Facility, will be locatcd on an approximately 8.393 aere parcel
owned by Strategic One Financial Inc.
C. The subject property is located within unincorporated Garfield County in the Industrial
zone district and east of the City of Rifle, Colorado and accessed off of County Road 352.
D. A Waste Transfer Facility may be permitted in the Industrial z¡ne district wíth a Limited

Impact Review.
E. The Board is authorized to approve, deny or approve with conditions a Limited Impact
application resulting in issuance of a Land Use Change Permit pursuant to the Garfield County
Land Use and Developmont Code of 2013, as amended.
F. The Board opened a public hearing onthe 13ú day ofNovember, 2018 for consideration
of whether the proposed Land Use Change Permit should be granted or denied, during which
hearing the public and interested persons were given the opportunity to express their opinions
regarding the request. During public testimony, an adjacent property owner indicated that there
were potential code violations on the property in the form of trash accumulation, trash burning and
the occupation of recreational vehicles parked onsite. The Board continued the hearing to the 3'd
day of December, 2018 in order to address the concems of the property ownor.
G. Garfield County Code Enforcement conducted a site visit and discovered that a
recreational vehicle parked onsite was in fact occupied which constitutes a code violation. Notice
of Violation was issued and a Condition of Approval to rectify the code violation prior to issuance
of the Land Use Change Permit was added for the Board to consider.
G. The Board re-opened the public hearing on the 3'd day of December, 2018 for
consideration of whether the proposed Land use Change Permit should be granted or deuied,
during which hearing the public and interested persons were given the opportunity to express their
opinions regarding the requesl.
H. The Board closed the public hearing on the 3'd day of December, 2018 to make a final
desision.
L The Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determinations of fact:
l. That proper public notice was provided as required for the hearing before the Board of
County Commissioners.
2. The hearing before the Board of County Commissioncrs ïvas extensive and complete, that
all pertinent facts, matters and issues were submitted and that all interested parties were
heard at that meeting.
3. That for the above stated and other reasons, the proposed Land Use Change Permit for an
Infectious rWaste Transfer Station is in the best interest of the health, safety, convenieuce,
order, prosperity and welfare of the citizens of Garfield County.
4. That the application is in general conformance with the 2030 Comprehensive Plan, as
amended,

5. That with the adoption of conditions and for the above stated and other reasons the
application has adequately met the requirements of the Garfield County Land Use and
Development Code, as amended.
RESOLUTION
NO\ry THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that:
A. The forgoing Recitals are incorporated by this reference as part of the resolution.
B. The Land Use Change Permit for a Waste Ttansfer Facility is hereby approved subject to
compliance with the following conditions:
Prior to the fssuance of the Land Use Change Permit
l. prior to issuance of the Land Use Change Permit, the Applicant shall bring the property
into code compliance so that no code violations exist.
Z. Prior to issuance of the Land Use Change Permit, the Applicant shall obtain a Certificate
of Designation ûom Garfield County Board of Health.
3. Prior to issuance of the Land Use Change Permit, the Applicant shall obtain a Waste
Handling Permit ttuougþ Colorado River Fire Rescue.
4. Prior to issuance of the Land Use Change Permi! the Applicant shall work with Colorado
River Fire Rescue to üeate a parking plan for trucks and trailers utilizing the site for
transfer operations. This plan wilt be signed off on by Colorado River Fire Rescue and
Garfield County.
5. Prior to issuance of the Land Use Change Permit, the Applicant shall submit an updated
and scalable site planthat shows accurate building locations, vehicular circulation patterns,
parking and loaãing âreas and parking orientations consistent with the parking plan
submitted to Colorado River Fire Rescue.
OperatÍonal Conditions
6. All representations of the Applicant contained in the Application sr¡bmittals shall be
conditions of approval unless specifrcally amended or modifïed by the conditions contained
herein.

7. The facility shall be operated in accordance with all applicable Federal, State and local
regulations governing the operation of this type of facility including but not limited to
CDPHE and OSHA laws and regulations.
8. Prior to operation, Metal Building G will undergo an inspection by Garfield County
Building Department. This building shall be subject to all Garfreld CountyBuilding Code
Requirements. The property owner shall obtain all necessary Garfield County Building
pemrits for modification and/or expansion to the structure.
9. At time of building permit, the Applicant will provide evidence to the County that a secure
fence has been installed enclosing the truck and transfer trailer parking area. The fence
orientation shall be approved by the County.
i0. At time of building permit, the Applicant will provide eiidence to the County that an all-
weather driving surfase for the transfer and parking areas and fire truck turnaround has
been installed.
11. The Applicant shall comply with Garfield County's Noxious Weed Management Plan by
monitoring the site in the 2019 growing season with treatments if necessary.
12. The access road and driveway from County Road 352 shall be maintained to the standards
outlined in Section 7-107 of the Land Use and Development Code of 2013, as amended.
13. Vehicles entering and exiting the site shall adhere to the designated haul route that avoids
higher haffic areas as shown on the site plan.
14. Use of Metal Building G by drivers shallbe limited to activities related to the loading and
unloading ofvehicles.
15. Portable sanitation unit(s) shall be provided for on-site employees and maintained on a
weekly basis.
16. As per Colorado River Fire Rescue referral comments, the property shall have fire
extinguisher(s) wïth a 3A-40 BC rating that shall be mounted $o they can he accessed
within 75' travel distance from anywhere in the building. The property shall have the
address posted and visible from County Road 352 and an address sign posted at entrance
gate. The access gate shall have Knox Box or Knox Paddlock installed.
17. Waste shall be stored on-site fç¡r no longer than 72 hours. Trailers shall utilize refrigeration
as needed.

18. Operation of the site is permitted primarily during the hours of I a.m. to 5 p.m. Monday
through Friday with the exception of hours outside these due to exceptional or unusual
circumstances. Truck drivsrs shall lirnit vehicle idline while on site.
i9. The use shall comply with all applicable County and State noise requirements.
20. The Applicant shall comply with all Indusrial use standards as described in Section 7-1001
ofthe Land Use and Development Code of 2013, as amended.
