PC.2O1 8-03 A RESOLUTION CONCERNED WITH A LOCATION AND EXTENT APPLICATION FOR COLORADO MOINTAIN COLLEGE ASCENT CENTER AND RECREATION AND FITNESS CENTER (FrLE NO. LAEA-07-18-866ó) Recitals A. Garñeld County is a legal and political subdivision of the State of Colorado forwhich the Board of County Commissioners is authorized to act. B. Pursuant to law, the Board of County Commissioners of Garfield County has appointed the Garfield County Planning Commission (the Commission). C. Colorado Mountain Local College District (the Applicant) applied to the Planning Commission pursuant to File No. LAEA-07-18-8666 for a Location and Extent Review for the proposed conitruction of two new campus buildings: a Fitness and Recreation Center and "Ascent Center". D. The proposed construction will allow the Colorado Mountain College S¡ring Valley Campus to expand within its existing footprint in order to meet the current needs of students and enhance their bo[ege experience. Pursuant to Section 4-ll1(C) of the Garfield County Land Use and Development Code, as amended, and C.R.S. g 30-28-110(1Xa) the Commission is required to review the location and extent of the proposed construction of educational facilities to determine whether the proposed public facilig arrd improvements are in general conformance with the County's Comprehensive Plan of 2030, as amended (the Comprehensive Plan) and its Master Plan. F. In accordance with state law, the Planning Commission has adopted a Master Plan. The Master Plan applicable to this Petition is the Comprehensive Plan. G. The Commission opened a public hearing on August22,2018 upon the question of whether the proposal is in general conformanse rvith the Comprehcnsive Plan. H. The Commission closed the public hearing on August 22,2018 to make a decision on the request. I. The Commissior¡ on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following detenninations of fact: l. That proper public notice was provided as required for the hearing before the Planning Commission. Z. That the hearing before the Planning Commission was extensive and complete, that all pertinent facts, matters and issues were submitted or could be submitted and that all interested parties were heard at that hearing. 3. That for the above stated and other reasons, approval ofthe Location & Extent request by the Colorado Mountain Local College District is in the best interest of the health, safety, and welfare ofthe citizens of Garfield County. 4. That the Location and Extent request has been determined to be in general conformance with the Comprehensive Plan 2030, as amended. 5. Thæ the Location and Extent request is in conformance with the Review Criteria contained in Section 4-111, Location and Extent of the Garfield County Land Use and Development Code, as amended. 6. The determination of General Conformance is based on the Applicant's representations in their Application submittals and at the public hearing before the Planning Commission. Exhibit "4" describes the site plans and location of the proposed public facilities. C. The Location and Extent request for the construction of the Colorado Mountain College Ascent Center and Fitness and Recreation Center is hereby approved subject to the foilowing conditions of approval: l. That all representations made by the Applicant in the Application shall be conditions of approval unless specifically altered by the conditions of approval contained herein. That the Applicant shall obtain all required permits from the State of Colorado and comply with all applicable requirements of the local Fíre District- That the Facilities shall be operated in accordance with all applicable Federal, State and local regulations governing the operation of the specifio type of facilities.
