Copies of Garfield County Approved permits Page 1 of 6 TEP Rocky Mountain LLC Trail Ridge Employee Housing Facility Amendment to an Approved Land Use Change Permit PROJECT NARRATIVE August 24, 2018 Ms. Sheryl Bower- Garfield County Community Development Director Mr. Dave Pesnichak- Garfield County Community Development- Senior Planner Garfield County Community Development 108 8th Street, Suite 401 Glenwood Springs, CO 81601 Dear Ms. Bower and Mr. Pesnichak, I am writing in regards to Garfield County Commissioner’s resolution #2018-28 (Reception #907005) and the associated Amended Land Use Change Permit (Reception #907006) approving the Trail Ridge Employee Housing Facility. Condition #8 of the Amended Land Use Change Permit notes the following: “8. The Applicant shall install an Onsite Wastewater Treatment System (OWTC) to serve the proposed facility prior to August 27, 2018. The Applicant shall apply for an updated Septic System Permit and the installation of the System shall be in accordance with the Engineering Designs by All Service Septic, dated April 26, 2017, as submitted with Garfield County Permit #SEPT-05-17-4714.” The Certificate of Occupancy for the employee housing facility was issued on 3/27/17. TEP Rocky Mountain LLC is currently evaluating their future drilling schedule in the Trail Ridge area. It is possible that usage of the Trail Ridge Employee Housing Facility will become intermittent, dependent upon the TEP Rocky Mountain LLC drilling schedule in the area. Page 2 of 6 We respectfully request that Garfield County revise condition #8 as follows: “8. The Applicant shall not be required to install an Onsite Wastewater Treatment System (OWTC) to serve the proposed facility. The Applicant applied for a Waiver Request for Garfield County Land Use and Development Code- Section 7-705(C)(2)(e)- Wastewater Systems. Garfield County has found that the Waiver Request meets the criteria of Section 4-118 of the Garfield County Land Use and Development Code.” prior to August 27, 2018. The Applicant shall apply for an updated Septic System Permit and the installation of the System shall be in accordance with the Engineering Designs by All Service Septic, dated April 26, 2017, as submitted with Garfield County Permit #SEPT- 05-17-4714.” We respectfully request that Garfield County add condition #16 as follows: “16. Garfield County acknowledges that the Applicant plans to utilize the site for a Major Temporary Employee Housing Facility on an intermittent basis. The Applicant understands that removal of any structures from the site and relocation of the structures back to the site will require filing an application for building permits to the Garfield County Community Development Department.” Garfield County Land Use and Development Code Section 4-106.A.3 states: “3. Change of a specific condition(s) of approval as identified in a final approval made by the Decision-Making Body. Any requested change of a specific condition(s) as identified in a resolution adopted by the BOCC shall be considered a Substantial Modification.” Waiver Request for Section 7-705(C)(2)(e)- Wastewater Systems Our request to revise condition #8 as noted above, is effectively requesting a waiver of the Garfield County Land Use and Development Code- Section 7-705(C)(2)(e)- Wastewater Systems that states that a Vault and Haul System must demonstrate “The facility will not exceed a cumulative of 1 year at the approved location; and”. TEP Rocky Mountain LLC Reply: The original land use permit issued via resolution 2015-30 was adopted by the Garfield County Board of Commissioners on June 8, 2016. WPX Energy then sold their local assets to TEP Rocky Mountain LLC. During the course of this ownership change, no further work was conducted on the project. Resolution 2016-42 was adopted by the Garfield County Board of Commissioners on 6/13/16 and extended the land use permit approval to June 8, 2017. A building permit was received by TEP Rocky Mountain LLC on 2/1/17 and the Certificate of Occupancy for the facility was issued by Garfield County on 3/27/17. Page 3 of 6 Garfield County Commissioner’s resolution #2018-28 approved on 1/8/18 (Reception #907005) and the associated Amended Land Use Change Permit approved on 5/21/18 (Reception #907006) extended the OWTS construction date to 8/27/18. Garfield County Land Use and Development Code Section 4-118(C)1 and 2 indicates the criteria for a waiver request: “C. Review Criteria. A waiver may be approved if the Applicant demonstrates that the following criteria have been met by the proposed alternative: 1. It achieves the intent of the subject standard to the same or better degree than the subject standard; and TEP Rocky Mountain LLC Reply: We have designed, applied for and received an on-site wastewater treatment system permit number SEPT-05-17-4714. This permit was issued by Garfield County on 5/8/17. During the course of scheduling the construction of the on-site wastewater treatment system, TEP Rocky Mountain LLC management issued concerns regarding installation of a system at the site that may be utilized intermittently. The current vault and haul system consists of an 8’ wide x 44’-11” long x 9’-2 ¼” high, 8,000 gallon capacity, fully enclosed skid that collects the sanitary sewage from the Trail Ridge Employee Housing Facility. The current vault and haul system is: 1. Fed with an electrical feed from the housing facility and has lights, pumps and heat. 2. Protected from freezing via the skid enclosure and electric heat tape system 3. Has an alarm system tied to the employee housing facility to alert facility management when the tankage reaches 80% of capacity. 4. Has secondary containment between the sanitary sewage tankage via the skid unit. 5. Is regularly pumped and cleaned and has been in operation since 3/27/17 with no accidents or issues. In conclusion, the vault and haul system meets the Wastewater standard to the same degree as installation of an on-site wastewater system. 2. It imposes no greater impacts on adjacent properties than would occur through compliance with the specific requirements of this Code.” TEP Rocky Mountain LLC Reply: The only additional impact of utilizing a vault and haul system versus an on-site wastewater system is the additional truck traffic for the vault and haul system. Page 4 of 6 We are currently hauling an average of 5,715 gallons of sanitary sewage a week from the facility. This equals a total of 1.73 truck trips per week. Avg. Sanitary sewage hauling trips per week- 1.73 truck trips per week. Avg. Potable water hauling trips per week- 1.65 truck trips per week. Total avg. truck trips per week- 3.38 truck trips per week Please see the attached November 2014 Traffic Impact Analysis, Appendix C. Potable Water Delivery was estimated at 4 trucks per week. The combined Sanitary Sewage and Potable Water hauling is 3.38 truck trips per week. Our sanitary sewage and potable water hauling trips are 16% less than what we had estimated in our traffic impact analysis. Even with the sanitary sewage vault and haul system, we have not exceeded the estimated trip generation for the Trail Ridge Employee Housing Facility. In conclusion, there are no greater impacts on adjacent properties than what we presented in the original land use application. Facility Operation as per Section 7-705(C)(2)- Wastewater Systems a. “Year-round access is available and maintained for safe and regular access for sewage hauling vehicles;” TEP Rocky Mountain LLC Reply: The access roads to the facility are maintained year-round to the facility. b. “The Operator can demonstrate and guarantee an arrangement for hauling sewage;” TEP Rocky Mountain LLC Reply: Sanitary sewage is being hauled by HB Rentals under contract with TEP Rocky Mountain LLC. c. “The Operator will maintain all records, including but not limited to, trip logs/reports and landfill receipts;” TEP Rocky Mountain LLC Reply: TEP Rocky Mountain LLC maintains all records, including trip logs/reports and landfill receipts. Page 5 of 6 Please find attached the following documents: A. Sewer hauling log from 3/27/17 to 9/29/17. B. HB Rentals- Garfield County Landfill monthly invoices for sanitary sewage in March, July, August and September 2017. Please note that the Garfield County Landfill was not accepting sanitary sewage in April/May/June 2017, thus all sanitary sewage was delivered to the Clifton Sanitation District during this time period. C. HB Rentals-Clifton Sanitation District sanitary sewage waste accepted from 3/1/17 to 9/30/17. Note: Records B and C attached show all of the sanitary sewage hauled by HB Rentals during this time period. These totals include sanitary sewage hauled from sites other than the Trail Ridge Employee Housing Facility. Many times an HB Rentals sanitary sewage truck will haul loads from multiple locations in order to maintain efficiency. Additionally, due to U.S. Dept. of Transportation regulations addressing driver daily hours, some loads are disposed of the day after retrieval from the employee housing facility. d. “The sewage disposal records will be maintained as public records to be available to the County upon request;” TEP Rocky Mountain LLC Reply: The sewage disposal records will be maintained as public records to be available to the County upon request . f. “The facility has been designed to accommodate 75 gallons of wastewater per person per day or an amount derived from engineered calculations taken from metered usage rates at a similar facility that has been reviewed and approved by the County.” TEP Rocky Mountain LLC Reply: The vault and haul system design was prepared by All Service Septic in the attached report dated 4/5/18 and was designed for 75 gallons per day per occupant as per page 2- Design Specifications of the report. Utilizing information from the sanitary sewage hauling log, the sanitary sewage output per occupant is 34 gallons per day versus the design capacity of 75 gallons per day per occupant. The actual sanitary sewage production is 45% of the design capacity for the system. Conclusion: The existing vault and haul system is being operated in compliance with Garfield County regulations. INTRODUCTION Felsburg Holt & Ullevig has prepared a basic traffic impact analysis for the proposed Employee Housing Facility that will be constructed for WPX Energy in Garfield County, Colorado. The facility will be located approximately 13.5 miles south of Rio Blanco County Road (RBCR) 5 and will access RBCR 5 from BLM 1009A. In the long term, the facility will house an estimated 24 employees. Figure 1 provides a vicinity map of the project location, and Figure 2 shows a preliminary site plan. The current parcel is undeveloped and generates no traffic volumes. The site will access BLM 1009A and the surrounding road network through an existing intersection with RBCR 5. No new access points will be constructed along Federal, State, or County roads. All staging and storage for the construction of the facility will be done on site. Three time periods have been analyzed for this traffic study. Existing traffic count volumes were collected over two 24-hour periods. This information provides the basis for analyzing background traffic volumes. The facility will be constructed within a one-year period, and site- generated traffic volumes have been analyzed for the peak period of this construction effort. The following is an analysis of potential traffic impacts that might result from the proposed development. Garfield County standards have been met for the purposes of this submittal; however, it is anticipated that Garfield County will refer to Rio Blanco County for review and comment. The following page provides a summary of those standards. WPX Energy Trail Ridge Employee Housing Facility Traffic Impact Analysis Page 2 Garfield County Basic Traffic Impact Analysis (TIA) Standards This study is compliant with Garfield County TIA Standards for a Basic Traffic Analysis. As such, a brief summary of requirements is indicated below: 1. This study is conducted as a basic traffic impact analysis since the following criteria are not met. (Further analysis of these requirements is included in the Site Generated Traffic section.) a. Traffic volumes projected at any intersection with a State or Federal highway exceeds current volumes by 20%, as determined by CDOT using current traffic counts and CDOT-approved methodology. b. Traffic volumes projected on any county road segment exceed current volumes by 20%. c. Traffic volumes on any road segment identified or contained within an approved municipal street plan within a 1-mile radius exceed current volumes by 30%. 2. As a basic traffic analysis, this study includes the following information: a. A map or maps depicting the parcel or activity area and showing the following information. b. A narrative of existing land uses on the parcel. c. A narrative of proposed land uses and trip generation projections for each use, based on current Trip Generation manuals or other credible and defensible analysis. d. A narrative description of the construction phase of development. e. Map depicting existing Average Daily Traffic Count information for all County Road segments and State or Federal Highway intersections, at the appropriate map scale. EXISTING CONDITIONS Turning movement volumes at the intersection of RBCR 5 and BLM 1009A were manually counted for a total of two days (November 16 and 17, 2014, and November 21 and 22, 2014) and are summarized in 15-minute periods. The counts started each day at 6:00 AM, and large trucks and other specialized vehicles were counted separately from cars. Appendix A provides these counts. The counts from November 21, 2014, resulted in higher traffic volumes than those for November 16; therefore, the analysis was based on the November 21 counts to be conservative. The peak hours were determined to be 6:30 to 7:30 AM, 12:00 to 1:00 PM, and 3:30 to 4:30 PM. Figure 3 shows the existing traffic volumes for these peak hours. The average daily traffic (ADT) along RBCR 5 is roughly 1,300 to 1,400 vehicles per day (vpd). Truck traffic at this intersection was analyzed using Passenger Car Equivalents (PCE), in which one large truck is equivalent to three passenger cars. This is consistent with CDOT standards and is used throughout the duration of this analysis. Truck traffic represents approximately 20 percent of the traffic at this intersection. A minor amount of traffic uses BLM 1009A, and almost no traffic uses the existing private access north of RBCR 5. It should be noted that existing traffic using BLM 1009A may continue past the proposed project site as the road provides access to the rangeland. Traffic operational analyses were completed to determine the level of service (LOS) for turning movements at the site access. LOS is a measure of several factors including operating speeds, freedom to maneuver, traffic interruptions, and average delay for vehicles at intersections. The LOS describes the quality of traffic flow for turn movements at an intersection by a letter designation ranging from “A” to “F.” Table 1 presents detailed LOS descriptions. Table 1. The high volume of trucks was specifically taken into account through the use of PCE for these analyses. The results of this analysis show that morning, noon, and evening peak hour volumes at this intersection currently operate at LOS A (see Figure 3). For auxiliary lanes analysis purposes, RBCR 5 was analyzed as an R-A – Rural Highway. The Colorado State Highway Access Code auxiliary lane criterion requires left turn deceleration lanes for movements over 10 vehicles per hour. However, this requirement can be waived if opposing traffic volumes are less than 100 vehicles per hour, which is true for existing traffic volumes. Therefore, no auxiliary lane would be recommended under these traffic conditions. No other approaches have high enough volumes to warrant the addition of an auxiliary lane. Appendix B includes existing LOS worksheets. TRIP GENERATION A. Trip Generation and Distribution Operational information provided by the client was used to determine appropriate trip generation for this development. Trip generation volumes were estimated for both 2015 (during construction of the site) and after completion (once the site is up and running). There are three phases to the construction process: earthwork (20 days), wastewater system installation (7 days), and camp installation (2 days). Appendix C summarizes the traffic impacts of these phases. The earthwork portion of construction is projected to have the greatest traffic impact (estimated 20-day period) and was used for analysis. Additionally, activity data provided by WPX Energy and general assumptions used in determination of trip generation are summarized below. Construction (Earthwork Phase) – 2015 It is anticipated that the construction of the site will be finished in early-to-mid 2015. The trip making for this phase is shown in Appendix C and summarized as follows:  A maximum of 5 personnel truck trips will occur daily.  An estimated 6 heavy vehicles and 2 tandem dump trucks will arrive and stay on site for 20 days.  A tandem water truck will make 3 trips per day.  An estimated 270 truckloads of earthwork materials will be delivered to the site over a 20-day period (approximately 14 trucks/day in a 12-hour work day) Construction materials and equipment will be delivered to the site throughout each phase of construction. An approximate total of 2,516 PCE trips have been estimated, as shown in the spreadsheet provided in Appendix C. A conservative estimate was made in Table 2 of how many of these vehicle trips would occur during the three peak hours being analyzed. When using the above assumptions and construction traffic estimations, the site will generate a maximum of approximately 157 PCE trips per day in 2015, as seen in Table 2. Refer to the Traffic Worksheet in Appendix C for more information. Plant Operations and Maintenance  An estimated 24 workers will reside within the facility. Workers will be shuttled to the site, live, and work for extended periods of time. These traffic impacts are negligible.  It is estimated, conservatively, that there will be up to 34 round trips per month to the site after completion (approximately 1 trip per day). See the Traffic Worksheet in Appendix C for more information.  This amount of traffic is negligible and will not have significant impact on surrounding roadways. It was assumed that most (80 percent) of the vehicles accessing the site would be oriented to the east on CR 5. This is the closest route to Rifle (and Meeker) where most of the off-site workers are expected to live and to I-70 where most of the deliveries will come from. The remaining 20 percent will be oriented to the west on CR 5, in the direction of Rangely. Analysis of existing roadways and traffic volumes indicates that traffic volumes will not increase substantially during construction or in the long term operation of this facility. Traffic volumes along RBCR 5 are expected to increase by a maximum of 157 PCE trips per day during the construction period and by a maximum of 1 to 2 vehicles per day in the long term operation. Comparing to collected daily traffic counts at the intersection of RBCR 5 and BLM 1009A results in an increase of approximately 8 percent during the construction phase and less than 0.1 percent in the long-term operation. At the intersection of RBCR 5 and State Highway 13, existing traffic volumes are approximately 3,900 vehicles per day. This results in a maximum projected increase of 3 percent. Additionally, traffic volumes are not projected to impact any municipal street plan within a one-mile radius of the site. WPX Energy Trail Ridge Employee Housing Facility Traffic Impact Analysis Page 10 IV. TOTAL TRAFFIC AND LEVELS OF SERVICE A. Traffic Volumes The addition of existing and site generated traffic yields the total traffic volumes used in this analysis. Figure 5 shows total traffic volumes. Passenger car equivalents were used in the analysis. B. Levels of Service Operational analysis was completed for total traffic volumes in 2015 for the RBCR 5/BLM 1009A intersection. The intersection of RBCR 5 and BLM 1009A was analyzed as a two-way stop- controlled intersection, with RBCR 5 traffic moving freely and BLM 1009A/Private Access traffic being stop-controlled. Figure 5 presents the resulting levels of service, and Appendix B includes the analysis worksheets. Traffic analysis was not completed for the operational phase of the facility because projected traffic volumes were approximately 1 to 2 vehicles per day. Auxiliary lane analysis was also completed for Total Traffic scenarios. In the AM peak hour, westbound left turn traffic volumes (51 vehicles per hour) again exceed the threshold for a left turn deceleration lane. However, as with existing traffic volumes, opposing traffic is lower than 100 vehicles per hour. This allows the left turn deceleration lane requirement to be waived. During the PM peak hour, westbound left turn traffic exceeds the threshold for a left turn deceleration lane (12 vehicles per hour). In this scenario, opposing traffic volumes are not below 100 vehicles per hour. As such, the auxiliary lane requirements cannot be waived. However, based on the short duration of these traffic conditions (20 days) and that the intersection operates at LOS A for all movements, it is not recommended that an auxiliary lane be required in the total traffic scenario. No other approaches have high enough volumes to warrant the addition of an auxiliary lane. The results of the analyses show that all turning movements operate at LOS A during all three peak hour periods in the total traffic scenario. SUMMARY / CONCLUSIONS The results of the LOS analyses show that traffic operations at the intersection of RBCR 5 and BLM 1009A will not be negatively impacted by the development of the WPX Energy Trail Ridge Employee Housing Facility. This intersection will operate at an LOS A during all peak hours for existing and total traffic scenarios with the existing lane configuration. Phil Vaughan 1038 County Road 323 Rifle, CO 81650 Onsite Wastewater Treatment System Design – Vault and Haul Terra Energy Partners - Trail Ridge Employee Housing Facility Garfield County, Colorado Phil, ALL SERVICE septic, LLC has completed an onsite wastewater treatment system (OWTS) vault design for the subject employee housing facility. This design is in accordance with Section 7-705 of the Garfield County Land Use and Development Code and Garfield County On-Site Wastewater Treatment System Regulations, Section 43.12 D. The Site is located in a rural area of Garfield County where OWTSs are necessary. This letter has been revised to address a change in size in the potable water skid from the original letter dated November 14, 2014. The legal description of the property is as follows: Section 3, Township 5 South, Range 97 West of the 6th Principal Meridian, County of Garfield, State of Colorado. SITE CONDITIONS The above-mentioned property (Site) is accessed via Rio Blanco County Road 5 and BLM Road No. 1009. A previously excavated flat pad exists on the Site and a 60’ x 125’ Storage Building will be developed on this portion of the Site. The employee housing will consist of six factory-built units with a footprint of approximately 72’ x 58’ and will be located east of the excavated pad. The proposed septic tanks (vaults) will be located south of the employee housing units. This area slopes to the south and is currently vegetated with sage and native grasses. Potable water will be hauled to the Site. The 8,000-gallon potable water skid will be located at least 25- feet from the proposed septic tanks. Page 2 DESIGN SPECIFICATIONS A 24-person employee housing facility is proposed. The OWTS vault design is based on a wastewater flow (Q) of 1999 gallons/day. OWTS Calculations: 75 gallons/person x 24 people = 1800 gallons/day Using 1999 gallons/day Vault capacity = 1999 gallons x 48 hours = 3398 gallons minimum Using 1500 gallon + 1500 gallons + 1500 gallons = 4500 gallons A commercial kitchen will be part of the employee housing facility. A grease recycling procedure will be implemented to minimize grease entering the OWTS. Grease will be collected in a bucket stored in the kitchen. The grease will then be transferred to a bear-proof recycling container located at the exterior of the kitchen. The sewer line exiting Unit MDP is 2 ½-inches in diameter and 10 ½-inches above the ground surface. The sewer line exiting Unit LP4 is 3 ½-inches in diameter and 8-inches above the ground surface. Both sewer pipes will transition to a 4-inch diameter, schedule 40 sewer line with double-sweep clean outs. Heat trace and insulation must be installed on all above grade sewer lines. The OWTS installation will include two 1500-gallon, single compartment septic tanks, followed by one 1500-gallon, two-compartment septic tank. An alarm float must be set at 17-inches above the bottom of the tank in the first compartment of the third 1500-gallon, two-compartment tank. The high- water alarm will connect to “Smart Camp” security system. An Orenco® AMAHW alarm and panel is recommended. Specifications are enclosed. Other alarms and control panels or ultra-sonic options may be considered. Once the alarm signals, pumping must be coordinated, understanding the septic tanks are at 75% capacity, with 1125 gallons of capacity remaining. Septic tanks must have PVC risers on all manhole access ports brought to grade. Tee posts and fencing (or steel bollards) must be placed around the tanks to eliminate the possibility of traffic over the area of the septic tanks. The component manufacturers are typical of applications used by contractors and engineers in this area. Alternatives may be considered or recommended by contacting our office. Construction must be according to Garfield County On-Site Wastewater Treatment System Regulations, the OWTS Permit provided by Garfield County Building Department, and this design. OPERATION INFORMATION AND MAINTENANCE The following items must be provided in accordance with Section 7-705 of the Garfield County Land Use and Development Code: a) Year-round access must be available and maintained for safe and regular access for sewage hauling vehicles; b) WPX Energy must demonstrate and guarantee an arrangement for hauling sewage; c) WPX Energy must maintain all records, including but not limited to, trip logs, reports, and landfill receipts; and d) Sewage disposal records must be maintained as public records and be available to the County upon request. Page 3 Garbage disposal use should be minimized, and non-biodegradable materials should not be placed into the OWTS. Grease should not be placed in drains. Loading from a water softener should not be discharged into the OWTS. No hazardous wastes should be directed into the OWTS. Mechanical room drains should not discharge into the OWTS. The OWTS is engineered for domestic waste only. INSTALLATION OBSERVATIONS ALL SERVICE septic, LLC must view the OWTS during construction. The OWTS observation should be performed before backfill, after placement of OWTS components. ALL SERVICE septic, LLC should be notified 48 hours in advance to observe the installation. LIMITS: The design is based on information submitted. All OW TS construction must be according to the county regulations. Requirements not specified in this report must follow applicable county regulations. The contractor should have documented and demonstrated knowledge of the requirements and regulations of the county in which they are working.
