HomeMy WebLinkAboutDirector's Determination - Land Use 11.05.2018Garfield County November 5, 2018 John Parrington, Tally Ho Construction 145 County Road 225 Rifle, CO 81650 DIRECTOR DETERMINATION — Pipe Manifold Specialists Small Contractor's Yard — Administrative Review — Land Use Change Application (GAPA-07-18-8657) Dear Mr. Parrington, This letter is provided to you, as the authorized representative for Garfield County File GAPA-07- 18-8657 pertaining to a Land Use Change Application for a Small Contractor's Yard, Small, The property is located at 3131 Highway 13 Rifle, CO 81650 and is known by Assessor's Parcel No. 2129-361-00-009. This letter is notification that your Land Use Change Request has been reviewed by the Community Development Department and the Director hereby issues a determination conditionally approving the request. The conditions of approval are as follows: Conditions Prior to Issuance of the Land Use Change Permit 1. Prior to issuance of the Land Use Change Permit, the Applicant shall provide the County with the complete and approved CDOT Access Permit and comply with any and all conditions contained therein. 2. Prior to issuance of the Land Use Change Permit, the Applicant will provide the County with the following updates to the site plan: • Include the location of the existing residence. • Show all current and future circulation patterns as well as employee parking areas. • Show the location of building access for employees and vehicles/trailers. General Conditions 3. All representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 1 4. At time of building permit, the Applicant shall install a vegetation buffer of at least 5' in width along the creek to mitigate any drainage issues that may arise from the proposed structure, parking and circulation areas. 5. At time of building permit, the Applicant shall work with Garfield County Vegetation Management to complete a weed management plan approved and accepted by the Vegetation Manager. 6. Prior to operation, the temporary storage structures west of Government Creek shall be removed from the property. 7. As per Colorado River Fire Rescue referral comments, the property shall have fire extinguisher(s) with a 3A-40 BC rating and shall be mounted so they can be accessed within 75' travel distance from anywhere in the building. The property shall also have the address posted and visible from Highway 13. 8. All uses associated with the contractor's yard shall be contained within the 60' x 100' metal building as shown on the site plan and the storage of vehicles and trailers shall be limited to 3 vehicles and associated trailers as indicated in the application. 9. The operation of the contractor's yard shall be done in accordance with all applicable Federal, State, and local regulations governing the operation of this type of facility. 10. All parking areas, loading areas and access drives shall have a durable, all-weather surface made of materials suitable for the use. 11. The access driveway from State Highway 13 shall be maintained to the standards outlined in Section 7-107. 12. The bridge shall not be used as an access point for employees. 13. The 60' x 100' metal building shall be subject to all Garfield County Building Code Requirements. The property owner shall obtain all necessary Garfield County Building Permits for modifications and/or expansions to the proposed structure. 14. All exterior lighting shall be downcast and shielded and comply with Section 7-304, Lighting Standards, of the Land Use and Development Code of 2013, as amended. 15. The Applicant shall comply with all Industrial Uses standards as described in Section 7- 1001 of the Land Use and Development Code of 2013, as amended. 2 Notice of this decision will be provided to the Board of County Commissioners who has the ability to `call-up' the application for review at a public hearing. You will be notified of the Board decision once it is received or upon expiration of the 10 day notice period (November 15, 2018).
