AGREEMENT REGARDING CERTIFICATE OF OCCUPANCY
WHEREAS, Neil Westberg (hereinafter "Owner") has applied for a
Certificate of Occupancy for a house located on Lot No. 1, 45855 Hwy 6 &
24, Canyon Creek Estates, Garfield County, Colorado and,
WHEREAS, the following items have been determined to be apparent
defects or deficiencies with the application which prohibits the issuance of
a Certificate of Occupancy until they have been resolved pursuant to the
UBC (Uniform Building Code) and approved by the Garfield County Building
Official:
1. The smoke detectors on the lower and middle level of the house
have been located on the ceiling about 2 or 3 inches from the wall.
This appears to be contrary to the U.L. Listing of the detectors.
2. Permanent columns and foundation for the columns supporting a
deck on the South East side of the building have not been
constructed. Columns are now temporary.
3. The roof over hang on the North East side is supported by a
temporary column and requires a permanent column and foundation
for the column.
and,
WHEREAS, the Owner is willing to make certain assurances and
agreements relating to these identified defects and deficiencies and on the
basis of such assurances the County is willing to issue a Certificate of
Occupancy.
NOW, THEREFORE, it is agreed as follows:
A. The owner agrees to do the following:
Deficiency No. 1. The smoke detectors on the lower and middle level of the
house have been located on the ceiling about 2 or 3 inches from the wall.
This appears to be contrary to the U.L. Listing of the detectors.
ACTION REQUIRED OF THE OWNER:
The Owner will provide verification that the smoke

detectors are located in accordance with the
manufacturers installation instructions and if they are
not, cause the detectors to be relocated as specified in
these instructions.
Deficiency No. 2. Permanent columns and foundation for the columns
supporting a deck on the South East side of the building have not been
constructed. Columns are now temporary.
ACTION REQUIRED OF THE OWNER:
The Owner will install foundations for columns below
frost line and provide columns for the support of the deck
in compliance with the U.B.C. The owner will request
appropriate inspections by the building department to
verify code compliance.

by a temporary column and requires a permanent column and foundation
for the column.
ACTION REQUIRED OF THE OWNER:
The Owner will install foundations for columns below
frost line and provide columns for the support of the roof
overhang in compliance with the U.B.C. The owner will
request appropriate inspections by the building
department to verify code compliance.
FURTHER ACTION REQUIRED OF THE OWNER:
The Owner will complete all work described herein and request
inspection of all work by the Garfield County Building
Department. All Work shall be completed in compliance with
the stated provisions of the UBC in a manner that will enable
approval of all work. All work, inspections and approval of
work shall be completed within Fifteen (15) days of the date of
signing of this document.
B. In the event the Owner fails to perform as agreed on any of the
above, the County may revoke any permits which may have been granted to

the owner. The County will require that habitation and occupancy of the
house cease immediately and all personal possessions be immediately
removed from the building.
C. This agreement is binding upon the heirs, successors in title, and
assigns of the parties.
