Also included are the permit conditions and a reporting form. While operating this system you must follow the permit conditions and engineering specifications. Please read the permit conditions carefully as there are updated conditions included with this permit. Specific conditions of this permit require you to submit monthly reports, It is imperative to the success of this program that you comply with all of the sampling and reporting requirements. Failure to comply with these requirements could result in initiation of an enforcement action. Please submit lab reports along with daily bench sheets and any other relevant data at least monthly. I will be paying close attention to this requirement as this level of detailed reporting was not included with monthly lab data for your last operation. Additionally, lab data must include the original lab reports along with any QA/QC data provided to you by the laboratory. Your design engineer is responsible for inspecting the installation of the approved system and must certify, in writing, to Garfield County Public Health within 5 working days after installation of the unit that the installation complies with the approved plans. The design engineers installation certification shall include as -built information, including any system modifications and/or optional appurtances installed by EnCana Oil and Gas, USA or its contractors. In accordance with the permit application, treated effluent associated with this permit will only be used at EnCana Oil and Gas, USA leaseholds for downhole drilling and completion operations (per COGCC regulations), boiler feed, dust mitigation and irrigation water. The effluent must be used only in accordance with the permit conditions and any effluent use location and purpose of use must be included on the daily report form. All installation must comply with all requirements of the Colorado State Board of Health Individual Sewage Disposal Systems Chapter 25, Article 10 C.R.S. 1973, Revised 1984. 2. This permit is valid only for connection to structures which have fully complied with County zoning and building requirements. Connection to or use with any dwelling or structures not approved by the Building and Zoning office shall automatically be a violation or a requirement of the permit and cause for both legal action and revocation of the permit. 3. Any person who constructs, alters, or installs an individual sewage disposal system in a manner which involves a knowing and material variation from the terms or specifications contained in the application of permit commits a Class 1, Petty Offense ($500.00 fine - 6 months in jail or both). White - APPLICANT Yellow - DEPARTMENT AUTHORIZATION TO DISCHARGE TREATED WASTEWATER EFFLUENT UNDER THE GARFIELD COUNTY BOARD OF HEALTH INDIVIDUAL SEWAGE DISPOSAL SYSTEMS REGULATIONS PERMIT #4561 - CONDITIONS FOR DOMESTIC WASTEWATER TREATMENT SYSTEMS THAT DISCHARGE TREATED EFFLUENT TO THE GROUND SURFACE, BELOW THE GROUND OR TO THE ATOMSPHERE In accordance with the Garfield County Board of Health Individual Sewage Disposal Systems (ISDS) Regulations and in compliance with Section 25-10-104(2), (3), and (4) C.R.S., these permit conditions shall govern all aspects of permits, performance, location, construction, alteration, installation, and use of this individual sewage disposal system of less than 2,000 gallon per day design capacity that will reuse treated effluent through applications that discharge treated effluent to the ground surface, below ground (without a soil absorption system) or to the atmosphere. At no time shall this system exceed an average daily sewage flow of 1999 gallons per day as measured by the designed influent flow meter over a rolling 30 -day period. This ISDS permit specifically authorizes the permittee to discharge treated domestic wastewater in accordance with permit requirements and conditions set forth in this document. All discharges authorized herein shall be consistent with the terms and conditions of the permit. A. GENERAL: Those systems that discharge effluent directly to the atmosphere, the ground surface or below the ground or which employ aerobic or other secondary wastewater treatment principles may be permitted by Garfield County only if designed and stamped by a Colorado registered professional engineer. All system components must meet or exceed the minimum component design criteria as outlined in Section VIIIA of the Garfield County ISDS Regulations and must be constructed and installed in strict accord with the plans as submitted and hereby approved. Sewer lines must be constructed of pressure rated or equivalent materials with sealed joints and meet the 10 -foot separation to potable water lines. There shall be no discharge of treated effluent to waters of the State of Colorado without an appropriate discharge permit from the Colorado Department of Public Health and Environment, Water Quality Control Division. Treated effluent may not be discharged in a manner that allows drainage or discharge off the property of origin. The permit is issued only to the owner of the wastewater treatment system. If the owner of the wastewater treatment system is not the owner of the land to which the effluent will be applied, the permit application must be accompanied by a letter from the landowner indicating the landowner's approval for discharge of treated domestic wastewater effluent to the ground surface, below ground or to the atmosphere above the subject property. As stated in the permit application submittal materials by the permittee, treated effluent produced under this permit will only be used on the property of origin, only for down hole drilling and completion operations per COGCC regulations, make-up water, boiler feed water, dust mitigation and irrigation. Additional uses of treated effluent must receive advance written approval of the Garfield County Public Health (GCPH). The design engineer is responsible for inspecting the installation of the approved system and must certify, in writing, GCPH within 5 working days after installation of the unit that the installation complies with the approved plans. The design engineer's installation certification shall include as -built information, including any system modifications and/or optional appurtances installed by the permittee. B. MINIMUM EFFLUENT QUALITY REQUIREMENTS Effluent discharged from the permitted system must meet the following effluent limits due to the possibility for occasional direct human contact with the discharged effluent. Parameter Limits: Applied at point of sampling, BODS (mg/1) Twenty (20) when averaged over any three (3) consecutive samples TSS, mg/1 Forty (40) when averaged over any three (3) consecutive samples Fecal Coliform (# 100 ml) Twenty-five (25) when averaged over any five (5) consecutive samples and no single sample result for fecal Coliform shall exceed 200 per 100 rnI By CDPHE and COGCC approval, domestic wastewater effluent treated in accordance with the conditions of this permit may be utilized in downhole oil and gas well development processes. To maintain effluent quality from point of compliance to point of use, the permittee shall not transport treated effluent for reuse in any D. METHODS OF ANALYSIS — SAMPLING POINTS (Point of Compliance): All effluent samples shall be analyzed by a Iaboratory certified by the State of Colorado to conduct such analyses, in accordance with the methods prescribed in the most recent edition of "Standard Methods for Examination of Water and Wastewater" (American Public Health Association). The point of compliance for this permit shall be the sampling port inside the building following disinfection. Results of any analysis must be submitted to the GCPH representative with regular system reports unless a permit violation occurs, in which case, such violation must be reported to GCPH within 24 hours of discovery. E. RECORDS The Permittee shall establish and maintain records. Records must be submitted to the regulatory authority no less often than monthly or as otherwise directed by the GCPH representative. Required records shall include, but not be limited to, the following: • A copy of the chain of custody from the analyzing laboratory; • The date, type, exact place, and time of sampling or measurements; • The individual(s) who performed the sampling or measurements; • The date(s) the analyses were performed; • The individual(s) who performed the analyses; • A copy of the analytical report provide by the laboratory QAJQC results; • The analytical techniques or methods used; • Any system repair or maintenance performed including the reason for said repair or maintenance; • Accounting of type and quantity of materials removed from the system; • Accounting of how the treated effluent was used/discharged (e.g. irrigation, dust mitigation on-site, area dust mitigation). F. RELOCATION OF SYSTEM, CHANGE OF EFFLUENT USE The Permittee shall inform GCPH in writing of any intent to construct, install, or alter any process, facility, or activity that is likely to result in a new or altered discharge either in terms of location or effluent quality no less than 10 working days of the planned move or the occurrence of the new or altered discharge, and shall furnish GCPH such plans and specifications which GCPH deems necessary to evaluate the effect on the proposed discharge. Relocation of the treatment facility constitutes a new installation and thus requires a new permit. A permit application, site plan of the new location and any associated fees must accompany notification of the planned relocation or modification of the system. G. REMOVED SUBSTANCES Solids, sludge, or other pollutants removed in the course of treatment or control of wastewater shall be transported and disposed of in a manner that prevents any pollutant from such materials from discharging to the ground surface or entering waters of the State. For all domestic wastewater treatment systems, the permittee shall dispose of septage or other waste materials in accordance with State (Regulation No. 64) and Federal (Section 405(d) of the Act) regulations. The Permittee shall take all reasonable steps to minimize or prevent any discharge or disposal in violation of this permit that could adversely affect public health or the environment. The Permittee shall maintain a copy of a service contract and any pumping and disposal records from the contracted systems cleaner and submit such information when requested by GCPH. H. PERMIT VIOLATIONS Failure to comply with any terms and/or conditions of this permit shall be a violation of this permit. The discharge of any pollutant identified in this permit more frequently than or at a level in excess of that authorized shall constitute a violation of the permit. Permit violations will be subject to enforcement provisions as outlined in Section IV.H, IV.I, and IV.N of the Garfield County ISDS Regulations. In addition, within 24 hours of discovery, the Permittee shall report to the regulatory authority, any violation of the permit conditions. Exceedence of effluent quality limits requires the permittee to immediately cease discharge of effluent to the ground surface or other reuse applications until the Permittee reestablishes compliance with effluent limits as confirmed by GCPH. During periods of no discharge due to exceedance of effluent limits or other reasons, the effluent must be either contained in onsite tankage for recirculation through the treatment system or removed by the contracted systems cleaner and disposed of at an approved septage disposal facility. Violations of the permit are the sole responsibility of the Permittee. I. ACCESS TO THE SITE For the purpose of inspection and enforcing applicable rules, regulations, terms and conditions of any permit issued, GCPH or designated agent is authorized to enter upon private property at reasonable times and upon reasonable notice for the purpose of determining whether or not operating sewage treatment systems are functioning in compliance with this permit. J. OPERATOR REQUIREMENTS To ensure effective operation and maintenance of the wastewater treatment system the Permittee is encouraged but not required to provide a Colorado Class C Certified Wastewater Operator for each permitted wastewater treatment system permitted for reuse of the treated effluent. Any operator of a permitted system, whether certified or not, shall be thoroughly trained by a manufacturer's representative in the operation and maintenance of any system of which they are responsible for overseeing and shall insure the effective oneration ()fall mechanical and e1ertriral
