The applicant is requesting a permit for an Secondary Dwelling Unit (SDU) on a 17.5 acre parcel located within the Rural zone district. The property is over the 2 acre minimum lot size for an SDU in the Rural zone district. As the property is over 4 acres, the SDU is limited to 3000 square feet. The Garfield County Comprehensive Plan of 2030 identifies the property as a Residential Medium. This means the suggested density is 6 to 10 acres per dwelling unit. This structure shares the Stryker's well (their well permit explicitly states that it is limited to two single family dwellings, has its own septic tank that is correctly sized for a 2-bedroom SDU and also has its own driveway. The project would entail modifying the existing space to include a kitchen and converting one of the half bathrooms into a ¾-bathroom. On 8/7 /18 the Stryker's authorized representative, Kerry Kleisner, worked with "Bev" at the courthouse. They learned that Fred Jones reserved½ the mineral rights to oil/gas/minerals when he sold the land in 1963. Everyone else who has bought and sold the land has not reserved rights and so currently the Strykers own the other half. According to Bev, the line ended with Freddy--there is no documentation on record that shows who Fred ,Jones purchased the land from. Improvements Agreement/Development Agreement: A waiver is requested from an improvements agreement as there are no public improvements associated with the land use change request. A waiver is also requested from a development agreement as the project will not be phased. Site Plan A waiver is requested for this since the structure has already been built. Grading and Drainage Plan Topo map demonstrating positive drainage off the site: included in documentation, printed out by Garfield County Landscape Plan Per Claire Dalby at Garfield Co, SDUs are exempt from this requirement Impact Analysis Response to identified impacts as addressed in Section 4-203(G). All adjacent properties are single home properties. The structure already exists on the property; there are no water features on this property as well as no potential natural or manmade hazards. We do not anticipate any environmental impacts or impacts on neighbors by modifying this structure in order to turn it into an SDU. Traffic Study If this is rented out to a family of 2-4 persons, it is anticipated that 1-2 cars will leave the SDU and return daily 1-2 times per day. Water Supply /Distribution Plan Need to include well permit, augmentation plan, 4-hour pump test and water quality test. The current well permit on file showing it as a shared well, so documentation has been provided showing that the property that used to share the well has separated from the Stryker's well (new well permit for 7209 CR 100 and Quit Claim Deed) January 2019: From CO Division of Water Resources: as long as we have Smalley permit, we don't need to re-permit the well. The Stryker well is already approved for 2 single family structures. Wastewater Management Plan GarCo issued septic permit is included in documentation. Per permit it has a 750 gallon capacity which per Claire Dalby at Garfield County is adequate for 2 bedrooms. Design Standards Demonstration of conformance with Section 7-107, Access and Roadways This structure has its own driveway and is currently being used as an office so 2 cars can already park there safely. There is no public right-of-way or new impacts associated with this structure. The road that leads to this driveway is just off CR 100 and falls in the "Semi Primitive Road" category from Table 7-107. It measures 16' and therefore takes care of the requirement that it require two 8-feet lanes. GENE RA L PROJECT DESCRI PT ION The applicant is requesting a permit for a Secondary Dwelling Unit on a 17.5 acre parcel located approximately 4 miles northeast of the Town of Carbondale. The property is over the 2-acre minimum lot size for an SDU in the Rural zone district. As the property is over 4 acres, the SDU is limited to 3,000 square feet. The Garfield County Comprehensive Plan identifies the property as Residential Medium (6 to 10 acres per dwelling unit). The improvements on the property are a single-family dwelling unit and a studio/office space. Staff understands that the SDU will be built within this existing studio/office space and will be approximately 2,880 square feet in size. It is understood that the unit will be served by an individual septic. Should the Applicant wish to utilize the existing septic system, the Applicant will either need to provide a septic permit issued by Garfield County demonstrating the number of bedrooms the system can handle and gallons of the tank along with demonstration of the total number of bedrooms the system is proposed to serve. Alternatively, the applicant may provide a letter from a professional engineer registered in the State of Colorado indicating that the septic is capable of handling the additional capacity of the SDU. If a new system is to be installed, then this arrangement needs to be represented in the application. 1 It is understood that the SDU will be served by an existing well on the property. The Applicant will need to demonstrate that the existing well is legally and physically able to serve the SDU and the primary dwelling unit. A well permit will need to be provided that demonstrates that each unit on the property is legally served by water. Staff recommends that the applicant contact Dwight Whitehead (970-945-5665 x 5011) at the Division of Water Resources for further information on the legal status of the well. A 4-hour pump test and water quality test are required, but may be done as a condition of approval (however, please submit any supporting information available). A ~ water quality test in compliance with Section 4-203(M)(l)(b)(S)(C) will need to be provided. Please note that the water quality test does not need to include testing for Alpha/ Beta as it is no longer a part of the CDPHE Deluxe testing package. Similar to the 4-hour pump test, this water quality test may be done as a condition of approval if requested in the application. Demonstration of conformance to Section 7-107 and specifically Table 7-107, Roadway Design Standards, needs to be provided. This demonstration should include all private driveways and roads from the proposed SDU to public right of way. Please respond to each of the items in the * Roadway Design Standards Table (7-107) to show compliance with these parameters (ROW width, Lane width, Shoulder width, etc.). In addition, should the access driveway cross adjacent properties before reaching the public right of way, then easements or other demonstration of legal access needs to be provided. Should the roadway not meet one or more of the dimensional standards identified in Table 7-107, then the Applicant will need to have a professional engineer evaluate the roadway and make a determination as to whether it is adequate despite not meeting one or more specific standards. Note: please identify which Average Daily Trip (ADT) category this access road may fall within with each dwelling unit accessing this driveway counting as 9.57 ADT (all homes and other development planned and existing off the driveway). For public notice requirements, the Applicant will need to provide a list of names and mailing addresses for all adjacent property owners within 200' as well as the owners of the mineral estate under the subject parcel (See attached memo from the County Attorney's Office). Jones as having reserved½ the mineral rights to the land, in 1963. Following submission of the Stryker SOU application, it was requested that an address be provided for Fred R. Jones, to inform him of the SOU application. Edna at the Garfield County Courthouse confirmed that there is no other record on file with Garfield County pertaining to Fred R. Jones. No record of him having deceased, no record of an heir and no forwarding address. A additional search online also did not find an address on record for Fred R. Jones. The included screenshot shows a mineral document submitted for a Rural Land Development Exemption Application by nearby Strang Ranch (0390 CR 102 Carbondale, CO) in 2011, which demonstrates that their land was once previously owned by Fred R. Jones, that ½ their mineral rights were also reserved by Fred R. Jones, and that they too were unable to find any forwarding address for Mr. Jones. Assess ment for Common Expenses. lhe Owners of the Residential Estates shall be obligated to pay the assessments imposed by the Architectura 1 Conunittee to meet the cor1111on expenses incurred in con- nection with ,;uch Residential Estates. The assessments 5hall be made pro rata according to each Owner's total acrrage compared to the total acreage of the Protected Property ( 142 acres). Assessment for the estimated conmon "xpenses shall be made on an annual basis, unless otherwise provided for by the Architectural Committee. 8. The amount of the common expenses assessed again~t or incurred on acc,1unt of the Residential Estates shall be the personal and Individual debt of the Owner thereof. No Owner ma_y exempt himself from liability for his contri- bution towards the common expenses by waive1· of the use or enjoyment , of any benefit conferred upon the Protected Property or by abandonment of h1s Residential Estate. 9. Lien for Nati-Payment of Common Expenses. All sums due or unpaid for the share of common expenses chargeable to a Residential Estate, including interest thereon at the legal rate, shall constitute a lien on such Residential Estate superior (prior) to all other liens and encumbrances except: a. The financing of the construction shall be by assessment on each individual share held, o\'lned or beneficially owned in the Missouri Heights Irrigation Company. In no event shill the assessment levied exceed three hundred dollars ($300.00) per share. Any further amounts needed for completion of the system shall be raised by imposing an assessmi:nt on the users of the system. Such assessment shall be considered an assessment for conman expense and shall be enforced as provided for in paragraphs 8 and 9. 12, Right of First Refusal by Owners. a. However, in the event the Archilectural Committee has not recorded such a certificate of non-compliance •iithin one (1) year from date of recording in the case of a deed delivered in violation of this paragraph, such conveyance shal 1 be conclusively deemed to have been made in compliance with this paragraph and no longer voidable. In no case shall the right of first refusal reserved herein affect the right of an Owner to subject h ·is parcel to a trust deed, mort- gage, or other security interest. (c) Cert i ficate of Comp l iance, Riqht of First Refusal . Upon written· request of any prospective transferee, purchaser or an existing or prospective mortgagee of any Residential Estate, the Architectural Committee sha11 forth1~ith, or,1·1here time is specified, at the end of that time, issue a written and acknowledged certificate in recordable form evidencing: i. With respect to a proposed sale under (a), that proper notice ~,as g·ive-1 by the selling Owner and that the 1-emaining Owners did not elect to exercise their J['tion to purchase. ii. With respect to a deed to the first mortgagee or its nominee in lieu of foreclosure and a deed from such first mortgagee or its nominee, pursuant to paragraph (b), that the deeds were, in fact, given in lieu of foreclosure and were not subject to the provisions of (a). iii. With respect to any contemplated transfer which is not in fact a sale, that the transfer 1,1111 not be subject to the pro- visions of (a). Such certificate ~hall be conclusive evidence of the facts contained therein. 12. Enforcement. a. Enforcement Action. The Architectural Committee sha 1l have the right to prosecute any action to enforce any of the provisions of any or al1 of these Covenants by injunctive 1·elief, on behalf of itself and all or a part of the Owners of Residential Estates in the Protected Property. When reviewing a plan and it's discovered that required information has not been provided by the applicant, this will result in the delay of the permit issuance and in proceeding with building construction. The owMr or contractor shall be required to provide this information before the plan review can proceed. Other plans that are in line for review may be given attention before the new information may be reviewed after it has been provided to the Building Department. Please review this document to determine if you have enough information to design your project and provide adequate information to facilitate a plan review. Also, please consider using a design professional for assistance in your design and a construction professional for construction of your project. Any project with more than ten (10) occupants req_uires the plans to be sealed by a Colorado Registered Design Professional.
