Drake Road, Suite 3B Fort Collins, Colorado 80526 Phone: (970) 223-3984 Fax: (970) 223-8484 On behalf of the Colorado Department of Transportation (CDOT), Region 3, this is a letter documenting that the flood scour repairs at State Highway (SH) 82 (included as part of CDOT Project 21200) does not cause an adverse impact to the Cattle Creek regulated Federal Emergency Management Association (FEMA) Zone AE floodplain. All items listed in the submittal requirements for development in the 100 -year floodplain in Garfield County are addressed in this letter. The Land Use Change Permit Application Form is included as Attachment A and the Agreement to Pay Form is provided in Attachment B. Review of Floodplain Overlay Regulations, provided in Garfield County's Land Use Development Code (LUDC), Article 3, pertaining to development within the 100 -year floodplain (3-301) are addressed in Attachment C. The Review Criteria provided in Garfield County's LUDC, Article 4, for development in the 100 -year floodplain (4-109) was considered and responses are provided in Attachment D. Drake Rd., Suite 3B Fort Collins, CO 80526 (970) 223-3984 Contact: Albert Molinas, Ph.D, PE Project Description CDOT Project 21200 is a roadway surface treatment project with associated curb ramp and guardrail upgrades and chip seal treatment. This project is being constructed between Mile Marker 1.5 and 11.6 along SH 82 near Glenwood Springs, Colorado. Chip seal treatment is being conducted in New Castle, Colorado. Alongside these roadway repairs, CDOT is implementing scour mitigation countermeasures at CDOT Structure G -07-B on SH 82. CDOT Structure G -07-B experiences high flow velocities during the design discharge event and may experience significant scour. Therefore, countermeasures were designed to protect the bridge from scour damage. At Structure G -07-B, concrete aprons with toewalls are designed to be constructed at both the inlet and outlet. Riprap protection at Structure G -07-B was designed to be placed at the downstream outlet. Site Plan and construction plan drawings, including details of proposed improvements and significant features are provided in Attachment E. The scour portion of the project is located in Garfield County at Mile Marker 7.909 along SH 82. Because Structure G -07-B is in a FEMA Zone AE regulatory floodplain (see Attachment F for the effective FIRM), base flood elevations have been determined and compliance with NFIP HYDRAU-TECH, INC. The documentation, prepared for Garfield County, is to demonstrate that the proposed scour countermeasures will not adversely alter existing topography and that as a result will not change hydraulic conditions and water surface elevations (no -rise) prevailing at the project site. Vicinity Map A vicinity map, township and range map, and section map with property information are provided in Figures 1 through 3, respectively. List of Owners Table 1 provides a list of property owners, collected from Garfield County's website, within 200 feet of the scour mitigation work. Attachment G is a list of the property owners, provided by CDOT, that was used for acquiring temporary easement areas at the project site. These property owners were contacted by CDOT during the easement acquisition process. Construction access to the upstream portion of the work is proposed for the north side of G -07-B directly off SH 82 Frontage Road, with staging (0.23 acres) proposed on both sides of Cattle Creek. Construction access to the downstream portion of the work is proposed for the north side of G -07-B directly off SH 82 south bound, with staging (0.25 acres) proposed on both sides of Cattle Creek. Additional details of construction access and staging are provided in the Stormwater Management Plan (SWMP) Site Map (Sheet E07 of E08) in Attachment H. Once constructed, the proposed scour countermeasures for G -07-B will be fully within CDOT right-of-way (ROW). However, during construction, excavations will be required to install the concrete toewalls and downstream riprap apron. Due to the limited ROW that CDOT has at this site, it was necessary to acquire temporary easements from the adjacent land owners. CDOT ROW has acquired a total of four temporary easements at this site (TE 8-1 1). Through CDOT's extensive ROW process, adjacent property owners listed in Appendix G have been notified of the work that is being performed. Section 7-203(B) Protection of Waterbodies Compliance According to Garfield County LUDC, Article 7, Section 7-203(B), irrigation and water diversion facilities, flood control structures, culverts, bridges, pipelines, and other reasonable and necessary structures requiring some disturbance within the 35 foot setback may be permitted. The proposed construction activities are within this 35 foot setback. Environmental and Biological Impacts Environmental impacts due to construction operations were investigated in coordination with CDOT Region 3 Environmental Staff. Water quality from sediment or erosion potential has been addressed using multiple best management practices, including but not limited to, erosion control logs and a downstream rock check dam for sediment capture. Noxious weeds found by CDOT Environmental Staff will be treated with herbicide treatment (0.4 acres). Areas of disturbance due to staging and construction activities will receive native seeding and soil conditioning for permanent stabilization. Existing wetlands were identified by CDOT Environmental Staff and will be treated or protected accordingly. Areas of temporary wetland impacts (0.015 acres) will be protected using soil retention blankets and weed free straw. Areas of permanent impacts (0.006 acres) will be offset by providing wetland seeding and soil conditioning to areas (0.03 acres) to reestablish equivalent or greater wetland zones. Additional information on environmental impact mitigation, and equipment required for the work, can be found in Attachment H in the SWMP Narrative (Sheets E01 through E06). Details of permanent stabilization and wetland protection efforts are provided in Attachment H on the SWMP Site Map (Sheet E07of E08) and Temporary Wetland Protection Detail (Sheet E08 of E08). Biological impacts and mitigation were investigated in coordination with CDOT Environmental Staff. During scour countermeasure construction, the contractor is to prevent increases in sediment being deposited into the stream channel from overbank areas and from in -stream work that would impact water quality in downstream habitats, especially in the Roaring Fork River. In -stream work will be conducted from August 1St - September 30th to minimize turbidity downstream for spawning fish in the Roaring Fork River. The contractor is to minimize and/or eliminate work within wetland areas, use mats to decrease impacts to wetlands if practicable. The contractor is to keep all staging areas to previously disturbed sites and minimize impacts to HYDRAU-TECH, INC. ENGINEERING & SOFTWARE 363 W. Vegetation removal will be conducted after August 31st and before April 1st, to prevent impacts to migratory birds. Floodplain Analysis Peak Flows FEMA obtained peak discharges for Cattle Creek from a detailed hydrologic analysis performed by the US Army Corps of Engineers. These discharges are provided in the U.S. Army Corps of Engineers HEC -2 hydraulic model. Per the HEC -2 model, the 100 -year peak discharge at the southern study limit of Cattle Creek is 2,850 cfs. FEMA Modeling As previously stated, the effective FEMA floodplain for Cattle Creek in the vicinity of Structure G -07-B is a Zone AE, indicating that a detailed hydraulic analysis was completed, and base flood elevations were determined. The effective model for Cattle Creek was prepared using the U.S. Army Corps of Engineers HEC -2 hydraulic model and is available in hardcopy format from the FEMA archives. However, utilizing the effective HEC -2 model was not deemed necessary for hydraulic analysis of this project and is therefore not included in this permit application. No Floodplain Impacts The proposed construction at Structure G -07-B is all at or below existing grade and therefore there is no filling within the channel. The native material is proposed to restore Cattle Creek channel elevations to existing conditions. Attachment I presents multiple cross sections along the Cattle Creek channel upstream and downstream of Structure G -07-B. These cross sections are placed along the proposed scour countermeasures to show minimal extent of channel adjustments due to grading and the associated cut and fill areas and volumes. A table corresponding to each cross section provides the magnitude of cut, fill, and net area and volume changes. In general, 1. As shown in Section A (Sheet 03 of 06) there will be no change in channel geometry upstream of the bridge (backfill native material to match existing ground). 2. As shown in Sections B through F (Sheets 04 through 06), only a total of 7 cubic yards of material is removed from the existing channel downstream from the bridge along a 20 - foot reach. The average change in flow area is approximately 6 square feet. 3. The changes in the downstream channel configuration are in general along the banks at higher elevations (lower conveyance areas), and are to create a smooth finished surface. 4. From the FIRM, the 100 -year floodplain width is approximately 400 feet at the downstream of the bridge and the depth of flow is approximately 10 feet. The volume of material removed is negligible to the channel volume containing the 100 -year flows in the same reach. Therefore no change in hydraulic conditions is anticipated. A ' 363 W. Floodways located within SFHAs are designated as "Floodways." Since the Floodway is an extremely hazardous area due to the velocity of flood waters which carries debris, potential projectiles, and erosion potential, the following provisions shall apply: 1. Encroachments are prohibited unless it has been demonstrated through hydrologic and hydraulic analyses, performed in accordance with standard engineering practice, that the proposed encroachment would not result in any increase in flood levels within the community during the occurrence of the Base Flood discharge. Encroachments include Fill, New Construction, Substantial Improvements, and other development within the regulatory Floodway; There is no floodway at Cattle Creek 2. All New Construction and Substantial Improvements shall comply with all applicable flood hazard reduction provisions in this Code; and The structure at Cattle Creek is an existing structure. The improvements are minor and are for scour protection. 3. Under provisions of 44 CFR Chapter 1, Section 65.12, of the National Flood Insurance Regulations, a community may permit encroachments within the regulatory Floodway that would result in an increase in BFEs provided that the community first applies for a conditional FIRM and Floodway revision through FEMA. There is no floodway at Cattle Creek and scour countermeasures will not increase or decrease BFEs since the installation follows existing ground. E. Standards for Areas of Shallow Flooding. Areas designated as shallow flooding are located within the SFHAs. These areas have special flood hazards associated with Base Flood depths of 1 to 3 feet where a clearly defined channel does not exist and where the path of flooding is unpredictable and where velocity flow may be evident. Such flooding is characterized by ponding or sheet flow; therefore, the following provisions apply: 1. All New Construction and Substantial Improvements of residential structures have the Lowest Floor (including Basement) elevated above the highest adjacent Natural Grade at least 1 foot above the depth number specified in feet on the community's FIRM (at least 3 feet if no depth number is specified). N/A 3. Adequate drainage paths around structures are required to guide flood waters around and away from proposed structures. Drainage shall not adversely impact adjacent properties. Proposed countermeasures are designed to improve the safety of Structure G-07-8, which carries all flood waters from Cattle Creek. Installation of these countermeasures will not affect the drainage path and therefore will not adversely impact adjacent properties. G. Alteration of a Watercourse. For all proposed developments that alter a watercourse within a SFHA, the following standards apply: 1. Channelization and flow diversion projects shall appropriately consider issues of sediment transport, erosion, deposition, and channel migration and properly mitigate potential problems through the project as well as upstream and downstream of any improvement activity. A detailed analysis of sediment transport and overall channel stability should be considered, when appropriate, to assist in determining the most appropriate design. Flow diversion will occur only during construction for a short distance (approximately 20 feet upstream and downstream) and only while the concrete aprons are being constructed during lowest flow season. Flow will remain within the Cattle Creek channel during all construction activities. Sediment transport in Cattle Creek will not be affected since the sediment inflow and outflow to the project reach are not being altered, transport capacity remains the same, and new sediment sources are not being introduced. Erosion and deposition from the overbank construction areas as well as in -stream activities will be properly mitigated through procedures outlined in the Stormwater Management plan that was developed in coordination with CDOT Environmental Staff. Channel migration will not occur due to construction of the scour countermeasures. Therefore, a detailed analysis was not necessary at this site. 2. Channelization and flow diversion projects shall evaluate the residual 100 -year Floodplain. After construction of the scour countermeasures, the project site will be returned to its original configuration and no residual impacts to the 100 -year Floodplain will occur. 3. Any channelization or other stream alteration activity proposed by a project proponent must be evaluated for its impact on the regulatory Floodplain and be in compliance with all applicable Federal, State, and local Floodplain rules, regulations, and ordinances. The only impact to flows during construction will be water diversion (up to 15 cfs) to install the scour countermeasures. Any stream alteration activity shall be designed and sealed by a qualified professional engineer or certified professional hydrologist. No stream alteration is proposed at this site. 5. All activities within the regulatory Floodplain shall meet all applicable Federal, State, and local Floodplain requirements and regulations. All scour countermeasure construction activities and related mitigation efforts shall meet applicable Federal, State, and local Floodplain requirements and regulations. No impacts to the Floodplain will occur. 6. Within the regulatory Floodway, stream alteration activities shall not be constructed unless the Applicant demonstrates through a Floodway analysis and report, sealed by a qualified professional engineer, that there is no more than a 0.00 -foot rise in the proposed conditions compared to the existing conditions of the Floodway resulting from the project, otherwise known as a No -Rise Certification. A No -Rise Certification is not required if the community first applies for a Conditional Letter of Map Revision (CLOMR) and Floodway through FEMA. There is no regulatory Floodway at Cattle Creek. Scour countermeasure installation activities at Cattle Creek, Structure G-07-8, are to improve the safety of the structure during flooding events and do not alter stream characteristics and properties. PROJECT SITE LOCATION: Project 21200 is being constructed between mile marker 1.5 and 11.6 along State Highway 82 near Glenwood Springs, Colorado. Scour mitigation work is being constructed at mile marker 7.909 at CDOT Structure G -07-B over Cattle Creek, 4 miles North of Carbondale, Colorado. Chip seal treatment is being conducted in New Castle, Colorado. B. PROJECT SITE DESCRIPTION: Project 21200 is a surface treatment project with associated curb ramp and guardrail upgrades. Also included in the project are traffic signal upgrades, chip seal treatment, and construction of scour countermeasures that will be installed at G -07-B over Cattle Creek. The scour countermeasures at this site include installation of riprap and construction of concrete slab, apron and toewalls at the inlet and outlet of the structure. Excavation will be required for installation of the aprons, slabs, and riprap. C. ACRES OF DISTURBANCE: 1. Total area of construction site (LOC): 0.54 acres 2.
