HomeMy WebLinkAbout3.0 Director's Determination 07.16.18Garfield CoulnU Community Development Department July 16, 2018 Randy Long 279 County Road 216 Rifle, CO 81650 RE: Sun Meadow Estates Subdivision Amended Plat Lots 1 and 11 (File No. FPAA-04-1 8-8630) Dear Randy; This letter is provided to you as the applicant for an Amended Final Plat application for Lots 1 and 11 of the Sun Meadow Estates Subdivision. The amendment requests the removal of lot lines in order to merge two parcels into one. The properties are known by Assessor Parcel Numbers 2179-052-02-011, 2179-052- 02-001 and further described on the Sun Meadow Estates Subdivision Plat recorded at Reception No. 648958 with the Garfield County Clerk and Recorders Office. The Application has been reviewed in accordance with the Administrative Review procedures contained in the Land Use and Development Code as amended. Said provisions require a Decision by the Director of the Community Development Department on whether to approve, approve with conditions, or deny the request. The Director's Decision is hereby issued approving with conditions the Application for an Amended Plat for Lots 1 and 11 of the Sun Meadow Estates. This includes a finding that the Application meets the requirements and standards of the Garfield County Land Use and Development Code as amended including the Review Criteria contained in Section 5-305 (C). The approval is subject to the following cond itions of approval. 1. That all representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. The proposed plat shall be updated and edited prior to submittal for final review by the Community Development Department and the County Attorney's Office as follows (additional updates or changes may be required pending the final review): a. The language that states Property Line to be dissolved shall state, "Property Line Dissolved". b. The easement to be vacated shall state, "Vacated with this plat". c. The plat shall include Plat Note L from the County Resource Guide regarding irrigation ditches. The applicant shall include a lienholder certificate that matches the certificate in the County Resource Guide. All improvement location information shall be removed. Remove all color from the plat. g. Remove Building Setback Lines from the Plat. h. The resulting lot name and acreage shall be labeled on the Final Plat. i. Lot 1 and Lot 11 labelling on the plat should be titled as "Formerly". 3. The Applicant shall submit an updated electronic copy to the County for Final Review once the updates have been completed. Additional updates or changes to the plat may be required as part of this additional review. Once approved for Mylar the applicant shall supply: a. A plat Mylar with signed Certificates that include Dedication and Ownership, County Surveyor's, Clerk and Recorder's, Taxes Paid, County Commissioners', Surveyor, Title, and Lienholders b. Recording Fees The Land Use and Development Code requires notification to the Board of County Commissioners for their review and potential call-up of the Director's Decision. The Board review is for a period of 10 days commencing on the date of the Director's Decision. The Amended Final Plat will be scheduled on the Board of County Commissioner's consent agenda after expiration of the call-up period and once all conditions of approval have been satisfied including editing of the plat and acquisition of all necessary signatures. Please note that you will have 90 days from the date of approval to submit a plat suitable for recording. Extensions of this time period may be requested prior to the expiration of the original time limit. d. e. f. Please contact the Community questions regarding the Director's amended plat.
