The Garfield County Assessor's parcel numbers for the impacted parcels are 21790520201 1 and 217905202001. Lot 11:2.391Acres - Lot 1:2.088 Rural PROJECT INFORMATION AND F COMMENTS I. DESCRIPTION OF PROPOSAL . REQUEST The Applicant is requesting an Amendment to the Sun Meadows Estates Final Plat to combine lots 1 and 11 into one lot. The applicant owns both parcels. The property is zoned Rural, and with the merging of the two parcels the existing single-family structure will be the primary dwelling unit for the lot. Any addition of a future residential dwelling unit will require the applicant to comply with County regulations in place at that time. The Sun Meadows Subdivision was approved in 2004 by the Garfield County Board of County Commissioners. Staff review of the Plat shows no prohibition regarding the merging of lots. No changes to the plat are proposed other than the combination of the lots. No new lots will be created and no changes to roadways are proposed. The applicant is proposing to eliminate an Access easement across Lot 11 to Lot 1, as there will on be one access for the combined parcel. AUTHORITY - APPLICABLE REGULATIONS The Amended Final Plat Application is being processed in accordance with Section 5- 305, Amended Final Plat and 4-103, Administrative Review of the Land Use and Development Code, as amended. Public notice is required in accordance with Sections 4-103 and 4-101 and the Applicant has provided documentation that all required public notice has been completed. III. PUBLIC AND REFERRAL COMMENTS No public comments were received as a result of public notice. Referral Comments received on the Application are attached as Exhibits and summarized below: 1. Garfield County Surveyor: Requested that the lot name and acreage is labeled on the Final Plat 2. Assistant Garfield Gounty Attorney: Lienholder consent is required. No further comments or corrections. IV. STAFF ANALYSIS 1. The applicant's proposal was reviewed against the Amended Final Plat Criteria contained in Section 5-305 (C), as follows: a. Does not increase the number of lots; and The proposed Amended Final Plat does not increase fhe number of lots, rather, it merges multiple lots. b. Does not result in the major relocation of a road or add any new roads; or The proposed Amended Final Plat will not result in a maior relocation of a road or add new roads. There rs an easement being removed as part of the plat, however there is no relocation or addition of any roads. c. Will correct technical errors such as surveying or drafting errors. The Amended Final PIat has not been proposed to correct technical errors 2. No conflicts with the existing underlying zoning have been noted including lot size and setbacks. 3. The applicant has indicated that no changes or impacts are anticipated with regards to Article 7 Divisions 1-3 of the Land Use and Development Code. 4. The updated final plat shows the Building Setback on Parcel 1 encroaching onto the irrigation ditch easement. Staff has included a suggested condition of approval that no setbacks are shown on the Final Plat. Additionally, staff has included a suggested condition that the applicant update the plat with a plat note regarding irrigation ditches (plat note L from the County Resource guide). 2 V. SUGGESTED FINDINGS AND RECOMMENDATION Staff supports a finding that the Amended Final Plat Application for Lots 1 & 11 meets the requirements and standards of the Garfield County Land Use and Development Code as amended including the Review Criteria contained in Section 5-305 (C) and is recommended for Administrative Approval by the Director of the Community Development Department subject to the following conditions of approval and findings. Suggested Findings 1. That proper public notice was provided as required for the Director's Decision 2. Consideration of the Application was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were given an opportunity to provide input prior to the Director's decision. 3. That for the above stated and other reasons, the proposed amended plat is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in general conformance with the 2030 Comprehensive Plan, as amended. 5. That with the adoption of conditions and for the above stated and other reasons the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended. Recommended Gonditions of Approval 1. That all representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. The proposed plat shall be updated and edited prior to submittal for final review by the Community Development Department and the County Attorney's Office as follows (additional updates or changes may be required pending the final review): a. The language that states Property Line to be dissolved shall state, "Property Line Dissolved". b. The easement to be vacated shall state, "Vacated with this plat". c. The plat shall include Plat Note L from the County Resource Guide regarding irrigation ditches. d. The applicant shall include a lienholder certificate that matches the certificate in the County Resource Guide. e. All improvement location information shall be removed. f . Remove all color from the Plat. ^J Remove Building Setback Lines from the Plat. The resulting lot name and acreage shall be labeled on the Final Plat Lot 1 and Lot 11 labelling on the plat should be titled as "Formerly". 3. The Applicant shall submit an updated electronic copy to the County for Final Review once the updates have been completed. Additional updates or changes to the plat may be required as part of this additional review. Once approved for Mylar the applicant shall suPPlY: a. The resulting lot name and acreage should be labeled on the Final Plat. Once this and all final comments from Community Development have been completed, the Mylar may be prepared for recording. The Mylar shall be delivered to the Community Development office with all private party signatures no later than Monday the week prior to the next commissioner meeting day in order to make that meeting.
