I. DESCRIPTION OF THE PROPOSAL
The Applicant is requesting approval for a Solar Energy System, Small on an
approximately 5.3 acre parcel. The applicant proposes to use the 21.6 kW ground
mounted solar PV array as an accessory use to the existing house on the property. The
system willtie into the existing electric grid. The proposal includes two rows of 15 modules
each, approximately 51 feet wide. The applicant has represented that the combined
footprint of the arrays will be approximately 1,144 square feet or 0.47o/o of the parcel's 5.6
acre size. The panels will be approximately 8 feet 6 inches tall. The artay will be
unmanned and require minimal maintenance.
II. DESCRIPTION OF THE SITE
The site is currently developed with a single-family residence. Adjacent parcels vary in
size from 5 acres and greater. There is existing vegetation on the site with trees and
topography that the applicant has indicated will screen the solar energy system from
adjacent residences.
The property was created as part of the Marquis Subdivision Exemption and went through
a Boundary Line Adjustment to create its current configuration.

III. APPLICABLE REGULATIONS
A. The Land Use Tables contained in Section 3-403 of the Land Use and
Development Code, designates a Solar Energy System, Small within the Rural Zone
District as requiring Administrative Review. A Solar Energy System, Small is defined in
Chapter 15 as, "A device and/or sysfem that has a combined name plate DC rating of 15
kilowaft to 500 kilowatt and includes fhe equivalent kilowatt measurement of energy for
sysfems other that photovoltaic that converts the sun's radiant energy into thermal,
chemical, mechanical, or electrical energy."The proposed system is 21.6 kW, which falls
into the Solar Energy System, Small category.
B. Section 4-103 of the Land Use and Development Code sets forth the
Administrative Review Procedures by which the current Application is being considered.
C. Article 7 of the Land Use and Development Code sets forth General approval
standards in Division 1, General Resource Protection Standards in Division 2 and Site
Planning and Development Standards in Division 3. ln addition, the Solar Energy System,
Small is subject to Section 7-1101, Solar Energy System standards. The standards are
addressed in the Application submittals and in the Staff Analysis section of the Staff
Report.
IV. PUBLIC AND REFERRAL COMMENTS
The Applicant has provided documentation that all required notice mailings have been
completed. No public comments were received. Referral comments received on the
Application are attached as Exhibits and summarized below:
1. Garfield County Public Health (Exhibit 7):- The project is consistent with the goals of Garfield County's Comprehensive
Plan- lt appears there will be minimal impacts to public health and environment- All infrastructure should be properly maintained to prevent wildfires from
sparking
2. Mountain Cross Engineering (Exhibit 8):- The applicant should discuss any impacts to neighboring properties from glare.
- The application materials had the analysis of the driveway evaluated by a
California Professional Engineer, with pending licensure in Colorado. The
Applicant should verify that Colorado licensure was obtained or provide an
opinion from a Colorado licensed P.E.- The application material state that approvals are pending from Holy Cross
Energy. The Applicant should provide documentation on approval from Holy
Cross Energy.
3. Garfield County Road and Bridge (Exhibit 9):- No issues provided the solar facility is accessed from a private road.
- The system shouldn't have any negative drainage for County Road 112.
4. Carbondale and Rural Fire Protection District (Exhibit 10):
- No issues with the proposal
5. Other agencies that did not submit comments include: Colorado Parks and
Wildlife, Holy Cross Energy, Xcel Energy
V. STAFF ANALYSIS
Article 7, Division 1: General Standards
Section 7-101: Compliance with Zone District Use Reoulations
The property is in general compliance with zone district regulations for the Rural Zone
District. !t is currently developed with a single-family residence, which is permitted by-
right in Garfield County. The solar energy system is located outside of required property
line setbacks and is in compliance with those requirements.
Section 7-102: Compliance with Comprehensive Plan and lGAs
The site is identified as Residential Medium which suggests a density of greater than 1
dwelling unit per 6-10 acres. The Residential Medium district is described as follows:

The proposed use can be considered accessory to the residential structure on the
property and no additional dwelling units have been proposed.
The Comprehensive Plan is supportive of Solar Energy as follows:
Secfion 10 - Renewable Energy
Vision
Garfield County has encouraged the development of renewable
energy sources throughout the county and has ensured that
generating facilities are located in appropriate places in the county.
The county has a/so ensured that county regulations are not unduly
burdensome or difficult to negotiate in regards to the development
and location of new renewable energy resources.
/ssues
There are incentiyes fo explore alternative sources to conventional
energy for the benefit of individuals, communities, and the county as
a whole.
There is potential that alternative energy is a tool for economic
diversification.
It is likely that the individual and large-scale use of alternative energy
will become more prevalent in Garfield County and the county needs
to anticipate visual and other impacts.
Goals
1. Promote and encourage the development of renewable energy
resources within the county.
2. Encourage the implementation of energy efficient sife design and
building orientation in development proposals.
3. Ensure that renewable energy activities mitigate their effecfs on
the natural environment, including air quality, water quality, wildlife
habitat, and visual quality.
Policies
1. The county encourages the development of energy efficient
building design and the use of alternative energy sources.
Sfrafegies and Action s:
1. Continue to develop county standards for renewable energy
installations.
2. Encourage current, and require future, PONHOA's to adopt local
standards to promote and allow for renewable energy technologies
to occur within their subdivisions.
3. Evaluate the viability of various renewable energy resources
within the County. Develop appropriate mechanisms to encourage
their development.
It is Staff's opinion that the proposal is in general compliance with the Comprehensive
Plan.
Section 7-1 03: Compatibility
The application includes the following description of the surrounding land uses.
The parcel is surrounded by five (5) adjacent Rural zone-classified parcels, the
smallest of which being 5.28 acres, and the largest being 54.7 acres. The shorfesf
distance the project parcel is from the nearest public roadway, County Road 112,
is approximately 380 ft. Trees and vegetation to the nofth, south, and east would
obscure the views of the proposed array from the existing neighboring residences.
Notice of the proposed array installation shall be sent to the owners of neighboring
parcels as well, making them aware of it as well as allowing for comments.
The County is seeing an increase in Solar Facilities that are accessory to single-family
residences. While this proposal falls into the Solar Energy Small category, the applicant
has represented that it is associated with the single-family residence on the property. No
public comments have been received on the application. lt is staff's opinion that this
proposal is compatible with surrounding uses.
Section 7-104: Sufficient, Adequate, Leqal and Physical Source of Water
As the site will be unmanned, no long-term supply of water is needed for the use. The
applicant has represented that workers and maintenance crews will supply their own
drinking water.
Section 7-105: Adequate CentralWater Distribution and Wastewater svstems
As the site will be unmanned, no OWTS or connection to central services is required.
Section 7-106: Adequate Public Utilities
The applicant has indicated that the system will tie into the Holy Cross Energy grid,
pending approval by the utility. The Garfield County designated engineer provided
comments stating that the applicant should provide a demonstration of approval from Holy
Cross Energy (Exhibit 8). The applicant has since submitted a Holy Cross Energy
preliminary approval (Exhibit 12).
Section 7-107: Access and Roadways
a. The parcel has access to CR 112 via a parcel that appears to be reserved for
access as part of the Marquis Exemption (Recorded No. 383220). Road and Bridge had
no concerns with the application, provided there was no impact to drainage on the County
Road. The road is located on the other side of the parcel from the proposed solar facility
and no impacts are anticipated.
b. The application provided an analysis from a Professional Engineer that indicated.
Access serving the proposed project has the capacity to efficiently and safely
service the additionaltraffic generated by the project. Project construction shall not
cause traffic congestion or unsafe traffic conditions.
As a California-licensed Professional Engineer (with Colorado licensure planned
momentarily), if is Mr. Summers' professional opinion that the existing access
roadways are adequate for project material and product materials for the proposed
project to the project site, and that there should be no greater impacts imposed on
adjacent properties.
The applicant indicated that while the Roadway did not meet the Land Use and
Development Code requirements, the existing roadways are adequate for the proposed
use. Additionally, the applicant has indicated they will not be constructing a new road and
will park in the already disturbed driveway area. No comments were noted on the access
by the Carbondale and Rural Fire District. Based on the review of the Community
Development Director and the overall limited use of the road that is only associated with
construction, this representation is sufficient to qualify for a Waiver from Section 7-107 of
the Land Use and Development Code (Roadway Standards).
Garfield County Road and Bridge provided referral comments discussing possible
impacts from drainage onto the County Road. Because the facility is located
approximately 0.2 miles from the County Road, staff anticipates no drainage impacts from
the proposed solar facility.
Section 7-108: Natural Hazards
The Applicant has represented that there are no natural hazards on the property. County
Hazard Mapping does not indicate any hazards on the property.
Section 7-109: Adequate Fire Protection
The application was reviewed by the Carbondale and Rural Fire Protection District, who
indicated that they had no concerns (Exhibit 10).
Article 7, Division 2: General Resource Protection Standards
Section 7-201 Aqricultural Lands
The application indicates that the proposal will have no impact or otherwise limit the
viability of any agricultural operations. There are no known ditches on the property and
the applicant has indicated that there are no ditch crossings in order to get to the subject
location. None were noted by Staff during the site visit.
Section 7-202 Wildlife Habitat Areas
The parcel is already improved with a single-family residence. The addition of the
unmanned Small Solar Energy system is not anticipated to have a significant impact on
wildlife. The application was referred to Colorado Parks and Wildlife, who did not respond
with a referral comment.
Section 7-203 Protection of Wetlands and Waterbodies
The application indicates that there are no waterbodies on the proposed project's parcel.
Section 7-204 Drainaqe and Erosion
The application included the topography and soils map of the property which were
reviewed by the County designated engineer. Additionally, the application indicated that
there will be no drainage modifications or grading to the existing site. No Drainage and
Erosion comments were generated by the engineering review.
Sections 7-205 Environmental Qualitv
lmpacts to air and water quality are anticipated to be minimal to non-existent.
Section 7-206 Wildfire Hazards
The subject property is identified as Not Rated and Very High according to, Wildland Fire
Susceptibility lndex of the Community Wildfire Protection Plan (CWPP). No slopes over
30o/o or fire chimneys have been identified on the site.
The application was referred to the Carbondale and Rural Fire Protection District (Exhibit
10), who indicated thatthey have no issueswith the proposal. A referral commentwas
received from the Environmental Health Department who indicated that the infrastructure
should be properly maintained to prevent any wildfire hazard. This has been included as
a suggested condition of approval.
Section 7-207 Natural and Geoloqic Hazards
See Section 7-108, above

Section 7 -208 Reclamation
The applicant has indicated the following regarding Reclamation:
There will be no notable site degradation due to short-brm site preparation. The
installation crew shall park their vehicle on previously disturbed areas, and will not
contribute any additional impact.
The application has also indicated that all disturbed areas will be restored within 10 days
of completion of the project. Staff has included a suggested condition of approval that
Reclamation of the site proceed as indicated in the application. An additional condition of
approval has been included that requires the applicant to abide by all State and County
noxious weed requirements.
Article 7, Division 3, Site Planning and Development Standards
Section 7-301 Compatible Desiqn
The use will have very limited traffic to the site once installation is complete. The
application has indicated that no dust, odors, gas, fumes, or glare will be emitted.
Regarding glare, the nearest potentially impacted residence is at least 1,500 away from
the proposed installation. The applicant also provided the following information regarding
glare (Exhibit 13):
So/ar panels employ anti-reflective glare technology in their g/ass in order to
"direct" more sunlight into the solar cells of the panels instead of reflecting it away
from the panels - fhis helps the panels produce more energy. With only one house
within view of the solar panels, and that house being located in front of and over a
1/3d of a mile away, there should be no glare impact from the solar array - the arc
of the sun will not allow for direct reflection off the g/ass towards the house. There
have been sfudles conducted in which solar glare impacts were assessed af
airports and the resu/fs concluded that glare was not a factor - see fhe link below
to the article that summarizes the study. Hopefully this information is sufficient for
the director to approve the project and allow us to proceed. Please /ef us know as
soon as you have more information.
Based on the applicant's representations staff anticipates that the impact from glare will
be minimal. A suggested condition of approval has been included regarding mitigation of
any unintended glare issues.
Section 7-302 Off-Street Parkino and Loadinq Standards
Once the installation of the facility is complete, no long-term parking will be needed. Any
required maintenance workers will be able to access the site via the existing single-family
driveway.

Sections 7-303 Landscapinq Standards
No long-term disturbance of the site is anticipated. There is existing vegetation in place
for additional screening. Any removal of existing vegetation is understood to be minimal.
Section 7-304 Liqhtinq
The proposed project does not include any exterior lighting. This has been included as a
suggested condition of approval.
Section 7-305 Snow Storaqe Standards
Adequate areas for snow storage is available for the proposed facility.
Section 7-306 Trail and Walkwav Standards
These standards are not applicable based on the proposed use.
Article 7, Division 3, Section 7-1101: Solar Energy Systems
Section 7-1001 Solar Enerqy Systems
The applicant has indicated that they shall install signage warning of electrical shock
around the perimeter of the system. The remainder of the standards are not required for
Solar Energy System, Small uses.
VI. SUPPLEMENTAL SUBMITTALS
The applicant submitted additional documentation addressing referral comments, glare
issues, and an approval from Holy Cross for the system.
VII. SUGGESTED FINDINGS
1. That proper public notice was provided as required for the Director's Decision.
2. That the Application does adequately meet the requirements of the Land Use and
Development Code of 2013, as amended, with approval of the following Waivers:
Section 7-107 Access and Roadways (Roadway Standards).
3. That the application is in general conformance with the 2030 Comprehensive Plan,
as amended.
VIII. REGOMMENDATION
Staff recommends a finding that, with the recommended conditions and aforementioned

Waivers, the proposed Solar Energy System, Small is in conformance with the
Comprehensive Plan of 2030 as well as the Land Use and Development Code. Staff,
therefore, recommends approval with conditions for the Klein, Solar Energy System,
Small application.
Suggested Conditions of Approval
1. All representations of the Applicant contained in the application shall be considered
conditions of approval unless specifically modified by the Director's Decision.
2. The operation of the solar facility shall be done in accordance with all applicable
Federal, State, and local regulations governing the operation of this type of facility.
3. The applicant shall complete any reclamation activities as indicated in the
application.
4. No lighting is permitted on the site in association with the project.
5. Signage around the perimeter of the facility warning of electrical shock shall be
installed.
6. Electrical infrastructure shall be appropriately maintained to prevent any potential
wildfire hazard.
7. The applicant shall comply with any Holy Cross Energy requirements for
connection to the electric grid.
8. Any unintended glare issues shall be subject to mitigation acceptable to the
Community Development Director.
9. The applicant shall abide by Garfield County and State of Colorado noxious weed
requirements.

Hello Patrick,
I have reviewed the application for the Klein Solar Energy System located at773 County Road
112, Carbondale. This project is consistent with the goals of Garfield County's Comprehensive
Plan to "promote and encourage the development of renewable energy resources within the
county" (pg. 65).
lf the solar array will not be visible to neighboring properties and therefore cause nuisance
conditions like glare, it appears there will be minimal impacts to public health and environment
as a result of this operation. Attention should be given to ensuring that all electrical components
and infrastructure are properly maintained to prevent wildfires from sparking in the project
location's arid environment.

Road and Bridge has reviewed this and see no issues as long as access to the solar farm is from their private road. lf they
will be accessing it from CR 112 then we would need a driveway permit for the new access. Also depending on how far
the farm will be from CR112 it can't have any negative effect on drainage for 172

I received the email and attachments you sent to Dirk and wanted to address the comments with information and
answers.
- With neighboring properties completely out of view of the solar array there will be no opportunity for glare.
- The vehicles that will be accessing the property will be standard pickup trucks/work vehicles and as such no
engineering analysis should need to be conducted for the driveway. lf it is necessary for a Colorado licensed
engineer to state in a letter that the driveway is suitable to accommodate standard vehicles/equipment please
indicate as such.
- As for Holy Cross Electric approval, please see the attached approval letter.

After the above has been reviewed and accepted by Holy Cross, a witness test will be scheduled. The system must be disconnected
until such a time as Holy Cross performs or waives (in writing) the witness test. Holy Cross will change out the electrical meter, if
necessary, to allow net metering and reserves the right to further inspect the system to verifl,that all interconnection requirements
have been met.
Payment of any incentive from Holy Cross requires that the following have been provided to Holy Cross in an acceptable manner:. A signed Renervable Energy Credit Sales and Assignment Agreement (enclosedl. So regarding glare: Solar panels employ anti-reflective glare technology in their glass in order to "direct" more sunlight
into the solar cells of the panels instead of reflecting it away from the panels - this helps the panels produce more
energy. With only one house within view of the solar panels, and that house being located in front of and over a 7/3'd of
a mile away, there should be no glare impact from the solar array - the arc of the sun will not allow for direct reflection
off the glass towards the house. There have been studies conducted in which solar glare impacts were assessed at
airports and the results concluded that glare was not a factor - see the link below to the article that summarizes the
study. Hopefully this information is sufficient for the director to approve the project and allow us to proceed. Please let
us know as soon as you have more information.
