E Carbondale, CO 81623 DIRECTOR DETERMINATION Klein Solar Energy System, Small -773 County Road 112, Carbondale 81623 - Administrative Review Dear Mr. Summers and Mr. Sweeney This letter is being provided to you as the representative for an Administrative Review Application for Solar Energy System, Small. The proposed use will be located at 773 County Road 112, Carbondale, CO 81623, also known by Assessor's Parcel No. 2393-231 -00-280. The Director's Determination on the Application is based on the following findings and subject to the Applicant's representations and conditions of approval. Findings 1. That proper public notice was provided as required for the Director's Decision. 2. That the Application does adequately meet the requirements of the Land Use and Development Code of 2013, as amended, with approval of the following Waivers: Section 7-107 Access and Roadways (Roadway Standards). 3. That the application is in general conformance with the 2030 Comprehensive Plan, as amended. A Director's Decision is hereby issued approvinq the Application with the following conditions. The operation of the solar facility shall be done in accordance with all applicable Federal, State, and local regulations governing the operation of this type of facility. 3, The applicant shall complete any reclamation activities as indicated in the application. 4. No lighting is permitted on the site in association with the project. 5. Signage around the perimeter of the facility warning of electrical shock shall be installed. 6. Electrical infrastructure should be appropriately maintained to prevent any potential wildfire hazard. 7. The applicant shall comply with any Holy Cross Energy requirements for connection to the electric grid. 8. Any unintended glare issues shall be subject to mitigation acceptable to the Community Development Director. 9. The applicant shall abide by Garfield County and State of Colorado noxious weed requirements. The Land Use and Development Code requires notification to the Board of County Commissioners for their review and potential call-up of the Director's Decision. The Board review is for a period of 10 calendar days commencing on the date of the Director's Decision. Once the call-up period has passed with no request for review or public hearing, and provided all relevant conditions of approval have been resolved the Land Use Change Permit will be issued. Pursuant to the Land Use and Development Code, the Applicant has one year from the date of the Director's Decision to satisfy all conditions of approval or request an extension.
