I. DESCRIPTION OF THE PROPOSAL
The applicant is requesting a Land Use Change Permit to operate a Stone Yard on an
approximately 35.308 acre parcel located in the Rural zone district east of Carbondale.
The applicant proposes to use the facility to sell natural stone and masonry products for
both retail and wholesale. The applicant has indicated that 1-3 employees will be on site.
The proposed facility will be located in a reclaimed gravel pit that went through a
Comprehensive Plan Amendment in 2011 to include the designation of a Rural
Employment Center. The use of the site as a gravel pit ceased in April 2013 and the
applicant has represented that all reclamation for the pit was completed in the fall of 2018.
Other uses within the pit include a batch plant and a Contractor's Yard.
The applicant has proposed that water for the site will be provided by bottled water and
that wastewater will be addressed via a maintained handicap accessible port -a -potty. As
proposed, the use will be limited to 3 -years, after which a new location will be found or a
long-term water and wastewater plan will be included.

II. DESCRIPTION OF THE SITE
The property is a reclaimed gravel pit that the applicant has indicated has been reclaimed
in the fall of 2018. The floor of the reclaimed pit is level and as required by the reclamation
plan, the slopes are vegetated.

The Applicant has provided documentation that all required notice mailings have been
completed in accordance with the LUDC prior to the BOCC Hearing. Referral Comments
received on the Application are attached as Exhibits and summarized below:

IV. STAFF ANALYSIS
In accordance with the Land Use and Development Code, the Applicant has provided
detailed responses to the Submittal Requirements and applicable sections of Article 7,
Divisions 1, 2, and 3. The application materials include an Impact Analysis and related
consultant reports, technical studies, and plans.
The following standards apply to all proposed Land Use Changes, including divisions of
land, unless elsewhere in this Code a use is explicitly exempt from one or more standards.

7-101. ZONE DISTRICT USE REGULATIONS.
The Land Use Change is permitted by Administrative Review in the Rural zone district.
This application was referred to the Board of County Commissioners pursuant to Section
4-112 of the Land Use and Development Code because of questions regarding the Water
Supply and the Wastewater Management Plan. It appears that the site is otherwise
compliant with the zoning regulations.
7-102. COMPREHENSIVE PLAN AND INTERGOVERNMENTAL AGREEMENTS.
The site is designated on the Future Land Use Map as Residential Medium and also went
through a Comprehensive Plan Amendment process to be designated as a Rural
Employment Center. A Rural Employment Center is designated as follows in the Garfield
County Comprehensive Plan:

Example.
The proposal for a Retail, Stone Yard fits in the Rural Employment Center as the use will
be more of an industrial type of retail that requires a larger area than a traditional small
retail store. Other uses on the parcel also fit within the designation of a Rural Employment
Center.
7-103. COMPATIBILITY.
The property is currently developed with a Batch Plant and a Contractor's Yard facility.
The proposed use is compatible with both of these uses. The bottom of the reclaimed
gravel pit is buffered by significant berms and the parcel is bordered to the south by
Highway 82. Property to the north and west appears to be agricultural and no residential
use is within close proximity to the subject area.

7-104. SOURCE OF WATER.
The Applicant has indicated that they will supply water via a 5 -gallon water dispenser for
employee and public use. The Land Use and Development Code allows the BOCC to
determine whether or not the proposed water supply is adequate. Pursuant to Community
Development policy, unmanned facilities have been the only ones not required to have
Tong -term water. The facility is different from an unmanned facility where no water or
wastewater is required because there will be employees and customers on the site.
The applicant has requested that the limited supply of water be considered adequate by
the Board, as the applicant only anticipates using the site for 3 -years, while they search
for another location for the business.
The Division of Water Resources provided a referral comment that stated they had no
issues with the hauling of water to serve the proposed use. Environmental Health,
Garfield County's designated engineer, and the Garfield County Building Department all
indicated that they had no issues with the Water Supply Plan.
While the Land Use and Development Code allows the Board, in its sole discretion to
make a finding that the use is served by adequate water, Staff feels that if the Board
approves the application, a waiver from this section is appropriate. The waiver process
allows the Board to consider site and use specific considerations of this application. The
Board may grant a waiver from this section provided that:
1. It achieves the intent of the subject standard to the same or better degree
than the subject standard; and
2. It imposes no greater impacts on adjacent properties than would occur
through compliance with the specific requirements of this Code.
This use is unique in that there is not any substantial buildings proposed with the use on
the parcel. Also, the applicant is proposing the use of the parcel for 3 -years. No issues
were identified with the source of water from any of the referral agencies.
7-105. CENTRAL WATER DISTRIBUTION AND WASTEWATER SYSTEMS.
To address the wastewater criteria on the property, the applicant has indicated that they
will provide a handicap accessible port -a -potty. This was proposed via an engineering
report from Sopris Engineering, submitted as part of the application. The applicant
proposes that this use be temporary for 3 -years, after which the wastewater plan would
be re-evaluated.
The Land Use and Development Code requires that the Wastewater System for the
proposed use is adequate to serve the proposed use and density. The proposal was
reviewed by the Garfield County Building Department and the Garfield County Designated
Engineer, both of whom did not have an issue with the proposal. Garfield County
Environmental Health did recommend that the applicant consider a vault and haul system,
which has been included as an option in the suggested conditions of approval. Their

referral comment also included a statement indicating, "Alternatively, if a portable
bathroom is permitted and the applicant decides to make this a permanent location, an
OWTS may be necessary." If the Board finds the Water Supply and Wastewater
Management Plans adequate, Staff has included a suggested condition of approval that
it be permitted for only 3 -years, or until a connection to central services is available.
While the Land Use and Development Code allows the Board to determine whether or
not the use is to be served by an adequate waste water system, Staff feels that if the
Board approves the application, a waiver from this section is the appropriate route as it
will be limited to the specific circumstances around this application. The waiver criteria is
as follows:
1. It achieves the intent of the subject standard to the same or better degree
than the subject standard; and
2. It imposes no greater impacts on adjacent properties than would occur
through compliance with the specific requirements of this Code.
This use and the property is somewhat unique as there is no substantial building
associated with the proposed use and the applicant has proposed that the use will be
limited to 3 -years.
7-106. PUBLIC UTILITIES.
The Applicant has represented that electric power for the office will be supplied through
the use of building mounted solar panels with a back-up generator. The Land Use and
Development Code requires that the site is provided with adequate public utilities. In
conversations with the Chief Building Official, there is nothing in the Building Code that
prohibits the use of solar panels with a back-up power generator. As such it is Staff's
opinion that public utilities for the site are adequate.
7-107. ACCESS AND ROADWAYS.
The applicant provided a review of the roadways, completed by a professional engineer
that indicated the access to the property exceeded County Roadway requirements. This
includes two 16 -foot asphalt drive lanes with 4 -foot gravel shoulders on each side and a
separated 8 -foot raised median. This report was reviewed by Garfield County Road and
Bridge, Carbondale & Rural Fire Protection District and the Garfield County designated
engineer. No issues were identified with the access.
The property accesses directly onto County Road 103 and then Highway 82. There is a
developed left turn on Highway 82 both into and out of County Road 103. The application
was reviewed by the Colorado Department of Transportation who indicated that there
were no issues.

7-108. USE OF LAND SUBJECT TO NATURAL HAZARDS.
Staff reviewed the County geologic hazards information and no hazards were identified
on the subject property. There are steep slopes on the site, however the applicant has
indicated that those areas have been reclaimed and the proposed use will be located on
the gravel floor of the reclaimed pit. As part of the Comprehensive Plan designation
process as a Rural Employment Center future industrial like uses were anticipated to be
located on the parcel.
The applicant provided a grading and drainage statement from a professional engineer
that indicated there were no issues with drainage on the property. This report was
reviewed by the County designated engineer who did not identify any issues.
7-109. FIRE PROTECTION.
The application was reviewed by Carbondale & Rural Fire Protection District. The referral
comment indicated that access to the site is adequate and that the department has no
issues with the proposal.
DIVISION 2. GENERAL RESOURCE PROTECTION STANDARDS.
The following resource protection standards apply to all proposed Land Use Changes,
including divisions of land unless elsewhere in this Code a use is explicitly exempt from
one or more standards.
7-201. AGRICULTURAL LANDS.
The property is not in agricultural production and the proposed use will have minimal to
no impact on nearby agricultural uses. The application did not indicate any ditches located
in the immediate area of the proposed stone yard. During Staffs site visit, the applicant
indicated that there may be a piped ditch in the area. Staff did not see evidence of any
irrigation ditch. The applicant's proposed use is temporary in nature with limited
infrastructure. A Condition of Approval has been included that requires the applicant to
maintain compliance with Section 7-201 if a ditch is located nearby.
7-202. WILDLIFE HABITAT AREAS.
The Application was referred to Colorado Parks and Wildlife. No comment was received.
The proposed land use change is occurring on an industrially developed property and the
impact on wildlife is anticipated to be minimal.
7-203. PROTECTION OF WATERBODIES.
No waterbodies were identified on the site in the application or during Staff's site visit.
The Roaring Fork River is located south of the site, across Highway 82.

7-204 DRAINAGE AND EROSION.
The Applicant supplied an Engineering Report that addressed Grading and
Drainage/Stormwater. The report indicated that the engineer reviewed the grading and
drainage impacts with the drainage study that was prepared for the Powers Pit Concrete
Batch Plan Comp Plan Amendment. The engineering report provided the following
comment:
With that, it is therefore our opinion that with no proposed grading at your site,
there will be no adverse impacts to the overall site drainage and the proposed
development is in compliance with the Drainage Study for Powers Pit Concrete
Batch Plant Comp Plan Amendment.
Additionally, the applicant's engineering indicated that no grading is necessary to
accommodate the proposed temporary use. The engineering report was reviewed by
Garfield County's designated engineer who did not indicate any issues with the proposed
use.

7-205. ENVIRONMENTAL QUALITY.
The application was sent to the Colorado Department of Public Health, who did not reply
with any comment. Garfield County Environmental Health reviewed the application and
indicated that idling should be limited on site and that if fugitive dust emissions become
an issue on site that mitigation measures should be undertaken. Environmental quality
impacts on the site are anticipated to be minimal.

7-206. WILDFIRE HAZARDS.
The Community Wildfire Protection Plan identifies the parcel as in either the Not Rated or
Very High designation. However, because the facility is located in a reclaimed gravel pit,
there is limited vegetation on the property. Additionally, the application was reviewed by
Carbondale & Rural Fire Protection District, who indicated that there were no issues in
serving the facility.
7-207. NATURAL AND GEOLOGIC HAZARDS.
See Staff's analysis in Section 7-108.
7-208. RECLAMATION.
The property was required to go through a substantial reclamation process because it is
located in an old gravel pit. The applicant provided information that the Reclamation
process was completed in the Fall of 2018. The application was reviewed by the Garfield
County Vegetation Manager who indicated that the reclamation plan was adequate. No
additional disturbance is anticipated to require reclamation. If the Board does approve the
application, Staff has included a suggested condition that the applicant be required to
adhere to the reclamation plan requirements.
DIVISION 3. SITE PLANNING AND DEVELOPMENT STANDARDS.
Unless a use is explicitly identified elsewhere in this Code as being exempt from 1 or
more standards, the following standards shall apply to all uses, divisions of land and
PUDs.
7-301. COMPATIBLE DESIGN.
The application benefits from a number of site characteristics that address compatible
design issues. The floor of the reclaimed gravel pit is buffered from surrounding uses by
significant slopes surrounding the pit. From Highway 82, the Stone Yard will not be visible,
and only the entrance road is visible from County Road 103. These slopes also help to
mitigate possible noise impacts to adjacent properties.
Regarding hours of operation, the applicant has indicated that the site will be open from
8:00 a.m. - 4:00 p.m. December through March and 7:00 a.m. - 5:00 p.m. April through
November. Building materials will not detract from the adjacent batch plant and
Contractor's Yard.
7-302. OFF-STREET PARKING AND LOADING STANDARDS.
The Applicant has included a site plan with four customer parking spaces identified, as
well as delivery truck parking and forklift parking. The parking standards in the Land Use
and Development Code tie the number of parking spaces to floor area, which requires the
floor area of buildings to be counted. The floor area of any buildings on the site will be

small (approximately 400 square feet) and parking exceeds the amount of floor area
required by the office.
However, this use is unique as the use of the property is more connected to the outside
storage than the floor area of the structures. Because the use is temporary and because
more parking can easily be created by the applicant depending on future demand, Staff
is supportive of the parking plan included on the site plan.
Staff has included a suggested condition of approval that the parking and drive aisles be
maintained in a drivable condition with a durable, all-weather surface.
7-303. LANDSCAPING STANDARDS.
The proposed use will be located on the floor of a reclaimed gravel pit. No landscaping is
anticipated and there will be minimal vegetation removal.
7-304. LIGHTING STANDARDS.
The applicant indicated that minimal exterior lighting is anticipated and that it will be
limited to night security. A suggested condition of approval has been included requiring
the applicant to comply with County lighting standards.
7-305. SNOW STORAGE STANDARDS.
Snow storage appears to be adequate on the subject site.
7-306. TRAIL AND WALKWAY STANDARDS.
No trails currently exist in the rural residential and agricultural area.
V. BOARD OPTIONS
The application includes a request that the Board determines the temporary use of port -
a -potties and potable water tanks is adequate for the use. The Community Development
Director chose to call this application up to the BOCC for their consideration because of
this issue. If the Board determines that the water and wastewater plan is sufficient, Staff
suggests memorializing that finding with a waiver. If the Board decides to approve the
application, Staff has included the following Suggested Findings and Conditions of
Approval.
VI. SUGGESTED FINDINGS FOR APPROVAL
1. That proper public notice was provided as required for the hearing before the
Board of County Commissioners.
2. The hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters, and issues were submitted and that all
interested parties were heard at that meeting.

3. That for the above stated and other reasons the proposed Retail, General — Stone
Yard application submitted by CRC LLC is in the best interest of the health, safety,
convenience, order, prosperity, and welfare of the citizens of Garfield County.
4. That with the adoption of conditions the application is in general conformance with
the 2030 Comprehensive Plan, as amended.
5. That with the adoption of conditions and waivers from Section 7-104 and 7-105,
the application has adequately met the requirements of the Garfield County Land
Use and Development Code, as amended.
VII. SUGGESTED CONDITIONS OF APPROVAL
Suggested Conditions of Approval:
1. All representations made by the Applicant in the application shall be conditions of
approval unless specifically altered by the Board of County Commissioners.
2. The operation of the Stone Yard shall be done in accordance with all applicable
Federal, State, and local regulations governing the operation of this type of facility,
including, but not limited to OSHA requirements.
3. The applicant shall be permitted to use handicap accessible portable toilets, and/or
a vault and haul system, for wastewater management on the site for a period of 3 -
years from the date of the issuance of the Land Use Change Permit.
a. Prior to the expiration of this 3 -year period, the applicant shall either provide
an alternate long-term water and wastewater system including an OWTS,
acceptable to the Community Development Department and obtain all
required permits for the facility or the applicant shall discontinue the use.
b. If permanent connections to sewer and water services are available before
the expiration of the 3 -year period, the applicant shall be required to connect
to those services at the time they are available.
4. The applicant shall be permitted to use a 5 -gallon tank for potable water on the
site. Potable water shall be available at all times for the employees on the site and
the public.
5. Prior to the operation of the facility, the applicant shall have required provisions for
potable water and wastewater management in place.
6. Prior to the operation of the facility, the applicant shall have concrete barriers and
fencing in place around the border of the facility.

7. The applicant shall obtain any Building Permits as required by Garfield County,
including for the office, gazebo, and tool shed. The operation of the site does not
require that those facilities are in place prior to operation, however, under no
circumstances may a structure be built or installed without obtaining required
Building Permits.
8. The applicant shall designate additional parking spaces for employee parking.
9. The drive aisles, access to the site, and parking areas shall have a durable all-
weather surface made of materials that are suitable for the proposed uses.
10.Any lighting on the site shall be compliant with Land Use and Development Code
standards.
11. If an irrigation ditch is later located on the property, in the area of the Stone Yard,
the applicant shall maintain compliance with Section 7-201 (E) of the Land Use
and Development Code of 2013, as amended.
12. The applicant shall comply with any Reclamation requirements for the gravel pit.
13. The applicant shall maintain receipts for the purchase/delivery of hauled water and
provide the receipts to the local water commissioner upon request.

Check with public health, but I could live with the bottled water porta toilet option for the first 3 years. They should
submit what they are planning on or a site visit to the tree farm to see it would be a good idea. If you do not have a
source of water, a septic system does not make much sense. Another option is to allow the porta systems for the first
year with an upgrade required after that. I think they would need a storage tank for the potable water to make a septic
system make much sense.

Patrick - CDOT does have an access permit for 190 DHV (Access Permit # 312039). The traffic letter indicates
that the proposed contractor yard use will only be 7 DHV (design hourly volume). Based upon the traffic letter
by Sopris Engineering March 6, 2019, CDOT agrees no access permit is required for this additional use.

Mountain Stone Supply, Inc. The submittal was found to be thorough and well organized. The
review generated the following comment:
• The facility is proposing to use temporary facilities in bottled water and port -a -potties.
Currently the Applicant is anticipating using the proposed site for three years while searching
for a permanent location. There are no sewer and water services available to the site. It would
be reasonable to have a condition of the permit making it temporary for three years or until
permanent connections to sewer and water services area made, whichever comes first.

We have reviewed the review request to operate a Retail Stone Yard on approximately 1.25
acres of a 35.3 -acre site in a portion of the SE 1/4 of Section 26, Township 7 South, Range
88 West of the 6th P.M., located at 87 County Road 103, Carbondale.
According to the application, the site will have an office for up to three employees, and a
gazebo for literature distribution and for visiting customers. Drinking water will be provided
through a bottled water dispenser in the office. There will be restrooms within the office and
a portable restroom. Per the applicant, both the office restrooms and portable restroom are
temporary wastewater storage that will be serviced by a local waste disposal service.
Monitoring Well Permit No. 282659 is located on the southern part of the parcel and was
issued February 16, 2010. The use of this well is limited to monitoring water levels and/or
water quality sampling. The well was constructed March 17, 2010.
If any water is from offsite, as long as the hauled water is from a legal source, there should
not be an issue for our agency. In any situation where water is hauled, receipts for the
water purchased/delivered should be kept and provided to the local water commissioner
upon request.
This office has no objection to the proposed retail stone yard. If you have any questions or
concerns, please contact me at this office.

I've reviewed the application for the Rocky Mountain Stone Supply Stone Yard, and have the
following comments from Public Health:
- Nuisance Conditions: We understand that this operation will be concealed from adjacent
land uses, causing minimal smoke, noise, or glare. If fugitive dust emissions begin to
occur at the stone supply yard, we recommend application of water or other dust
suppression at the property.
- Drinking water supply: The 5 -gallon water dispenser should be an adequate water
supply for employees and the occasional customer.
- Wastewater treatment: It appears based on the discussion in the application that this
facility is "manned" in that it will have employees on site during business hours. In that
case, a portable bathroom service would likely not be sufficient for wastewater needs.
However, rather than requiring an onsite wastewater treatment system (OWTS) for a
potentially temporary operation, the applicant might consider a vault -and -haul system.
Alternatively, if a portable bathroom is permitted and the applicant decides to make this
a permanent location, an OWTS may be necessary.
- Other recommendations:
o Delivery truck drivers and customers of the Stone Yard should limit vehicle idling
time while conducting operations on the site to reduce air pollution impacts.
Reduced idling signage is available from Public Health if desired.
