Following my e-mail below, CRMS shared their plans for the Solar Dorm remodel project with the Town. The Town was
able to determine that the proposed work does not increase the water demand beyond what existed
previously. Therefore, the Town has no objection to the issuance of this permit as it will not increase water
demand. We have asked CRMS to provide a letter from the Fire Department indicating that they believe the pressures
and flows to the fire suppression system will be adequate for it to operate in case of an emergency. CRMS has indicated
their willingness to provide that letter. Therefore, from the Town's perspective, we have no reason to ask for a delay in
the review or issuance of the permit for the Solar Dorm.
While we are okay with the proposed work on the Solar Dorm project, we have still not reached an agreement on
expansion of future water service on the CRMS campus so future projects will be handled on a case-by-case basis, with
no guarantee of approval of expansion, until such time as an overarching agreement can be reached.

This e-mail is being written to update you on the status of the water service agreement between the Town and
CRMS. As you may know, the Town and CRMS have been working toward a formal agreement related to expansion of
water service to the CRMS campus for several years due to the long standing moratorium on out-of-town water
taps. Recently, the negotiations have stalled. We just want to make you aware that there is currently no agreement in
place that would allow expansion of CRMS's current water service beyond what it is now. What this means is that any
addition to an existing building, change of use of a building, or construction of additional buildings which would increase
the overall water usage at CRMS, will have to be negotiated between the Town and CRMS on a case by case basis with
no guarantee of approval. This e-mail should not be interpreted in a way to suggest that the Town would generally
deny any expansion of the system, rather, proposed expansion will have to be discussed and code requirements at the
time will need to be met prior to allowing expansion of water service on the campus. If, in the future, we are able to
come to an agreement with CRMS related to water service, we will share that with you. Let me know if you have any

This matter has no bearing on the Solar Dorm project which is already connected to Town services and not at all
in dispute. In fact, the Town is probably not even aware of the Solar Dorm remodel project. This
communication from the Town was not expected and CRMS now has some work to do to clarify the
arrangement for future campus expansion. In the meantime, should we seek additional water and sewer taps,
you can rely on the attached letter as we have done since 1999. Please let me know if you have any further
questions.

The Carbondale Board of Trustees requested that I respond to your January 8th letter
requesting that the Town clarify its position with respect to providing water and
wastewater services to the Colorado Rocky Mountain School campus.
We understand that the school has completed a Master Plan, which envisions expansion
of the campus. This letter is to assure you that the Town of Carbondale is committed to
providing water and wastewater service to additional school facilities identified in the
Master Plan. The school would be required to pay the applicable tap fees associated with
any expansion and the resultant service fees.
Depending upon the location of facilities served, the school may need to extend Town
utility lines to these locations and provide the Town easements for their maintenance.
Your engineers will want to coordinate these improvements with the Town utility staff.
We also understand that the facilities being serviced with Town utilities will be located
on or near the main campus, east of the Crystal River and that no Town service is
contemplated for school facilities west of the Crystal River.

I am writing in regard to Colorado Rocky Mountain School. As we have discussed, CRMS
presently has pending before Garfield County an application for conditional use permit. The reason
for the application is that although schools are allowed as a conditional use in the applicable Garfield
County Zone District, CRMS predates the zoning and is thus a pre-existing nonconforming use.
Recently, CRMS applied for a building permit to relocate an existing dormitory and construct a new
faculty apartment on the relocated dorm. The request for building permit was denied, because
County staff took the position that it would be an unlawful expansion of a pre-existing
nonconforming use.
Garfield County staff requested that CRMS obtain a conditional use permit for the school
and suggested that a school "master plan" be the basis of the permit. For that reason, as well as for
the reason that CRMS was independently engaged in an exercise to plan for its future, the school
adopted the CRMS Campus Master Plan, a copy of which I have previously provided to you.
The Master Plan envisions the growth of CRMS to a maximum of 250 students, which would
be an increase of approximately 83 students above today' s population. It identifies locations for new
classroom space, dormitory space, faculty housing and support facilities that would be needed to
serve the expanded population. I would also add that many of these new facilities are desired in
order to maintain and improve the quality of the education and living experience for the existing
student population, regardless of whether or not there is an actual increase in student population.

expected to occur over the next twenty years. As I understand the County's position, if the
conditional use permit is approved under the terms of the school's Master Plan, then the school can
obtain a building permit for any facility identified in the Master Plan without further land use review.
To date we have appeared before the Garfield County Planning and Zoning Commission on
the school's application for a conditional use permit. The P&Z recommended approval, upon a list
of conditions. One of those conditions, originally recommended by County staff, is that prior to any
approval by the Board of County Commissioners, the applicant "submit a written statement from the
Town of Carbondale, stating that water and sewer service can be provided for the proposed school
expansions." The purpose of this letter is to formally request that written statement from the Town.
As you will see from the Master Plan, the proposed location for all new and expanded
facilities, except for limited faculty housing on the west side of the Crystal River (which will be
served by individual well and septic), is located in the proximity of the existing campus core, which
is presently receiving water and sewer service from the Town. We therefore believe, that subject to
payment of any applicable tap fee, the Town would be willing and able to provide water and sewer
service to any new or expanded CRMS facility identified in the Master Plan. We therefore request
that the Town issue the appropriate letter to Garfield County indicating the availability of water and
sewer service.
From our previous discussions, it is my understanding that this matter will be discussed with
the Trustees on Tuesday, January 12, 1999, under the manager's report. I will plan on attending to
answer any questions the Trustees may have. In the meantime, if you have any questions or
comments, please contact me.

Thanks for the quick response. It is hard for the county to interpret how the various communications old and new might
affect the present application.
It would appear the structure has an addition of almost 200 sq.ft. which would not require any additional water. The
issue could be the addition of a larger water main to the structure for the new fire sprinkler system. See attached
information from the submitted set we are reviewing. Hopefully the sprinklers will not be needed, but this would
appear to increase the required water from the city system and constitute a change to the water system.
This new section of water main will more than likely require inspections by the city. It appears an email or letter from
the city prior to construction might keep things from being an issue during construction which can cause additional cost
and other hardships to the project.
It could be the water issue gets kicked upstairs for further review on a higher level than the Building Department. We
will wait for further direction before we issue the building permit. We will finish up the review of the permit application,
so it is ready to issue once the above has been addressed.

Andy,
I am so sorry about the unfortunate timing of Kevin's email. We only coordinate with them when we are adding
or subtracting - which we are not with the Solar Dorm project.
The Town of Carbondale's table for calculating system improvements (i.e. expansion) does not consider square
footage for dormitory uses. It is based on bed count which is not changing. Also, their table specifies zero EQRs
for fire sprinklers. Again, no expansion in our project.
Furthermore, the water "main" is CRMS (i.e. privately owned) infrastructure that should not require any
inspection by the Town. I will reach out to Kevin and ask him to get in touch with you to verify all this. We will
have just 13 weeks between graduation and the start of the school year to complete the project. Please help us
out to the extent you can.
